NGHỊ QUYẾT

VỀ CHƯƠNG TRÌNH HOẠT ĐỘNG GIÁM SÁT CỦA QUỐC HỘI NĂM 2006

(Từ ngày 18 tháng 10 đến ngày 29 tháng 11 năm 2005)

Căn cứ điều 84 của Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung theo Nghị quyết số 51/2001/QH10 ngày 25 tháng 12 năm 2001 của Quốc hội khóa X, kỳ họp thứ 10;
Căn cứ Luật hoạt động giám sát của Quốc hội;
Trên cơ sở xem xét đề nghị của Hội đồng dân tộc, các Ủy ban của Quốc hội, các Đoàn đại biểu Quốc hội và Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam, Tờ trình của Ủy ban Thường vụ Quốc hội và ý kiến của các vị đại biểu Quốc hội.

QUYẾT NGHỊ:

Điều 1. Cùng với việc xem xét các báo cáo của Chính phủ, Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, chất vấn và trả lời chất vấn, Quốc hội tiến hành giám sát các nội dung sau đây tại các kỳ họp:

1. Tại kỳ họp thứ 9: Việc thực hiện quy hoạch, kế hoạch sử dụng đất theo Luật đất đai.

2. Tại kỳ họp thứ 10: Việc triển khai thực hiện Nghị quyết của Quốc hội về Chương trình trồng mới 5 triệu ha rừng;

Điều 2. Giao Ủy ban thường vụ Quốc hội tiến hành giám sát các nội dung sau đây và báo cáo kết quả với Quốc hội:

1. Việc các cơ quan tiến hành tố tụng ở huyện, quận, thị xã, thành phố thuộc tỉnh thực hiện thẩm quyền mới theo quy định của Bộ luật tố tụng hình sự và Bộ luật tố tụng dân sự (báo cáo Quốc hội tại kỳ họp thứ 9).

2. Việc thực hiện cổ phần hóa doanh nghiệp nhà nước (báo cáo Quốc hội tại kỳ họp thứ 10).

Điều 3. Giao Hội đồng dân tộc, các Ủy ban của Quốc hội tiến hành giám sát các nội dung sau đây và báo cáo kết quả với Quốc hội:

1. Hội đồng dân tộc: Việc thực hiện chính sách hỗ trợ đất sản xuất, đất ở, nhà ở và nước sinh hoạt cho hộ đồng bào dân tộc thiểu số nghèo, đời sống khó khăn.

2. Ủy ban pháp luật: Việc chấp hành pháp luật trong thi hành án hình sự.

3. Ủy ban kinh tế và ngân sách: Chất lượng tín dụng và an toàn của hệ thống ngân hàng.

4. Ủy ban quốc phòng và an ninh: Tình hình thực hiện Pháp lệnh dân quân tự vệ và Pháp lệnh về lực lượng dự bị động viên.

5. Ủy ban văn hóa, giáo dục, thanh niên, thiếu niên và nhi đồng: Về đội ngũ giáo viên và cán bộ quản lý trong lĩnh vực giáo dục, đào tạo và dạy nghề.

6. Ủy ban về các vấn đề xã hội: Tình hình thực hiện pháp luật về dân số, người cao tuổi và người tàn tật.

7. Ủy ban khoa học, công nghệ và môi trường: Việc thực hiện chính sách, pháp luật trong lĩnh vực quản lý chất lượng, vệ sinh an toàn thực phẩm.

8. Ủy ban đối ngoại: Việc thực hiện các hiệp định về biên giới giữa Việt Nam và các nước láng giềng.

Điều 4. Trên cơ sở Chương trình hoạt động giám sát của Quốc hội và căn cứ vào nhiệm vụ, quyền hạn theo quy định của pháp luật, Ủy ban thường vụ Quốc hội, Hội đồng dân tộc, các Ủy ban của Quốc hội chủ động xây dựng và triển khai thực hiện chương trình giám sát của mình.

Điều 5. Căn cứ vào các nội dung tại Điều 1, Điều 2, Điều 3 của Nghị quyết này và điều kiện, tình hình thực tế, các Đoàn đại biểu Quốc hội, các đại biểu Quốc hội chủ động lựa chọn nội dung để xây dựng chương trình, tiến hành giám sát tại địa phương và báo cáo kết quả giám sát theo quy định.

Điều 6. Giao Ủy ban thường vụ Quốc hội chỉ đạo việc thực hiện Chương trình hoạt động giám sát của Quốc hội; chỉ đạo, điều hòa, phối hợp hoạt động giám sát của Hội đồng dân tộc, các Ủy ban của Quốc hội; hướng dẫn các Đoàn đại biểu Quốc hội, các đại biểu Quốc hội trong việc thực hiện hoạt động giám sát; chỉ đạo công tác bảo đảm thực hiện chương trình giám sát của Quốc hội; chỉ đạo các cơ quan tiến hành giám sát thực hiện việc theo dõi, tổng hợp kết qủa giải quyết các kiến nghị.

Điều 7. Các cơ quan, tổ chức hữu quan tạo điều kiện thuận lợi để các cơ quan của Quốc hội, Đoàn đại biểu Quốc hội và đại biểu Quốc hội tiến hành giám sát; chủ động chuẩn bị báo cáo và cung cấp tài liệu cần thiết theo yêu cầu của Ủy ban thường vụ Quốc hội, Hội đồng dân tộc, các Ủy ban của Quốc hội, các Đoàn đại biểu Quốc hội và của đại biểu Quốc hội; nghiêm túc giải quyết các kiến nghị và báo cáo kết quả với các cơ quan tiến hành giám sát.

Điều 8. Ủy ban thường vụ Quốc xem xét báo cáo tổng hợp kết quả hoạt động giám sát của các cơ quan của Quốc hội, các Đoàn đại biểu Quốc hội 6 tháng và cả năm; tổng hợp và báo cáo kết quả việc thực hiện Chương trình hoạt động giám sát của Quốc hội năm 2006 tại kỳ họp thứ 10 của Quốc hội.

Nghị quyết này được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XI, kỳ họp thứ 8 thông qua ngày 19 tháng 11 năm 2005./.

RESOLUTION

ON THE NATIONALS ASSEMBLY 2006 SUPERVISORY PROGRAM

THE NATIONAL ASSEMBLY

Pursuant to the Article 84 of the Constitution of the Social Republic of Vietnam, which was amended and supplemented under Resolution No.51/2001/QH10 of December 25,2001, of the Xth National Assembly, the 10th session ;
Pursuant to the Law on Supervisory Activities of the National Assembly;
Having considered the proposal of the Nationality Council, National Assembly committees, National Assembly deputies delegations, and the Vietnam Fatherland Fronts Central Committee, the report of the National Assembly Standing Committee, and the opinions of National Assembly deputies,

RESOLVES:

Article 1: Together with considering and examining reports of the Government, the Supreme Peoples court and the Supreme Peoples Procuracy, questions and answers, the National Assembly shall supervise the following contents at various sessions:

1. At the 9th session

2. The implementation of land-use plannings and plans under the Land Law.

3. At the 10th session

Article 2: To assign the National Assembly Standing Committee to supervise the following contents and report the supervision results to the National Assembly:

1. The exercise of new powers specified in the Criminal Procedure Code and the Civil Procedure Code by procedure-conducting bodies in districts, towns and provincial cities (to be reported to the National Assembly at its 9th session).

2. The equitization of state enterprises (to be reported to the National Assembly at its 10th session).

Article 3: To assign the Nationality council and National Assembly committees to supervise the following contents and report the supervision results to the National Assembly:

1. The Nationality Council: The implementation of policies on provision of supports in production land, residential land, dwelling houses and daily-life water for poor ethnic minority households facing difficulties.

2. The Law Committee: The observance of law in the enforcement of criminal sentences.

3. The Economic and Budgetary Committee: The quality of credit and safety of the banking system.

4. The Defense and Security Committee: The implementation of the Ordinance on Militia and Self-Defense Forces and the Ordinance on Reserves Forces.

5. The Committee for Culture, Education, youth, Teenagers and Children: On the contingent of teachers and managers in the domain of education, training and job-training.

7. The Committee for Science, Technology and Environment: The implementation of policies and laws on the management of food quality, hygiene and safety.

8. The Committee for External Relations: The implementation of border treaties between Vietnam and the neighboring countries.

Article 4: On the basis of the National Assemblys supervisory program and their law-prescribed tasks and powers, the National Assembly Standing Committee, the Nationality Council and the Nationality Assembly committees shall take initiative in formulating and implementing their own supervisory programs.

Article 5: Based on the contents mentioned in Articles 1,2 and 3 of this Resolution as well as practical conditions and situation, National Assembly deputies delegations and National Assembly deputies shall take initiative in selecting contents for elaboration of their supervision in localities and reporting on supervision results according to regulations.

Article 6: To assign the National Assembly Standing Committee to direct the implementation of the National Assemblys supervisory program; direct and coordinate supervisory activities of the National Council and the National Assemblys committee; guide National Assembly deputies delegations and National Assembly deputies in carrying out supervisory activities; direct the work of ensuring the implementation of the National Assemblys supervisory program; to direct supervising agencies in monitoring the settlement of recommendations and synthesizing its results.

Article 7: Concerned and agencies and organizations shall create favorable conditions for National Assembly agencies, National Assembly deputies in conducting supervision; take initiative in preparing reports and supplying necessary documents at the request of the National Assembly Standing Committee, the Nationality Council, the National Assembly deputies delegations, and National Assembly deputies; and seriously settle recommendations and report the results thereof to supervising agencies.

Article 8: The National Assembly Standing Committee shall consider biannual and annual sum-up reports on the results of supervisory activities of National Assembly agencies and National Assembly agencies and National Assembly deputies delegations; synthesize and report on the results of implementation of the National Assemblys 2006 supervisory program at its 10th session.

The Resolution was passed on November 19, 2005, by the XIth National Assembly of the Socialist Republic of Vietnam at its 8th session.
