NGHỊ QUYẾT

VỀ CHỦ TRƯƠNG ĐẦU TƯ DỰ ÁN THỦY ĐIỆN LAI CHÂU

QUỐC HỘI NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM

Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung một số điều theo Nghị quyết số 51/2001/QH10;
Căn cứ Nghị quyết số 13/2002/QH11 ngày 16 tháng 12 năm 2002 của Quốc hội khóa XI, kỳ họp thứ 2 về phương án xây dựng công trình thủy điện Sơn La; Nghị quyết số 66/2006/QH11 ngày 29 tháng 6 năm 2006 của Quốc hội khoá XI, kỳ họp thứ 9 về dự án, công trình quan trọng quốc gia trình Quốc hội quyết định chủ trương đầu tư;
Sau khi xem xét Tờ trình số 124/TTr-CP ngày 13 tháng 8 năm 2009 của Chính phủ về báo cáo đầu tư xây dựng công trình thủy điện Lai Châu, Báo cáo thẩm tra số 740/BC-UBKHCNMT12 ngày 20 tháng 10 năm 2009 của Ủy ban khoa học, công nghệ và môi trường của Quốc hội, Tờ trình số 180/TTr-CP ngày 23 tháng 10 năm 2009 của Chính phủ trình Quốc hội quyết định chủ trương đầu tư Dự án thủy điện Lai Châu và ý kiến của các vị đại biểu Quốc hội;

QUYẾT NGHỊ:

Điều 1

Quyết định chủ trương đầu tư Dự án thủy điện Lai Châu để cung cấp điện cho hệ thống điện quốc gia; góp phần cùng với các nhà máy thủy điện trên sông Đà phục vụ chống lũ về mùa mưa, cấp nước về mùa khô cho đồng bằng Bắc Bộ; phục vụ phát triển kinh tế - xã hội tỉnh Lai Châu, tỉnh Điện Biên và cả vùng Tây Bắc.

Địa điểm xây dựng đập và nhà máy thủy điện Lai Châu: xã Nậm Hàng, huyện Mường Tè, tỉnh Lai Châu.

Điều 2

Một số thông số cơ bản của Dự án:

1. Mực nước dâng bình thường: 295 mét (m);

2. Công suất lắp máy: 1.200 mê-ga-oát (MW);

3. Công nghệ chính: bảo đảm yêu cầu hiện đại, hiệu quả, an toàn;

4. Tổng mức đầu tư: dự tính 32.600 tỷ đồng (tại thời điểm lập Dự án, quý II năm 2008);

5. Thời gian và lộ trình thực hiện: khởi công xây dựng nhà máy vào cuối năm 2010, phát điện tổ máy số 1 vào năm 2016, hòan thành công trình vào năm 2017.

Điều 3

Giao Chính phủ quyết định đầu tư và triển khai Dự án với các yêu cầu, nhiệm vụ cơ bản sau đây:

1. Tổ chức triển khai kịp thời các bước tiếp theo của Dự án: hòan thiện hồ sơ, thiết kế kỹ thuật; xây dựng, ban hành quy trình, tiêu chuẩn, quy chuẩn kỹ thuật trong thiết kế, thi công, giám sát xây dựng công trình nhằm bảo đảm tiến độ, an toàn tuyệt đối, hiệu quả kinh tế tổng hợp; quản lý chặt chẽ các khâu theo quy định của pháp luật về đầu tư;

2. Xây dựng quy hoạch, phương án cụ thể và tổ chức thực hiện tốt công tác di dân tái định cư theo nguyên tắc công khai, dân chủ, đúng đối tượng, đúng chính sách và pháp luật; tổ chức lại sản xuất, chuyển đổi cơ cấu kinh tế, phương thức canh tác để phát triển sản xuất, ổn định và nâng cao đời sống của người dân tái định cư một cách căn bản, bền vững, lâu dài;

3. Thực hiện đầy đủ nhiệm vụ, giải pháp đề ra trong Báo cáo đánh giá tác động môi trường của Dự án; bảo vệ nghiêm ngặt khu bảo tồn thiên nhiên Mường Tè - Mường Nhé; đẩy mạnh công tác bảo vệ, khoanh nuôi tái sinh, trồng mới rừng đầu nguồn, tăng nhanh độ che phủ rừng trên toàn lưu vực sông Đà thuộc lãnh thổ Việt Nam; giữ gìn và phát huy bản sắc văn hóa của các dân tộc, đặc biệt là các dân tộc ít người; bảo đảm quốc phòng, an ninh khu vực biên giới.

Điều 4

1. Giao Chính phủ tổ chức, chỉ đạo triển khai thi công trước các hạng mục chuẩn bị, công trình tạm, công trình phụ trợ để bảo đảm tiến độ công trình.

2. Đồng ý cho áp dụng đối với Dự án thủy điện Lai Châu những cơ chế, chính sách đã phát huy hiệu quả tốt trong quá trình thực hiện Dự án thủy điện Sơn La.

3. Trường hợp cần thiết phải áp dụng cơ chế, chính sách đặc biệt thì Chính phủ trình Quốc hội xem xét, quyết định.

Điều 5

Đồng thời với Dự án thủy điện Lai Châu gồm hai dự án thành phần chính là công trình thủy điện và di dân tái định cư, Chính phủ tổ chức lập quy hoạch, quyết định đầu tư các dự án sau đây:

1. Dự án đường giao thông bên bờ phải sông Đà, đường kết nối và 3 cầu bắc qua sông Đà nhằm khắc phục tình trạng bị cô lập của địa bàn huyện Mường Tè và vùng lân cận sau khi tích nước lòng hồ, phục vụ yêu cầu phát triển kinh tế - xã hội, quốc phòng, an ninh;

2. Dự án điều chỉnh địa giới hành chính, sắp xếp lại dân cư, đổi mới cách thức sản xuất, chuyển dịch cơ cấu kinh tế của huyện Mường Tè và đơn vị hành chính liên quan của tỉnh Lai Châu; đầu tư phát triển kinh tế - xã hội của các đơn vị hành chính mới.

Chính phủ xác định cụ thể lộ trình triển khai thực hiện dự án và bố trí vốn đầu tư cho từng dự án quy định tại khoản 1 và khoản 2 Điều này theo quy định của pháp luật.

Điều 6

1. Sau khi triển khai đầu tư xây dựng, hằng năm Chính phủ báo cáo Quốc hội về tình hình thực hiện Dự án.

2. Ủy ban thường vụ Quốc hội, Hội đồng dân tộc, các Ủy ban của Quốc hội, các Đoàn đại biểu Quốc hội, các đại biểu Quốc hội trong phạm vi nhiệm vụ và quyền hạn của mình giám sát việc thực hiện Nghị quyết này.

Nghị quyết này có hiệu lực từ ngày Quốc hội thông qua.

Nghị quyết này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khoá XII, kỳ họp thứ 6 thông qua ngày 25 tháng 11 năm 2009.

RESOLUTION

APPROVING INVESTMENT IN LAI CHAU HYDROPOWER PROJECT

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 5I/2001/QH10;
Pursuant to Resolution No. 13/2003/QH11 of December 16, 2003, of the XI^th National Assembly, the 2^nd session, on the plan on construction of Son La hydropower work; and Resolution No. 66/2006/QH11 of June 29, 2006, of the XI^th National Assembly, the 9'1' session, on important national projects and works to be submitted to the National Assembly for investment decision;
After considering the Government's Report No. 124/2TTr-CP of August 13, 2009, on investment in the construction of Lai Chau hydropower work, Verification Report No. 740/ BC- UBKHCNMT12 of October 20, 2009, of the National Assembly's Committee on Science, Technology and Environment, and the Government's Report No. 180/TTr-CP of October 23, 2009, submitting the proposal on investment in Lai Chau hydropower project to the National Assembly for decision, and National Assembly deputies' opinions;

RESOLVES:

Article 1.

To approve investment in Lai Chau hydropower work to supply electricity for the national power grid, together with hydropower plants on Da river, contributing to controlling floods in the rainy season and supplying water in the dry season for the northern delta and serving the socio-economic development of Lai Chau and Dien Bien provinces and the whole northwestern region.

The site of construction of a dam and Lai Chau hydropower plant is Nam Hang commune, Muong Te district, Lai Chau province.

Below are several basic parameters of the Project:

1. Normal water rise level: 295 meters (m);

2. Engine capacity: 1,200 megawatts (MW);

3. Main technology: To be modern, efficient and safe;

4. Total investment: estimated at VND 32.6 trillion (at the time of formulation of the Project in the 2nd quarter of 2008);

5. Implementation schedule: To commence construction of the plant by the end of 2010, put the first engine group into operation by 2016, and complete the work by 2017.

Article 3.

To assign the Government to decide on the project investment and implementation to meet the following major requirements and tasks:

1. To organize the prompt implementation of the Project's subsequent steps: finalizing the technical dossier and design: elaborating and promulgating technical processes, standards and regulations in the designing, construction and supervision of construction of works in order to ensure progress, absolute safety and general economic efficiency; and strictly manage all steps in accordance with the investment law;

3. To fully perform the tasks and solutions set out in the Project's environmental impact assessment report; to strictly safeguard Muong Te-Muong Nhe nature reserve; to promote the protection, zoning off for tending and planting of riverhead forests, quickly increasing the forest coverage all over the Da river basin within the Vietnamese territory; to preserve and promote cultural traits of all nationalities, especially ethnic minorities; and to assure defense and security in border areas.

Article 4.

1. To assign the Government to organize and direct the construction of preparatory items, temporary works and auxiliary works to ensure the work progress.

2. To approve the application of mechanisms and policies to Lai Chau Hydropower Project which have effectively worked in the process of implementation of Son La Hydropower Project.

3. When it is necessary to apply special mechanisms and policies, the Government shall submit them to the National Assembly for consideration and decision.

Article 5.

Together with Lai Chau Hydropower Project, which consists of two component projects, namely the hydropower work and the relocation and resettlement of people, the Government shall organize the planning of and decide on investment in the following projects:

1. A project on a road along the right bank of Da river, a connecting road and three bridges spanning over this river, aiming to address the isolation of Muong Te district and surrounding areas once the reservoir has been filled with water, serving the requirements of socio-economic development, defense and security;

2. A project on adjustment of the administrative boundaries, redistribution of population, renovation of production methods and restructure the economy of Muong Te district and related administrative units of Lai Chau province; and investment in the socio-economic development of new administrative units.

Article 6.

1. After commencing construction, annually the Government shall report on the implemen­tation of the Project to the National Assembly.

2. The National Assembly Standing Committee, the Ethnic Council, the Committees of the National Assembly, delegations of National Assembly deputies and individual National Assembly deputies shall, within the ambit of their respective tasks and powers, oversee the implementation of this Resolution.

This Resolution takes effect on the date of its adoption by the National Assembly.

This Resolution was adopted on November 25, 2009, by the XI^th National Assembly of the Socialist Republic of Vietnam at its 6^th session.-
