NGHỊ ĐỊNH

CỦA CHÍNH PHỦ SỐ 32-CP NGÀY 22-5-1995 VỀ VIỆC CHUYỂN CỤC HÀNG KHÔNG DÂN DỤNG VIỆT NAM TRỰC THUỘC CHÍNH PHỦ

Căn cứ Luật Tổ chức Chính phủ ngày 30 tháng 9 năm 1992;
Để thực hiện Luật sửa đổi, bổ sung một số điều của Luật Hàng không dân dụng Việt Nam ngày 20 tháng 4 năm 1995 về đặt cơ quan quản lý Nhà nước chuyên ngành hàng không dân dụng là cơ quan thuộc Chính phủ,

NGHỊ ĐỊNH:

Điều 1.- Nay chuyển Cục Hàng không dân dụng Việt Nam từ Bộ Giao thông vận tải đặt trực thuộc Chính phủ để giúp Chính phủ thực hiện chức năng quản lý Nhà nước chuyên ngành về hàng không dân dụng.

Bộ Giao thông vận tải có trách nhiệm chuyển giao toàn bộ tổ chức, bộ máy, nhân sự, cơ sở vật chất kỹ thuật, tài liệu và nhiệm vụ quản lý Nhà nước về Hàng không dân dụng cho Cục Hàng không dân dụng Việt Nam.

Điều 2.- Ban Tổ chức - Cán bộ Chính phủ cùng Cục Hàng không dân dụng Việt Nam soạn thảo nghị định quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức bộ máy của Cục Hàng không dân dụng Việt Nam để trình Chính phủ quyết định.

Điều 3.- Nghị định này có hiệu lực thi hành từ ngày ban hành. Các quy định trước đây trái với Nghị định này đều bãi bỏ.

Bộ trưởng Bộ Giao thông vận tải, Cục trưởng Cục Hàng không dân dụng Việt Nam, Bộ trưởng, Trưởng ban Ban Tổ chức - Cán bộ Chính phủ, các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Nghị định này.

DECREE

TO PLACE THE VIETNAM CIVIL AVIATION DEPARTMENT UNDER THE DIRECT CONTROL OF THE GOVERNMENT

THE GOVERNMENT

Pursuant to the Law on Organization of the Government on the 30th of September 1992;
In implementation of the Law on Amendments to a Number of Articles of the Law on Vietnam Civil Aviation on the 20th of April 1995 which stipulates that the office that performs the function of State management of civil aviation is attached to the Government,

DECREES:

Article 1.- To transfer the Vietnam Civil Aviation Department from the Ministry of Transport and Communication to the direct control of the Government in order to perform the function of specialized State management over the civil aviation service.

The Ministry of Transport and Communication is responsible for turning over the whole organizational apparatus, personnel, material and technical bases, documents and the function of State management of civil aviation to the Vietnam Civil Aviation Department.

Article 2.- The Government Commission on Organization and Personnel, together with the Vietnam Civil Aviation Department, shall draft a decree to stipulate the function, tasks, powers and organizational structure of the Vietnam Civil Aviation Department, and submit it to the Government for approval.

The Minister of Transport and Communication, the Director of the Vietnam Civil Aviation Department, the Minister-Chairman of the Government Commission on Organization and Personnel and the other Ministers, the Heads of the agencies at ministerial level, the Heads of the agencies attached to the Government, and the Presidents of the People's Committees of the provinces and cities directly under the Central Government are responsible for implementing this Decree.
