CIRCULAR

PROMULGATION OF THE PARENT COMMITTEE CHARTER

Pursuant to Law on Education dated June 14, 2005 and Law on amendments thereto dated November 25, 2009;

Pursuant to Decree No. 75/2006/ND-CP dated August 02, 2006 by the Government detailing and guiding the implementation of a number of articles of Law on Education; Decree No. 31/2011/ND-CP dated May 11, 2011by the Government on amendments to a number of articles of Decree No. 75/2006/ND-CP;

Pursuant to Decree No.178/2007 /ND-CP dated December 03, 2007 by the Government defining the function, tasks, powers and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No.32/2008/ND-CP dated March 19, 2008 by the Government defining the function, tasks, powers and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 115/2010/ND-CP dated December 24, 2010 of the Government on the responsibility of the state management on education;

Article 1. The Parent Committee Charter is promulgated together with this Circular.

Article 2. This Decree takes effect on January 07, 2012 and replaces Decision No. 11/2008/QD-BGDDT dated March 28, 2008 by the Minister of Education and Training on Parent Committee Charter.

Article 3. Chief of Office, Director Generals of Preschool Education Department, Primary Education Department, Secondary Education Department, Planning and Finance Department, Chairpersons of relevant units affiliated to the Ministry of Education and Training, Chairmen of provincial People’s Committees, Directors of Departments of Education and Training shall implement this Circular.

GENERAL PROVISIONS

Article 1. Scope and regulated entities

1. This Charter provides for organization and operation of parent committees and the responsibility for management of parent committees.

Article 2. Rules for organizing parent committees

1. The parent committee of each class and school is established every school year by parents or guardians of students (hereinafter referred to as "parents"). The committees will cooperate with the school in educational activities.

2. The parent committee shall not be established between schools and in administrative levels.

ORGANIZATION AND OPERATIONS OF PARENT COMMITTEES

Each class must have one class parent committee consisting of 3 - 5 members, including a chairperson and a vice-chairperson.

b) Members of the parent committee of a class should be enthusiastic and responsible persons, who will cooperate with the homeroom teacher, subject-specific teachers and the school in organizing educational activities for students;

2. Parent committees of schools:

Each school must have one parent committee consisting of a chairperson, vice-chairpersons and standing members if necessary.

b) Members of the parent committee of a school are chairpersons or vice-chairpersons of the class parent committees.

c) The number of vice-chairpersons and standing members (if any) of the parent committee shall be decided in the meeting of chairpersons and vice-chairpersons of class parent committees.

3. The term of the parent committee of a class or a school is one year. The term of a parent committee ends at the beginning of the next school year; the term of the parent committee of a senior class ends at the end of the school year.

4. Members of a parent committee can be changed or added at request of its chairperson. The change or addition of members of the parent committee of a class shall be decided by parents of the class. The change or addition of members of the parent committee of a school shall be decided by the whole committee.

5. Parent committees shall work by principle of consensus. The discussions and approvals made during meetings of the parent representatives committees shall be recorded in writing.

1. The parent committee of a class has the responsibility to:

Cooperate with the homeroom teacher and subject-specific teachers in organizing educational activities for students;

b) Cooperate with the homeroom teacher in preparing for the parent-teacher conferences during the school year;

c) Take part in ethics education for students; foster excellent students, help underperforming students, encourage dropouts to come back to school; help poor students, disabled students and other disadvantaged students.

2. The parent committee of a class has the right to:

Convene parent-teacher conferences in accordance with regulations prescribed in Article 9 of this Charter (except for the first meeting at the beginning of the school year, during which the parent committee is established) after reaching agreement with the homeroom teacher;

b) Enquire parents about the methods for management and education of students to propose specific measures to the homeroom teacher and subject-specific teachers in order to improve the quality of knowledge and ethics education;

c) Cooperate with the homeroom teacher in organizing extracurricular activities, education of tradition, culture, art and sport activities to provide comprehensive education for students.

Article 5. Responsibilities and rights of the chairperson and members of parent committees of classes

 The chairperson of the parent committee of a class has the responsibility to:

- Cooperate with the homeroom teacher in formulating and implementing the plan for organizing educational activities according to the contents approved during the first parent-teacher conference;

- Prepare for meetings of the parent committee and parent committee other parents; collect comments and proposals of parents.

The chairperson of the parent committee of a class has the right to:

- Assign tasks for the vice-chairperson and members; chair the meetings of the parent committee, represent the parent committee when cooperating with the homeroom teacher in organizing educational activities for students;

- Discuss activities of the parent committee with the homeroom teacher; deliver the comments of students’ parents on the quality of education;

- Cooperate with the homeroom teacher in considering commendation or taking disciplinary actions for students of the class.

2. The responsibilities and rights of the vice-chairperson of the parent committee of a class:

The vice-chairperson parent committee shall assist the chairperson and perform tasks given by the chairperson.

The members of the parent committee shall perform the tasks assigned by the parent committee of the class and the school.

Article 6. Responsibilities and rights of parent committees of schools

1. The parent committee of a school has the responsibility to:

Cooperate with the headmaster in performing the tasks of the school year and organizing educational activities according to the contents approved at the first meeting of the parent committee;

b) Cooperate with the headmaster to provide guidance, disseminate laws and policies on education for parents to improve their responsibility for caring, protecting and educating students;

c) Cooperate with the headmaster to educate students with poor conduct during the summer vacation;

d) Cooperate with the headmaster in ethics education for students; foster excellent students, help underperforming students; help poor students, disabled and other disadvantaged students ; encourage dropouts to come back to school.

dd) Provide guidance on the organization and operation for parent committees of classes.

2. The parent committee of a school has the right to:

b) Propose necessary measures for performance of the tasks of the school year and the management, education of students according to opinions offered by parent committees of the classes;

c) Decide the expenditures on operations of the parent committee from contributions and sponsorships in accordance with regulations prescribed in Article 10 of this Charter.

Article 7. Responsibilities and rights of the chairperson, vice-chairpersons and members of parent committees of schools

1. Responsibilities and rights of chairpersons of the parent committees of schools:

The chairperson of the parent committee has the responsibility to:

- Plan and conduct the activities of parents, the parent committee in accordance with regulations prescribed in Article 9 of this Charter.

- Plan the assignment of tasks to the vice-chairpersons, standing members for approval at the meeting of parent committees of the school;

- Prepare the agenda of meetings of the parent committee:

- Collect opinions of the parent committees of classes and parents and discuss them with the headmaster.

- Chair the meetings of the committee (except for the meeting of selecting the chairperson of the parent committee);

- Cooperate with the school in organizing educational activities for students;

- Encourage dropouts to come back to school;

- Work with the headmaster periodically on operation of the parent committee of the school;

- Handle recommendations of parents on the school’s educational activities;

2. The responsibilities and rights of vice-chairpersons:

The vice-chairpersons shall assist the chairperson, perform assigned tasks on behalf of the chairperson; chair the meeting of the committee if authorized by the chairperson.

3. Responsibilities of the members of the parent committee:

The members of the parent committee shall perform the tasks assigned by the parent committee.

1. Responsibilities of parents:

Cooperate with the school in management and education of their children and achievement of objectives of the school year which assigned by the parent committee;

b) Cooperate with the homeroom teacher, subject-specific teachers of the class in caring, managing and encouraging students to improve their proactivity, moral sense and compliance to regulations of the Charter and the school’s regulations.

c) Take responsibility for their children’s violations and weaknesses in accordance with regulations of law and comply with the recommendations of the class parent committee on the cooperation with the school to care, manage and educate students.

2. Rights of parents:

Parents have the rights prescribed in Article 95 of Law on Education and the right to propose measures for improvement of the educational environment the school;

b) Nominate themselves for a position in the class parent committee;

c) Refuse to contribute to the parent committee funds.

d) Decide whether to perform the tasks that are not agreed during the general meeting of parents.

1. General meetings of parents:

At the beginning of the school year, the homeroom teacher must conduct the parent-teacher conference to establish the class parent committee with the number of the committee prescribed in Point a, Clause 1, Article 3 of this Charter. Parent-teacher conferences must be held at the beginning of the school year, upon the end of the first semester, the end of the school year and when requested by at least 50% of the parents in the class.

b) The organization of general meetings of parents shall be decided by the parent committee of the school.

2. Meetings of the parent representatives committees:

At the beginning of the school year, the homeroom teacher shall conduct the meeting of the class parent committee to choose its chairperson and vice-chairperson. After the selection, the chairperson shall chair the general meeting of parents for approval of the activity program for the school year.

The parent committees of classes shall organize periodical meetings in accordance with the school program and unscheduled meetings at request of at least 50% of parents in the class or of the chairperson of the class parent committee;

b) At the beginning of the school year, the headmaster shall have a meeting with chairpersons and vice-chairpersons of all parent committees of the classes to establish the parent committee of the school, those who are absent may be nominated if they have agreed to join the meeting. The headmaster shall chair the first meeting of the parent committee the school to designate the chairperson and vice-chairpersons, even standing members if necessary. The designated chairperson shall chair the meeting of chairpersons and vice-chairpersons of parent committees of the classes to consider approving activities of the school year;

The parent committee of the school shall organize periodical meetings in accordance with the school year’s program and unscheduled meetings at request of at least 50% of the members of the committee or of the chairperson of the parent committee;

3. The parent committee shall organize the performance of its tasks, powers and activities approved during the meetings of parents and the parent committees.

1. Funds for operation of parent committees:

 Funds for parent committees of classes shall be contributed by the parents and other lawful sponsors.

b) Funds for the parent committee of a school are derived from the funds of the parent committees of the classes according to the result of the first meeting of chairpersons of parent committees of the classes and other lawful sponsors.

2. Management and use of funds:

The chairperson of the parent committee of each class shall cooperate with the homeroom teacher in planning use of the funds and only use the funds after such plan is approved by all the members of the class parent committee.

The chairperson of the parent committee of the school shall cooperate with the headmaster in planning use of the funds and only use the funds after such plan is approved by all the members of the committee.

3. The collection and use of funds of parent committees must ensure the principle of openness and democracy; the financial settlement must be announced at the meetings of the parent committees of classes and the parent committee of the school. No amount of average funding from parents shall be specified.

4. The parent committees of classes must not receive the following kinds of contributions from students or their parents:

Chapter III

RESPONSIBILITY FOR MANAGEMENT AND IMPLEMENTATION

Article 11. Responsibilities of provincial and district-level People’s Committees:

1. The People's Committee of provinces and centrally-run cities (referred to as provincial People's Committees) shall manage implementation of the Parent Committee Charter in their provinces; instruct the People’s Committee at inferior levels, education authorities and relevant units to manage the implementation thereof.

2. The People's Committee of districts shall organize implementation of the Parent Committee Charter in accordance with regulations of this Charter and the instruction of the provincial People’s Committees, cooperate with Departments of Education and Training in inspecting the implementation thereof and take or propose actions against violations.

Article 12. Responsibilities of Departments of Education and Training and Divisions of Education and Training

2. Encourage, commend the parent committees with outstanding contribution to the work of education, caring and promotion of students’ learning and training.

3. Departments of Education and Training shall cooperate with district-level People’s Committees in inspecting the operation of the parent committees to promptly deal with violations against the Parent Committee Charter.

2. Attend periodical meetings with the parent committee of the class and the school; cooperate with the representative committee and students’ parents in the management of the school, implementation of measures to help poor students, encouraging dropouts to come back to school and the handling of parents’ recommendations; provide suggestions on the activities of the parent committees.

3. The school shall assign a manager to regularly cooperate with the parent committee of the school in organizing its activities and those of students’ parents.

Chapter IV.

COMMENDATION AND ACTIONS AGAINST VIOLATIONS

Article 14. Commending

1. The results of activities the parent committee is one of the criteria for considering commendation for educational institutions.

2. Parent committees with good performance, outstanding contribution to the education of students shall be rewarded in accordance with regulations of law on emulation and commendation.

Article 15. Actions against violations

Organizations and individuals that obstruct the implementation of the Parent Committee Charter violate the regulations of the Parent Committee Charter and other regulations of law relating to the activities of parent committees shall be dealt with in accordance with regulations of law depending on the seriousness of their violations.
