VỀ THỰC HIỆN THÍ ĐIỂM KHÔNG TỔ CHỨC HỘI ĐỒNG NHÂN DÂN HUYỆN, QUẬN, PHƯỜNG

Căn cứ Điều 84 của Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung một số điều theo Nghị quyết số 51/2001/QH10;
Sau khi xem xét Tờ trình số 18/TTr-CP ngày 30 tháng 10 năm 2008 của Chính phủ về Đề án và dự thảo Nghị quyết của Quốc hội thí điểm không tổ chức Hội đồng nhân dân huyện, quận, phường và nhân dân bầu trực tiếp Chủ tịch Ủy ban nhân dân xã; Báo cáo thẩm tra số 544/BC-UBPL12 ngày 31 tháng 10 năm 2008 của Ủy ban pháp luật của Quốc hội và ý kiến của các vị đại biểu Quốc hội,

QUYẾT NGHỊ

Điều 1.

Thí điểm việc không tổ chức Hội đồng nhân dân huyện, quận, phường tại một số địa phương; danh sách cụ thể do Chính phủ trình Ủy ban thường vụ Quốc hội quyết định.

Điều 2.

Thời gian thực hiện thí điểm bắt đầu từ ngày 25 tháng 4 năm 2009 cho đến khi Quốc hội quyết định chấm dứt việc thực hiện thí điểm. Tại những nơi thực hiện thí điểm, Hội đồng nhân dân huyện, quận, phường kết thúc nhiệm kỳ 2004-2009 vào ngày 25 tháng 4 năm 2009, Ủy ban nhân dân huyện, quận, phường nhiệm kỳ 2004-2009 tiếp tục hoạt động cho đến khi Ủy ban nhân dân mới được thành lập.

Điều 3.

Giao Ủy ban thường vụ Quốc hội trên cơ sở các quy định của pháp luật, Nghị quyết này, các nội dung cơ bản của Đề án và yêu cầu thí điểm ban hành nghị quyết:

1. Điều chỉnh một số nhiệm vụ, quyền hạn của Hội đồng nhân dân huyện, quận nơi không tổ chức Hội đồng nhân dân cho Hội đồng nhân dân, Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương;

2. Quy định nhiệm vụ, quyền hạn và tổ chức bộ máy của Ủy ban nhân dân huyện, quận, phường tại nơi không tổ chức Hội đồng nhân dân;

3. Quy định thẩm quyền, trình tự, thủ tục bổ nhiệm, miễn nhiệm, cách chức Chủ tịch Ủy ban nhân dân, các thành viên khác của Ủy ban nhân dân huyện, quận, phường nơi không tổ chức Hội đồng nhân dân.

Điều 4.

1. Ủy ban thường vụ Quốc hội, Chính phủ, Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, Ủy ban trung ương Mặt trận Tổ quốc Việt Nam trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm:

a. Tổ chức thực hiện thí điểm không tổ chức Hội đồng nhân dân huyện, quận, phường;

b. Trình Quốc hội xem xét, quyết định những vấn đề chưa phù hợp hoặc phát sinh trong quá trình thực hiện thí điểm;

c. Sơ kết, tổng kết việc thí điểm, báo cáo Quốc hội xem xét, quyết định.

2. Ủy ban thường vụ Quốc hội, Hội đồng dân tộc, các Ủy ban của Quốc hội, các Đoàn đại biểu Quốc hội, các đại biểu Quốc hội trong phạm vi nhiệm vụ, quyền hạn của mình giám sát việc thực hiện Nghị quyết này.

Điều 5.

Nghị quyết này có hiệu lực thi hành từ ngày 01 tháng 4 năm 2009.

Nghị quyết này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XII, kỳ họp thứ 4 thông qua ngày 15 tháng 11 năm 2008.

RESOLUTION

ON TRIAL NON-ORGANIZATION OF PEOPLES COUNCILS OF RURAL DISTRICTS, URBAN DISTRICTS AND WARDS

THE NATIONAL ASSEMBLY OF THE SOCLALIST REPUBLIC OF VIETNAM

Pursuant to Article 84 of the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10;
After considering the Governments Report No. 18/TTr-CP of October 30, 2008, on the scheme and the National Assembly’s draft resolution on trial non-organization of Peoples Councils of rural districts, urban districts and wards, and the direct election of presidents of commune Peoples Committees by the people; and the National Assembly Law Committees Examination Report No. 544/BC-UBPL12 of October 31, 2008, and opinions of National Assembly deputies;

RESOLVES:

Article 1. Not to organize on a trial basis Peoples Councils of rural districts, urban districts and wards in a number of localities, which are specified in a list to be submitted by the Government to the National Assembly Standing Committee for decision.

Article 2. The trial period will begin on April 25.2009, and end under a decision of the National Assembly. In rural districts, urban districts and wards where Peoples Councils will not be organized on a trial basis, the 2004-2009 term of office of their Peoples Councils will expire on April 25, 2009, while the Peoples Committees of the 2004-2009 term of office in these localities will continue operating until new ones are established.

Article 3. To assign the National Assembly Standing Committee to issue, in accordance with law, this Resolution and principal contents of the trial scheme and requirements, resolutions on:

2. Defining tasks, powers and organizational structures of Peoples Committees of rural districts, urban districts and wards where no Peoples Councils will be organized;

3. Defining the competence, order and procedures for appointing, relieving from office or dismissing presidents and other members of Peoples Committees of rural districts, urban districts and wards where no Peoples Councils will be organized.

Article 4.

1. Within the ambit of their respective tasks and powers, the National Assembly Standing Committee, the Government, the Supreme Peoples Court, the Supreme Peoples Procuracy and the Central Committee of the Vietnam Fatherland Front shall:

a/ Organize the trial non-organization of Peoples Councils of rural districts, urban districts and wards;

b/ Propose to the National Assembly for consideration and decision matters which are inappropriate or arise during the trial period;

c/ Organize preliminary reviews and final review of the trial non-organization of Peoples Councils of rural districts, urban districts and wards, and report it to the National Assembly for consideration and decision.

2. The National Assembly Standing Committee, the Council for Ethnic Minorities, the Committees of the National Assembly, the delegations of National Assembly deputies and National Assembly deputies shall, within the ambit of their respective tasks and powers, oversee the implementation of this Resolution.

Article 5. This Resolution takes effect on April 1, 2009.
