CIRCULAR

PRESCRIBING MANAGEMENT AND USE OF STATE EXPENDITURES ON IMPLEMENTATION OF HEALTH-POPULATION TARGET PROGRAM IN THE 2016-2020 PERIOD

Pursuant to the Law on State Budget dated June 25, 2015;

Pursuant to the Government’s Decree No. 163/2016/ND-CP dated December 21, 2016, elaborating on certain articles of the Law on State Budget;

Pursuant to the Government's Decree No. 87/2017/ND-CP dated July 26, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Finance;

Pursuant to the Government’s Resolution No. 73/NQ-CP dated August 26, 2016 on approval of policies for investment in Target Programs in the 2016 – 2020 period;

Upon implementation of the Prime Minister’s Decision No. 1125/QD-TTg dated July 31, 2017 on approval of the health-population target program for the 2016-2020 period (hereinafter referred to as Decision No. 1125/QD-TTg);

Chapter I

GENERAL PROVISIONS

Article 1. Scope and subjects of application

1. Scope of application:

This Circular regulates the management and use of state budget expenditures on implementation of the health – population target program in the 2016-2020 period (hereinafter referred to as program) under the Prime Minister’s Decision No. 1125/QD-TTg dated July 31, 2017 (including reciprocal capital of other programs and projects for implementation of the program); except need-based financial aids of domestic and foreign organizations and individuals, aids of which purposes and amounts have been agreed upon between sponsors (or authorized representatives of sponsors) and the Vietnamese side.

2. Subjects of application:

This Circular shall apply to entities and persons managing, using and benefiting from state budget expenditures on implementation of the program.

Article 2. Sources of funding for expenditures on implementation of the program

b) Provide funding for the adequate number of vaccines, syringes, needles and safety boxes for the expanded immunization program; first line and second line tuberculosis drugs for the 2016 – 2018 period (from 2019, HI card holders will be paid for their tuberculosis drugs by the health insurance (HI) fund while other patients who have not yet been paid for tuberculosis drugs by the HI fund will be paid for their tuberculosis drugs by each program’s budget); drugs for psychiatric patients; drugs, chemicals, chemical sprayers and medical supplies intended for prevention and control of malaria; birth control devices distributed to advantaged persons and for social marketing purposes; Vitamins A; ensure adequate funding for purchasing particular articles and manufacturing footwear specially designed for leprosy patients, formulating topical medications used for detecting signs of leprosy through clinical examination; anti-HIV drugs (ARV drugs) for the 2016 – 2018 period (from 2019, HI card holders will be paid for their tuberculosis drugs by the health insurance (HI) fund while other patients who have not yet been paid for tuberculosis drugs by the HI fund will be paid for their tuberculosis drugs by each program’s budget), opportunistic infection drugs, biological products used for testing HIV, drugs used in opioid replacement therapy, syringes, needles, condoms and other items used in prevention and control of HIV/AIDS; chemicals, chemical sprayers and other medical equipment or supplies used for prevention and control of haemorrhagic fever; synchronized equipment required by projects;

c) Provide funding for hiring of immunization software and information technology services for national immunization information management systems, software used for management of patients undergoing opioid replacement and ARV therapy; hiring of facilities designed for storing vaccines and birth control devices; purchase of insurance for vaccine warehouses; immunization compensations; subsidies on vaccination technician’s remunerations for several provinces in hardship;

d) Provide funding to support localities in carrying out tasks involved in projects (except for those spending tasks assured by local government’s budgets) according to principles prescribed in point b of clause 7 of Article 1 in the Resolution No. 1125/QD-TTg, especially those within areas of importance of epidemiology, areas potential disease outbreak areas, areas with the high fertility rate, areas with the high sex ratio at birth; localities facing socio-economic difficulties, localities which have not yet balanced budgets on their own, poor, mountainous, border provinces, islands, Northwest, Highland, Southwest, Mekong delta regions and provinces badly hit by natural disasters (e.g. storms or floods).

2. Local government’s budget:

a) Ensure sufficient revenues of local government’s budgets for implementation of the following duties:

- Buying medical supplies used for immunization purposes (except syringes, needles and safety boxes); birth control devices; common medical supplies, equipment and chemicals used in programs;

- Destroying syringes, needles, contraceptive devices, drugs, vaccines, pathology specimens, medical supplies and chemicals that have expired (if any), hazardous wastes (if any) in the program; destroying food products, raw and input materials and chemicals used in the food industry that have been found violating laws on food safety (with respect to ownerless commodities) after inspection, audit or surveillance activities involved in the program;

- Granting subsidies for costs incurred by poor patients’ travel to specialized healthcare establishments at the district or higher level to have medical check-ups;

- Building, maintaining and updating specialized management information systems and databases of local programs and projects;

- Building and putting to use models for management of diabetes disease, high blood pressure disease, chronic obstructive pulmonary disease, bronchial asthma disease and mental illness; models for prevention and control of illnesses and impairments in school-aged children; models for improvement of nutritional status, family planning and response to health incidents with participation of practitioners having relevant specializations;

- Providing training and drilling courses in enhancing competencies of medical staff at the grassroots level; providing training, drilling and practice courses in improvement of competencies of participants in projects at the grassroots level;

- Assisting in management of the program implemented by localities; inspecting, supervising and assessing implementation of the program at localities;

b) Allocate reciprocal capital to entities in combination with central government's budget to carry out activities involved in the project; integrate with other programs, projects and activities concerned within local jurisdictions in order to ensure implementation of objectives, tasks and activities included in projects constituting the program under the Decision No. 1125/QD-TTg.

3. Funds lent and contributed by domestic and foreign individuals and organizations and other legitimate financial sources.

Article 3. State budget preparation, distribution, compliance and final accounts

1. Preparation, distribution of, compliance with and final accounts of state budget expenditures on implementation of the program shall be subject to regulations enshrined in the 2015 Law on State Budget and other instruments providing instructions on implementation thereof. In addition, this Circular shall provide additional instructions about budget preparation matters as follows:

a) Ministries, centrally-affiliated entities, provincial-level PCs prepare the budgets of expenditures on implementation of the program (shortly called program budget) for next year which includes spending details specific to projects and sectors for submission to the Ministry of Finance, the Ministry of Planning and Investment and the Ministry of Health ahead of July 20 each year;

b) Based on the program budgets received from Ministries, centrally-affiliated entities and provincial-level PCs, according to review reports on accomplishment of objectives in the previous year, epidemic diseases and predetermined objectives of each project in the 2016-2020 period and central government’s estimated budget expenditures informed by the Ministry of Finance on implementation of the program in the following year (briefly called state budget funding, capital or expenditures), the Ministry of Health will formulate the proposal for objectives, tasks of and plans for allocation of central government's budget expenditures, including details of expenditures specific to projects, Ministries, centrally-affiliated entities and localities, enclosing interpretation of distribution principles, criteria and limits of expenditures distributed to specific projects before submitting it to the Ministry of Finance and the Ministry of Planning and Investment prior to August 15 each year.

3. With respect to activities and duties carried out under contracts between entities authorized to implement budgets and other entities, documents serving as payment and accounting bases shall be deposited with entities authorized to implement budgets, including contract full texts (enclosing detailed budgets approved by presiding entities), reports on acceptance testing of completed work, reports on discharge of contracts, documents evidencing state budget spending (budget withdrawal notes), payment documents (payment orders) and other related documents (if any). Detailed invoices and spending documents shall be deposited with entities directly executing contracts.

4. Budget preparation, allocation and final accounts of expenditures on repair, improvement, refurbishment and expansion of physical infrastructure shall be subject to provisions laid down in the Circular No. 92/2017/TT-BTC dated September 18, 2017 of the Ministry of Finance, prescribing the preparation, allocation of budgets and final accounts of expenditures for repair, maintenance, renovation, improvement and expansion of facilities.

Chapter II

SPENDING DETAILS AND GENERAL SPENDING AMOUNTS

Article 4. Spending details and general spending amounts in the program

1. Spending on design, revision and supplementation of programs, syllabuses and materials used in professional training and refresher courses and professional instruction manuals:

a) Design, revision and supplementation of training programs and syllabuses: Spending details and amounts prescribed in point b, c and d of clause 2 of Article 4 in the Circular No. 123/2009/TT-BTC dated June 17, 2009 of the Ministry of Finance, prescribing details and amounts of spending on formulation of framework programs and design of training curriculum and syllabus of academic subjects in undergraduate, associate and professional postsecondary degree disciplines (hereinafter referred to as Circular No. 123/2009/TT-BTC);

b) Spending on design, revision and supplementation of materials used in professional training and refresher courses: Spending details and amounts shall be subject to point c and d of clause 2 of Article 4 in the Circular No. 123/2009/TT-BTC;

c) Spending on creation of professional instruction manuals (if any): Spending amount shall be determined depending on actual demands, legal contracts, invoices and spending documents and shall be subject to provisions laid down in laws on bidding, order placement and task assignment.

a) Spending details and amounts shall be subject to provisions of the Circular No. 139/2010/TT-BTC dated September 21, 2010 of the Ministry of Finance, prescribing the budgeting, management and use of state budget expenditures on training and education of public officials and officers (hereinafter referred to as Circular No. 139/2010/TT-BTC).

b) In addition to spending details referred to in point a of this clause, entities tasked with opening training classes may use the program's budgeted expenditures for supporting persons who are not entitled to receive salaries from the state budget as follows:

- Spending amounts for meals shall be the same as those paid to public officials, officers and servants as prescribed in the Circular No. 139/2010/TT-BTC;

- Spending amounts for payment of costs of travel from their residences to training establishments (one round trip costs);

- Spending amounts for payment of accommodation rental costs (if training establishments do not have dwellings and need to rent houses);

Details and the maximum amounts of spending on rental of accommodation and travelling allowance shall be subject to provisions laid down in clause 1 of Article 5 and Article 7 in the Circular No. 40/2017/TT-BTC dated April 28, 2017 of the Ministry of Finance, prescribing travelling allowance and financial support for organization of workshops and conferences applied to state regulatory authorities and public service units (hereinafter referred to as Circular No. 40/2017/TT-BTC). In case where trainees are able to have means of transport at their disposal, they shall be entitled to allowance for travel costs which is equal to 0.2 liters of petrol/km calculated according to the distances of administrative subdivisions and petrol prices at the training time.

3. Spending on organization of workshops and conferences on planning and implementation, preliminary and final review meetings over the implementation of the program, activities and constituent projects of the program: Spending details and amounts shall be subject to provisions laid down in the Circular No. 40/2017/TT-BTC.

4. Spending on organization of domestic scientific workshops, spending on researches and support for specialized contents of the program according to research proposals approved by competent entities. Spending details and amounts shall be subject to provisions set forth in the Joint Circular No. 27/2015/TTLT-BKHCN-BTC dated December 30, 2015 of the Ministry of Science and Technology and the Ministry of Finance, prescribing lump-sum payments for implementation of science and technology tasks using state budget allocations and the Joint Circular No. 55/2015/TTLT-BTC-BKHCN dated April 22, 2015 of the Ministry of Science and Technology and the Ministry of Finance, providing instructions about limits set after budget preparation and allocation and final accounts of expenditures on science and technology tasks using the state budget allocations (hereinafter referred to as Joint Circular No. 55/2015/TTLT-BTC-BKHCN).

5. Spending on organization of international workshops and conferences about tasks and activities involved in the program: Spending details and amounts shall be subject to provisions set forth in the Circular No. 01/2010/TT-BTC dated January 6, 2010 of the Ministry of Finance, prescribing allowance for welcoming and reception of foreign guests working in Vietnam, spending on organization of international workshops and conferences in Vietnam and spending on reception of domestic guests (hereinafter referred to as Circular No. 01/2010/TT-BTC).

7. Spending on building, management, use and update of databases and data management software; development, update of and management of information about projects and programs on electronic information pages and portals:

a) With regard to formulation of projects, project-based spending amounts shall be approved by competent entities. Formulation of information technology application projects shall be subject to existing regulations on management of information technology application projects; sector-specific limits and unit prices issued by the Ministry of Information and Communications, the Ministry of Finance and other related ministries or sectoral administrations. Several existing regulations shall be as follows:

- Estimation and management of costs of information technology application projects shall be subject to provisions laid down in the Circular No. 06/2011/TT-BTTTT dated February 28, 2011 of the Ministry of Information and Communications, prescribing the estimation and management of costs of investment in information technology applications;

- Limits on project management and consultancy costs shall be set under the provisions of the Decision No. 2378/QD-BTTTT dated December 30, 2016 of the Minister of Information and Communications, introducing the limits on project management costs and consultancy costs for IT application investment projects using the state budget allocations;

- Project assessment costs shall be subject to provisions laid down in the Circular No. 209/2016/TT-BTC dated November 10, 2016 of the Ministry of Finance, prescribing amounts of receipts, regimes for collection, payment, management and use of fees for assessment of construction investment projects and fees for assessment of basic designs;

- Costs of audit and approval of final accounts shall be subject to provisions laid down in the Circular No. 09/2016/TT-BTC dated January 18, 2016 of the Ministry of Finance, prescribing final accounts of completed projects using state capital;

- Limits on installation of hardware and software shall be subject to provisions of the Decision No. 1601/QD-BTTTT dated October 3, 2011 of the Minister of Information And Communications regarding release of limits on installation of hardware and software used in application of information technology; the Decision No. 1235/QD-BTTTT dated September 4, 2014 of the Minister of Information And Communications regarding modification and supplementation of the Decision No. 1601/QD-BTTTT dated October 3, 2011 on promulgation of limits on installation of hardware and software used in application of information technology;

- Limits on building of databases shall be subject to provisions laid down in the Decision No. 1595/QD-BTTTT dated October 3, 2011 of the Minister of Information and Communications regarding promulgation of limits on building of databases used in application of information technology;

- Spending on construction and upgrade of internal software shall be subject to regulations of the Ministry of Information and Communications regarding instructions for determination of costs of development and upgrade of internal software;

c) Spending on input of data and creation of hypertext pages and electronic information shall be subject to provisions laid down in Article 3 and Article 4 in the Circular No. 194/2012/TT-BTC dated November 15, 2012 of the Ministry of Finance, providing instructions for spending on creation of electronic information with the aim of maintaining regular operations of entities using state budget capital;

d) Amounts of spending on data standardization shall be based on economic-technical norms prescribed in the Decision No. 1595/QD-BTTTT dated October 3, 2011 of the Minister of Information and Communications regarding promulgation of limits on building of databases used in application of information technology;

dd) Spending on renovation and repair of infrastructure, purchase of property and equipment used for applying information technology shall be subject to provisions of law on bidding:

e) Spending on hiring of information technology services shall be subject to regulations enshrined in the Prime Minister’s Decision No. 80/2014/QD-TTg dated December 30, 2014, prescribing tests hiring of information technology services for state regulatory entities and shall be subject to laws on bidding;

g) Spending on maintenance, servicing and minor repair of equipment classified as information technology infrastructure and continuity of network services (including lease of transmission lines, broadband, maintenance of domain names, IP addresses, collection, storage and transmission of information and other online services) shall be conformable to legitimate contracts, invoices and documents and shall conform to laws on bidding.

8. Spending on hiring of domestic experts under the decisions of heads of entities executing the program. Spending amounts shall be subject to the Circular No. 02/2015/TT-BLDTBXH dated January 12, 2015 of the Ministry of Labor, War Invalids and Social Affairs, regulating pay rates of domestic consulting experts as a basis for estimation of costs of procurement packages for provision of consultancy services in the form of the time-based contract made according to the period of use of state capital. Hiring independent consulting organizations to implement the budgets shall be subject to the approval decisions of competent entities and laws on bidding.

9. Spending on study and exchange of experience and international cooperation that are aimed at enhancing competency and effective implementation of activities involved in the program: Spending details and amounts shall be subject to provisions laid down in the Circular No. 01/2010/TT-BTC and the Circular No. 40/2017/TT-BTC.

10. Spending on purchase of drugs, food samples, birth control devices, medical equipment, biological products, chemicals, consumables, tools and other particular items, equipment (e.g. used for training, communications, computer science and management) (hereinafter referred to as goods) intended for specialized activities of specific projects in the program (including purchases thereof for clinical and pre-clinical courses (if any)). Spending amounts shall be consistent with legitimate invoices and spending documents and shall be subject to laws on bidding.

11. Spending on destruction of syringes, needles, contraceptive devices, pathology specimens, medical supplies, hazardous medical wastes and chemicals that have expired (if any) in the program; destruction of ownerless goods which are food products, raw and input materials and chemicals used in the food industry that have been found violating laws on food safety (inclusive of counterfeit foods, imitation foods, low-quality foods or unsafe foods) after inspection and surveillance activities involved in the program according to the decision on disposing thereof issued by competent regulatory authorities:

b) Rental of warehouses intended for storage of materials, chemicals and germs that need to be destroyed;

c) Renting of machinery and equipment serving destruction purposes (where necessary);

Spending amounts prescribed in point a, b and c of this clause shall be based on the budgets approved by competent entities, contracts, invoices and other legitimate spending documents to correspond to market prices at the time of execution of the program within localities;

d) Spending on transportation of drugs, vaccines, birth control devices, pathology specimens, foods, raw materials used in the food industry; input materials and chemicals used in manufacturing and business activities that need to be destroyed; equipment and persons participating in destruction activities. Spending amount shall be subject to provisions laid down in clause 13 in this Article;

dd) Amount of spending on hiring of personnel performing destruction activities (if any) shall be 1.5 times as much as the region-specific minimum wage rate (per day) in accordance with the Government’s regulations on region-specific minimum wage rates for employees working under employment contracts. In case where it is obligatory to hire other entities to carry out destruction activities, spending amounts shall be subject to contracts and invoices of destruction service providers.

12. Spending on repair, maintenance, care, periodic maintenance and calibration of equipment and warehouses (used for storage and preservation of drugs, birth control devices, biological products, pathology specimens, input materials and chemicals) that serve the specialized demands of specific projects as constituents of the program, subject to approval decisions issued by competent entities, shall be consistent with invoices and other legitimate evidencing documents and laws on bidding.

13. Spending on transportation of goods, pathology specimens and test specimens from sampling locations to test facilities for the purposes of carrying out specialized activities of specific projects, machinery and equipment; spending on payment of travelling costs of health, population officers, attendants, collaborators and persons involved in tests for screening and detection of disease and launch of campaigns:

a) Amounts of spending on support for payment of costs of travel by public transit vary depending on fares;

b) Amounts of spending on support for charges for postal transportation services vary depending on current prices of postal services;

d) If they arrange means of land travel or transport at their disposal, the maximum amounts of spending shall be equal to 0.2 liter of petrol/km, based on local travel distances and petrol prices at the time of use of such means.

In case of transportation of multiple goods, equipment, pathology specimens and passengers on the same means of travel or transport, the maximum amount of payment of travelling or transportation costs shall not exceed the aforestated amounts.

14. Amounts of spending on hiring of guides who also act as ethnic language interpreters or those guides who do not act as ethnic language interpreters shall be subject to provisions laid down in the Circular No. 109/2016/TT-BTC.

15. Spending on translation services:

a) Translation from foreign languages to Vietnamese and vice versa: Spending details and amounts shall be subject to regulations laid down in point g of clause 1 of Article 2 in the Circular No. 01/2010/TT-BTC;

b) Spending on interpretation (oral translation) from Vietnamese to ethnic languages and vice versa: Amounts of spending on payment of remunerations shall be equal to those paid to guides who also act as ethnic language interpreters as stated in the Circular No. 109/2016/TT-BTC;

c) Spending on translation from Vietnamese to ethnic languages and vice versa: Amount of spending on such service shall be the same as those paid for translation from Vietnamese to ethnic languages as prescribed in the Circular No. 338/2016/TT-BTC dated December 28, 2016 of the Ministry of Finance, prescribing the budgeting, management, use and final accounts of state budget expenditures sufficient for the preparation of legislative documents and the perfection of the legislative system.

16. Amounts of spending on rewards for persons giving and collecting specimens used in tests according to specialized medical regulations for diseases in the program (especially in the extended immunization project, these amounts are paid to such diseases as diphtheria, whooping cough, tetanus, measles, rubella, hepatitis B, Japanese encephalitis, pneumonia/Hib meningitis, tuberculosis and polio) during inspections, audits and supervisions, including:

a) Paying rewards to persons collecting pathology specimens, articles and blood samples (except cerebrospinal fluid specimens): 7,000 dong/each;

c) Paying rewards to persons giving venous blood samples: 30,000 dong/each; rewards to persons giving capillary blood samples: 10,000 dong/each.

17. Amounts of spending on payments for inspection, assessment, professional supervision and technical assistance at different levels and provision of instructions on carrying out specialized activities in the program:

a) Spending details and amounts shall be subject to provisions laid down in the Circular No. 40/2017/TT-BTC and clause 1 and clause 2 of Section II in the Circular No. 06/2007/TT-BTC dated January 26, 2007 of the Ministry of Finance, providing instructions on the budgeting, management and use of expenditures sufficient for the inspection of implementation of policies, strategies, planning schemes and plans;

As for interdisciplinary and interagency inspection and assessment groups, entities presiding over these groups shall be liable for costs of their trips according to the prescribed compensation package (e.g. payments for transport costs, accommodation allowances, payments for accommodation rentals at destination places and charges for carry-on baggage and documents used to work onboard) paid to group members. In order to avoid overlapping payments, entities presiding over inspection and assessment groups must inform entities seconding their staff members to go on business trips in writing (in their invitation letters or summons) about exemption from making these payments;

b) In case of making field trips to carry out monitoring and surveillance of epidemiological patterns, diseases, food safety, nutrition, reproductive health, sex imbalance at birth, congenital diseases and anomalies, sanitation and hygiene conditions in schools within the scope of projects, community health and population workers making such field trips shall be entitled to an allowance of 40,000 dong/person/day in addition to travelling allowance payments prescribed in the Circular No. 40/2017/TT-BTC;

Additionally, depending on requirements of each inspection, audit, monitoring and surveillance, the program’s budget may be used for performing the following tasks:

- As regards collection, storage or purchase of test samples and analytical specimens, amounts of spending on the collection of test samples shall be subject to provisions of clause 16 in this Article; amounts of spending on the storage and purchase of test samples shall be based on evidencing document and invoices which are legitimate and correspond to local market prices at the sample collection time;

- Amount of spending on transportation and analysis of test samples from sample collection places to test facilities shall be subject to provisions of clause 13 of this Article;

- Amounts of spending on hiring of guides who also act as ethnic language interpreters or those guides who do not act as ethnic language interpreters shall be subject to provisions laid down in clause 14 of this Article;

- Amounts of spending on epidemiological survey, inspection and statistics shall be subject to provisions of clause 6 of this Article.

18. Amounts of spending on thematic talks and discussions that provide patients and patient's relatives with instructions on disease prevention, treatment, patient care and psychological support for patients; organization of club activities designed to give counsels on the program's contents:

a) Crowd or hall thematic advices, talks, dialogues or discussions:

- Amounts of spending on hiring of venues, tables, chairs, backdrops and tents (if any) shall be calculated based on contracts (in case of hiring of services) or local market prices and legitimate spending documents (receipts or invoices);

- Amounts of spending on drinking water for participants shall be subject to provisions laid down in clause 3 of Article 12 in the Circular No. 40/2017/TT-BTC;

- Amounts of spending on payment of remunerations to counselors shall be the same as those prescribed in subparagraph 1.1, clause 1 of Article 3 in the Circular No. 139/2010/TT-BTC. If panelists or speakers are collaborators or medical staff working at villages or mountainous villages, they shall receive amounts of spending the same as applied to lecturers or panelists/speakers who are public officials, officers and servants working at district-, equivalent or lower-level entities;

- Amounts of spending on translation services (if any) shall be subject to provisions laid down in clause 15 in this Article;

b) In case talks or discussions are held on a monthly basis at HIV test facilities or medical establishments providing opioid replacement therapy,

- Remuneration paid to each health counselor shall be 100,000 dong/counselor/session and shall be restricted to 500,000 dong/counselor/month. The number of counselors shall be decided by heads of local authorities specialized in health and population affairs;

c) In case of community outreach activities,

- They shall be entitled to payments of travelling allowance in accordance with the Circular No. 40/2017/TT-BTC and shall receive bonuses specific to target audiences at the rate of 15,000 dong/target audience/session but restricted to 300,000 dong/counselor/month. Especially in food safety counsels, amounts of spending shall be 30,000 dong/counseled establishment/session but restricted to 450,000 dong/counselor/month;

- Amounts of spending on interpretation services (if any) shall be subject to provisions laid down in clause 15 of this Article;

- Amounts of spending on hiring of guides who also act as ethnic language interpreters or those guides who do not act as ethnic language interpreters (if any) shall be subject to provisions laid down in clause 14 of this Article.

19. Amounts of spending on screening examinations, screenings for detection, management of screenings, campaigns and mobile community outreach health examinations of diseases and activities of the program’s projects (even including the combination of medical examination and treatment with mitigation of natural disasters and fortification of national defence and security within localities belonging to the scope of the military and civilian medicine combination project). In the extended immunization project, such amounts shall be paid for examinations and program’s activities related to the following diseases: diphtheria, whooping cough, tetanus, measles, rubella, hepatitis B, Japanese encephalitis, pneumonia/Hib meningitis, typhoid, tuberculosis and polio) (hereinafter referred to as screening examination). Spending details and amounts shall include the followings:

a) Amounts of spending on tests and operations for collection of biopsy specimens, histopathology specimens and other technical medical services (if any). Amounts of spending shall be calculated at the prices of medical services currently applied to public health establishments;

b) Amounts of spending on allowance for persons directly participating in screening examinations in addition to current payments of travelling allowance:

- As regards those who are entitled to monthly salaries and allowance funded by the state budget:

+ Those directly performing medical examinations and tests (including doctors, physicians, nurses, midwives and technicians) shall be entitled to an allowance of 125,000 dong/person/day if these medical examinations are conducted at specially underprivileged communes along beaches and on islands, specially underprivileged communes, border communes and communes within safe zones according to the Prime Minister's decisions; an allowance of 90,000 dong/person/day if these medical examinations are conducted at other communes;

- As regards those who do not receive monthly salaries and allowance from the state budget:

+ Persons directly performing medical tests and examinations shall be entitled to allowance equal to 1.3 times more than region-specific minimum wage rates (per day) according to the Government’s regulations on region-specific minimum wage rates applied to employees working under employment contracts;

+ Other persons directly assisting in performing screening examinations (including collaborators (if any)): The rate of allowance shall be equal to the region-specific minimum wage rate (per day) in accordance with the Government’s regulations on region-specific minimum wage rates for employees working under employment contracts;

In case of screening examinations in combination with technology transfers to localities, amounts of spending on allowance to doctors, physicians, nurses, midwives or test technicians shall be the same as the rate of remuneration paid to lecturers as prescribed in the Circular No. 139/2010/TT-BTC. Persons participating in screening examinations at the places where these examinations take place shall not be entitled to payments of travelling allowance in accordance with existing regulations;

c) Amounts of spending on hiring of locations, tables, chairs, backdrops or tents (if any) and payment of costs of fuel, electricity, water and medical supplies intended for screening examinations shall vary depending on actual costs inscribed on invoices and legitimate spending documents;

d) Amounts of spending on translation services (if any) shall be subject to provisions laid down in clause 15 of this Article;

Duration of each examination at a cluster and the minimum number of patients/day shall be subject to specialized regulations of the Ministry of Health;

Persons participating in screening examinations shall be entitled to only 01 level of allowance according to regulations of this clause or regulations on particular spending details of projects and activities of the program (if any).

20. Amounts of spending on grants or aids offered to communes, wards or towns for management of the program shall be subject to the decisions of the provincial-level People’s Committees provided that they are in line with conditions and capability of local government’s budgets.

a) Beneficiaries (e.g. medical staff at villages or others) and the number of collaborators in each commune shall be subject to the decisions of heads of local health and population establishments if projects and activities of the program require regular collaborators;

b) Amounts of spending on allowance to collaborators shall be as follows:

- As for communes, wards, key towns or specially underprivileged communes, the rate of allowance shall be 200,000 dong/person/month/project (Project No. 2, 4, 5, 6 and 7) or shall be equivalent to the rate applied to 01 disease in the Project No. 1 or 01 activity in the Project No. 3;

- As for other communes, the rate of allowance shall be 150,000 dong/person/month/project (Project No. 2, 4, 5, 6 and 7) or shall be equivalent to the rate applied to 01 disease in the Project No. 1 or 01 activity in the Project No. 3;

In case where a collaborator gets involved in multiple projects (Project No. 2, 4, 5, 6 and 7) or multiple diseases or activities in the project No. 3, he/she may be entitled to an allowance of 50,000 dong/month per each project or 01 disease/activity added.

22. Amounts of spending on payment of travelling costs (one round trip and 03 times at maximum) to poor patients taking health check-ups at specialized medical establishments at the district or higher level (with respect to diseases not belonging in the list of diseases of which costs of treatment are paid by health insurance entities and not yet entitled to grants or aids funded by other capital sources) according to doctor’s prescriptions after medical examinations and disease detection screenings at community shall be subject to provisions laid down in clause 13 of this Article within the scope of authorized budgets.

23. Amounts of spending on subsidies given to medical establishments to design and put to use models of management, detection and recording of patients with noninfectious diseases (including diabetes, high blood pressure, cerebral vascular accident/stroke, coronary thrombosis, cancer, chronic obstructive pulmonary disease, bronchial asthma and mental illnesses) according to regulations of the Ministry of Health shall be 200,000 dong/disease/medical establishment/month for performing the following tasks:

a) Completing notes of assessment of disease risks, recording diseases, tables of interview of patients (if any);

b) Preparing medical records and logbooks used for periodic monitoring of patients to the program’s requirements;

24. With regard to the case in which the State Auditor does not carry out annual audits (where necessary), amounts of spending on hiring of independent audits shall be subject to laws on bidding.

25. Amounts of spending on assessment of deaths occurring owing to implementation of projects or activities in the program where necessary shall be subject to the decisions of competent entities:

a) Amounts of spending on meetings of assessment committees shall be the same as those on assessment of tasks involved in and finances of scientific and technological missions prescribed in clause 1 of Article 9 in the Joint Circular No. 55/2015/TTLT-BTC-BKHCN;

b) Amounts of spending on payment of travelling allowance (if any) shall be subject to provisions of the Circular No. 40/2017/TT-BTC;

c) Amounts of spending on hiring of guides (if necessary) shall be subject to clause 14 of this Article.

26. Spending details and amounts on rewards for collectives or individuals showing excellent performance in organization and implementation of the program under the decisions of competent entities shall be subject to laws on emulation, commendation and grant of rewards.

27. Details of spending on payment of reciprocal capital from aid projects shall be conformable to those specified in treaties or agreements with sponsors while amounts of spending shall be subject to existing spending regulations, legitimate invoices and documents and laws on bidding within the scope of authorized budgets.

1. Prevention and control of leprosy:

a) Amounts of spending on purchase and production of specially designed items provided for leprosy patients shall be subject to regulations of the Minister of Health. All purchases thereof shall be subject to laws on bidding;

b) Amounts of spending on payment of allowance to medical staff members directly dispensing drugs and monitoring leprosy patients treated with multiple drug chemotherapy at home in addition to current travelling costs shall be as follows:

- Patients infected with fewer bacteria and receiving adequate doses for the treatment duration of 6 – 9 months: 200,000 dong/patient/each duration of treatment with adequate dose;

- Patients infected with more bacteria and receiving adequate doses for the treatment duration of 12 - 18 months: 400,000 dong/patient/each duration of treatment with adequate dose;

c) Patients living in family households below poverty thresholds that are entitled to financial support:

- Functional rehabilitation tools designed for leprosy patients with physical impairments shall be subject to provisions laid down in point b of clause 2 of Article 7 herein;

- Patients receiving rotted hole clearance services rendered by commune-level or regional-level healthcare establishments shall be entitled to allowance of 50,000 dong/person/day within the maximum duration of 20 days;

- If leprosy patients suffering from serious leprosy reactions or incidents occurring during the treatment duration are entitled to allowance paying for leases of means of transport from homes to communal-level healthcare stations, leprosy treatment departments or regional-level general hospitals, amounts of spending shall be subject to clause 13 of Article 4 herein;

- Patients residing at specially underprivileged communes: 300,000 dong/patient;

- Patients residing at other communes: 200,000 dong/patient.

2. Prevention and control of tuberculosis:

a) Amounts of spending on allowance for medical staff members testing and detecting main sources of infection (AFB tuberculosis) at community shall be 30,000 dong/patient with AFB tuberculosis;

b) Amounts of spending on allowance for communal-level medical staff members directly testing and taking tuberculosis patients to district-level tuberculosis prevention and control groups:

- Specially underprivileged communes: 50,000 dong/commune/month;

- Other communes: 30,000 dong/commune/month;

c) Amount of spending on allowance for medical staff members directly dispensing drugs, checking and monitoring patients with tuberculosis, multidrug-resistant tuberculosis and latent tuberculosis that have already been treated for the full length of treatment at community according to instructions given by the Ministry of Health (National Tuberculosis Control Project):

- Specially underprivileged communes: 170,000 dong/patient/treatment length of 6-8 months; 150,000 dong/patient with latent tuberculosis/treatment length; 200,000 dong/patient with multidrug-resistant tuberculosis/treatment length of 9 months or 400,000 dong/patient with multidrug-resistant tuberculosis/treatment length of 20 months;

3. Prevention and control of malaria:

a) Amounts of spending on allowance for medical staff members conducting tests for malaria at home:

- Tests for identification of malaria vectors: 5,000 dong/specimen;

- Tests for chemical sensitivity and mosquito-repellent efficacy of specific chemicals (in the stages of catching, rearing mosquitoes and developing the number of mosquitoes to reach the expected number of mosquitoes per each specimen and testing): 600,000 dong/specimen;

- Serological tests for diagnosis of malaria (at the stages of collection, transportation, storage of blood samples and testing): 25,000 dong/specimen;

- PCR tests and genome sequencing: 30,000 dong/specimen;

b) Amounts of spending on allowance for medical staff members working at microscopy laboratory points: 150,000 dong/point/month;

c) Amounts of spending on paying wages to persons feeding mosquitoes and persons catching mosquitoes at night: 130,000 dong/person/night;

d) Amounts of spending on wages paid to persons directly involved in anti–mosquito chemical spraying and impregnation shall be equal to 1.5 times more than region-specific minimum wage rates (per day) according to the Government’s regulations on region-specific minimum wage rates applied to employees working under employment contracts;

- Amounts of spending on allowance for medical staff members involved in virus culture and isolation: 40,000 dong/specimen;

- Amounts of spending on wages paid to persons directly involved in anti–mosquito chemical spraying and impregnation activities shall be equal to 1.5 times more than region-specific minimum wage rates (per day) according to the Government’s regulations on region-specific minimum wage rates applied to employees working under employment contracts;

- Amounts of spending on wages paid to persons directly performing environmental sanitation activities and killing mosquito larvae at home and participating in campaigns (except members of family households) shall be equal to 3,000 dong/household/time and these amounts per day at maximum shall be equal to the region-specific minimum wage rates (per day) under the Government’s regulations on region-specific minimum wage rates for employees working under employment contracts.

a) Amounts of spending on detection, management and early treatment of patients with mental illness:

Amounts of spending on allowance for medical staff members preparing Beck Depression Inventory or other depression assessment checklists, subject to regulations of the Minister of Health, shall be equal to: 15,000 dong/checklist;

b) Amounts of spending on allowance for communal-level medical staff members assigned to dispense drugs periodically to patients with mental illness at home, medical staff members working at (mountainous) villages participating in functional rehabilitation activities for patients with mental illness at community: The number of medical workers and staff members entitled to such allowance shall be subject to the decisions issued by the Chairpersons of provincial-level PCs or heads of specialized entities receiving delegated powers to make decisions. Amounts of allowance shall be as follows:

- Amounts of spending on allowance for communal-level medical staff members assigned to dispense drugs periodically to patients with mental illness at home: 150,000 dong/commune/month;

- Allowance for medical staff members at (mountainous) villages participating in the functional rehabilitation of patients with mental illness at community: 20,000 dong/patient/month in delta and urban zones, 25,000 dong/patient/month in mountainous areas, highlands and islands, but restricted to 100,000 dong/(mountainous) village/month.

6. Prevention and control of diabetes and iodine deficiency disorders:

Amounts of spending on allowance for medical staff members involved in screening tests and campaigns:

a) Amounts of spending on allowance for medical staff members carrying out procedures for sampling venous blood and centrifuging blood samples to collect serum used in laboratory tests: 20,000 dong/specimen;

b) Amounts of spending on allowance for medical staff members carrying out blood sugar rise procedures: 5,000 dong/specimen;

d) Amounts of spending on paying wages for the ultrasonic testing of thyroid glands that serves investigation, assessment and survey purposes: 10,000 dong/tested person;

dd) Amounts of spending on supplying drinking water and glucose to persons taking blood sugar rise tests: 10,000 dong/person.

7. Chronic obstructive pulmonary disease and bronchial asthma:

Amounts of spending on allowance for grassroots-level medical staff members providing instructions about physical exercise and functional rehabilitation one time for patients with chronic obstructive pulmonary disease and bronchial asthma at community: 15,000 dong/patient or 100,000 dong/medical staff member/day if that medical staff member instructs at least 7 patients at the same place.

8. School health activities:

Amounts of spending on integrating education about knowledge of prevention and control of school-related diseases and impairments at educational institutions in the national education system:

a) Amounts of spending on allowance paid for design of school health syllabus shall be subject to provisions laid down in clause 1 of Article 4 herein;

b) Amounts of spending on remunerations paid to lecturers in school health disciplines shall be subject to provisions laid down in the Circular No. 139/2010/TT-BTC.

Article 6. Particular spending details and amounts for Project No.2 – Extended immunization

a) Specially underprivileged communes: 24,000 dong/child orally given or given injection of full vaccine doses (equivalent to 3,000 dong/child/time of oral administration or injection of vaccine);

2. Amounts of spending on allowance for medical staff members giving children injection of hepatitis B birth dose vaccines within 24 hours of birth at hospitals or medical establishments; giving 18-month-old babies injection of one of the following vaccines, including Japanese encephalitis B, cholera, typhoid, measles – rubella and DPT4; injecting/orally administering vaccines to children in supplementary immunization campaigns:

a) Specially underprivileged communes: 4,000 dong/child/dose (per each session);

b) Other communes: 2,000 dong/child/dose (per each session);

3. Amounts of spending on allowance for medical staff members administering full tetanus vaccine doses to pregnant women and women of childbearing age:

a) Specially underprivileged communes: 4,000 dong/person injected with full vaccine doses;

b) Other communes: 2,000 dong/person injected with full vaccine doses.

4. Amounts of spending on surveillance and investigation of each case of acute flaccid paralysis from the date of detection to the 60th day, collection and transportation of clinical specimens in accordance with regulations in force:

5. Amounts of spending on surveillance and investigation of each suspected case of infection with neonatal tetanus, measles, rubella, Japanese encephalitis or each case of neonatal death from the date of detection, investigation and completion of survey forms under the decisions of competent entities:

- Specially underprivileged communes: 300,000 dong/case;

- Other communes: 150,000 dong/case.

6. Amounts of spending on compensation given if vaccines in the extended immunization program cause serious dangers to health and lives of vaccinated persons: Amounts of compensation shall be subject to provisions of the Government’s Decree No. 104/2016/ND-CP dated July 1, 2016, prescribing immunization activities.

7. Amounts of spending on purchase of insurance against risks to vaccines and immunization supplies stored at warehouses shall be based on contracts with and invoices issued by insurance suppliers.

Article 7. Particular spending details and amounts for Project No. 3 – Population and development

1. Population – family planning activities:

a) Amounts of spending on financial support for implementation of sterilization policies:

- Amounts of spending on allowance for these persons: 300,000 dong/ voluntarily sterilized person;

- Amounts of spending on subsidies on travelling costs for persons voluntarily coming to medical centers to receive sterilization services, medical staff members making field trips to communes or medical clusters providing surgical services shall be subject to provisions of clause 13 of Article 4 herein;

b) Amount of spending on storage and receipt of birth control devices: Amounts of spending based on contracts, invoices and other legitimate documents and laws on bidding; amounts of spending on transportation of birth control devices shall be subject to provisions of clause 13 of Article 4 herein.

c) Free-of-charge allocation of birth control devices in the list issued by the Ministry of Health:

- Receivers of free-of-charge birth control devices: Persons living in family households below or near the poverty line; social protection beneficiaries; residents at communes in provinces with the birth ratio of greater than 2.3 babies; persons working at sea before going on long sea journeys (at least 15 days) and when arriving at docks located at coastal communes having the minimum population of 200 inhabitants working at sea;

- Entities and persons tasked with providing birth control devices free of charge shall be responsible for making the full statistics and update of the list of receivers according to instructions given by project presiding entities;

d) Social marketing of birth control devices in the list of birth control devices: Implementation and mechanism for financial management of social marketing activities shall be subject to existing regulations;

dd) Expenditures on quality assessment of birth control devices shall be calculated based on the assessment prices quoted by competent regulatory authorities or in compliance with laws on bidding;

e) Expenditures on implementation of family planning and incident response services based on medical specializations for voluntarily sterilized persons and persons allocated birth control devices free of charge:

- Amounts of spending on wages paid for injection of contraceptive drugs shall be calculated at the current prices of injection services applied at public healthcare establishments;

- Amounts of spending on payment of costs of travel (one round trip) of patients living in family households below the poverty line, and persons who are voluntarily sterilized or allocated birth control devices (e.g. rings, injections or transplant medications) free of charge in case any incident determined according to the medical specialty takes place, to district- or higher-level specialized medical establishments to take their health check-ups (with respect to diseases not in the list of diseases qualified for health insurance covers and not yet obtaining any subsidy from other funding sources) according to doctor's prescriptions made up after completion of medical examinations and screenings for detection of diseases at community, shall be subject to provisions laid down in clause 13 of Article 4 herein.

g) Prenatal and neonatal diagnostic screenings:

- The Ministry of Health shall choose the number of eligible communes meeting objectives of the Project within authorized budgets. Heads of entities allocated expenditures on carrying out prenatal and neonatal screenings and diagnoses shall decide on healthcare establishments meeting requirements for and having competences in rendering these technical medical services in accordance with laws on bidding and placement of orders for public services;

- Persons eligible to receive subsidies for charges for prenatal and neonatal screenings and diagnoses shall be those living in family households below or near the poverty line, social protection beneficiaries, people that live in regions facing high risks, infected with dioxin agents and have not yet held health insurance cards.

- Details and amounts of spending on prenatal and neonatal diagnostic screenings:

+ Expenditures on medical examination, ultrasonic testing and other tests necessary for prenatal and neonatal screenings and diagnoses according to medical procedures regulated by the Minister of Health: Amounts of spending on these services shall be determined at the current prices of healthcare services (inclusive of costs of collection of venous blood samples, neonatal heel prick blood samples, maternal finger prick blood samples, prenatal and neonatal diagnoses);

+ Expenditures on sending notifications of screening results of tested persons (including negative or positive results) shall be determined at the current rate of charges for postal services (if any);

+ If tested persons are referred to other healthcare establishments at correct medical technical levels and upon the requests of heads of healthcare establishments rendering prenatal and neonatal screening and diagnosis services within their jurisdiction, amounts of spending on payment of travelling costs shall be subject to provisions of clause 13 of Article 4 herein;

- Persons eligible to be entitled to subsidies for charges for such services: Persons living in family households below or near the poverty line, social protection beneficiaries, people that live in regions facing high risks and infected with dioxin agents;

- Amounts of spending on such services shall be calculated at the prices of medical services currently applied to public health establishments;

i) Amounts of spending on inputting updated population – family planning information into the initial population – family planning logbooks of collaborators: 5,000 dong/information sheet received from at least 5 family households registered in logbooks or from a new family household;

k) Expenditures on control of population living ashore on islands and in coastal regions:

- Expenditures on health check-ups, tests for high-risk factors, Rh (Rhesus) factor, hepatitis B virus and other factors directly affecting pregnancy, development and quality of fetuses for premarital couples living in family households below the poverty line, persons rendering meritorious revolutionary services and ethnic people exposed to high risks in giving birth to babies with anomalies: Amounts of spending on such services shall be calculated at the prices of medical services currently applied to public health establishments;

- Expenditures on health check-up services rendered to pregnant women at high risks of direct adverse impacts on the normal development of fetuses caused by marine environment in the model of trial on medical interventions to assure the normal development of fetuses and the healthy condition of pregnant women currently living and working at areas flooded with salt water, lagoons or estuaries within coastal communes: Amounts of spending on such services shall be calculated at the prices of medical services currently applied to public health establishments;

- Expenditures on health check-up services intended for prevention and control of sexually transmitted diseases, prevention of unexpected pregnancy and safe abortion for persons that are aged from 15 to 24 years, have not yet married, have not gone to school, have been unemployed or have been employed unstably at coastal communes, communes with industrial parks, export processing zones, tourist sites, economic zones, ship docks, fishing ports, fishing villages or estuaries: Amounts of spending on such services shall be calculated at the prices of medical services currently applied to public health establishments;

l) Amounts of spending on communal-level medical staff members providing post-surgical care for voluntarily sterilized persons at home (if any): 50,000 dong/ voluntarily sterilized person;

m) Amount of spending on allowance for 01 person in charge of population affairs at the communal level that has not yet received any salary or subsidy funded by the state budget shall be 0.5 times as much as the base pay rate/person/month;

o) Expenditures on repair and fortification of physical infrastructure of warehouses and storage facilities of birth control devices, population – family planning consultancy and service centers; establishments providing family planning services, those providing prenatal and neonatal screening and diagnosis services at the central or provincial level according to the approval decisions of competent entities: Spending amounts shall be consistent with legitimate invoices and spending documents and shall be subject to laws on bidding;

p) Expenditures on printing registers or logbooks at establishments providing population - family planning services; record cards designed to monitor participating persons to meet the program's reporting requirements. Spending amounts shall be consistent with legitimate invoices and spending documents and shall be subject to laws on bidding.

2. Functional rehabilitation of disabled persons at community:

a) Expenditures on design of functional rehabilitation models for grassroots-level medical establishments. Spending details and amounts shall be subject to regulations laid down in Article 7, Article 8 and Article 9 in the Joint Circular No. 55/2015/TTLT-BTC-BKHCN;

b) Expenditures on support for disabled persons living in family households below the poverty line, ethnic minority households and disabled children aged under 6 years (hereinafter referred to as disabled people) involved in functional rehabilitation models:

- Amounts of spending on surgeries and orthopaedic surgeries (if any) for disabled people not entitled to covers of the health insurance fund shall be calculated at the current prices of medical services that competent entities decide to apply to public healthcare establishments;

- Amounts of spending on subsidies for costs of orthopaedic instruments (if any): 650,000 dong/patient;

- Amounts of spending on subsidies for costs of functional rehabilitation instruments designed for disabled people: 1,300,000 dong/patient.

b) Expenditures on implementing typical long-term care models; models of care at community, concentrated care and nursing centers for elderly people according to the approval decisions of the Minister of Health. Spending details and amounts shall be subject to the financial spending regime in force.

4. Reproductive health care:

a) Amount of expenditure on allowance for midwives at (mountainous) villages within mountainous, remote, isolated or island communes who have already been trained and are directly involved in performing reproductive health care activities at community (not yet receiving rates of allowance for medical staff members working at (mountainous) villages as per the Prime Minister’s Decision No. 75/2009/QD-TTg dated May 11, 2009, prescribing policies on allowance for medical staff members serving at (mountainous) villages) shall be 0.3 times as much as the base pay rate/person/month (at each (mountainous) village, only one midwife is entitled to such allowance);

b) Expenditures on medical bags of midwives at (mountainous) villages, clean midwifery kits and medical records intended for monitoring health of mothers and babies according to specialized instructions issued by the Minister of Health: All purchases thereof shall be subject to laws on procurement.

5. Child nutrition improvement activities

a) Amounts of spending on purchases of food ingredients used for practice classes in nutrition, cooking techniques for pregnant women, caretakers of children under 5 years of age who suffer from malnutrition or obesity: 6,000 dong/person;

b) Expenditures on purchase and transportation of nutritional products supplied free of charge for pregnant women, breastfeeding women and malnutrition-stricken children under 5 years of age living in family households below or near the poverty line, classified as social protection beneficiaries or residing in regions in need of urgent nutritional support. Amounts of spending on purchase and transportation thereof shall be calculated based on legitimate invoices and documents, shall be subject to legislative regulations on procurement and must fall within the scope of budgets approved by competent entities;

c) Expenditures on support for children at age of 6 months to 60 months that take vitamin A at community:

- Specially underprivileged communes: 4,000 dong/child/dose (per each oral administration);

Article 8. Particular spending details and amounts for the Project No.4 – Food safety

1. Expenditures on implementation of techniques and assessment of test methods; implementation of international and regional test methods and assessment of quality of testing laboratories:

a) Expenditures on proficiency testing and inter-laboratory comparison. Particular spending details and amounts shall include the followings:

- Amount of spending on formulation of draft proposals of test programs: 1,000,000 dong/proposal;

- Amounts of spending on international and domestic proficiency testing and inter-laboratory comparison shall be calculated based on contracts, invoices and other legitimate spending documents;

- Amounts of spending on hiring of proficiency testing experts (if any) shall be subject to provisions of clause 8 of Article 4 herein;

- Amounts of spending on meetings of proficiency testing committees shall be the same as those on assessment of tasks involved in and finances of scientific and technological missions prescribed in clause 1 of Article 9 in the Joint Circular No. 55/2015/TTLT-BTC-BKHCN.

- Amounts of spending on synthesis and handling of analysis results of testing laboratories: 1,000,000 dong/report;

- Amounts of spending on sending of analysis results to regulatory entities in accordance with regulations in force shall be calculated at the rates of postal services;

c) Expenditures on standardization of test laboratories according to TCVN ISO/IEC 17025:2005 with respect to food testing laboratories under the control of the Ministry of Health, the Ministry of Industry and Trade, and the Ministry of Agriculture and Rural Development, including:

- Amounts of spending on design and standardization of ISO test methods: 500,000 dong/test method;

- Amounts of spending on allowance for standardization officers shall be 100,000 dong/person/day but restricted to 500,000 dong/person/month;

d) Expenditures on internal assessments carried out at a frequency of no more than 2 times/year:

- Amounts of spending on formulation of internal assessment proposals: 1,000,000 dong/proposal;

- Amounts of spending on hiring of consultants on supervision of internal assessments (if any) shall be subject to clause 8 of Article 4 herein;

- Internal assessments: Amounts of spending on internal assessments shall be the same as those on assessment of tasks involved in and finances of scientific and technological missions prescribed in clause 1 of Article 9 in the Joint Circular No. 55/2015/TTLT-BTC-BKHCN;

- Amounts of spending on synthesis and reporting of internal assessment results: 1,000,000 dong/report;

- Amounts of spending on support for officers in charge of standardizing documents and supervising internal assessments shall be 200,000 dong/person/assessment session, but paid to 5 officers/assessment session at maximum.

a) Amounts of spending on activities such as data analysis and reporting of food poisoning: 2,600,000 dong/food poisoning case;

b) Amounts of spending on remunerations paid to persons directly investigating and responding to food poisoning and foodborne illnesses (apart from travelling allowance; if an officer has already received epidemic resistance allowance from other funding sources, he/she shall not be entitled to remuneration of this kind) shall be as follows:

- Amounts of spending on support given at areas prone to floods, natural disasters, calamities and foodborne illness hotspots shall be 130,000 dong/person/day;

- Amounts of spending on support given at other areas and places shall be 100,000 dong/person/day;

c) Amounts of expenditures on construction of typical food safety models for food, beverage and street food businesses; local collective catering kitchens shall be subject to decisions of heads of respective specialized regulatory entities at the provincial level. Spending details and amounts shall include the followings:

- Amounts of spending on formulation of proposals: 1,000,000 dong/proposal;

- Amounts of spending on hiring of consultants on assessment of typical models, provision of instructions for development of programs and model supervision (including trial assessments for inspection and surveillance of effectiveness of quality management programs in models) shall be subject to clause 8 of Article 4 herein;

- Other activities prescribed in decisions of competent entities: Amounts of spending on these activities shall be subject to regulations in force and provisions laid down herein, shall fall within the scope of budgets approved by competent entities.

3. Expenditures on assurance of food hygiene and safety in the agricultural and fishery production industry

b) Expenditures on implementation of national programs for surveillance of food safety of agricultural produce and fishery products:

- Amounts of spending on investigation, survey and statistics shall be subject to provisions of clause 6 of Article 4 herein;

- Amounts of spending on inspection and surveillance shall be subject to provisions of clause 17 of Article 4 herein;

c) Details and amounts of spending on carrying out assessment of food safety risks of agricultural produce and fishery products shall include the followings:

- Amounts of spending on composition of practice manuals shall be subject to clause 1 of Article 4 herein;

- Amounts of spending on building of databases concerning warning and investigation into causes and recalls of agricultural produce and fishery products that do not conform to food safety and quality requirements shall be subject to clause 7 of Article 4 herein;

- Sampling, hiring of sample analysis and assessment of food safety indictors, strengthened inspection and audit of cases suspected of committing violations (once there are food safety warnings or incidents or suspicious signs of violation): Amounts of spending on collection of samples for inspection and audit purposes as per clause 16 and clause 17 of Article 4 herein; hiring of analysis of samples and assessment of indicators shall be calculated at the prices of test services prescribed in laws on prices.

4. Expenditures on building and initial application of manufacturing and business models, chain linkage models and advanced management programs (e.g. GMP, GHP, VietGAP, HACCP, ISO 22000,...) approved by the Minister of Agriculture and Rural Development, and the Minister of Industry and Trade. Local-level models shall be subject to decisions of heads of local specialized regulatory entities at the provincial level. Spending details and amounts shall include the followings:

a) Amounts of spending on formulation of proposals: 1,000,000 dong/proposal;

c) As for medium and small-sized businesses initially applying food safety and quality management models (e.g. production models, chain linkage models and advanced management programs), amounts of spending on support for some of their activities in the first year shall include the followings:

- Amounts of spending on sampling, analysis and assessment of food safety and hygiene indicators according to specialized regulations shall be approved by competent entities as follows: Amounts of spending on collection of samples for inspection and audit purposes shall be subject to clause 16 and clause 17 of Article 4 herein. Amounts of spending on hiring of analysis of samples and assessment of indicators shall be determined at the prices of test services prescribed in laws on prices;

- Amounts of spending on subsidies for costs of quick monitoring instruments of medium and small-sized businesses shall be subject to regulations of entities having competence in approving models and must fall within the scope of authorized budgets.

5. Expenditures on building of accredited advanced models of food safety markets: Central-level models shall be decided by the Minister of Industry and Trade while local-level models shall be decided by heads of local specialized regulatory entities at the provincial level. Spending details and amounts shall include the followings:

a) Amounts of spending on hiring of consultants on assessment of typical models, provision of instructions for development of programs and model supervision (including trial assessments for inspection and surveillance of effectiveness of quality management programs in models) shall be subject to clause 8 of Article 4 herein;

b) Other activities prescribed in decisions of competent entities: Amounts of spending on these activities shall be subject to regulations in force and provisions laid down herein, shall fall within the scope of approved budgets.

6. Details and amounts of spending on field trips to models of food hygiene and safety market with a view to building and multiplication of these models at localities shall be subject to the Circular No. 40/2017/TT-BTC.

7. Subsidies for costs of renovation and repair of facilities which are granted to entities tasked with food safety testing and state management. Amounts of spending on such subsidies shall vary depending on repair or renovation projects approved by competent entities and shall be subject to legislative regulations on procurement.

8. Expenditures on inspection and surveillance of compliance with food safety regulations shall be subject to provisions of clause 17 of Article 4 herein.

1. Enhancement of HIV/AIDS tests:

a) Expenditures on HIV and sexually transmitted infection (STI) tests serving specialized activities in the program during HIV/AIDS or STI epidemiological surveillance surveys (including sentinel surveillance, detection surveillance surveys, sentinel surveillance surveys combined with behavioral surveillance and biological indicator monitoring surveys) on persons compulsorily tested for HIV in accordance with laws (including those tests used in surveys or for research purposes): Amounts of such expenditures shall be calculated at the prices of healthcare services, HIV/AIDS testing and treatment services or prophylactic services for prevention of HIV infection which are approved by competent entities to be applied at state-owned healthcare, HIV/AIDS treatment and HIV infection prophylaxis establishments;

b) Expenditures on support for tests for the presence of opioids in the blood, urine and other conventional tests regulated by the Ministry of Health with regard to persons living in family households below or near the poverty line or ethnic people residing in areas facing special socio-economic disadvantages, all of whom participate in replacement therapies for opioid addictions. Amounts of such expenditures shall be determined at the prices of medical services, examinations and replacement therapies for opioid addictions which are approved by competent entities with regard to state-owned healthcare service providers and medical establishments specialized in examinations and replacement therapies for opioid addictions;

c) Amount of spending on allowance for persons in high risk groups giving blood samples or clinical specimens: 30,000 dong/sample or specimen.

2. Expenditures on implementing interventions for mitigation of harmful effects and prophylaxis of HIV:

a) Amounts of spending on allowance for community outreach workers already granted staff ID cards: 500,000 dong/person/month. If community outreach workers have managed to convince persons in high risk groups to be tested positive for HIV or treated with antiretroviral drugs, they may be entitled to an additional allowance of 200,000 dong/person but restricted to 600,000 dong/month. In case where community outreach workers have already been entitled to remunerations from other funding sources, they may not be entitled to remunerations from the program's funding sources and vice versa;

b) Expenditures on monthly subsidies for activities of the peer group of communicators:

- Amounts of spending on monthly subsidies for activities shall be 10,000 dong/member/month but restricted to 1,200,000 dong/group/year;

- Amounts of spending on subsidies for costs of materials, means of communications, personal protective equipment used in collection of interventional items, uniforms of the peer group of communicators shall be calculated based on limits regulated by provincial-level medical regulatory entities;

d) Amounts of spending on the one-off payment of allowance for members of the peer group of communicators who have multiple contributions to preventing and controlling HIV/AIDS and are living in hardship: 200,000 dong/member;

The number of community outreach workers already receiving member ID cards, groups and members in a peer group of communicators shall be decided by heads of medical regulatory entities at localities provided that such number has to meet actual requirements of respective localities;

dd) Amounts of spending on external inspections shall be calculated at the prices of external HIV laboratory inspection services quoted by the Ministry of Health.

3. Expenditures on subsidies for costs of HIV/AIDS treatment and prophylaxis of mother-to-baby transmission of HIV:

a) HIV/AIDS treatment support:

- Persons infected with HIV owing to occupational accidents, risks of medical procedures, people at risk of being infected with HIV when participating in rescue, prevention and control of criminals, pregnant women, children under 6 years of age, poor people and ethnics residing in areas facing special disadvantages (except beneficiaries of health insurance covers for their medical costs by social insurance agencies by using health insurance funds or other funding sources) may be entitled to the following subsidies:

+ Subsidies for costs from taking medical tests regulated by the Ministry of Health to serve medical treatment purposes. Amounts of spending on such subsidies shall be calculated at the prices of medical tests, HIV/AIDS examination and treatment services subject to the approval decisions of competent entities with respect to state-owned medical establishments and HIV/AIDS treatment establishments;

+ Subsidies for costs of treatment of opportunistic infections for persons infected with HIV. Amounts of spending on such subsidies shall be defined as 200,000 dong/person/year;

- Persons infected with HIV at continuing education institutions, reform schools, medical care – education – labor social facilities, social protection establishments, prisons or detention camps: Amounts of spending on subsidies for costs of treatment of opportunistic infections shall be subject to the Prime Minister’s Decision No. 96/2007/QD-TTg dated June 28, 2007 on managing, caring for and providing counsels on treatment for HIV-infected patients and preventing HIV infections at education establishments, reform schools, social protection centers or establishments, prisons, detention camps and other documents providing instructions on the Decision;

c) Subsidies for costs of prophylaxis of mother-to-baby transmission of HIV: Expenditures on HIV tests for pregnant women voluntarily taking HIV tests, children under 18 months of age that are born to HIV/AIDS infected mothers. Amounts of such expenditures shall be calculated at the prices of healthcare services, HIV/AIDS examination and treatment services subject to the approval decisions of competent entities with respect to state-owned medical establishments and HIV/AIDS treatment establishments;

d) Deceased HIV-infected persons abandoned or having no families: Establishments conducting funerals shall be entitled to subsidies for costs of burial, movement of dead bodies and remains in accordance with laws on prevention and control of infectious diseases. Amounts of spending on such subsidies shall not be 30 times more than the standard level of social assistance as prescribed in the Government's Decree No. 136/2013/ND-CP dated October 21, 2013 on social assistance policies for social protection beneficiaries.

Article 10. Particular spending details and amounts for the Project No. 6 – Assurance of safety, prevention and control of hematologic diseases

1. Organizing voluntary blood donation communications programs and events: Heads of entities shall be assigned to implement decisions to organize such programs and events according to current expenditure regimes and within the scope of authorized budgets.

2. Expenditures on implementation of programs for external inspection of tests for screening of blood units for the purposes of assurance of blood transfusion safety for prevention and control of HBV, HCV, HIV and syphilis infections:

Spending details and amounts shall be subject to clause 19 of Article 4 herein, in addition to the followings:

a) Amounts of spending on collection of documents, data input, data synthesis and analysis of results and report preparation: 150,000 dong/unit;

b) Amounts of spending on update of documents and quality procedures related to EQAS: 500,000 dong/set of procedures;

c) Amounts of spending on allowance for persons establishing blood banks and storing blood bank specimens: 10,000 dong/specimen;

3. Support for building of reserve forces of blood donors for establishment of live blood banks: Spending details and amounts shall be subject to clause 19 of Article 4 herein, in addition to other financial support for drawing up plans, programs and making reports: Amounts of such financial support shall be 500,000 dong at maximum for entities at the communal and district levels; 2,000,000 dong at maximum for entities at the central level.

Article 11. Particular spending details and amounts for Project No. 7 – Combined military and civilian medicine

1. Spending on one-off payment of subsidies for costs of repair and addition of necessary medical equipment of military and civilian medical establishments located at borders or on islands. The list of necessary medical equipment that needs to be repaired or supplemented shall be subject to the decisions of the Minister of Health.

2. Building of typical combined military and civilian medicine models under the approval decisions of the Minister of Health: According to the budget authorized by a competent entity, the Minister of Health shall decide on central-level models while Chairpersons of provincial-level PCs shall decide or delegate authority to decide on local-level models. Spending details and amounts shall be subject to the financial spending regime in force.

3. Expenditures on support for organizing training or drilling sessions for mobile medical forces in response to demands for quick interventions in case of emergency, including:

a) Amounts of spending on allowance for participation in drilling sessions: 200,000 dong/person/day;

b) Expenditures on subsidies for costs of preparation of drill scenarios and instruments, personal suits, renting of medical equipment, means and other costs incurred from training and drilling activities (if any). Amounts of spending on subsidies for costs of preparation of drill scenarios and instruments shall be calculated under contracts decided by project directors within the scope of authorized budgets. Amounts of spending on subsidies for costs of personal suits, renting of equipment, means and other costs incurred from training and drilling activities (if any) shall be calculated based on invoices and other legitimate spending documents and under laws on bidding.

4. Details and amounts of spending on mobile medical examination and treatment activities or campaign-based ones for policy beneficiaries, poor people living at specially underprivileged communes, region-I, II or III communes in ethnic and mountainous areas or key national security and defence areas shall be subject to clause 19 of Article 4 herein.

Article 12. Particular spending details and amounts for the Project No. 8 – Monitoring, inspection, surveillance and assessment of implementation of the program and medical communications activities

2. Details and amounts of spending on subsidies for costs of communication and dissemination of the program’s contents on social networks for the purpose of meeting communication requirements in the current context (if any) shall be subject to clause 7 of Article 4 herein.

3. Amounts of spending on subsidies for costs incurred from editing communication contents at community: 80,000 dong/news or article containing from 350 to less than 600 words; 100,000 dong/article containing at least 600 words.

4. Expenditures on payment of royalties to auditors or copyright owners; remunerations to persons involved in carrying out activities relating to press works, printed publications, persons collecting documents and providing information used for creating press works and printed publications about information and communication: Amounts of such expenditures shall be subject to the Government’s Decree No. 18/2014/ND-CP dated March 14, 2014 on royalties in the press and publishing industry.

5. Details and amounts of spending on organizing seminars, discussions, communication education classes and thematic talks shall be subject to point a of clause 18 of Article 4 herein.

6. Expenditures on organizing meetings, months of action, communication and integrated communication campaigns:

a) Amounts of spending on allowance for persons organizing and supervising implementation of campaigns, attracting people to take part in these events and providing counsels (apart from current travelling allowance): 40,000 dong/person/day;

b) Amounts of spending on allowance for persons directly involved in campaigns: 50,000 dong/person/day. Heads of entities assigned communication tasks shall be accorded authority to decide the number of participants in campaigns within the scope of authorized budgets;

c) Amounts of spending on allowance for speakers: 100,000 dong/person/day;

d) Costs of petrol or hiring of means of transport, decoration, documentary photos, renting of conference halls, backdrops, tents, desks, chairs, amplifiers, radio equipment and other reasonable costs. Heads of assigned entities shall be vested with authority to decide relevant spending details. Amounts of spending shall be determined according to contracts and other legitimate spending documents and must fall within the scope of approved budgets.

a) Expenditures on using press and means of communications to attract participants and release information about rules of competitions: Heads of assigned entities shall be vested with authority to decide relevant spending details. Amounts of spending shall be determined according to contracts and other legitimate spending documents and must fall within the scope of authorized budgets;

b) Other expenditures (if any) on design of scenarios; renting of conference halls and equipment used in competitions; hiring of masters of ceremonies; design of questions, answers, allowance paid to boards of judges and organizers; grant of prizes to persons, collectives and payment of allowance for attendants and masters of ceremonies (MC); stationery; subsidies for travelling, meal and accommodation costs of participants living away from competition venues shall be subject to the Joint Circular No. 14/2014/TTLT-BTC-BTP dated January 27, 2014 of the Ministry of Finance and the Ministry of Justice, prescribing the budgeting, management, use and final accounts of state budget expenditures for the purpose of assuring adequate budgets for dissemination of and education about law soft, and standards for access to laws for grassroots-level people.

Chapter IV

IMPLEMENTATION PROVISIONS

Article 13. Transitional provisions

1. With respect to activities and missions already implemented before July 31, 2017, details and amounts of spending on these activities and missions shall be subject to regulations set forth in Joint Circulars of the Ministry of Finance and the Ministry of Health, including No. 113/2013/TTLT-BTC-BYT dated August 15, 2013, prescribing management and use of expenditures on implementation the national health target program in the 2012-2015 period; No. 117/2015/TTLT-BTC-BYT dated August 11, 2015, amending and supplementing the Joint Circular No. 113/2013/TTLT-BTC-BYT dated August 15, 2013, prescribing management and use of expenditures on implementation the national health target program in the 2012-2015 period; No. 67/2013/TTLT-BTC-BYT dated May 21, 2013, prescribing management and use of expenditures on implementation the national target program on food hygiene and safety in the 2012-2015 period; No. 163/2012/TTLT-BTC-BYT dated October 8, 2012, prescribing management and use of expenditures on implementation of the national target program on prevention and control of HIV/AIDS in the 2012-2015 period; No. 20/2013/TTLT-BTC-BYT dated February 20, 2013, prescribing management and use of expenditures on implementation of the national target program on population and family planning in the 2012-2015 period.

2. As regards activities and missions implemented from July 31, 2017 to end of May 6, 2018, details of spending on these activities and missions shall be subject to the Decision No. 1125/QD-TTg while amounts of spending on these activities and missions shall be subject to the Joint Circular of the Ministry of Finance and the Ministry of Health which is prescribed in clause 1 of this Article and current spending regimes.

3. As for activities and missions implemented from May 7, 2018, details and amounts of spending on these activities and missions shall be subject to the Decision No. 1125/QD-TTg and provisions laid down herein.

2. Joint Circular No. 113/2013/TTLT-BTC-BYT dated August 15, 2013, Joint Circular No. 67/2013/TTLT-BTC-BYT dated May 21, 2013, Joint Circular No. 163/2012/TTLT-BTC-BYT dated October 8, 2012, Joint Circular No. 20/2013/TTLT-BTC-BYT dated February 20, 2013 and Joint Circular No. 117/2015/TTLT-BTC-BYT dated August 11, 2015 of the Ministry of Finance and the Ministry of Health shall be repealed from the entry into force of this Circular.

Article 15. Implementation

1. Based on capabilities of balancing local government’s budgets and current situations, People’s Councils of provinces and centrally-affiliated cities may, within their respective jurisdiction, consider issuing decisions on amounts of spending higher than those prescribed herein with a view to successfully implementing the program.

2. In case where legislative documents used as references in this Circular have been amended or supplemented or replaced, relevant points, clauses and articles in new documents shall apply.

3. In the course of implementation, if any particular expenditure not prescribed in instruments of the Government, the Prime Minister, the Ministry of Finance and this Circular arises, provincial-level People’s Councils shall consider issuing decisions on amounts of spending corresponding to the capacity of local government’s budgets in accordance with clause 3 of Article 21 in the Government’s Decree No. 163/2016/ND-CP dated December 21, 2016, elaborating on implementation of the Law on State Budget.

4. In the course of implementation of this Circular, if there is any difficulty that arises, involved entities should inform the Ministry of Finance for its review and decision on any necessary and timely amendment or supplement./.
