NGHỊ QUYẾT

VỀ VIỆC THI HÀNH LUẬT LUẬT SƯ  

QUỐC HỘI NƯỚC CỘNG HOÀ XÃ HỘI CHỦ NGHĨA VIỆT NAM

 Căn cứ vào Hiến ph nước Cộng hòa xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung theo Nghị quyết số 51/2001/QH10 ngày 25 tháng 12 năm 2001 của Quốc hội khóa X, kỳ họp thứ 10;

QUYẾT NGHỊ:

 1. Luật luật sư được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XI, kỳ họp thứ 9 thông qua ngày 29 tháng 6 năm 2006, có hiệu lực từ ngày 01 tháng 01 năm 2007.

2. Chính phủ tổ chức việc rà soát những văn bản quy định chi tiết và hướng dẫn thi hành Pháp lệnh luật sư năm 2001 để huỷ bỏ, ban hành văn bản mới để thi hành Luật này.

3. Kể từ ngày Luật luật sư có hiệu lực thì:

a) Người đã được cấp Chứng chỉ hành nghề luật sư theo quy định của Pháp lệnh luật sư năm 2001 được tiếp tục hành nghề luật sư theo quy định của Luật này;

b) Người đang là luật sư tập sự theo quy định của Pháp lệnh luật sư năm 2001 được tiếp tục tập sự hành nghề luật sư theo quy định của Luật này; thời gian đã tập sự hành nghề luật sư được tính vào thời gian tập sự hành nghề luật sư theo quy định của Luật này và Thẻ luật sư tập sự không còn giá trị;

c) Thẻ luật sư do Đoàn luật sư cấp theo quy định của Pháp lệnh luật sư năm 2001 có giá trị cho đến khi được đổi thẻ mới; tổ chức luật sư toàn quốc hướng dẫn việc đổi Thẻ luật sư;

d) Trong thời hạn sáu tháng, văn phòng luật sư, công ty luật hợp danh đã được cấp Giấy đăng ký hoạt động theo quy định của Pháp lệnh luật sư năm 2001 phải thực hiện thủ tục chuyển đổi thành văn phòng luật sư, công ty luật hợp danh theo quy định của Luật này.

Bộ Tư pháp hướng dẫn việc chuyển đổi đối với các văn phòng luật sư, công ty luật hợp danh đã được cấp Giấy đăng ký hoạt động theo quy định của Pháp lệnh luật sư năm 2001;

đ) Trong thời hạn sáu tháng, cá nhân, tổ chức đang kinh doanh dịch vụ pháp lý theo quy định của Luật doanh nghiệp năm 1999 mà tiếp tục kinh doanh dịch vụ pháp lý thì phải có đủ các điều kiện hành nghề luật sư và phải chuyển đổi hình thức tổ chức hành nghề theo quy định của Luật này; nếu không chuyển đổi thì phải chấm dứt hoạt động.

Bộ Tư pháp hướng dẫn việc chuyển đổi đối với cá nhân, tổ chức kinh doanh dịch vụ pháp lý theo quy định của Luật doanh nghiệp năm 1999;

e) Luật sư nước ngoài đã được cấp Giấy phép hành nghề tại Việt Nam; chi nhánh của tổ chức hành nghề luật sư nước ngoài, công ty luật nước ngoài, công ty luật hợp danh nước ngoài và Việt Nam đã được cấp Giấy phép thành lập theo quy định của Nghị định 87/2003/NĐ-CP ngày 22 tháng 7 năm 2003 của Chính phủ về hành nghề của tổ chức luật sư nước ngoài, luật sư nước ngoài tại Việt Nam được tiếp tục hành nghề theo quy định của Luật này;

g) Đoàn luật sư được thành lập theo quy định của Pháp lệnh luật sư năm 2001 không phải làm thủ tục xin phép thành lập lại;

h) Trong thời gian tổ chức luật sư toàn quốc chưa được thành lập, việc kiểm tra kết quả tập sự hành nghề luật sư do Bộ Tư pháp tổ chức thực hiện, việc cấp Thẻ luật sư do Đoàn luật sư thực hiện.

4. Chính phủ quy định cụ thể việc hỗ trợ kinh phí từ ngân sách nhà nước đối với các tỉnh miền núi đặc biệt khó khăn để phát triển đội ngũ luật sư và bảo đảm hoạt động của Đoàn luật sư.

Nghị quyết này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XI, kỳ họp thứ 9 thông qua ngày 29 tháng 6 năm 2006.

RESOLUTION

ON IMPLEMENTATION OF THE LAW ON LAWYERS

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10 of December 25, 2001, of the Xth National Assembly, the 10th session;

RESOLVES:

1. The Law on Lawyers, which was passed on June 29, 2006, by the XIth National Assembly of the Socialist Republic of Vietnam at its 9th session, takes effect on January 1, 2007.

2. The Government shall organize the review of legal documents detailing and guiding the implementation of the 2001 Ordinance on Lawyers for annulment or promulgation of new ones for implementation of this Law.

3. As from the effective date of the Law on Lawyers:

b/ Persons who works as probationary lawyers under the provisions of the 2001 Ordinance on Lawyers may continue their probation in accordance with this Law; their past probationary duration is counted into their further probationary duration under the provisions of this Law but their probationary lawyer's cards are no longer valid;

c/ Lawyer's cards granted by bar associations under the provisions of the 2001 Ordinance on Lawyers remain valid until they are renewed; the national lawyers' organization shall guide the renewal of lawyer's cards;

d/ Within 6 months, lawyer's offices and law partnerships which have been granted operation registration certificates under the provisions of the 2001 Ordinance on Lawyers shall fill in the procedures for their transformation in accordance with this Law.

The Justice Ministry shall guide the transformation of lawyer's offices and law partnerships which have been granted operation registration certificates under the provisions of the 2001 Ordinance on Lawyers;

e/ Within 6 months, if individuals or organizations dealing in legal services under the provisions of the 1999 Enterprise Law continue to provide those services, they must meet all the law-practicing conditions and transform the professional practice organization in accordance with this Law; in case of non-transformation, they are required to stop their operations.

The Justice Ministry shall provide guidance on transformation for individuals and organizations dealing in legal services under the provisions of the 1999 Enterprise Law.

f/ Foreign lawyers who have been granted permits for professional practice in Vietnam; Vietnam-based branches of foreign law-practicing organizations, foreign law firms or Vietnamese and foreign law partnerships which have been granted establishment permits under the provisions of the Government's Decree No. 87/2003/ND-CP of July 22, 2003, on law practice by foreign lawyers' organizations and foreign lawyers in Vietnam, may continue practicing law in accordance with this Law;

g/ Bar associations established under the provisions of the 2001 Ordinance on Lawyers need not fill in the procedures to apply for their re-establishment;

h/ Pending the establishment of the national lawyers' organization, the Justice Ministry shall organize tests for probationary lawyers and the bar associations shall grant lawyer's cards.
