CIRCULAR
PRICE RANGE FOR
LEASING THE RIGHT TO PROVIDE AIR SERVICES
Pursuant to the Law on Civil Aviation of Vietnam
No. 66/2006/QH11 dated June 29, 2006 and the Law on amendments to the Law on
Civil Aviation of Vietnam No. 61/2014/QH13 dated November 21, 2014;
Pursuant to Law on Prices No. 11/2012/QH13 dated
June 20, 2012;
Pursuant to Decree No. 177/2013/ND-CP dated
November 14, 2013 of the Government on elaborating to the Law on Prices and
Decree No. 149/2016/ND-CP dated November 11, 2016 of the Government on
amendments to Decree No. 177/2013/ND-CP;
Pursuant to Decree No. 05/2021/ND-CP dated
January 25, 201 of the Government on management and utilization of airports and
aerodromes;
Pursuant to Decree No. 12/2017/ND-CP dated
February 10, 2017 of the Government on functions, tasks, powers, and
organizational structure of Ministry of Transport;

Article 1. Scope and regulated entities
1. This Circular prescribes the price range for
leasing the right to provide air services at airports and aerodromes.
2. This Circular applies to:
a) Airport enterprises;
b) Providers of air services at airports and
aerodromes;
c) Other organizations and individuals related to
the leasing of the right to provide air services at airports and aerodromes.

2. Regulations on calculating prices for leasing
the right to provide services
a) Prices under Clause 1 of this Article exclude
VAT;
b) Percentage-based prices from number 1 to number
5 under Clause 1 of this Article are calculated based on revenues (VAT
excluded) of enterprises providing similar services;
c) Revenues or yield based on which the prices for
leasing the right to provide services does not include revenues or yield of
service providers which provide services for themselves and subsidiaries which
provide services to parent companies which hold 100% of charter capital of the
subsidiaries.
3. Airport enterprises and providers of air
services at airports and aerodromes shall negotiate prices under Clause 1 of
this Article.
Article 3. Organizing implementation
1. This Circular comes into force from September
01, 2022.
2. The Chief of the Ministry Office, Chief
Inspector of Ministry Inspectorate, directors, Director of Civil Aviation
Authority of Vietnam, heads of agencies, relevant organizations and individuals
are responsible for the implementation of this Circular./.
