PROMULGATING REGULATIONS ON ENROLMENT AND TRAINING IN UNIVERSITY PREPARATORY PROGRAMS (UPP); CONSIDERATION OF PERMISSION FOR TRANSFER TO UNDERGRADUATE OR JUNIOR COLLEGE DEGREE PROGRAMS IN PRESCHOOL EDUCATION FIELD OF STUDY FOR UPP STUDENTS

Pursuant to the Law on Education dated June 14, 2019;

Pursuant to the Law on Higher Education dated June 18, 2012; the Law on Amendments and Supplements to certain Articles of the Law on Higher Education dated November 19, 2018;

Pursuant to the Government’s Decree No. 69/2017/ND-CP dated May 25, 2017, setting out regulations on functions, duties, powers and organizational structure of the Ministry of Education and Training;

Upon the request of the Director of the Department of Ethnic Education;

The Minister of Education and Training of Vietnam herein adopts the Regulations on enrolment and training in university preparatory programs (UPP); consideration of permission for transfer to undergraduate or junior college degree programs in preschool education field of study for UPP students.

Article 3. Chief of the Office; Director of the Department of Ethnic Education; Heads of affiliated entities of the Ministry of Education and Training; Directors of Departments of Education and Training; Directors of Department of Education, Science and Technology in Bac Lieu province; Directors of universities, academies; Provosts of junior colleges providing preschool education training programs; Headmasters of university preparatory schools; Principals of Viet Bac Highland School; interested entities and persons shall be responsible for implementing this Circular./.

ON ENROLMENT AND TRAINING IN UNIVERSITY PREPARATORY PROGRAMS (UPP); CONSIDERATION OF PERMISSION FOR TRANSFER TO UNDERGRADUATE OR JUNIOR COLLEGE DEGREE PROGRAMS IN PRESCHOOL EDUCATION FIELD OF STUDY FOR UPP STUDENTS

Article 1. Scope

These Regulations prescribe enrolment and training in university preparatory programs (UPP); consideration of permission for transfer to undergraduate or junior college degree programs in preschool education field of study for UPP students.

Article 2. Subjects of application

These Regulations apply to university preparatory schools; higher education and other education institutions licensed to provide undergraduate degree programs; junior colleges providing preschool education training courses (collectively referred to as educational institution); entities and persons involved.

Viet Bac Highland School shall perform UP training tasks according to these Regulations.

Chapter II

ENROLMENT IN UNIVERSITY PREPARATORY PROGRAMS

Article 3. Enrolment method, candidates and enrolment conditions

1. Enrolment method: UP schools can apply both direct and admission consideration method.

a) Candidates for direct admission:

- Candidates from ethnic minorities who have graduated from high school in accordance with the provisions of the Government's Decree No. 57/2017/ND-CP dated May 9, 2017, stipulating incentive policies for admission and study support for preschool children, pupils and students of ethnic minorities with small populations;

- Nominees for training programs according to the provisions of the Government’s Decree No. 141/2020/ND-CP dated December 8, 2020, stipulating the admission nomination policy for students from ethnic minorities.

b) Candidates for the admission consideration process:

- Candidates from ethnic minorities permanently residing for 18 consecutive months or more till the date of submission of enrollment registration documents at tier-1 (KV1) communes, wards and townships as prescribed in the Regulations on Enrollment in university degree programs; enrolment in Preschool Education programs issued by the Minister of Education and Training and whose natural parents or guardians are permanently residing in these areas;

- Candidates from Kinh ethnicity permanently residing for 36 consecutive months or more till the date of application for enrollment in areas with extremely difficult socio-economic condition as prescribed by competent authorities and whose natural parents or guardians are permanently residing in these areas. UP schools are allowed to accept no more than 5% of total annual enrollment quota for candidates who are from the Kinh ethnic group.

c) Candidates who once have been admitted and enrolled to a UP school shall not be entitled to the second admission; university students or graduates shall not be entitled to admission to a UP school.

3. Enrolment conditions

a) Candidates completing upper secondary education diplomas;

Article 4. Enrolment proposal

1. Pursuant to these Regulations and the Regulations on enrollment in undergraduate degree programs; enrollment in junior college degree programs in preschool education field of study issued by the Minister of Education and Training, UP schools shall develop enrollment proposals and submits them to the Ministry of Education and Training to seek its approval.

2. Each enrolment proposal must contain the followings:

a) Enrolment method, candidates and enrolment conditions;

b) Student intake;

c) Basis, groups of subjects considered for admission, thresholds for entry quality assurance;

d) Preferential treatment (if any) used when considering admission of candidates from ethnic minorities that are permanently residing in areas facing extreme socio-economic disadvantage;

dd) Enrolment schedule.

3. 15 working days before enrolment in UPP is open for candidates, UP schools must post enrolment proposals on their websites.

1. Registration for admission

Candidates who are eligible and meet enrolment requirements set out in Article 3 herein are entitled to apply for enrolment to a UP school according to one of the following methods: Apply by post or directly to an expected UP school or register online on the electronic enrolment system of that school.

2. Application dossier including:

a) For direct admission, each dossier is composed of:

- Registration form available for use;

- Copy of secondary education graduation diploma or temporary certificate of completion of secondary education program;

- Copy of the birth certificate;

- Decision on nomination for training program issued by the competent authority to the eligible candidate.

b) For admission consideration, each dossier is composed of:

- Copy of the test result certificate prescribed in the enrolment proposal;

- Copy of secondary education graduation diploma or temporary certificate of completion of secondary education program;

- Copy of the high school transcript record;

- Copy of the birth certificate;

- Written confirmation of permanent residence of candidate and his/her natural parent or guardian.

3. Carrying out the enrolment procedures:

Pursuant to the enrollment proposal approved by the Ministry of Education and Training; based on the approved quota after deducting the number of ethnic minority candidates eligible for direct admission; based on the number of enrollment applications, the Admissions Council of the UP school will decide on the admission score plans for use in each form of admission consideration and carry out the admission consideration process according to the principle of admission granted in descending order of scores.

4. Approving the list of enrollees

Within a maximum of 30 working days from the deadline for submission the enrollment application, the Rector of a UP school approves the list of successful candidates, publishes it on the school's website and publicly posts it at the school's headquarter.

a) Each UP school sends admission notices or offers to successful candidates;

b) Admission candidates need to complete the enrollment application dossier and present the originals of required documents to be checked against the documents specified in Clause 2 of this Article; Candidates are responsible for the authenticity of the information given in the enrollment application dossier;

c) The UP school checks and verifies submitted documents of enrollees in accordance with regulations in force.

Chapter III

TRAINING IN UNIVERSITY PREPARATORY PROGRAMS

Article 6. Training courses

1. Training curriculum

a) UPP students are entitled to training in academic knowledge of three subjects classified into the subject areas considered for admission to the UP school (subject 1, subject 2, subject 3), English and Informatics;

b) UPP students have access to physical training activities and academic activities. Based on actual condition of each school, academic and extracurricular demands of students, school’s Rectors can decide on appropriate ones;

2. Time frame

c) UP training duration is equivalent to an academic year. The Rector of the UP school can decide the academic Plan that ensures that the actual duration of study is 28 weeks and the remaining duration is intended for classes on consolidation of learning, final exams and other activities.

Article 7. Periodic tests, final exams, total subject score

1. Periodic tests

a) During an academic year, there must be two periodic tests delivered in either form of multiple choice or writing. Duration of a multiple-choice test on Mathematics is 60 minutes and on other subjects is 45 minutes. Duration of a writing test on Mathematics and Literature is 90 minutes and on other subjects is 60 minutes;

b) If a student missing any periodic test of each subject is able to give valid reasons, he/she is entitled to consideration of complementary test.

2. Final exam

a) Subjects used in the final exam are three subjects according to subject areas of which scores are considered for admission of the examinee to the UP school and in which the examinee is trained at the UP school;

b) The student can take the final exam when fully completing two periodic tests and not being absent from class for more than 35 days;

c) The final exam can be in either multiple-choice or writing form. Duration of a final exam on Mathematics is 90 minutes and on other subjects is 60 minutes. Duration of a final exam on Mathematics and Literature is 120 minutes and on other subjects is 90 minutes;

3. Total subject scores:

a) The grading scale for the periodic test and the final exam is a 10-point scale. For the periodic test and the final exam in the multiple-choice form, it is possible to adopt another grading scale, but total score must be converted according to the 10-point scale. At the end of each school year, each subject has a final score, the final score of each subject is rounded to the nearest tenth;

b) Total score (DTK) of each subject with the final exam is calculated according to the following formula:

Article 8. Assessment of training outcomes

1. Each UP school organizes the assessment of students' training results based on specific expressions concerning their ethical attitudes and behaviors; behaviors towards school teachers, staff, friends, family and social members; awareness and efforts in learning or participating in collective activities of the class, school and unions; conformance to health, wellness, hygiene and environmental protection requirements.

2. One of the following grades indicating training outcome is given to a student for his/her entire academic year: Good, Fair, Satisfactory, Unsatisfactory.

a) Good grade is given when he/she meets the following regulations:

- Strictly comply with law, regulatory regulations on social order, safety, traffic safety and school rules; actively engage in the fight against misconducts, prevention and control of crimes and social evils;

- Actively cultivate moral qualities, lead a healthy and simple lifestyle; always respect teachers and the elderly; have a sense of team-building responsibility, solidarity, and gain trust and love from other friends;

- Fully complete learning tasks; keep moving forward; show honesty in his/her life and study;

- Actively train his/her body; maintain hygiene and protect environment;

- Fully participate in educational activities and activities organized by the school; actively participate in activities of the Ho Chi Minh Communist Youth Union.

c) Give the Satisfactory grade to the student who has some faults when implementing the regulatory provisions laid down in point a of clause 2 of this Article, if these faults are not serious; after being reminded or enlightened, he/she has been corrected and obtain recognition that he/she is making progress.

d) Give the Unsatisfactory grade to the student that has not yet reached the Satisfactory grade.

Chapter IV

CONSIDERATION OF PERMISSION FOR TRANSFER TO UNDERGRADUATE OR JUNIOR COLLEGE DEGREE PROGRAMS IN PRESCHOOL EDUCATION FIELD OF STUDY

Article 9. Recognition for completion of UP programs

1. Eligibility conditions for completion of a UP program:

a) Training outcome in the entire academic year is graded Satisfactory or higher;

b) Total score of all subjects is at least 5.0.

2. Rectors shall be accorded authority to grant decisions on completion of UP program.

1. Eligibility conditions:

a) Complete the UP program;

b) Reach the thresholds for entry quality assurance (if any) set in several fields of study in accordance with regulations in force.

2. Procedures for consideration of permission for transfer to undergraduate or junior college degree programs in preschool education field of study

a) In the first quarter each year, UP schools directly discuss student intakes and plans for admission of students completing the UP program with training institutions. Then they must make student intakes known to the public;

b) Scores considered for transfer is total score of three subjects involved in the final exam.

c) UP schools must take the following steps:

- Instruct students to register their option to transfer to the training institution. Each student completing UP program may register no more than 03 options to transfer to the major trained by the school, arrange options in descending order (option 1 is ranked in the first place);

- Input applicant data; post them on the school’s website within 05 working days; allow applicants to change the order of registered options during data posting duration; finalize data on consideration of transfer after completed changes in options;

- Rector of the UP school can approve admission consideration results; post them on the school’s website and at the campus; report to the Ministry of Education and Training on any issue or problem arising from the admission consideration process to protect rights and benefits of students.

3. Applicant's dossier transferred by the UP school to the receiving training institution is composed of:

a) Dossier on admission in the UP school of the student and evidence showing that the student intake quota referred to in point b of clause 1 of this Article is satisfied;

b) Academic and training results of the student completing UPP;

c) Written statement of approval of results of consideration of permission for transfer to the receiving training institution.

4. Consider nominated students completing UPP for transfer to training institutions according to the provisions of the Government’s Decree No. 141/2020/ND-CP dated December 8, 2020, stipulating the admission nomination policy for students from ethnic minorities.

Article 11. Intermission and grade repetition

1. A student getting admitted in the UP program is entitled to intermission in the following cases:

a) He/she is on duty in the military. In this case, the duration of intermission is not more than one year after discharge from military duty;

2. When falling into the following situations, a UP student will be considered for the first grade retention:

a) Skip the class for more than 35 days due to sickness or accident needing medical treatment. In this case, competent health authority's certification is required.

b) Skip the test on any required subject due to health problem or accident. In this case, competent health authority's certification is required.

c) The student from ethnic minority with small population; the student nominated for admission in training program has not fully satisfied conditions for completion of UPP specified in clause 1 of Article 9 herein.

Chapter V

IMPLEMENTATION

Article 12. Responsibilities of UP schools and training institutions

1. UP schools shall:

a) Develop an enrollment proposal and submit it to the Ministry of Education and Training for approval; formulate the schedule of academic activities in the academic year and organize UPP training sessions; take charge of consideration of permission for transfer of students completing UPP to training institutions.

2. Training institutions shall:

a) Discuss student intakes and plans for admission of students completing the UP program with training institutions;

b) Enroll students completing UPP according to student intake quota agreed with training institutions.

Article 13. Reporting and filing regime

1. Each year, UP schools shall report to the Ministry of Education and Training on results of consideration of permission for transfer of students completing UPP to training institutions by September 30; results of admission of UPP students by October 30.

2. Answer sheets in periodic tests, final exams and other documents related to the process of student admission, training and consideration of permission for transfer of UPP students to undergraduate and junior college degree programs in Preschool Education field of study must be stored and filed according to regulations in force.

Article 14. Grandfather clause

1. Regulations of point d of clause 1 of Article 10 herein are not applied to students admitted in UPP in the academic year 2021 - 2022.

2. If legal documents referred to in this Circular are amended, supplemented or replaced, those used as references herein must be revised and new ones created from such change shall prevail./.
