CIRCULAR
GUIDING ADJUSTMENT
TO MONTHLY ALLOWANCE FROM JANUARY 1, 2022 FOR OFFICIALS OF COMMUNES, WARDS,
COMMUNE-LEVEL TOWNS WHO RETIRED IN ACCORDANCE WITH DECISION NO. 130-CP DATED
JUNE 20, 1975 OF THE GOVERNMENT COUNCIL AND DECISION NO. 111-HDBT DATED OCTOBER
13, 1981 OF THE MINISTER COUNCIL
Pursuant to Decree No. 34/2017/ND-CP dated April
3, 2017 of Government on functions, tasks, powers, and organizational structure
of Ministry of Home Affairs;
Pursuant to Clause 2 Article 4 of Decree No.
108/2021/ND-CP dated December 7, 2021 of the Government on adjustment to
pension, social insurance allowance, and monthly allowance;
At request of Director of the Department of
Remunerations;
The Minister of Home Affairs promulgates
Circular guiding adjustment to monthly allowance from January 1, 2022 for
officials of communes, wards, commune-level towns who retired in accordance
with Decision No. 130-CP dated June 20, 1975 of the Government Council and
Decision No. 111-HDBT dated October 13, 1981 of the Minister Council.
Article 1. Regulated entities
Public officials of communes, wards, commune-level
towns who retired and are receiving monthly allowance in accordance with
Decision No. 130-CP dated June 20, 1975 of the Government Council and Decision
No. 111-HDBT dated October 13, 1981 of the Minister Council (hereinafter
referred to as “retired commune-level officials”).

From January 1, 2022, adjust monthly allowance
applicable to retired commune-level officials in accordance with Article 2 of
Decree No. 108/2021/ND-CP dated December 7, 2021 of the Government as follows:
1. Increase monthly allowance eligible in December
2021 by 7,4% using the following formula:

In which: Monthly allowance eligible in December
2021 refers to the allowance mentioned under Clause 2 Article 2 of Circular No.
09/2019/TT-BNV dated June 14, 2019 of the Minister of Home Affairs applicable
to commune-level officials who retired under Decision No. 130-CP dated June 20,
1975 of the Government Council and Decision No. 111-HDBT dated October 13, 1981
of the Minister Council.
2. If monthly allowance for retired commune-level
officials is lower than 2.500.000 VND/month after being adjusted, the monthly
allowance shall be increased as follows:

b) Increase to 2.500.000 VND/person/month for
individuals whose monthly allowance ranges from 2.300.000 VND/person/month to
less than 2.500.000 VND/person/month.
3. Based on Clause 1 and Clause 2 of this Article,
monthly allowance eligible from January 1, 2022 (rounded accordingly) for
retired commune-level officials is as follows:
a) For officials who formerly held the position of
Party Committee Secretary, Chairperson of People’s Committee of commune:
2.473.000 VND/month;
b) For officials who formerly held position of
Deputy Secretary, Vice Chairperson, Permanent Standing Official of Committee of
Communist Party, Member of Secretariat of People’s Committee, Secretary of the
People’s Committee of commune, Commanding Officer of commune, Chief of commune
police: 2.400.000 VND/month.
c) For officials who formerly held remaining
positions: 2.237.000 VND/month.
Article 3. Organizing implementation
1. People’s Committees of provinces and
central-affiliated cities shall pay monthly allowance in accordance with this
Circular from January 1, 2022 for eligible beneficiaries.
2. Funding sources for adjusting monthly allowance
for retired commune-level officials shall conform to Clause 1 Article 3 of
Decree No. 108/2021/ND-CP dated December 7, 2021 of the Government.

2. Regulations under this Circular shall be
implemented from January 1, 2022.
3. This Circular replaces Circular No.
09/2019/TT-BNV dated June 14, 2019 of the Minister of Home Affairs.
Difficulties that arise during the implementation
of this Circular should be reported to the Ministry for consideration./.
