SỬA ĐỔI, BỔ SUNG MỘT SỐ ĐIỀU CỦA LUẬT PHÒNG, CHỐNG THAM NHŨNG

Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung một số điều theo Nghị quyết số 51/2001/QH10;
Quốc hội ban hành Luật sửa đổi, bổ sung một số điều của Luật phòng, chống tham nhũng.

Điều 1. Sửa đổi, bổ sung một số điều của Luật phòng, chống tham nhũng:

1. Điều 73 được sửa đổi, bổ sung như sau:

“Điều 73. Ban chỉ đạo phòng, chống tham nhũng

1. Ban chỉ đạo trung ương về phòng, chống tham nhũng do Thủ tướng Chính phủ đứng đầu có trách nhiệm chỉ đạo, phối hợp, kiểm tra, đôn đốc hoạt động phòng, chống tham nhũng trong phạm vi cả nước. Giúp việc cho Ban chỉ đạo trung ương về phòng, chống tham nhũng có bộ phận thường trực hoạt động chuyên trách.

2. Ban chỉ đạo tỉnh, thành phố trực thuộc trung ương về phòng, chống tham nhũng do Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương đứng đầu có trách nhiệm chỉ đạo, phối hợp, kiểm tra, đôn đốc hoạt động phòng, chống tham nhũng trong phạm vi tỉnh, thành phố trực thuộc trung ương. Ban chỉ đạo tỉnh, thành phố trực thuộc trung ương về phòng, chống tham nhũng có bộ phận giúp việc.

3. Tổ chức, nhiệm vụ, quyền hạn và quy chế hoạt động của Ban chỉ đạo trung ương về phòng, chống tham nhũng, Ban chỉ đạo tỉnh, thành phố trực thuộc trung ương về phòng, chống tham nhũng do Ủy ban thường vụ Quốc hội quy định theo đề nghị của Thủ tướng Chính phủ.”

2. Điều 74 được sửa đổi, bổ sung như sau:

“Điều 74. Giám sát công tác phòng, chống tham nhũng

1. Quốc hội, Ủy ban thường vụ Quốc hội giám sát công tác phòng, chống tham nhũng trong phạm vi cả nước.

2. Hội đồng dân tộc và các Ủy ban của Quốc hội trong phạm vi nhiệm vụ, quyền hạn của mình giám sát công tác phòng ngừa tham nhũng thuộc lĩnh vực do mình phụ trách.

Ủy ban tư pháp của Quốc hội trong phạm vi nhiệm vụ, quyền hạn của mình giám sát việc phát hiện và xử lý hành vi tham nhũng.

3. Hội đồng nhân dân các cấp trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm giám sát công tác phòng, chống tham nhũng tại địa phương.

4. Đoàn đại biểu Quốc hội, đại biểu Quốc hội, đại biểu Hội đồng nhân dân trong phạm vi nhiệm vụ, quyền hạn của mình giám sát việc thực hiện các quy định của pháp luật về phòng, chống tham nhũng.”

Điều 2. Luật này có hiệu lực thi hành từ ngày công bố.

Luật này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XII, kỳ họp thứ nhất thông qua ngày 04 tháng 8 năm 2007.

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE ANTI-CORRUPTION LAW

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended under Resolution No. 51/2001/QH10;
The National Assembly promulgates the Law Amending and Supplementing a Number of Articles of the Anti-Corruption Law.

Article 1. To amend and supplement a number of articles of the Anti-Corruption Law as follows:

1. Article 73 is amended and supplemented as follows:

''Article 73. Steering Committee for Corruption Prevention and Combat

Steering Committee for Corruption Prevention and Combat

1. The Central Committee for Corruption Prevention and Combat is headed by the Prime Minister and has the responsibility to direct, coordinate, inspect and urge activities of corruption prevention and combat nationwide. The Central Steering Committee for Corruption Prevention and Combat is assisted by a standing section operating on a full-time basis.

3. The organization, tasks, powers and operation regulations of the Central Steering Committee for Corruption Prevention and Combat and provincial/municipal Steering Committees for Corruption Prevention and Combat are provided for by the National Assembly Standing Committee at the proposal of the Prime Minister.

2. Article 74 is amended and supplemented as follows:

''Article 74. Supervision of the work of corruption prevention and combat

Supervision of the work of corruption prevention and combat

1.The National Assembly and the National Assembly Standing Committee shall supervise the work of corruption prevention and combat nationwide.

2. The Nationalities Council and Committees of the National Assembly shall, within the ambit of their respective tasks and powers, supervise the work of corruption prevention and combat in the domains under their respective charge.

The Judicial Committee of the National Assembly shall, within the ambit of its tasks and powers, supervise the detection and handing of acts of corruption.

3. People's Councils at all levels shall, within the ambit of their tasks and powers, supervise the work of corruption prevention and combat in their respective localities.

4. Delegations of National Assembly deputies, National Assembly deputies and People's Council deputies shall, within the ambit of their respective tasks and powers, supervise the implementation of legal provisions on corruption prevention and combat.''

This Law takes effect on the date of its promulgation.

This Law was passed on August 4, 2007, by the XII^th National Assembly of the Socialist Republic of Vietnam at its 1^stsession.
