CIRCULAR

PLANNING FOR SUBCHANNELS FOR FIXED AND MOBILE SERVICES VIA FREQUENCY RANGE OF 30 - 30000 MHZ

Pursuant to the Law on Radio Frequency dated November 23, 2009;

Pursuant to Decree No. 17/2017/ND-CP dated February 17, 2017 of the Government on functions, tasks, powers, and organizational structures of Ministry of Information and Communications;

Pursuant to Decision No. 71/2013/QD-TTg dated November 21, 2013 of the Prime Minister promulgating the Planning for national radio frequency range;

Pursuant to Decision No. 02/2017/QD-TTg dated January 17, 2017 of the Prime Minister on amendments to the Planning for national radio frequency range attached to Decision No. 71/2013/QD-TTg dated November 21, 2013 of the Prime Minister;

At request of Director of the Authority of Radio Frequency Management,

The Minister of Information and Communications promulgates Circular on Planning for subchannels for fixed and mobile services via frequency range of 30 - 30000 MHz.

1. This Circular prescribes planning for subchannels for fixed and mobile services via frequency range of 30 - 30000 MHz.

2. This Circular applies to organizations and individuals managing, using, manufacturing, importing, and selling radio communication equipment associated with fixed and mobile services via frequency range of 30 - 30000 MHz (other than cellular communication systems) in Vietnam.

Article 2. Definitions

In this Circular, the terms below are construed as follows:

1. “radio frequency channel” (hereinafter referred to as “channel”) refers to a range of radio frequency determined by width and central frequency of the channel or other characteristic parameters.

2. “mobile service” refers to radio communication service between land stations and mobile stations or between mobile stations.

3. “fixed service” refers to radio communication service between specified fixed points.

4. “single-frequency transmission” refers to an operating method where 2 radio stations send transmission in either direction, but not both simultaneously, using one channel.

5. “dual-frequency transmission” refers to an operating method where 2 radio stations send transmission using two channels.

7. “duplex operation” refers to an operating method in which transmission is possible simultaneously in both directions of a telecommunication channel.

8. “semi-duplex operation” refers to a method which is simplex operation at one end of the circuit and duplex operation at the other.

9. “microwave system” refers to a radio communication system associated with fixed services, serving frequency range above 30 MHz, utilizing tropospheric scatter, and usually consisting of one or multiple relay stations.

10. “point-to-point connection” (applicable to microwave) refers to a communications connection between 2 radio stations at 2 specified fixed points.

11. “point-to-multipoint connection” (applicable to microwave) refers to communications connections between a radio station at a fixed point and multiple radio stations at specified fixed points.

12. “subchannels” refers to the arrangement of multiple channels in the same frequency band.

13. “main subchannel” means a subchannel defined by basic parameters such as central frequency, spacing between 2 sidebands, and transceiver frequency range.

14. “secondary subchannels” mean subchannels situated between main channels; have central frequency deviated by half of the spacing between 2 sidebands from central frequencies of main channels.

15. “minimum transmission distance” (applicable to microwave) refers to the smallest transmission distance in which a microwave transmission is recommended in respective subchannel.

1. Establish order of use of channels, unify standards applicable to radio communication system, and restrict harmful interference between equipment, systems, and networks.

2. Guide manufacturers, importers, sellers, and users in manufacturing, importing, and investing in equipment, assist the authorities in arranging order of use of frequency range and effectively managing frequency range.

Article 4. Rules of planning

1. Comply with the applicable Planning for national radio frequency range approved by the Prime Minister.

2. Rely on subchannel recommendations of the ITU and regional telecommunication organizations.

3. Take into account the use conditions of radio frequency in Vietnam; adopt proper roadmap for transforming from current conditions to the Planning.

4. Satisfy channel demand in upcoming years and potentially introduce new technologies into use.

Article 5. Contents of planning

The Planning for subchannels for fixed and mobile services via frequency range of 30 - 30000 MHz is accompanied by conditions for use of channels, including:

b) Planning for subchannels for fixed and mobile services via frequency range of 1000 - 30000 MHz under Appendix 2.

Article 6. Organizing implementation

1. The Authority of Radio Frequency Management is responsible for popularizing and guiding implementation of this Circular.

2. Organizations and individuals using radio frequency are responsible for doing so for the right purpose, services, and conditions under this Circular and other radio frequency laws.

3. Organizations and individuals manufacturing, importing, and selling radio communication equipment are responsible for ensuring that the radio communication equipment has technical features suitable for radio services and conditions under Circular and other radio frequency laws.

Article 7. Implementation

1. This Circular comes into force from January 28, 2019 and replaces Circular No. 13/2013/TT-BTTTT dated June 14, 2013 of the Minister of Information and Communications.

2. Chief of Office, Director of the Authority of Radio Frequency Management, heads of agencies and entities affiliated to the Ministry of Information and Communications, domestic and foreign organizations, individuals using, manufacturing, importing, and selling radio communication equipment in Vietnam for use in Vietnam are responsible for the implementation of this Circular.

3. Difficulties that arise during the implementation of this Circular should be reported to the Ministry for consideration./.
