CHỈ THỊ

VỀ VIỆC TĂNG CƯỜNG ĐẢM BẢO AN TOÀN, AN NINH THÔNG TIN BƯU CHÍNH, VIỄN THÔNGVÀ INTERNET TRONG TÌNH HÌNH MỚI 

Trong tình hình hiện nay, các thế lực thù địch tăng cường lợi dụng các dịch vụ bưu chính, viễn thông và internet hoạt động xâm phạm an ninh quốc gia và trật tự an toàn xã hội.

Thực hiện Chỉ thị số 26-CT/TW ngày 18/8/2003 của Ban Bí thư về việc tổ chức nghiên cứu, quán triệt và thực hiện Nghị quyết Hội nghị lần thứ 8 Ban chấp hành Trung ương (Khóa IX) và Chương trình hành động số 44A-CTHĐ/BCS ngày 15/10/2003 của Ban cán sự Đảng Bộ Bưu chính, Viễn thông thực hiện Nghị quyết Trung ương 8 (Khóa IX) về Chiến lược bảo vệ Tổ quốc trong tình hình mới; Thông tư Liên tịch số 01/2001/TTLT-TCBĐ-BCA ngày 7/6/2001 của Tổng cục Bưu điện (nay là Bộ Bưu chính, Viễn thông) và Bộ Công an; Nhằm tăng cường đảm bảo an toàn an ninh thông tin phục vụ cho công tác quản lý nhà nước đối với việc cung cấp và sử dụng các dịch vụ bưu chính, viễn thông và internet, sử dụng thiết bị phát, thu phát vô tuyến điện trên toàn quốc, Bộ trưởng Bộ Bưu chính, Viễn thông chỉ thị các cơ quan đơn vị trực thuộc Bộ Bưu chính, Viễn thông, các doanh nghiệp bưu chính, viễn thông và Internet thực hiện tốt những việc sau đây:

1. Nghiêm chỉnh chấp hành pháp luật về bưu chính, viễn thông và internet; có trách nhiệm bảo đảm an ninh thông tin trong hoạt động bưu chính, viễn thông và internet; thực hiện các yêu cầu về đảm bảo an toàn mạng lưới, an ninh thông tin của Bộ Bưu chính, Viễn thông, Bộ Công an và các cơ quan nhà nước có thẩm quyền theo quy định của pháp luật và các nội dung quy định tại Thông tư Liên tịch số 01/2001/TTLT-TCBĐ-BCA ngày 7/6/2001.

2. Các doanh nghiệp bưu chính, viễn thông và internet phối hợp với Công an địa phương xây dựng phương án hành động khi có tình huống bạo động, bạo loạn gây rối trật tự an toàn xã hội, xâm phạm an ninh quốc gia:

a, Bảo đảm thông tin liên lạc phục vụ chỉ đạo điều hành của cơ quan Đảng, Nhà nước, lực lượng vũ trang khi xảy ra bạo động, bạo loạn theo quy định hiện hành của pháp luật.

b, Tổ chức lực lượng bảo vệ, trang bị các thiết bị bảo vệ mạng lưới và các công trình bưu chính, viễn thông thuộc quyền quản lý; không được lợi dụng hoặc để người khác lợi dụng mạng lưới, thiết bị thuê bao, mật khẩu truy nhập gây nhiễu, gây rối loạn thiết bị, xâm phạm an ninh quốc gia, trật tự an toàn xã hội.

c, Phối hợp với các đơn vị nghiệp vụ của Bộ Công an tiến hành ngăn chặn khẩn cấp và ngừng cung cấp dịch vụ đối với những trường hợp gây bạo động, bạo loạn, sử dụng dịch vụ bưu chính, viễn thông và internet xâm phạm an ninh quốc gia, chống lại Nhà nước Cộng hòa Xã hội Chủ nghĩa Việt Nam.

3. Các doanh nghiệp bưu chính, viễn thông và internet tăng cường kiểm tra, giám sát chặt chẽ hoạt động của các đại lý dịch vụ viễn thông và internet; Tuyên truyền, hướng dẫn cho các chủ đại lý nắm vững các quy định của Nhà nước về đảm bảo an toàn, an ninh thông tin và buộc phải chấp hành nghiêm chỉnh các quy định về cung cấp dịch vụ bưu chính, viễn thông và internet; phải cung cấp đầy đủ số liệu khi có yêu cầu để cơ quan Công an tiến hành những biện pháp cần thiết góp phần bảo vệ an ninh quốc gia và trật tự an toàn xã hội.

4. Vụ Kế hoạch – Tài chính nghiên cứu xây dựng cơ chế miễn, giảm giá cước hỗ trợ các đơn vị nghiệp vụ của Bộ Công an trong việc sử dụng mạng lưới, dịch vụ bưu chính, viễn thông và internet khi xảy ra tình huống bạo động, bạo loạn, gây rối trật tự an toàn xã hội, xâm phạm an ninh quốc gia.

5. Các đơn vị trực thuộc Bộ, các doanh nghiệp bưu chính, viễn thông và internet có trách nhiệm hỗ trợ đào tạo chuyên môn nghiệp vụ, cử cán bộ có năng lực kỹ thuật phối hợp với các đơn vị nghiệp vụ liên quan của Bộ Công an nghiên cứu giải pháp kỹ thuật để đáp ứng yêu cầu đảm bảo an toàn, an ninh thông tin trên mạng viễn thông và internet.

Thủ trưởng các cơ quan, đơn vị trực thuộc Bộ, các doanh nghiệp bưu chính, viễn thông và internet chịu trách nhiệm tổ chức, triển khai thực hiện Chỉ thị này và gửi báo cáo kết quả thực hiện về Bộ Bưu chính, Viễn thông (Vụ Viễn thông); Trong quá trình thực hiện, nếu có vướng mắc phát sinh, báo cáo Bộ Bưu chính, Viễn thông để xem xét giải quyết.

Vụ Viễn thông và Vụ Bưu chính có trách nhiệm kiểm tra, đôn đốc việc thực hiện Chỉ thị này và báo cáo Bộ trưởng.

DIRECTIVE

ON INTENSIFYING THE ASSURANCE OF SAFETY AND SECURITY FOR POST, TELECOMMUNICATION AND INTERNET INFORMATION IN THE NEW SITUATION

In the present situation, the hostile forces are increasingly taking advantage of postal, telecommunication and Internet services, to infringe upon our national security and undermine our social order and safety.

In implementation of the Party Secretariat's Directive No. 26-CTITW of August 18, 2003 on organization of the study, thorough understanding and implementation of the Resolution of the 8th plenum of the Party Central Committee (the IX^th Congress) and Action Program No. 44A-CTHD/BCS of October 15, 2003 of the Caucus Commission of the Party organization of the Ministry of Post and Telematics in the implementation of the Resolution of the 8^th plenum of the Party Central Committee (the IX^th Congress) on the national defense strategy in the new situation; Joint Circular No. 0 11200 1ITTLT- TCBD-BCA of June 7, 2001 of the General Department of Post (now the Ministry of Post and Telematics) and the Ministry of Public Security,. in order to intensify the assurance of information safety and security in service of the State management over the provision and use of postal, telecommunication and Internet services, the use of radio transmitter and receivers nationwide, the Minister of Post and Telematics hereby directs the agencies and units attached to the Ministry of Post an Telematics and postal, telecommunication an Internet enterprises to well perform the following tasks:

1. To strictly observe the legislation on post, telecommunications and Internet; have the responsibility to assure information security in postal, telecommunication and internet activities; to comply with the requirements of the Ministry of Post and Telematics, the Ministry of Public Security and competent State bodies on assurance of network safety and information security according to law provisions and

2. Postal, telecommunication and internet enterprises shall coordinate with the local police in drawing up action plans to cope with violent incidents and riots undermining social safety and order or infringing upon national security:

a/ To ensure information and communication in service of the direction of the Party and State agencies and armed forces according to law provisions when violent incidents or riots break out;

c/ To coordinate with the professional units of the Ministry of Public Security in urgently stopping the provision of services in cases of provoking violence or riots, using postal, telecommunication and Internet services to infringe upon national security and opposing the State of the Socialist Republic of Vietnam.

3. Postal, telecommunication and internet enterprises shall intensify examination and close supervision of activities of internet and telecommunication service agents; propagate and guide the agents’ owners to firmly grasp the State's regulations on assurance of information safety and security and to strictly observe the regulations on provision of postal, telecommunication and internet services; to supply fully data as requested so that the police agencies take necessary measures to protect national security and social safety and order.

4. The Planning and Finance Department shall study and establish a mechanism for exemption and reduction of charges to support the professional units of the Ministry of Public Security when using the postal, telecommunication and internet networks and services upon the breaking out of violent incidents or riots undermining social safety and order or infringing upon national security.

5. The units attached to the Ministry and the postal, telecommunication and internet enterprises shall have to assist in the professional training and send technically capable staff to work with the relevant professional units of the Ministry of Public Security in studying technical solutions to satisfy the requirements on assurance of safety and security for information on telecommunications network and on the Internet.

The heads of the agencies and units attached to the Ministry of Post and Telematics, postal, telecommunication and Internet enterprises shall have to organize the implementation of this Directive and report the implementation results to the Ministry of Post and Telematics (the Telecommunications Department); in the course of implementation if they face any problems, they should report them to the Ministry of Post and Telematics for consideration and settlement.

The Telecommunications Department and the Post Department shall have to examine and urge the implementation of this Directive and report thereon to the Minister.
