DECREE

DEFINING FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF CULTURE, SPORTS AND TOURISM

Pursuant to the Law on Government Organization dated February 18, 2025;

At the request of the Minister of Culture, Sports and Tourism;

The Government hereby promulgates a Decree defining functions, tasks, powers and organizational structures of the Ministry of Culture, Sports and Tourism.

Article 1. Position and functions

The Ministry of Culture, Sports and Tourism is a governmental agency which exercises the function of state management of culture; family affairs; physical training, sports; tourism; press; radio and television; news agencies; publishing, printing, release; electronic information; fundamental information and foreign information services nationwide; state management of public services in the sectors and fields under its management.

Article 2. Tasks and powers

1. Submit to the Government bills and draft resolutions of the National Assembly; ordinance projects and draft resolutions of the Standing Committee of the National Assembly; draft decrees, draft resolutions of the Government formulated under the Ministry's approved annual law-making programs and plans, and other resolutions, projects and schemes as assigned by the Government or the Prime Minister.

2. Submit the Government and the Prime Minister annual, medium-term and long-term development strategies, planning and plans, and programs, projects and works of national significance in the sectors and fields under its state management.

3. Submit the Prime Minister draft decisions, draft directives and other documents in the sectors and fields under its state management.

4. Promulgate circulars, decisions, directives and other documents about state management in the sectors and fields under its state management.

Formulate national standards; promulgate national technical regulations, processes, rules and technical - economic norms in the sectors and fields under its state management.

5. Direct, provide guidance on, inspect and organize implementation of promulgated or approved legislative documents, strategies, planning, programs, plans, projects and works of national significance; provide information, propagandize and provide education about laws and supervise the implementation of laws in the fields under its state management.

6. Regarding cultural heritage:

a) Submit to the Prime Minister for decision on the ranking, de-ranking, supplementation and revision of scientific dossiers, approval of and decision on boundaries, adjustment of boundaries of protection zones of special national monuments; the proposal to the United Nations Education, Science and Culture Organization (UNESCO) for recognition, de-recognition and revision of dossiers on historical and cultural monuments and scenic landscapes of Vietnam and of Vietnam in cooperation with other countries as world heritage sites; inscribe, additionally inscribe, support the safeguarding of intangible cultural heritage and documentary heritage of Vietnam and of Vietnam in cooperation with other countries;

b) Submit to the Prime Minister for the recognition and de-recognition of national treasures; permission for bringing national treasures and documentary heritage inscribed by UNESCO abroad for display, exhibition, research or preservation and plans for handling of assets being cultural heritage as per the law; plans for recovery, purchase and repatriation of overseas vestiges, antiquities, national treasures and documentary heritage of Vietnamese origin; mechanisms and policies for mobilizing, managing and using resources for protection and promotion of values of cultural heritage;

d) Promulgate a National Action Program for safeguarding of intangible cultural heritage after it has been inscribed by UNESCO; provide reporting guidance; appraise schemes for safeguarding and promotion of values of the inscribed intangible cultural heritage.

dd) Provide guidance on organizing inventory of intangible cultural heritage, preparation of scientific dossiers on cultural heritage for applying for inscription or additional inscription of national monuments, intangible cultural heritage and documentary heritage on the national lists;

e) Appraise planning tasks and planning, adjust the planning for preservation, remodeling and restoration of national monuments; appraise projects, economic and technical reports on preservation, remodeling and restoration of national monuments, special national monuments, world heritage; certify cases where projects on preservation, remodeling and restoration of degraded world heritage, special national monuments and national monuments; offer appraisal opinions on the conformance with requirements for and promotion of values of cultural heritage ​​regarding repair, renovation, construction, reconstruction of works and conduct of the following activities: directly serving the safeguarding and promotion of the values ​​of monuments, world heritage, single dwellings and socio-economic works, using sea areas to exploit and use marine resources, and carrying out socio-economic activities according to regulations of specialized laws;

g) Approve and decide boundaries, adjust boundaries of protection zones of national monuments; decide addition, relocation and change of artifacts to/in special national monuments;

h) Rank or re-rank museums grade I museums; certify eligibility for establishment of public museums; contribute opinions on the ranking and re-ranking of grade II and grade III museums as prescribed by law; contribute opinions on display outlines, projects on investment in construction, renovation and upgradation of architectural works, technical infrastructure and displays at public museums; decide the assignment of relics, antiquities and national treasures to public museums for management, State’s agencies or organizations having appropriate functions and tasks as per the law;

i) Issue licenses for archaeological exploration and excavation and grant consent to persons in charge of archaeological exploration and excavation; provide guidance on procedures for registration of relics and antiques and operation of relic and antique appraisal business establishment, relic and antique business establishments; decide the bringing of antiques abroad for display, research or preservation; decide the bringing of national treasures for national display, research or preservation for a certain period of time; issue licenses to import overseas relics, antiques and national treasures of Vietnamese origin and repatriate them to Vietnam; issue licenses to make replicas of national treasures; give opinions on the fact that overseas Vietnamese, foreign organizations and individuals research, collect and document intangible cultural heritage and documentary heritage in Vietnam distributed in two or more provinces or central-affiliated cities in accordance with law;

k) Build and manage national database of cultural heritage;

l) Provide guidance on and inspect the safeguarding and promotion of values of cultural heritage.

7. Regarding performance art:

b) Approve or suspend the organization of art performances, competitions and festivals regarding various forms of performance art; cancel results of competitions and festivals regarding various forms of performance art within its power in accordance with law;

c) Receive the deposit of audio and/or visual recordings of art performances for commercial purposes of organizations affiliated to central government authorities as prescribed by law;

d) Provide guidelines for collecting, preserving and organizing the introduction and promotion of values of Vietnamese traditional performance art at the national level and the quintessence of the world performance art.

8. Regarding cinematography:

a) Organize national and international film festivals in Vietnam; grant approval for organization of specialized and thematic film festivals, foreign film days and weeks in Vietnam and Vietnamese film days and weeks in foreign countries;

b) Manage depositing or archiving of domestically produced films and motion pictures; depositing or archiving of foreign films released in Vietnam;

c) Issue and revoke licenses in the field of cinematography within its power as prescribed by law.

9. Regarding fine arts, photography and exhibitions:

a) Perform state management of national cultural symbols as prescribed by law;

c) Provide guidance on organization and directly organize displays and exhibitions of works of fine art and photographic works;

d) Provide guidance on inspection of works of fine art and photographic works;

dd) Issue and revoke licenses in the fields of fine art, photography and exhibition within its power as prescribed by law.

10. Regarding copyright and related rights:

a) Take measures to protect legitimate rights and interests of the State, organizations, individuals and society in the field of copyright and related rights;

b) Provide guidelines for the supply, cooperation, placement of orders, use and assurance of copyright to works and related rights of performances, audio and video recordings and broadcasts;

c) Manage and exploit copyright on works and related rights to performances, audio and video recordings, broadcasts whose ownership and management is represented by the State as prescribed by law; receive copyright and related rights transferred by organizations and individuals to the State as prescribed by law;

d) Manage the issuance, reissuance, replacement or invalidation of copyright registration certificates and related right registration certificates; authenticate copyright;

dd) Manage the assessment of copyright and related rights; issue, re-issue and revoke copyright and related right assessor’s cards; certificates of copyright and related right assessment body;

g) Manage operation of organizations acting as collective representatives of copyright or related rights and copyright or related right counseling organizations, copyright and related right service providers; approve royalty rates and payment methods.

11. Regarding library:

a) Direct the library interconnection; direct and provide guidance on the conduct of library operations and reading culture development; provide guidance on assessment of library activities according to national standards and regulations of law;

b) Provide guidance on conditions for establishment and operation of libraries as prescribed by law; receive and respond to notifications of the establishment, merger, consolidation, full division, partial division, dissolution or shutdown of central-level specialized libraries and public libraries in central-affiliated cities and provinces; respond to inquiries for the determination of public libraries of significance given investment priority by the State as prescribed by law;

c) Formulate mechanisms and policies for mobilizing, managing and using resources for the cause of library and reading culture development as prescribed by law.

12. Regarding advertising:

a) Perform state management of advertising as prescribed by law;

b) Provide guidance on formulation of outdoor advertising planning in localities;

c) Organize appraisal of advertisements as prescribed by law.

dd) Issue, extend, revise and revoke licenses to produce advertising channels and programs on audio and visual newspapers; receives notifications of release of advertising inserts for printed newspapers;

e) Receive notifications of provision of cross-border advertising services in Vietnam; receive and process notifications of illegal cross-border advertisements and take preventive measures as prescribed by law.

13. Regarding mass culture, propaganda and advocacy:

a) Provide guidance on and organize the implementation of regulations on founding days, traditional days, ceremonies organized in response to special events, anniversaries, funerals and other ceremonies under its state management or as assigned by the Government;

b) Direct, provide guidance on and organize the implementation of propaganda and advocacy (except for radio broadcasting activities, activities using the public address system; public bulletin boards) about guidelines of the Communist Party, polices and laws of the State through cultural and artistic activities, visual advocacy and mobile communication as prescribed by law;

c) Provide guidance on use of National Flag, Emblem, Anthem and portrait of President Ho Chi Minh in accordance with regulations of law;

d) Provide for the organization of popular art festivals, contests and performances, mobile propaganda (except radio broadcasting activities and activities using the public address system) and cultural activities; management of cultural activities, provision of cultural and recreational services in public areas;

dd) Perform state management of festivals as prescribed by law; provide guidelines for adopting a civilized lifestyle in weddings and funerals and lifestyle building; set up the movement “The entire country unites to build a cultural lifestyle”; take measures to prevent superstition, unsound customs and depraved cultural products which are contrary to fine traditions and customs, affect people’s health and damage ecological environment;

g) Supervise, inspect and review the firing of consumer fireworks by localities; report to the Prime Minister to direct ministries and local authorities to organize the firing of consumer fireworks; preside over and cooperate with the Ministry of National Defense, Ministry of Public Security and People’s Committees of provinces and central-affiliated cities in providing directions for organizing firing of consumer fireworks, and deciding the change of firing range and duration of fireworks as prescribed by law.

15. Regarding ethnic minorities’ culture:

a) Formulate, provide guidance and organize the implementation of policies, programs, schemes and projects on preservation and promotion of cultural values of ethnic minorities in Vietnam;

b) Provide guidance on organization and organize regional and national culture, sports and tourism days and festivals; provide guidance on cultural and artistic activities in remote and isolated areas and border areas, on islands and in ethnic minority areas; propagandize and introduce traditional culture of Vietnam's ethnic minorities;

c) Perform direct state management of Vietnam National Village for Ethnic Culture and Tourism as prescribed by law;

16. Regarding literature:

a) Formulate, provide guidance and organize the implementation of the approved literary activity-related mechanisms and policies;

b) Provide guidelines for organizing and inspecting literary activities;

c) Organize literature and art camps.

d) Provide guidance on organization of and organize national literary contests.

a) Propagandize and provide education about lifestyles and behaviors in families and values of Vietnamese families in the new period;

b) Build and develop the system of values of Vietnamese families in the new period; establish standards for cultural families;

c) Establish a database of family and domestic violence prevention and control; build and multiply the model of a happy and sustainable family;

d) Provide guidance on and organize the celebration of Vietnamese family days as prescribed by law.

18. Regarding physical training and sports for all:

a) Submit to the Prime Minister for decision on the organization of regional, continental or world games in Vietnam for persons with disabilities;

b) Prescribe criteria for evaluating mass physical training and sports movements;

c) Organize and provide guidance on the building of a contingent of mass physical training and sports instructors and collaborators; propagandize and provide guidance on methods for physical training and sports; provide professional training for grassroots physical training and sports collaborators;

d) Conduct surveys on people’s physical health; provide guidance, apply and develop national sports and domestic and foreign traditional physical training methods;

e) Cooperate with the Ministry of Education and Training, Ministry of National Defense and Ministry of Public Security in providing guidance on physical education and sports at schools and physical training and sports in people's armed forces;

g) Provide guidance on registration of mass physical training and sports clubs and facilities and fan clubs.

19. Regarding high-performance sports and professional sports:

a) Submit to the Prime Minister for decision on the organization of regional, continental or world games held in Vietnam; National Sports Games;

b) Provide guidance and organize the implementation of regulations on regimes and policies applicable to sports athletes, coaches and referees;

c) Decide the organization of regional, continental and world championships and junior championships for each sport held in Vietnam; annual national championships and national junior championships of each sport at the request of national sports federations; prescribe the management of international sports-related activities carried out in Vietnam; approve rules of the National Sports Games;

d) Issue standards and provide guidance on awarding ranks to sports athletes, coaches and referees; recognize the ranks awarded to Vietnamese sports athletes, coaches and referees by international sports organizations as prescribed by law;

dd) Prescribe the management of transfer of athletes, recruitment of athletes to national sports teams; prescribe procedures for establishing national sports delegation and national sports team for each sport;

e) Provide guidance on designing sports athlete, coach and referee training programs; prescribe sports training programs for specialists of sports enterprises;

20. Regarding tourism resources and tourism system planning:

a) Provide guidance on and organize survey, assessment and categorization of tourism resources; build database of tourism resources;

b) Provide guidance on and organize the implementation of the tourism system planning.

21. Regarding tourism areas and tourist attractions:

a) Decide the recognition of national tourism areas; submit to the Prime Minister for the recognition of national tourism areas located in at least 02 administrative units of provinces;

b) Provide guidance on and inspect the recognition of tourist attractions and tourism areas;

c) Provide guidance on management of national tourism areas.

d) Coordinate and connect transnational, inter-regional and inter-provincial tourism activities.

22. Regarding tourism business, tour guiding and tourism promotion:

b) Provide guidelines for conditions, procedures and applications for issuance, replacement, re-issuance and revocation of tour operator licenses;

c) Provide guidelines for standards, procedures and applications for rating of tourist accommodation establishments and revocation of decisions on rating of tourist accommodation establishment;

d) Organize the appraisal and rating of tourist accommodation establishments and inspection of quality of tourist accommodation establishments as prescribed by law;

dd) Provide guidelines for standards and the specimen of the signboard which shows the provider of other tourism services has been already qualified for provision of services for tourists, and applications and procedures for recognition of the provider of other tourism services qualified for provision of services for tourists;

e) Provide for persons in charge of provision of travel services; contents of training and refresher training in, organization of examinations and issuance of certificates of training in tour operation; contents of training and refresher training in, organization of examinations and issuance of tour guiding certificates; contents of on-site tour guiding examination; language proficiency standards;

g) Formulate and organize the implementation of domestic and foreign tourism promotion strategies, plans and programs; coordinate inter-regional and inter-local tourism promotion activities;

h) Appraise applications for establishment of representative office in Vietnam submitted by foreign tourism authorities and regional and international tourism organizations;

i) Build a database of tourism management.

23. Regarding press (including printed newspapers, electronic newspapers, broadcasting, newsletters, bulletins, special issues):

b) Promulgate regulations on organization of press contests and festivals;

c) Inspect legal deposit of press works; manage the national system of legal deposit of printed press works; carry out electronic deposit of audio, visual and electronic newspapers as per the law; and inspect press release of administrative authorities as prescribed by law;

d) Issue, amend, suspend, invalidate and revoke licenses pertaining to the press and broadcasting; issue and revoke press cards; approve press conferences according to regulations of press law;

dd) Provide guidance on operations of the press and journalists nationwide, and cooperate with relevant bodies in management of Vietnamese press operations related to other countries and press operations of foreign individuals and organizations in Vietnam;

e) Give opinions on appointment, re-appointment and assignment of heads of press agencies according to regulations.

24. Regarding publishing (including publication, printing and release):

a) Issue, extend, amend, suspend, invalidate and revoke licenses pertaining to publication, printing and release as prescribed by law;

b) Confirm and manage publication registration of publishers, registration of operation of printing facilities, registration of printing for products exempt from licensing, registration of release, registration of electronic publication and release of electronic publications as prescribed by law;

c) Organize appraisal of publications as prescribed by law; inspect publications in legal deposit and manage legal deposit of publications; procure and deliver publications to extremely disadvantaged areas, remote and isolated areas, mountainous areas, border areas and islands; organize national publication fairs and manage overseas release as prescribed by law;

dd) Issue, extend and revoke editing practicing certificates as per the law;

e) Manage activities of service to publishing as prescribed by law;

g) Give opinions on appointment, re-appointment and assignment of heads of publishing houses according to regulations.

25. Regarding electronic information:

a) Manage online gaming services; website and social network services; online information content services and applications for online information provision as prescribed by law;

b) Issue, extend, amend, suspend, invalidate and revoke licenses and certificates pertaining to online games, establishment of websites, provision of social network and online electronic information services as per the law;

c) Manage contents, quality and prices of broadcasting services as prescribed by law.

26. Regarding grassroots information:

a) Develop communication contents within the ambit of its functions and tasks and provide guidelines on deployment of such communication;

c) Organize information provision, management of information contents of grassroots information systems nationwide.

27. Regarding foreign information services:

a) Provide guidelines on contents and cooperate in provision of foreign information services for Vietnamese press and news agencies;

b) Preside over and cooperate in inspection and assessment of foreign information services of other ministries, ministerial agencies, Governmental agencies, People’s Committees of provinces and central-affiliated cities, and domestic and foreign press agencies and publishers;

c) Develop mechanisms for exchange, cooperation, provision and sharing of information between state agencies and press agencies;

dd) Monitor and submit consolidated reports to the Prime Minister on correction of and explanation for erroneous information about Vietnam in all fields.

28. Organize the implementation of regulations of laws on intellectual property for press products, encrypted broadcasting programs and publications as prescribed by law; cooperate in directing enterprises providing intermediary services for implementation of regulations of law on intellectual property.

29. Regarding international cooperation:

a) Submit to competent authorities for the signature, ratification, approval or accession to treaties in the fields under its management as prescribed by law; participate in international organizations as assigned by the Government;

c) Sign, organize and inspect the execution of internationally aided programs and projects; decide to organize and grant permission for organizing international conferences and seminars in the fields under its management within its power as prescribed by law;

d) Submit to a competent authority for establishment of foreign-based Vietnamese Cultural Centers and licensing of the establishment of Vietnam-based foreign cultural establishments;

dd) Manage activities of foreign-based Vietnamese Cultural Centers and Vietnam-based foreign cultural establishments as prescribed by law;

e) Organize national and international events, fairs, seminars, exhibitions and foreign relation programs on culture, family affairs, sports, tourism, press and publishing in order to introduce Vietnam's image, people, culture and arts.

30. Regarding human resource training, refresher training and development:

a) Within its power, provide guidance on, inspect and assess the implementation of regulations of law on human resource training, refresher training and development in the fields under its management;

b) Formulate, promulgate within its power or submit to competent authorities for the promulgation of legislative documents, strategies, planning, schemes and plans for human resource training, refresher training and development in the fields under its management, and special mechanisms and polices for training, refresher training, employment and preferential treatment of arts and sports talents.

31. Regarding cultural industry:

Provide guidelines for implementation of the approved strategy for cultural industry development; directly organize the implementation of strategies and schemes for development of development of cultural industries in respect of the sectors under its state management as prescribed by law.

33. Perform its tasks and exercise its rights towards associations and non-governmental organizations engaging in the sectors and fields under its state management as prescribed by law.

34. Issue licenses for import and export of goods in the fields under its state management as prescribed by law.

35. Decide to approve and organize the execution of investment projects in the fields within its power as prescribed by law.

36. Direct and organize scientific research, application of scientific and technological advances, digital transformation, environmental protection and response to climate change in the fields under its state management as prescribed by law.

37. Exercise rights and responsibilities of a representative of owner’s state capital invested in state-owned enterprises, partially state-owned enterprises and state off-budget financial funds under its management as prescribed by law.

38. Perform the task of managing conditional business lines and services in the fields within its power as prescribed by law.

39. Carry out inspections; receive citizens; settle complaints and denunciations; prevent and control corruption and misconduct; practice thrift, combat waste and impose penalties for violations as prescribed by law; conduct specialized inspections of cultural heritage.

40. Decide on and direct the execution of its administrative reform program in line with the objectives and contents of the state administrative reform program approved by the Government and Prime Minister; propose or decide within its power the decentralization of state management power in the sectors and fields under its state management.

41. Direct and provide guidelines on the emulation and commendation work in the fields under its state management as prescribed by law.

43. Manage allocated finances and assets and organize the use of state budget-derived funding in accordance with regulations of law.

44. Perform other tasks as assigned by the Government or the Prime Minister and as prescribed by law.

The organizations specified in clauses 1 to 20 of this Article are administrative organizations that assist the Minister of Culture, Sports and Tourism in exercising its state management functions; the organizations specified in clauses 21 to 25 of this Article are public service providers serving the Ministry’s state management functions.

The Minister of Culture, Sports and Tourism shall submit to the Prime Minister for promulgation a decision on a list of other public service providers affiliated to the Ministry.

The Minister of Culture, Sports and Tourism shall define the functions, tasks, powers and organizational structures of agencies and units affiliated to the Ministry.

The Department of Planning and Finance consists of 04 divisions; the Department of Organization and Personnel consists of 04 divisions.

Article 4. Effect

1. This Decree comes into force from March 01, 2025.

2. This Decree supersedes the Government’s Decree No. 01/2023/ND-CP dated January 16, 2023 defining functions, tasks, powers and organizational structures of the Ministry of Culture, Sports and Tourism.

Article 5. Responsibility for implementation

The Minister of Culture, Sports and Tourism, other Ministers, heads of ministerial agencies, heads of Governmental agencies and Chairpersons of People's Committees of provinces and central-affiliated cities are responsible for the implementation of this Decree.
