CIRCULAR
AMENDMENTS TO CIRCULAR NO. 36/2015/TT-BGTVT DATED JULY 24,
2015 OF THE MINISTER OF TRANSPORT OF VIETNAM ON MANAGEMENT OF DOMESTIC AIR
CARRIAGE PRICES AND AVIATION SERVICE PRICES
Pursuant to the Law on
Vietnam Civil Aviation No. 66/2006/QH11 dated June 29, 2006 and the Law on
Amendments to the Law on Vietnam Civil Aviation No. 61/2014/QH13 dated November
21, 2014;
Pursuant to the Law on
Prices No. 11/2012/QH13 of Vietnam dated June 20, 2012;
Pursuant to Decree No.
177/2013/ND-CP dated November 14, 2013 of the Government of Vietnam elaborating
the Law on Prices of Vietnam and its implementation guidelines and Decree No.
149/2016/ND-CP dated November 14, 2013 of the Government of Vietnam on
Amendments to Decree No. 177/2013/ND-CP dated November 14, 2013 of the
Government of Vietnam elaborating the Law on Prices of Vietnam and its
implementation guidelines.
Pursuant to Decree No.
05/2021/ND-CP dated January 25, 2021 of the Government of Vietnam on management
and operation of airports and aerodromes;
Pursuant to Decree No.
12/2017/ND-CP dated February 10, 2017 of the Government of Vietnam on
functions, tasks, entitlements, and organizational structure of the Ministry of
Transport of Vietnam;
At the request of the
Director of Department of Transport of Vietnam and Director of Civil Aviation
Authority of Vietnam;

Article 1. Amendments
to Circular No. 36/2015/TT-BGTVT dated July 24, 2015 of the Minister of
Transport of Vietnam on management of domestic air carriage prices and aviation
service prices (hereinafter referred to as “Circular No. 36/2015/TT-BGTVT”).
1. Point e is added to
Clause 3 Article 5:
“i) Transfer of rights to
operate aviation services includes: passenger terminals; airport terminals,
goods warehouses; territorial technical - commercial services; repair and
maintenance of aviation vehicles and equipment; aviation techniques; provision
of aviation meals; provision of aviation petroleum.”.
2. Amendments to Article
8:
“Article 8. Price
declaration implementation
1. Service providers
prescribed in Article 7 of this Circular shall implement the price declaration.
2. Civil Aviation
Authority of Vietnam shall receive documents on service price declarations of
service providers prescribed in Clause 1 of this Article.
3. Measures to implement
and receive price declarations shall be in accordance with regulations of
Circular No. 56/2014/TT-BTC dated April 28, 2014 of the Minister of Finance of
Vietnam providing implementation guidelines for Decree No. 177/2013/ND-CP dated
November 14, 2013 of the Government of Vietnam elaborating the Law on Prices of
Vietnam and its implementation guidelines; Circular No. 233/2016/TT-BTC dated
November 11, 2016 of the Minister of Finance of Vietnam on Amendments to
Circular No. 56/2014/TT-BTC dated April 28, 2014 of the Minister of
Finance of Vietnam providing implementation guidelines for Decree No.
177/2013/ND-CP dated November 14, 2013 of the Government of Vietnam elaborating
the Law on Prices of Vietnam and its implementation guidelines.”.
3. Amendment to the name
of Section 3 of Chapter II: “NIÊM YẾT, CÔNG BỐ CÔNG KHAI GIÁ” (“PRICE
POSTING AND ANNOUNCEMENT”)

Implementation provisions
1. This Circular comes
into force as of July 15, 2022.
2. Annul Circular No.
07/2017/TT-BGTVT dated March 14, 2017 of the Minister of Transport of Vietnam
on Amendments to Circular No. 36/2015/TT-BGTVT.
3. If any legal document
referred to this Circular is amended, supplemented, or replaced, comply with
its new edition.
4. Chief of the Office,
Chief Inspector of Office, Directors of the Civil Aviation Authority of
Vietnam, Directors of relevant agencies, organizations, and individuals shall
implement this Circular./.
