NGHỊ ĐỊNH

HƯỚNG DẪN THỰC THI CÔNG ƯỚC LA HAY NGÀY 05 THÁNG 10 NĂM 1961 VỀ MIỄN HỢP PHÁP HÓA ĐỐI VỚI GIẤY TỜ CÔNG CỦA NƯỚC NGOÀI (CÔNG ƯỚC APOSTILLE)

Căn cứ Luật Tổ chức Chính phủ số 63/2025/QH15;

Căn cứ Luật Điều ước quốc tế số 108/2016/QH13 được sửa đổi, bổ sung bởi Luật số 137/2025/QH15;

Căn cứ Luật Cơ quan đại diện Việt Nam ở nước ngoài số 33/2009/QH12 được sửa đổi, bổ sung bởi Luật số 19/2017/QH14 và Luật số 08/2026/QH16;

Theo đề nghị của Bộ trưởng Bộ Ngoại giao;

Chính phủ ban hành Nghị định hướng dẫn thực thi Công ước La Hay ngày 05 tháng 10 năm 1961 về miễn hợp pháp hóa đối với giấy tờ công của nước ngoài (Công ước Apostille).

Chương I

NHỮNG QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Nghị định này quy định về:

1. Thẩm quyền, trình tự, thủ tục cấp chứng nhận Apostille đối với giấy tờ công của Việt Nam.

2. Việc tiếp nhận, sử dụng tại Việt Nam giấy tờ công đã được cấp chứng nhận Apostille của Quốc gia thành viên Công ước La Hay ngày 05 tháng 10 năm 1961 về miễn hợp pháp hóa đối với giấy tờ công của nước ngoài (sau đây gọi là Công ước Apostille).

3. Xác minh chứng nhận Apostille và quản lý nhà nước về thực thi Công ước Apostille.

Điều 2. Đối tượng áp dụng

Nghị định này áp dụng đối với:

1. Cơ quan, tổ chức, cá nhân đề nghị cấp chứng nhận Apostille.

2. Cơ quan có thẩm quyền cấp chứng nhận Apostille của Việt Nam.

3. Cơ quan, tổ chức, cá nhân tiếp nhận, sử dụng tại Việt Nam giấy tờ công đã được cấp chứng nhận Apostille của Quốc gia thành viên Công ước.

4. Cơ quan, tổ chức khác có liên quan đến việc cấp, xác minh, quản lý nhà nước và hợp tác quốc tế về chứng nhận Apostille.

Điều 3. Giải thích từ ngữ

Trong Nghị định này, những từ ngữ dưới đây được hiểu như sau:

1. “Quốc gia thành viên Công ước” là các bên đã tham gia Công ước Apostille thông qua ký, phê chuẩn hoặc gia nhập theo quy định của Công ước.

2. “Chứng nhận Apostille” là chứng nhận do cơ quan có thẩm quyền của Việt Nam hoặc của Quốc gia thành viên Công ước cấp để xác nhận nguồn gốc của giấy tờ công, gồm tính xác thực của chữ ký, chức danh, thẩm quyền của người ký và con dấu hoặc dấu đóng trên giấy tờ công (nếu có), theo quy định tại Điều 4 Nghị định này.

3. “Giấy tờ công” là giấy tờ, tài liệu được lập dưới dạng bản giấy hoặc dữ liệu điện tử bởi cơ quan, tổ chức hoặc cá nhân có thẩm quyền theo pháp luật của nước nơi giấy tờ được lập, trong khi thực hiện chức năng, nhiệm vụ, quyền hạn theo pháp luật của nước đó, bao gồm: giấy tờ do cơ quan hoặc người có thẩm quyền thuộc tòa án hoặc cơ quan tư pháp lập; giấy tờ hành chính; văn bản công chứng; chứng nhận chính thức trên giấy tờ được ký với tư cách cá nhân.

4. “Cơ quan có thẩm quyền cấp chứng nhận Apostille” là cơ quan do Quốc gia thành viên Công ước chỉ định theo quy định của Công ước để cấp chứng nhận Apostille; trong Nghị định này bao gồm cơ quan có thẩm quyền của Việt Nam và của Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam.

5. “Chứng nhận Apostille điện tử (e-Apostille)” là chứng nhận Apostille được cấp dưới dạng dữ liệu điện tử, được ký bằng chữ ký số theo quy định của pháp luật về giao dịch điện tử và đáp ứng các yêu cầu kỹ thuật quy định tại khoản 3 Điều 20 Nghị định này.

6. “Hệ thống thông tin phục vụ công tác cấp và quản lý chứng nhận Apostille” là hệ thống thông tin nghiệp vụ do Bộ Ngoại giao xây dựng, quản lý và vận hành để phục vụ việc tiếp nhận, xử lý, cấp, lưu trữ, tra cứu và xác minh chứng nhận Apostille (sau đây gọi là Hệ thống thông tin Apostille).

7. “Kho quản lý dữ liệu điện tử về chứng nhận Apostille” (sau đây gọi là Kho dữ liệu) là thành phần của Hệ thống thông tin Apostille, dùng để lưu trữ, tra cứu và xác minh thông tin về chứng nhận Apostille đã cấp, được xây dựng, quản lý, vận hành và bảo đảm an toàn dữ liệu theo quy định của pháp luật về giao dịch điện tử, pháp luật về dữ liệu và pháp luật về an ninh mạng.

8. “Sổ đăng ký điện tử (e-Register)” là giao diện tra cứu trực tuyến công khai của Kho dữ liệu, cho phép xác minh tính xác thực của chứng nhận Apostille theo quy định của Công ước.

Điều 4. Nội dung chứng nhận Apostille

1. Chứng nhận Apostille xác nhận nguồn gốc của giấy tờ công, gồm tính xác thực của chữ ký, chức danh, thẩm quyền của người ký và con dấu hoặc dấu đóng trên giấy tờ công (nếu có).

2. Chứng nhận Apostille không xác nhận nội dung, hình thức của giấy tờ công.

Điều 5. Yêu cầu cấp chứng nhận Apostille và thứ tự ưu tiên áp dụng

1. Giấy tờ công của Việt Nam được cấp chứng nhận Apostille theo yêu cầu của cơ quan, tổ chức, cá nhân để sử dụng tại Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam. Việc cấp chứng nhận Apostille là không bắt buộc nếu giấy tờ công đó được miễn hoặc không yêu cầu chứng nhận, xác thực theo điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên hoặc theo pháp luật, thực tiễn đang được áp dụng tại nước nơi giấy tờ được sử dụng. Việc cấp chứng nhận Apostille không thay thế việc công chứng, chứng thực theo quy định của pháp luật trong trường hợp giấy tờ công đó được sử dụng tại Việt Nam.

2. Để được sử dụng tại Việt Nam, giấy tờ công của Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam phải được cấp chứng nhận Apostille, trừ giấy tờ bị từ chối theo quy định tại Điều 26 Nghị định này hoặc trường hợp điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên hoặc pháp luật và thực tiễn tại Việt Nam có quy định miễn hoặc không yêu cầu hợp pháp hóa lãnh sự hoặc thủ tục chứng nhận khác đối với loại giấy tờ đó.

3. Giấy tờ công của Việt Nam để sử dụng tại nước ngoài và giấy tờ công của nước ngoài để sử dụng tại Việt Nam được chứng nhận theo các hình thức sau đây:

a) Chứng nhận Apostille theo quy định tại Nghị định này, áp dụng đối với giấy tờ công lưu thông giữa Việt Nam và Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam;

b) Chứng nhận lãnh sự, hợp pháp hóa lãnh sự theo quy định của pháp luật về chứng nhận lãnh sự, hợp pháp hóa lãnh sự, áp dụng đối với giấy tờ công lưu thông trong quan hệ với quốc gia không phải là Quốc gia thành viên Công ước;

c) Trường hợp điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên có quy định đơn giản hơn hoặc miễn yêu cầu chứng nhận, xác thực giấy tờ công so với hình thức quy định tại điểm a hoặc điểm b khoản này, quy định của điều ước quốc tế đó được ưu tiên áp dụng.

Giấy tờ công đã được chứng nhận lãnh sự, hợp pháp hóa lãnh sự vẫn được cấp chứng nhận Apostille để sử dụng tại Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam và ngược lại.

4. Trường hợp Quốc gia thành viên Công ước phản đối việc gia nhập của Việt Nam hoặc ngược lại theo quy định tại Điều 12 Công ước, Công ước Apostille không có hiệu lực giữa hai nước; giấy tờ công lưu thông giữa hai nước thực hiện theo quy định tại điểm b khoản 3 Điều này.

Chương II

CẤP CHỨNG NHẬN APOSTILLE ĐỐI VỚI GIẤY TỜ CÔNG CỦA VIỆT NAM

Điều 6. Cơ quan có thẩm quyền cấp chứng nhận Apostille của Việt Nam

1. Bộ Ngoại giao là cơ quan có thẩm quyền cấp chứng nhận Apostille của Việt Nam. Bộ trưởng Bộ Ngoại giao quy định cụ thể cơ quan thực hiện việc cấp chứng nhận Apostille (sau đây gọi chung là Cơ quan cấp Apostille).

2. Bộ Ngoại giao thông báo về Cơ quan cấp Apostille và các thay đổi liên quan cho cơ quan lưu chiểu Công ước thông qua đường ngoại giao.

3. Bộ trưởng Bộ Ngoại giao quy định tiêu chí, điều kiện, lộ trình phân cấp thẩm quyền cấp chứng nhận Apostille cho Ủy ban nhân dân cấp tỉnh và trách nhiệm của Ủy ban nhân dân cấp tỉnh được phân cấp theo quy định của pháp luật về tổ chức Chính phủ và pháp luật về tổ chức chính quyền địa phương.

Điều 7. Đối tượng đề nghị cấp chứng nhận Apostille

1. Cơ quan, tổ chức, cá nhân có thể đề nghị cấp chứng nhận Apostille đối với giấy tờ, tài liệu của mình hoặc của người khác mà không cần giấy ủy quyền.

2. Người đề nghị cấp chứng nhận Apostille cho giấy tờ, tài liệu của người khác chịu trách nhiệm trước pháp luật về tính hợp pháp của việc nộp, sử dụng giấy tờ, tài liệu và tuân thủ quy định của pháp luật về bảo vệ dữ liệu cá nhân và pháp luật có liên quan.

Điều 8. Ngôn ngữ, địa điểm cấp chứng nhận Apostille

1. Ngôn ngữ sử dụng để cấp chứng nhận Apostille là tiếng Việt và tiếng Anh; tiêu đề “Apostille (Convention de La Haye du 5 octobre 1961)” được thể hiện bằng tiếng Pháp theo quy định tại Điều 4 Công ước Apostille.

2. Việc cấp chứng nhận Apostille được thực hiện tại trụ sở của Cơ quan cấp Apostille.

Điều 9. Phí đối với việc cấp chứng nhận Apostille

1. Người đề nghị cấp chứng nhận Apostille phải nộp phí chứng nhận lãnh sự và hợp pháp hóa lãnh sự tại thời điểm nộp hồ sơ theo quy định của pháp luật về phí và lệ phí.

2. Trường hợp nộp hồ sơ và nhận kết quả qua dịch vụ bưu chính, người đề nghị cấp chứng nhận Apostille phải trả cước phí bưu chính.

3. Trường hợp nộp hồ sơ trực tuyến, việc thanh toán phí được thực hiện theo quy định của pháp luật về thực hiện thủ tục hành chính trên môi trường điện tử.

4. Trường hợp hồ sơ đã bị trả lại do hết thời hạn xác minh và người đề nghị nộp lại hồ sơ theo quy định tại điểm c khoản 5 Điều 15 Nghị định này, hồ sơ nộp lại được tiếp tục giải quyết trên cơ sở hồ sơ và phí đã nộp.

Điều 10. Giấy tờ công của Việt Nam thuộc phạm vi cấp chứng nhận Apostille

Giấy tờ công của Việt Nam thuộc phạm vi cấp chứng nhận Apostille bao gồm:

1. Giấy tờ do cơ quan, người có thẩm quyền trong hoạt động tố tụng, thi hành án lập, ban hành hoặc chứng nhận theo quy định của pháp luật qua các thời kỳ, gồm: bản án, quyết định, văn bản tố tụng của Tòa án nhân dân, Viện kiểm sát nhân dân, Cơ quan điều tra; quyết định, biên bản, văn bản của cơ quan quản lý thi hành án dân sự, cơ quan thi hành án dân sự, cơ quan thi hành án hình sự; vi bằng và các văn bản khác do Thừa phát lại, Thừa hành viên lập khi thực hiện nhiệm vụ.

2. Giấy tờ hành chính do cơ quan, tổ chức hoặc người có thẩm quyền lập, cấp hoặc chứng nhận theo quy định của pháp luật, gồm: giấy tờ về hộ tịch, quốc tịch, nuôi con nuôi; phiếu lý lịch tư pháp; văn bằng, chứng chỉ, giấy xác nhận kết quả học tập, nghiên cứu; giấy khám sức khỏe, giấy chứng nhận y tế, kết luận giám định y khoa và giấy tờ y tế khác; các giấy tờ hành chính khác do cơ quan nhà nước hoặc tổ chức được Nhà nước phân cấp, ủy quyền thực hiện dịch vụ công cấp hoặc chứng nhận theo quy định của pháp luật.

3. Văn bản công chứng theo quy định của pháp luật về công chứng qua các thời kỳ, gồm hợp đồng, giao dịch, bản dịch và bản sao đã được công chứng.

4. Văn bản chứng thực do cơ quan, tổ chức hoặc người có thẩm quyền thực hiện theo quy định của pháp luật chứng thực, gồm: chứng thực bản sao từ bản chính; chứng thực chữ ký, chứng thực chữ ký người dịch; chứng thực hợp đồng, giao dịch.

5. Các giấy tờ công khác do cơ quan, tổ chức hoặc người có thẩm quyền của Việt Nam lập, cấp hoặc chứng nhận trong khi thực hiện chức năng, nhiệm vụ theo quy định của pháp luật cũng thuộc phạm vi cấp chứng nhận Apostille, trừ trường hợp quy định tại khoản 1 Điều 11 Nghị định này.

Điều 11. Giấy tờ không thuộc phạm vi hoặc không đủ điều kiện cấp chứng nhận Apostille

1. Các giấy tờ sau đây không thuộc phạm vi cấp chứng nhận Apostille:

a) Giấy tờ do viên chức ngoại giao hoặc viên chức lãnh sự của Việt Nam lập, cấp trong quá trình thực hiện chức năng ngoại giao, lãnh sự theo quy định của pháp luật Việt Nam và pháp luật quốc tế;

b) Giấy tờ hành chính liên quan trực tiếp đến hoạt động thương mại hoặc hải quan, trừ giấy tờ mà trước ngày Công ước Apostille có hiệu lực đối với nước Cộng hòa xã hội chủ nghĩa Việt Nam thuộc diện được chứng nhận lãnh sự theo quy định của pháp luật về chứng nhận lãnh sự, hợp pháp hóa lãnh sự. Bộ Ngoại giao xác định cụ thể giấy tờ quy định tại điểm này tại danh mục quy định tại khoản 7 Điều 30 Nghị định này;

c) Giấy tờ không do cơ quan, tổ chức hoặc người có thẩm quyền lập, cấp hoặc chứng nhận trong khi thực hiện chức năng, nhiệm vụ, quyền hạn theo quy định của pháp luật và chưa được công chứng, chứng thực;

d) Giấy tờ công do cơ quan, tổ chức hoặc người có thẩm quyền của nước ngoài lập, cấp hoặc chứng nhận.

2. Các giấy tờ sau đây không đủ điều kiện cấp chứng nhận Apostille:

a) Giấy tờ bị tẩy xóa, sửa chữa hoặc làm sai lệch nội dung trái phép;

b) Giấy tờ có căn cứ xác định là giả mạo;

c) Giấy tờ mà kết quả xác minh theo quy định tại Điều 15 Nghị định này xác định cơ quan có thẩm quyền không cấp giấy tờ đó, hoặc con dấu, chữ ký, chức danh, thẩm quyền trên giấy tờ không xác thực, không đúng thẩm quyền, không phải con dấu gốc, chữ ký gốc hoặc không phù hợp với mẫu đã đăng ký;

d) Giấy tờ công đã bị tuyên bố vô hiệu, thu hồi, hủy bỏ hoặc bị xác định là được cấp trái pháp luật theo quyết định, bản án hoặc văn bản có hiệu lực pháp luật của cơ quan nhà nước có thẩm quyền;

đ) Giấy tờ công thuộc diện không được đưa ra nước ngoài theo quy định của pháp luật Việt Nam;

e) Giấy tờ công của Việt Nam ở dạng dữ liệu điện tử không có chữ ký số hợp lệ của cơ quan, tổ chức, người có thẩm quyền hoặc chữ ký số không đáp ứng định dạng kỹ thuật theo quy định của pháp luật về giao dịch điện tử.

Điều 12. Hồ sơ và phương thức nộp hồ sơ đề nghị cấp chứng nhận Apostille

Hồ sơ đề nghị cấp chứng nhận Apostille được lập thành 01 bộ. Thành phần hồ sơ theo phương thức nộp được quy định như sau:

1. Nộp trực tiếp tại Bộ phận Một cửa hoặc qua dịch vụ bưu chính:

a) Tờ khai đề nghị cấp chứng nhận Apostille theo mẫu do Bộ trưởng Bộ Ngoại giao ban hành;

b) Bản chính giấy tờ công đề nghị cấp chứng nhận Apostille; trường hợp giấy tờ công là bản sao có chứng thực hoặc bản dịch có chứng thực theo quy định của pháp luật về công chứng, chứng thực thì nộp bản sao, bản dịch đó. Giấy tờ công phải được giữ nguyên vẹn, không bị tháo rời, tẩy xóa hoặc làm thay đổi nội dung.

2. Nộp trực tuyến toàn trình trên Cổng Dịch vụ công quốc gia hoặc Ứng dụng định danh quốc gia:

a) Tờ khai theo biểu mẫu điện tử tương tác;

b) Bản điện tử của giấy tờ công có chữ ký số hợp lệ của cơ quan, tổ chức, người có thẩm quyền theo quy định của pháp luật về giao dịch điện tử.

Điều 13. Tiếp nhận hồ sơ đề nghị cấp chứng nhận Apostille

Việc tiếp nhận hồ sơ đề nghị cấp chứng nhận Apostille được thực hiện theo quy định của pháp luật về thực hiện thủ tục hành chính theo cơ chế một cửa, một cửa liên thông và pháp luật về thực hiện thủ tục hành chính trên môi trường điện tử, theo trình tự sau đây:

1. Cơ quan tiếp nhận xác thực danh tính của người đề nghị thông qua tài khoản định danh điện tử. Trường hợp hồ sơ được nộp trực tiếp hoặc qua dịch vụ bưu chính mà không khai thác được thông tin định danh hoặc thông tin khai thác được chưa đầy đủ thì thực hiện kiểm tra, đối chiếu trên cơ sở giấy tờ tùy thân hoặc giấy tờ chứng minh tư cách pháp nhân của tổ chức do người đề nghị xuất trình hoặc nộp bổ sung.

2. Cơ quan tiếp nhận kiểm tra tính đầy đủ, hợp lệ của hồ sơ và đối chiếu thông tin trên giấy tờ công với thông tin trong tờ khai đề nghị cấp chứng nhận Apostille.

3. Trường hợp phát hiện giấy tờ công có dấu hiệu giả mạo, bị tẩy xóa hoặc sửa chữa trái phép, cơ quan tiếp nhận ghi chú tại hồ sơ để xử lý theo quy định tại Điều 14 và Điều 15 Nghị định này.

4. Trường hợp hồ sơ chưa đầy đủ hoặc chưa hợp lệ, cơ quan tiếp nhận hướng dẫn người đề nghị bổ sung, hoàn thiện hồ sơ một lần. Trong thời hạn 07 ngày làm việc kể từ ngày nhận được hướng dẫn, người đề nghị có trách nhiệm bổ sung, hoàn thiện hồ sơ; thời gian này không tính vào thời hạn giải quyết.

Điều 14. Giải quyết hồ sơ đề nghị cấp chứng nhận Apostille

1. Cơ quan cấp Apostille đối chiếu chữ ký, con dấu, chức danh và thẩm quyền trên giấy tờ công với thông tin, dữ liệu về con dấu, chữ ký, chức danh và thẩm quyền quy định tại Điều 23 Nghị định này.

2. Việc xử lý kết quả đối chiếu được thực hiện như sau:

a) Trường hợp kết quả đối chiếu phù hợp, Cơ quan cấp Apostille cấp chứng nhận Apostille theo quy định tại Điều 16 Nghị định này;

b) Trường hợp hồ sơ thuộc một trong các trường hợp phải xác minh quy định tại khoản 1 Điều 15 Nghị định này, Cơ quan cấp Apostille thực hiện xác minh theo quy định tại Điều 15 Nghị định này;

c) Trường hợp kết quả đối chiếu không phù hợp mà có căn cứ xác định thông tin, dữ liệu quy định tại Điều 23 Nghị định này chưa được cập nhật đầy đủ hoặc có sai lệch, Cơ quan cấp Apostille thực hiện xác minh theo quy định tại Điều 15 Nghị định này trước khi quyết định việc cấp chứng nhận Apostille. Đối với các trường hợp không phù hợp khác mà không thuộc trường hợp phải xác minh quy định tại khoản 1 Điều 15 Nghị định này, Cơ quan cấp Apostille từ chối cấp chứng nhận Apostille theo quy định tại Điều 18 Nghị định này;

d) Trường hợp giấy tờ công là bản sao có chứng thực hoặc bản dịch có chứng thực chữ ký người dịch, khi có căn cứ hợp lý nghi ngờ về tính xác thực của bản sao hoặc bản dịch, Cơ quan cấp Apostille ưu tiên khai thác, đối chiếu dữ liệu điện tử về công chứng, chứng thực theo quy định của pháp luật về công chứng, chứng thực; trường hợp không khai thác được thì yêu cầu người đề nghị xuất trình bản gốc để kiểm tra, đối chiếu.

3. Việc tiếp nhận, giải quyết và trả kết quả được cập nhật trên Hệ thống thông tin giải quyết thủ tục hành chính và đồng bộ với Cổng Dịch vụ công quốc gia theo quy định của pháp luật về thực hiện thủ tục hành chính theo cơ chế một cửa, một cửa liên thông.

Điều 15. Xác minh tính xác thực giấy tờ công

1. Cơ quan cấp Apostille thực hiện xác minh tính xác thực của giấy tờ công khi thuộc một trong các trường hợp sau đây:

a) Chữ ký, con dấu, chức danh và thẩm quyền trên giấy tờ công chưa có trong thông tin, dữ liệu về con dấu, chữ ký, chức danh và thẩm quyền quy định tại Điều 23 Nghị định này hoặc chưa được giới thiệu chính thức tới Bộ Ngoại giao;

b) Có căn cứ hợp lý nghi ngờ về tính xác thực của giấy tờ, bao gồm cả trường hợp giấy tờ có dấu hiệu giả mạo, bị tẩy xóa hoặc sửa chữa trái phép;

c) Có thông tin, dấu hiệu hoặc phản ánh về việc giấy tờ công thuộc diện không được phép đưa ra nước ngoài hoặc bị hạn chế sử dụng tại nước ngoài theo quy định của pháp luật chuyên ngành.

2. Khi hồ sơ thuộc trường hợp quy định tại khoản 1 Điều này, Cơ quan cấp Apostille tạm dừng việc giải quyết đối với giấy tờ có nghi vấn, thông báo cho người đề nghị về việc xác minh, nêu rõ lý do, thời gian dự kiến xác minh và gửi văn bản đề nghị xác minh như sau:

a) Đối với trường hợp quy định tại điểm a và điểm b khoản 1 Điều này: gửi đến cơ quan, tổ chức đã cấp giấy tờ hoặc cơ quan quản lý nhà nước cấp trên của cơ quan đó để xác nhận tính xác thực của giấy tờ, con dấu, chữ ký, chức danh và thẩm quyền; không yêu cầu người đề nghị nộp thêm tài liệu;

b) Đối với trường hợp quy định tại điểm c khoản 1 Điều này: gửi đến cơ quan nhà nước có thẩm quyền quản lý lĩnh vực liên quan để xác nhận tình trạng lưu hành của giấy tờ.

3. Cơ quan được đề nghị xác minh có trách nhiệm trả lời bằng văn bản trong thời hạn 05 ngày làm việc kể từ ngày nhận được đề nghị; trường hợp phức tạp, thời hạn không quá 10 ngày làm việc và phải thông báo lý do cho cơ quan đã gửi đề nghị.

4. Ngay sau khi nhận được kết quả xác minh bằng văn bản, Cơ quan cấp Apostille xử lý như sau:

a) Trường hợp kết quả xác nhận tính xác thực và giấy tờ đủ điều kiện lưu hành, Cơ quan cấp Apostille cấp chứng nhận Apostille theo quy định tại Điều 16 Nghị định này;

b) Trường hợp kết quả xác nhận giấy tờ không xác thực, Cơ quan cấp Apostille từ chối cấp chứng nhận Apostille và trả lại giấy tờ cho người đề nghị, thông báo theo quy định tại Điều 18 Nghị định này; trường hợp giấy tờ có yếu tố giả mạo hoặc được cấp bởi cơ quan, tổ chức không có thẩm quyền, Cơ quan cấp Apostille từ chối cấp và thực hiện lưu giữ, chuyển hồ sơ theo quy định tại khoản 4 Điều 18 Nghị định này;

c) Trường hợp giấy tờ là xác thực nhưng thuộc diện không được phép đưa ra nước ngoài hoặc bị hạn chế sử dụng tại nước ngoài theo quy định của pháp luật chuyên ngành, Cơ quan cấp Apostille từ chối cấp chứng nhận Apostille, thông báo theo quy định tại Điều 18 Nghị định này và chuyển hồ sơ cho cơ quan nhà nước có thẩm quyền quản lý lĩnh vực liên quan để xử lý theo quy định của pháp luật chuyên ngành.

5. Trường hợp hết thời hạn xác minh mà không nhận được kết quả trả lời, việc xử lý được thực hiện như sau:

a) Sau 15 ngày kể từ ngày gửi văn bản đề nghị xác minh mà chưa nhận được trả lời, Cơ quan cấp Apostille có trách nhiệm đôn đốc cơ quan được đề nghị xác minh;

b) Sau 30 ngày kể từ ngày gửi văn bản đề nghị xác minh mà không nhận được kết quả trả lời, Cơ quan cấp Apostille thông báo bằng văn bản cho người đề nghị về quá trình xác minh và trả lại hồ sơ kèm theo giấy tờ công;

c) Trường hợp nhận được kết quả xác minh sau thời hạn quy định tại điểm b khoản này và hồ sơ đã được trả lại, Cơ quan cấp Apostille thông báo cho người đề nghị để nộp lại hồ sơ theo quy định tại Điều 12 Nghị định này.

Điều 16. Cấp chứng nhận Apostille và trả kết quả

1. Chứng nhận Apostille bằng giấy thể hiện đầy đủ nội dung quy định tại Điều 20 Nghị định này theo hình thức do Bộ trưởng Bộ Ngoại giao quy định, được đóng hoặc dán trực tiếp trên giấy tờ công hoặc thể hiện trên một tờ rời đính kèm, gắn liền và không thể tách rời với giấy tờ công.

2. Chứng nhận Apostille điện tử được tích hợp hoặc gắn liền với giấy tờ công điện tử, bảo đảm tính toàn vẹn theo các yêu cầu kỹ thuật quy định tại khoản 3 Điều 20 Nghị định này.

3. Việc trả kết quả cho người đề nghị được thực hiện theo phương thức đã đăng ký khi nộp hồ sơ: trực tiếp tại Bộ phận Một cửa; qua dịch vụ bưu chính; hoặc bằng bản điện tử gửi đến Kho quản lý dữ liệu điện tử của tổ chức, cá nhân trên Hệ thống thông tin giải quyết thủ tục hành chính của Bộ Ngoại giao và Cổng Dịch vụ công quốc gia theo quy định của pháp luật hoặc địa chỉ thư điện tử của người đề nghị. Việc cấp, quản lý mã số kết quả giải quyết và lưu trữ kết quả điện tử được thực hiện theo quy định của pháp luật về thực hiện thủ tục hành chính theo cơ chế một cửa, một cửa liên thông.

4. Ngay sau khi cấp chứng nhận Apostille, Cơ quan cấp Apostille cập nhật thông tin vào Kho dữ liệu theo quy định tại Điều 21 Nghị định này.

Điều 17. Thời hạn giải quyết

1. Thời hạn cấp chứng nhận Apostille được tính từ ngày nhận đủ hồ sơ hợp lệ và được xác định theo số lượng giấy tờ công đề nghị cấp chứng nhận Apostille trong một bộ hồ sơ và phương thức nộp hồ sơ. Đối với hồ sơ đề nghị cấp chứng nhận Apostille bằng giấy nộp theo quy định tại khoản 1 Điều 12 Nghị định này, thời hạn giải quyết như sau:

a) 01 ngày làm việc đối với hồ sơ có từ 01 đến 04 giấy tờ công;

b) 02 ngày làm việc đối với hồ sơ có từ 05 đến 09 giấy tờ công;

c) 04 ngày làm việc đối với hồ sơ có từ 10 giấy tờ công trở lên.

2. Đối với hồ sơ đề nghị cấp chứng nhận Apostille điện tử nộp trực tuyến toàn trình theo quy định tại khoản 2 Điều 12 Nghị định này, thời hạn giải quyết như sau:

a) Trong ngày làm việc đối với hồ sơ có từ 01 đến 04 giấy tờ công được tiếp nhận trước thời điểm theo quy định của pháp luật về thực hiện thủ tục hành chính trên môi trường điện tử; trường hợp tiếp nhận sau thời điểm đó thì tính vào ngày làm việc tiếp theo;

b) 01 ngày làm việc đối với hồ sơ có từ 05 đến 09 giấy tờ công;

c) 03 ngày làm việc đối với hồ sơ có từ 10 giấy tờ công trở lên.

Thời điểm bắt đầu tính thời hạn giải quyết quy định tại khoản này được xác định theo quy định của pháp luật về thực hiện thủ tục hành chính trên môi trường điện tử.

3. Thời hạn quy định tại khoản 1 và khoản 2 Điều này không bao gồm thời gian xác minh theo quy định tại Điều 15 Nghị định này.

4. Trường hợp không thể giải quyết hồ sơ trong thời hạn quy định tại khoản 1 và khoản 2 Điều này vì lý do khách quan, sự cố kỹ thuật hệ thống hoặc trường hợp bất khả kháng theo quy định của pháp luật, không thuộc trường hợp xác minh quy định tại Điều 15 Nghị định này, Cơ quan cấp Apostille phải thông báo bằng văn bản cho người đề nghị trước ngày hết hạn, nêu rõ lý do và thời hạn giải quyết mới theo quy định của pháp luật về thực hiện thủ tục hành chính theo cơ chế một cửa, một cửa liên thông. Việc gia hạn thời gian giải quyết chỉ được thực hiện một lần.

Điều 18. Giải quyết các trường hợp từ chối và lưu giữ giấy tờ

1. Cơ quan cấp Apostille từ chối cấp chứng nhận Apostille trong các trường hợp sau đây:

a) Giấy tờ không thuộc phạm vi cấp chứng nhận Apostille theo quy định tại khoản 1 Điều 11 Nghị định này;

b) Giấy tờ công không đủ điều kiện cấp chứng nhận Apostille theo quy định tại khoản 2 Điều 11 Nghị định này;

c) Hết thời hạn quy định tại khoản 4 Điều 13 Nghị định này mà hồ sơ vẫn không đáp ứng yêu cầu quy định tại Điều 12 Nghị định này;

d) Kết quả đối chiếu theo quy định tại khoản 1 Điều 14 Nghị định này xác nhận chữ ký, con dấu, chức danh hoặc thẩm quyền trên giấy tờ công không phù hợp với thông tin, dữ liệu về con dấu, chữ ký, chức danh và thẩm quyền quy định tại Điều 23 Nghị định này.

2. Khi từ chối cấp chứng nhận Apostille, Cơ quan cấp Apostille phải thông báo cho người đề nghị theo quy định của pháp luật về thực hiện thủ tục hành chính theo cơ chế một cửa, một cửa liên thông trong thời hạn quy định tại khoản 1 và khoản 2 Điều 17 Nghị định này; đối với trường hợp từ chối quy định tại điểm c khoản 1 Điều này, thời hạn thông báo là 01 ngày làm việc kể từ ngày hết thời hạn quy định tại khoản 4 Điều 13 Nghị định này. Thông báo phải nêu rõ lý do và căn cứ áp dụng. Bản chính giấy tờ công đã tiếp nhận được trả lại cho người đề nghị kèm theo thông báo từ chối, trừ trường hợp quy định tại khoản 4 Điều này.

3. Cơ quan cấp Apostille hướng dẫn người đề nghị thực hiện thủ tục phù hợp theo quy định của pháp luật, như thủ tục chứng nhận lãnh sự, hợp pháp hóa lãnh sự theo quy định của pháp luật về chứng nhận lãnh sự, hợp pháp hóa lãnh sự đối với trường hợp giấy tờ cần sử dụng tại quốc gia không phải là Quốc gia thành viên Công ước.

4. Trường hợp kết quả xác minh bằng văn bản xác nhận giấy tờ có yếu tố giả mạo hoặc được cấp bởi cơ quan, tổ chức không có thẩm quyền, Cơ quan cấp Apostille thực hiện:

a) Lưu giữ toàn bộ giấy tờ công và tài liệu liên quan trong hồ sơ đề nghị; lập biên bản lưu giữ có chữ ký của người đề nghị hoặc ghi rõ lý do người đề nghị không ký;

b) Thông báo bằng văn bản cho người đề nghị về việc lưu giữ giấy tờ và việc chuyển hồ sơ cho cơ quan có thẩm quyền xử lý, nêu rõ lý do;

c) Trong thời hạn 05 ngày làm việc kể từ khi lập biên bản lưu giữ, thông báo bằng văn bản cho cơ quan có thẩm quyền theo quy định của pháp luật nơi Cơ quan cấp Apostille đặt trụ sở để đến tiếp nhận toàn bộ giấy tờ đang lưu giữ và biên bản lưu giữ nhằm xem xét, xử lý theo quy định của pháp luật.

Điều 19. Hủy bỏ, thu hồi và cấp đổi chứng nhận Apostille đã cấp

1. Cơ quan đã cấp chứng nhận Apostille hủy bỏ chứng nhận Apostille trong các trường hợp sau đây:

a) Hồ sơ đề nghị cấp chứng nhận Apostille bị xác định có yếu tố giả mạo trên cơ sở kết quả xác minh theo quy định tại Điều 15 Nghị định này hoặc kết luận của cơ quan có thẩm quyền;

b) Giấy tờ công đã được cấp chứng nhận Apostille bị cơ quan có thẩm quyền xác định được cấp trái pháp luật hoặc không có giá trị pháp lý tại thời điểm cấp chứng nhận Apostille.

Chứng nhận Apostille bị hủy bỏ không có giá trị pháp lý kể từ thời điểm được cấp.

2. Trừ trường hợp quy định tại khoản 1 Điều này, trường hợp có sai sót trong việc cấp chứng nhận Apostille không do lỗi của người đề nghị dẫn đến giấy tờ không thể sử dụng ở nước ngoài thì Cơ quan đã cấp chứng nhận Apostille thu hồi và cấp đổi theo đề nghị của người đó.

Chứng nhận Apostille bị thu hồi chấm dứt hiệu lực kể từ thời điểm thông tin về việc thu hồi được đăng tải công khai trên Sổ đăng ký điện tử của Việt Nam.

Chứng nhận Apostille cấp đổi có số và số quản lý mới theo quy định tại điểm h và điểm l khoản 1 Điều 20 Nghị định này. Việc cấp đổi được thực hiện trên cơ sở hồ sơ và phí đã nộp. Trường hợp giấy tờ công đã gắn kèm không thể tái sử dụng để cấp đổi, Cơ quan cấp Apostille hướng dẫn người đề nghị cung cấp bản chính khác hoặc bản sao có chứng thực, bản dịch có chứng thực của chính giấy tờ công đó và không yêu cầu nộp lại hồ sơ đề nghị. Việc đề nghị cấp đổi được thực hiện trực tiếp tại Bộ phận Một cửa, qua dịch vụ bưu chính hoặc theo phương thức trực tuyến; việc thu hồi và cấp đổi được thực hiện ngay sau khi nhận được đề nghị.

3. Cơ quan cấp Apostille thực hiện việc hủy bỏ hoặc thu hồi và cấp đổi chứng nhận Apostille theo quy định tại khoản 1 hoặc khoản 2 Điều này. Chậm nhất trong ngày làm việc tiếp theo kể từ ngày có quyết định hủy bỏ hoặc thu hồi và cấp đổi, Cơ quan cấp Apostille cập nhật tình trạng hiệu lực của chứng nhận Apostille trong Kho dữ liệu theo quy định tại Điều 21 Nghị định này, đăng tải công khai trên Sổ đăng ký điện tử của Việt Nam và thông báo cho người đã được cấp chứng nhận Apostille về việc hủy bỏ hoặc thu hồi và cấp đổi bằng phương thức phù hợp. Đối với chứng nhận Apostille điện tử, việc hủy hiệu lực kết quả giải quyết thủ tục hành chính điện tử được thực hiện theo quy định của pháp luật về thực hiện thủ tục hành chính trên môi trường điện tử. Trường hợp có căn cứ xác định chứng nhận Apostille đã được sử dụng hoặc đang trong quá trình xác minh tại một Quốc gia thành viên Công ước, Bộ Ngoại giao thông báo việc hủy bỏ hoặc thu hồi và cấp đổi cho cơ quan có thẩm quyền của Quốc gia thành viên đó bằng văn bản hoặc phương thức điện tử; trường hợp cần thiết, việc thông báo được thực hiện qua kênh ngoại giao.

Trên cơ sở hoạt động kiểm tra hoặc quản lý nhà nước về chứng nhận Apostille, trường hợp Cơ quan cấp Apostille chưa thực hiện việc hủy bỏ hoặc thu hồi và cấp đổi theo quy định tại khoản 1 hoặc khoản 2 Điều này, Bộ trưởng Bộ Ngoại giao ban hành văn bản yêu cầu Cơ quan cấp Apostille thực hiện trong thời hạn 05 ngày làm việc kể từ ngày nhận được yêu cầu. Trường hợp quá thời hạn nêu trên mà Cơ quan cấp Apostille không thực hiện, Bộ trưởng Bộ Ngoại giao trực tiếp quyết định hủy bỏ hoặc thu hồi và cấp đổi và chịu trách nhiệm về quyết định của mình.

4. Việc hủy bỏ hoặc thu hồi và cấp đổi chứng nhận Apostille không làm ảnh hưởng đến việc xử lý hệ quả đối với giao dịch đã được xác lập tại quốc gia tiếp nhận giấy tờ theo pháp luật của quốc gia đó. Tại Việt Nam, quyền và lợi ích hợp pháp của người thứ ba ngay tình được bảo vệ theo quy định của pháp luật dân sự.

Điều 20. Mẫu chứng nhận Apostille của Việt Nam

1. Chứng nhận Apostille có tiêu đề và ngôn ngữ thể hiện theo quy định tại khoản 1 Điều 8 Nghị định này, bao gồm đầy đủ các nội dung sau đây:

a) Tên nước nơi cấp chứng nhận Apostille;

b) Họ và tên người ký giấy tờ công;

c) Chức danh của người ký giấy tờ công;

d) Tên cơ quan có con dấu hoặc dấu đóng trên giấy tờ công trong trường hợp giấy tờ công không có chữ ký;

đ) Nơi cấp chứng nhận Apostille;

e) Ngày cấp chứng nhận Apostille;

g) Tên cơ quan cấp chứng nhận Apostille;

h) Số của chứng nhận Apostille;

i) Con dấu hoặc dấu đóng của cơ quan cấp chứng nhận Apostille;

k) Chữ ký của người có thẩm quyền của cơ quan cấp chứng nhận Apostille;

l) Số quản lý.

2. Chứng nhận Apostille được tích hợp mã QR liên kết đến Kho dữ liệu quy định tại Điều 21 Nghị định này, cho phép tra cứu, xác minh thông tin về chứng nhận Apostille đã cấp thông qua Sổ đăng ký điện tử.

3. Ngoài các yêu cầu quy định tại khoản 1 và khoản 2 Điều này, chứng nhận Apostille điện tử phải đáp ứng các yêu cầu kỹ thuật sau đây:

a) Được ký bằng chữ ký số chuyên dùng công vụ của Cơ quan cấp Apostille theo quy định của pháp luật về giao dịch điện tử và pháp luật về cơ yếu;

b) Có dấu thời gian xác định thời điểm phát hành chứng nhận Apostille;

c) Được gắn liền và không thể tách rời với giấy tờ công điện tử; bảo đảm tính toàn vẹn, không thể thay đổi nội dung sau khi phát hành.

4. Mẫu chứng nhận Apostille của Việt Nam phải thể hiện đầy đủ các nội dung quy định tại khoản 1 và khoản 2 Điều này; đối với chứng nhận Apostille điện tử, đáp ứng thêm các yêu cầu kỹ thuật quy định tại khoản 3 Điều này; đồng thời bảo đảm phù hợp với Mẫu Chứng nhận kèm theo Công ước. Bộ trưởng Bộ Ngoại giao quy định cụ thể về hình thức trình bày của mẫu chứng nhận Apostille.

Điều 21. Kho quản lý dữ liệu điện tử về chứng nhận Apostille và Sổ đăng ký điện tử

1. Kho dữ liệu quy định tại khoản 7 Điều 3 Nghị định này do Bộ Ngoại giao quản lý và vận hành. Sổ đăng ký điện tử quy định tại khoản 8 Điều 3 Nghị định này đáp ứng yêu cầu về đăng ký và xác minh chứng nhận Apostille theo quy định của Công ước.

2. Khi cấp chứng nhận Apostille, Cơ quan cấp Apostille cập nhật các thông tin sau đây vào Kho dữ liệu:

a) Số và ngày cấp chứng nhận Apostille;

b) Họ và tên, chức danh của người ký giấy tờ công hoặc tên cơ quan có con dấu trên giấy tờ công;

c) Hình thức chứng nhận Apostille bằng giấy hoặc điện tử;

d) Tình trạng hiệu lực của chứng nhận Apostille;

đ) Bản điện tử của chứng nhận Apostille đã cấp;

e) Số quản lý của chứng nhận Apostille.

3. Sổ đăng ký điện tử bảo đảm khả năng tra cứu công khai, liên tục 24 giờ trong ngày và 07 ngày trong tuần bằng số chứng nhận Apostille hoặc quét mã QR trên chứng nhận Apostille; không yêu cầu đăng ký tài khoản; hiển thị đầy đủ các thông tin quy định tại khoản 2 Điều này. Giao diện tra cứu được cung cấp tối thiểu bằng tiếng Việt và tiếng Anh.

4. Thông tin trong Kho dữ liệu được lưu trữ theo quy định của pháp luật về lưu trữ, bảo đảm đáp ứng yêu cầu tra cứu, xác minh chứng nhận Apostille theo quy định của Công ước Apostille; việc bảo mật, dự phòng, khai thác, chia sẻ và bảo đảm an toàn thông tin thực hiện theo quy định của pháp luật về dữ liệu, an ninh mạng và bảo vệ dữ liệu cá nhân.

Điều 22. Hồ sơ lưu trữ việc cấp chứng nhận Apostille

1. Thành phần hồ sơ giấy phát sinh trong quá trình cấp chứng nhận Apostille được thực hiện theo quy định của pháp luật về chứng nhận lãnh sự, hợp pháp hóa lãnh sự; chế độ bảo quản và thời hạn lưu trữ hồ sơ thực hiện theo quy định của pháp luật về lưu trữ.

2. Việc lưu trữ, bảo quản thông tin về chứng nhận Apostille điện tử được thực hiện theo quy định tại Điều 21 Nghị định này.

Điều 23. Thông tin, dữ liệu về con dấu, chữ ký, chức danh và thẩm quyền của người có thẩm quyền ký giấy tờ công của Việt Nam

1. Thông tin, dữ liệu về con dấu, chữ ký, chức danh và thẩm quyền của người có thẩm quyền ký giấy tờ công của Việt Nam trong hệ thống thông tin về chứng nhận lãnh sự, hợp pháp hóa lãnh sự được kế thừa, cập nhật vào Hệ thống thông tin Apostille để phục vụ việc đối chiếu, xác minh khi cấp chứng nhận Apostille.

2. Cơ quan cấp Apostille khai thác và sử dụng dữ liệu mẫu con dấu, chữ ký, chức danh và thẩm quyền của người có thẩm quyền ký giấy tờ, tài liệu theo quy định của pháp luật về chứng nhận lãnh sự, hợp pháp hóa lãnh sự để đối chiếu, xác minh nguồn gốc của giấy tờ công trước khi cấp chứng nhận Apostille.

3. Việc giới thiệu, cập nhật và quản lý mẫu con dấu, chữ ký, chức danh và thẩm quyền của người có thẩm quyền ký giấy tờ công được thực hiện theo quy định của pháp luật về chứng nhận lãnh sự, hợp pháp hóa lãnh sự.

Điều 24. Xác minh chứng nhận Apostille do Việt Nam cấp theo yêu cầu từ nước ngoài

1. Trường hợp cơ quan có thẩm quyền của Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam gửi yêu cầu xác minh về chứng nhận Apostille do Việt Nam cấp, Cơ quan cấp Apostille đã cấp chứng nhận có trách nhiệm xác minh và trả lời về tính xác thực của chứng nhận Apostille trên cơ sở thông tin lưu trong Sổ đăng ký điện tử hoặc hồ sơ lưu.

2. Việc xác minh theo Điều này nhằm xác nhận tính xác thực của chứng nhận Apostille và thông tin về việc cấp chứng nhận, không bao gồm việc xác nhận nội dung của giấy tờ công đã được cấp chứng nhận Apostille.

3. Yêu cầu xác minh và kết quả xác minh được gửi, nhận trực tiếp giữa các cơ quan có thẩm quyền bằng văn bản hoặc phương thức điện tử; trường hợp cần thiết, có thể thực hiện qua kênh ngoại giao.

4. Thời hạn trả lời yêu cầu xác minh là 05 ngày làm việc kể từ ngày nhận được yêu cầu xác minh; trường hợp cần xác minh bổ sung hoặc có yếu tố phức tạp, thời hạn này là không quá 10 ngày làm việc.

5. Cơ quan cấp Apostille thông báo kết quả xác minh đã thực hiện cho Bộ Ngoại giao để theo dõi, tổng hợp phục vụ công tác quản lý nhà nước về thực thi Công ước Apostille.

Chương III

MIỄN HỢP PHÁP HÓA LÃNH SỰ VÀ SỬ DỤNG TẠI VIỆT NAM ĐỐI VỚI GIẤY TỜ CÔNG CỦA QUỐC GIA THÀNH VIÊN CÔNG ƯỚC

Điều 25. Nguyên tắc miễn hợp pháp hóa lãnh sự và sử dụng giấy tờ công có chứng nhận Apostille

1. Trong Chương này, Quốc gia thành viên Công ước được hiểu là Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam, trừ trường hợp có quy định khác.

2. Giấy tờ công của Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam đã được cấp chứng nhận Apostille bởi cơ quan có thẩm quyền của Quốc gia thành viên đó, không thuộc trường hợp quy định tại Điều 26 Nghị định này, được miễn hợp pháp hóa lãnh sự và được sử dụng tại Việt Nam mà không phải thực hiện thêm bất kỳ thủ tục chứng nhận nào theo quy định của pháp luật có liên quan.

3. Cơ quan, tổ chức tại Việt Nam không được yêu cầu thực hiện thêm thủ tục chứng nhận lãnh sự, hợp pháp hóa lãnh sự đối với giấy tờ công đã được cấp chứng nhận Apostille hợp lệ.

4. Chứng nhận Apostille điện tử do cơ quan có thẩm quyền của Quốc gia thành viên Công ước cấp có giá trị pháp lý tương đương chứng nhận Apostille bằng giấy và không bị phủ nhận giá trị pháp lý chỉ vì được thể hiện dưới dạng dữ liệu điện tử. Tính xác thực của chứng nhận Apostille điện tử được xác minh thông qua Sổ đăng ký điện tử của Quốc gia thành viên đã cấp theo quy định tại Điều 27 Nghị định này hoặc theo cơ chế do Công ước Apostille quy định.

Điều 26. Các trường hợp từ chối tiếp nhận giấy tờ công đã được cấp chứng nhận Apostille

Giấy tờ của Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam đã được cấp chứng nhận Apostille bị từ chối tiếp nhận tại Việt Nam trong các trường hợp sau đây:

1. Giấy tờ có chứng nhận Apostille không phải giấy tờ công theo pháp luật của quốc gia nơi giấy tờ được lập hoặc giấy tờ do viên chức ngoại giao, viên chức lãnh sự lập hoặc giấy tờ hành chính liên quan trực tiếp đến hoạt động thương mại hoặc hải quan.

2. Chứng nhận Apostille không được cấp bởi cơ quan có thẩm quyền của Quốc gia thành viên Công ước nơi giấy tờ công được lập, hoặc chứng nhận Apostille không có tiêu đề bằng tiếng Pháp “Apostille (Convention de La Haye du 5 octobre 1961)” và không đầy đủ các nội dung theo Mẫu Chứng nhận kèm theo Công ước Apostille.

3. Giấy tờ công và chứng nhận Apostille có dấu hiệu giả mạo, tẩy xóa, sửa chữa trái phép.

4. Nội dung của giấy tờ công vi phạm pháp luật Việt Nam, xâm phạm lợi ích của Nhà nước Việt Nam, trái với các nguyên tắc cơ bản của pháp luật Việt Nam về trật tự công cộng, đạo đức xã hội.

5. Chứng nhận Apostille đã bị hủy bỏ hoặc thu hồi bởi cơ quan có thẩm quyền của Quốc gia thành viên Công ước.

Điều 27. Sử dụng giấy tờ công của Quốc gia thành viên Công ước tại Việt Nam

1. Giấy tờ công đã được cấp chứng nhận Apostille không được lập bằng tiếng Việt phải được dịch ra tiếng Việt; bản dịch phải được công chứng hoặc chứng thực theo quy định của pháp luật Việt Nam, trừ trường hợp pháp luật chuyên ngành có quy định khác.

2. Chứng nhận Apostille hợp lệ được tiếp nhận, sử dụng tại Việt Nam mà không phải thực hiện thêm thủ tục hợp pháp hóa lãnh sự. Khi cần thiết, cơ quan, tổ chức tiếp nhận có thể xác minh chứng nhận Apostille thông qua Sổ đăng ký điện tử của Quốc gia thành viên đã cấp bằng cách tra cứu trực tuyến hoặc quét mã QR trên chứng nhận Apostille.

3. Trường hợp có căn cứ hợp lý nghi ngờ về tính xác thực của chứng nhận Apostille và không thể tra cứu qua Sổ đăng ký điện tử của Quốc gia thành viên đó, cơ quan, tổ chức tiếp nhận đề nghị Bộ Ngoại giao hỗ trợ xác minh theo quy định tại Điều 28 Nghị định này.

Điều 28. Hỗ trợ xác minh chứng nhận Apostille do cơ quan có thẩm quyền của Quốc gia thành viên Công ước cấp theo yêu cầu của cơ quan, tổ chức trong nước

1. Cơ quan, tổ chức trong nước thuộc trường hợp quy định tại khoản 3 Điều 27 Nghị định này có thể đề nghị Bộ Ngoại giao hỗ trợ xác minh chứng nhận Apostille bằng văn bản, kèm thông tin về chứng nhận Apostille cần xác minh.

2. Ngay sau khi nhận được đề nghị, Bộ Ngoại giao gửi yêu cầu xác minh đến cơ quan có thẩm quyền cấp chứng nhận Apostille của Quốc gia thành viên Công ước bằng văn bản hoặc phương thức điện tử; khi nhận được trả lời, Bộ Ngoại giao thông báo ngay kết quả cho cơ quan, tổ chức đã đề nghị.

3. Trường hợp kết quả xác minh cho thấy chứng nhận Apostille không hợp lệ hoặc có dấu hiệu giả mạo, Bộ Ngoại giao phối hợp với Bộ Công an và cơ quan có liên quan xem xét, xử lý theo quy định của pháp luật; đồng thời, trường hợp cần thiết, thông báo cho Quốc gia thành viên đã cấp chứng nhận Apostille.

Chương IV

QUẢN LÝ NHÀ NƯỚC VÀ TRÁCH NHIỆM CỦA CƠ QUAN, TỔ CHỨC, CÁ NHÂN VỀ THỰC THI CÔNG ƯỚC APOSTILLE

Điều 29. Nội dung quản lý nhà nước

Nội dung quản lý nhà nước về thực thi Công ước Apostille bao gồm:

1. Xây dựng, ban hành và tổ chức thực hiện văn bản quy phạm pháp luật về thực thi Công ước Apostille.

2. Tổ chức, chỉ đạo việc cấp chứng nhận Apostille; việc tiếp nhận, sử dụng tại Việt Nam giấy tờ công của Quốc gia thành viên Công ước đã được cấp chứng nhận Apostille.

3. Xây dựng, quản lý, vận hành Hệ thống thông tin Apostille, Sổ đăng ký điện tử.

4. Kiểm tra, giám sát, xử lý vi phạm pháp luật trong lĩnh vực thực thi Công ước Apostille.

5. Đào tạo, bồi dưỡng đội ngũ cán bộ, công chức thực hiện việc cấp chứng nhận Apostille.

6. Tuyên truyền, phổ biến pháp luật về Công ước Apostille.

7. Hợp tác quốc tế trong lĩnh vực thực thi Công ước Apostille.

8. Thống kê, báo cáo về tình hình thực thi Công ước Apostille.

Điều 30. Trách nhiệm của Bộ Ngoại giao

Bộ Ngoại giao giúp Chính phủ thống nhất quản lý nhà nước về thực thi Công ước Apostille, có nhiệm vụ, quyền hạn sau đây:

1. Là đầu mối quốc gia thực thi Công ước Apostille; chủ trì tổ chức triển khai Nghị định này.

2. Tổ chức cấp chứng nhận Apostille thông qua Cơ quan cấp Apostille. Bộ trưởng Bộ Ngoại giao phân cấp thẩm quyền cấp chứng nhận Apostille cho Ủy ban nhân dân cấp tỉnh theo tiêu chí, điều kiện và lộ trình quy định tại khoản 3 Điều 6 Nghị định này.

3. Xây dựng, quản lý, vận hành Hệ thống thông tin Apostille, Sổ đăng ký điện tử và hạ tầng kỹ thuật phục vụ cấp chứng nhận Apostille; bảo đảm kết nối, liên thông với Cổng Dịch vụ công quốc gia.

4. Quy định hình thức trình bày của mẫu chứng nhận Apostille; ban hành biểu mẫu tờ khai, biểu mẫu điện tử tương tác và các biểu mẫu nghiệp vụ; tổ chức in, phát hành mẫu chứng nhận Apostille; thông báo mẫu chứng nhận Apostille của Việt Nam đến cơ quan lưu chiểu Công ước và các Quốc gia thành viên Công ước thông qua đường ngoại giao.

5. Cập nhật, công bố danh sách Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam và thông tin về việc tiếp tục công nhận hay không công nhận kết quả chứng nhận lãnh sự đã cấp trước ngày Công ước có hiệu lực đối với nước Cộng hòa xã hội chủ nghĩa Việt Nam của các Quốc gia thành viên này; đăng tải công khai trên Cổng thông tin điện tử của Bộ Ngoại giao và Cổng Dịch vụ công quốc gia.

6. Là đầu mối quốc gia về xác minh chứng nhận Apostille theo Công ước Apostille; theo dõi, tổng hợp việc xác minh chứng nhận Apostille do Việt Nam cấp theo yêu cầu từ nước ngoài; hỗ trợ cơ quan, tổ chức trong nước xác minh chứng nhận Apostille do Quốc gia thành viên Công ước cấp và đôn đốc cơ quan có thẩm quyền của Quốc gia thành viên Công ước trong trường hợp chậm trả lời yêu cầu xác minh.

7. Hướng dẫn, kiểm tra việc thực hiện Nghị định này; chủ trì, phối hợp với các bộ, cơ quan ngang bộ có liên quan rà soát, ban hành danh mục và tài liệu hướng dẫn nghiệp vụ về các loại giấy tờ công thuộc và không thuộc phạm vi cấp chứng nhận Apostille theo quy định của pháp luật chuyên ngành. Danh mục và tài liệu hướng dẫn nghiệp vụ được đăng tải công khai trên Cổng thông tin điện tử của Bộ Ngoại giao để cơ quan, tổ chức, cá nhân tra cứu, áp dụng thống nhất.

8. Tổng hợp, báo cáo Chính phủ về tình hình thực thi Công ước Apostille định kỳ hằng năm hoặc khi cần thiết theo yêu cầu.

Điều 31. Trách nhiệm của các bộ, ngành, Ủy ban nhân dân cấp tỉnh

Các bộ, cơ quan ngang bộ, Ủy ban nhân dân cấp tỉnh, trong phạm vi nhiệm vụ, quyền hạn của mình, có trách nhiệm:

1. Phối hợp với Bộ Ngoại giao trong việc tổ chức thực hiện Nghị định này;

2. Chỉ đạo cơ quan, tổ chức trực thuộc tiếp nhận giấy tờ công của Quốc gia thành viên Công ước đã được cấp chứng nhận Apostille theo đúng quy định tại Nghị định này; không yêu cầu thực hiện thủ tục chứng nhận Apostille đối với giấy tờ công đã được miễn hợp pháp hóa lãnh sự theo điều ước quốc tế khác mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên hoặc theo quy định của pháp luật chuyên ngành; chủ động phối hợp xác minh khi cần thiết theo quy định.

Điều 32. Trách nhiệm của các cơ quan, tổ chức lập, cấp giấy tờ công của Việt Nam

1. Chịu trách nhiệm theo quy định của pháp luật về tính xác thực, nội dung và hình thức của giấy tờ, tài liệu do mình lập, cấp.

2. Thông báo kịp thời cho Bộ Ngoại giao mẫu con dấu, chữ ký, chức danh, thẩm quyền và thời hạn ủy quyền của cơ quan, tổ chức, người có thẩm quyền ký cấp giấy tờ công theo quy định của pháp luật về chứng nhận lãnh sự, hợp pháp hóa lãnh sự.

3. Cơ quan, tổ chức lập, cấp giấy tờ công khi nhận được đề nghị xác minh theo quy định tại khoản 2 Điều 15 Nghị định này có trách nhiệm trả lời bằng văn bản theo thời hạn quy định tại khoản 3 Điều 15 Nghị định này.

Điều 33. Trách nhiệm của cơ quan, tổ chức và cá nhân liên quan

1. Cơ quan, tổ chức, cá nhân đề nghị cấp chứng nhận Apostille có trách nhiệm:

a) Chịu trách nhiệm trước pháp luật về mục đích sử dụng, nội dung, tính xác thực và tính hợp pháp của giấy tờ, tài liệu;

b) Cung cấp thông tin có liên quan cho Cơ quan cấp Apostille.

2. Cơ quan, tổ chức của Việt Nam khi tiếp nhận, sử dụng giấy tờ, tài liệu đã được cấp chứng nhận Apostille của Quốc gia thành viên Công ước có trách nhiệm:

a) Xem xét, đối chiếu với quy định của pháp luật và các giấy tờ có liên quan để quyết định việc chấp nhận hoặc không chấp nhận giấy tờ, tài liệu trong giải quyết công việc thuộc phạm vi chức năng, quyền hạn;

b) Chủ động phối hợp với cơ quan có thẩm quyền để xác minh tính xác thực của giấy tờ, tài liệu của nước ngoài khi cần thiết.

Chương V

ĐIỀU KHOẢN THI HÀNH

Điều 34. Hiệu lực thi hành

Nghị định này có hiệu lực thi hành từ ngày 11 tháng 9 năm 2026.

Điều 35. Áp dụng pháp luật về chứng nhận Apostille và chứng nhận lãnh sự, hợp pháp hóa lãnh sự

1. Kể từ ngày Nghị định này có hiệu lực thi hành, việc cấp chứng nhận đối với giấy tờ công để sử dụng tại Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam được thực hiện theo quy định tại Nghị định này.

2. Việc chứng nhận lãnh sự, hợp pháp hóa lãnh sự tiếp tục được thực hiện theo quy định của pháp luật về chứng nhận lãnh sự, hợp pháp hóa lãnh sự đối với các trường hợp sau đây:

a) Giấy tờ công của Việt Nam để sử dụng tại quốc gia không phải là Quốc gia thành viên Công ước;

b) Giấy tờ, tài liệu không thuộc phạm vi giấy tờ công quy định tại khoản 3 Điều 3 và Điều 10 Nghị định này hoặc không thuộc phạm vi cấp chứng nhận Apostille theo quy định tại khoản 1 Điều 11 Nghị định này;

c) Các trường hợp khác không thuộc phạm vi điều chỉnh của Nghị định này.

Điều 36. Điều khoản chuyển tiếp

1. Hồ sơ đề nghị chứng nhận lãnh sự đối với giấy tờ công của Việt Nam đã được tiếp nhận hợp lệ trước ngày Nghị định này có hiệu lực thi hành nhưng đến ngày đó chưa có kết quả giải quyết, kể cả trường hợp hồ sơ đang trong quá trình xác minh bổ sung, được tiếp tục giải quyết và trả kết quả theo quy định của pháp luật về chứng nhận lãnh sự, hợp pháp hóa lãnh sự. Việc sử dụng kết quả chứng nhận lãnh sự này tại Quốc gia thành viên Công ước thực hiện theo điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên hoặc nguyên tắc có đi có lại. Người được cấp có quyền đề nghị cấp chứng nhận Apostille đối với giấy tờ công đó theo quy định tại Nghị định này.

2. Cơ chế chuyển tiếp đối với giấy tờ đã được chứng nhận, xác thực trước ngày Nghị định này có hiệu lực thi hành được thực hiện như sau:

a) Giấy tờ công của Quốc gia thành viên Công ước đã được cơ quan có thẩm quyền của Việt Nam hợp pháp hóa lãnh sự trước ngày Nghị định này có hiệu lực thi hành tiếp tục có giá trị sử dụng tại Việt Nam; cơ quan, tổ chức tiếp nhận không được yêu cầu người sử dụng phải thực hiện thủ tục cấp chứng nhận Apostille đối với giấy tờ công đó;

b) Giấy tờ công của Việt Nam đã được chứng nhận lãnh sự trước ngày Nghị định này có hiệu lực thi hành, trường hợp cần sử dụng tại Quốc gia thành viên Công ước mà Công ước có hiệu lực trong quan hệ với Việt Nam, người được cấp có quyền đề nghị Cơ quan cấp Apostille cấp chứng nhận Apostille đối với giấy tờ công đó theo quy định tại Nghị định này, mà không phải đề nghị cấp lại giấy tờ công gốc. Việc thu phí thực hiện theo quy định tại Điều 9 Nghị định này.

3. Kể từ ngày Công ước có hiệu lực trong quan hệ với Việt Nam, chứng nhận Apostille do cơ quan có thẩm quyền của Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam cấp trước thời điểm đó được tiếp nhận, sử dụng tại Việt Nam nếu không thuộc trường hợp từ chối tiếp nhận quy định tại Điều 26 Nghị định này.

4. Việc triển khai cấu phần điện tử trong cấp và quản lý chứng nhận Apostille được thực hiện theo lộ trình vận hành của Hệ thống thông tin Apostille như sau:

a) Trong thời gian Hệ thống thông tin Apostille chưa được đưa vào vận hành, Cơ quan cấp Apostille cấp chứng nhận Apostille bằng giấy theo quy định của Nghị định này; việc tiếp nhận, giải quyết hồ sơ theo phương thức trực tuyến được thực hiện trên Hệ thống thông tin giải quyết thủ tục hành chính của Bộ Ngoại giao kết nối với Cổng Dịch vụ công quốc gia; các nội dung của thủ tục đủ điều kiện thực hiện trên môi trường điện tử được triển khai ngay trên các hệ thống này; việc ghi nhận, lưu trữ, tra cứu và xác minh chứng nhận Apostille đã cấp được thực hiện trên cơ sở hồ sơ lưu, bảo đảm đáp ứng yêu cầu của Công ước Apostille;

b) Việc cấp chứng nhận Apostille điện tử, vận hành Sổ đăng ký điện tử, tích hợp mã QR trên chứng nhận Apostille và tiếp nhận, giải quyết hồ sơ theo phương thức trực tuyến toàn trình được thực hiện kể từ thời điểm Hệ thống thông tin Apostille được đưa vào vận hành;

c) Bộ trưởng Bộ Ngoại giao công bố thời điểm đưa Hệ thống thông tin Apostille vào vận hành và chỉ đạo việc chuyển đổi phương thức cấp chứng nhận Apostille, bảo đảm không gián đoạn hoạt động cấp chứng nhận Apostille.

Điều 37. Tổ chức thực hiện

1. Kể từ ngày Công ước Apostille có hiệu lực đối với nước Cộng hòa xã hội chủ nghĩa Việt Nam, cơ quan đại diện ngoại giao, cơ quan đại diện lãnh sự của Việt Nam ở nước ngoài không thực hiện hợp pháp hóa lãnh sự đối với giấy tờ công của Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam thuộc trường hợp được miễn hợp pháp hóa lãnh sự theo quy định của Công ước Apostille.

2. Bộ Ngoại giao hướng dẫn, kiểm tra việc thực hiện khoản 1 Điều này; chỉ đạo cơ quan đại diện ngoại giao, cơ quan đại diện lãnh sự của Việt Nam ở nước ngoài thông báo cho cơ quan có thẩm quyền của nước sở tại, cộng đồng người Việt Nam và các tổ chức, cá nhân có liên quan về việc áp dụng cơ chế Apostille thay cho hợp pháp hóa lãnh sự đối với giấy tờ công của Quốc gia thành viên Công ước có quan hệ áp dụng với Việt Nam và hướng dẫn thực hiện thủ tục cấp chứng nhận Apostille. Việc thông báo được thực hiện kịp thời, bảo đảm không gián đoạn việc xác thực giấy tờ công.

3. Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương chịu trách nhiệm thi hành Nghị định này.

DECREE

ON THE IMPLEMENTATION OF THE HAGUE CONVENTION OF 5 OCTOBER 1961 ABOLISHING THE REQUIREMENT OF LEGALISATION FOR FOREIGN PUBLIC DOCUMENTS (APOSTILLE CONVENTION)

Pursuant to the Law on Organization of the Government No. 63/2025/QH15;

Pursuant to the Law on International Treaties No. 108/2016/QH13, amended by Law No. 137/2025/QH15;

Pursuant to the Law on Vietnamese Representative Missions Abroad No. 33/2009/QH12, amended by Law No. 19/2017/QH14 and Law No. 08/2026/QH16;

At the proposal of the Minister of Foreign Affairs;

The Government hereby issues a Decree on the implementation of the Hague Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents (Apostille Convention).

Article 1. Scope

This Decree provides regulations on:

1. The authority and procedures for issuing Apostilles in respect of public documents of Vietnam.

2. The receipt and use in Vietnam of public documents bearing an Apostille by a Contracting State in respect of which the Hague Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents (hereinafter referred to as the Apostille Convention).

3. Verification of Apostilles and state management of the implementation of the Apostille Convention.

Article 2. Regulated entities

This Decree applies to:

1. Agencies, organizations and individuals applying for Apostilles.

2. Competent authorities for issuing Apostilles of Vietnam.

4. Other agencies and organizations related to the issuance, verification, state management and international cooperation on Apostilles.

Article 3. Definitions

For the purposes of this Decree, the following terms shall be construed as follows:

1. "Contracting State" means a party that has acceded to the Apostille Convention through signature, ratification or accession in accordance with the provisions of the Convention.

2. "Apostille" means a certificate issued by a competent authority of Vietnam or of a Contracting State to certify the origin of the public document, including the authenticity of the signature, the capacity of the person signing and the seal or stamp affixed to the public document (if any), as prescribed in Article 4 of this Decree.

3. "Public document" means a document or paper prepared in paper form or electronic form by a competent agency, organization or individual in accordance with the law of the country where the document is prepared, in the exercise of their functions, duties and powers under the law of that country, including: documents prepared by a court or judicial authority or an official thereof; administrative documents; notarial acts; and official certifications on documents signed in a private capacity.

4. "Competent authority for issuing Apostilles" means an authority designated by a Contracting State in accordance with the provisions of the Convention to issue Apostilles; for the purposes of this Decree, this includes competent authorities of Vietnam and of Contracting States in respect of which the Convention is in force for Vietnam.

5. "Electronic Apostille (e-Apostille)" means an Apostille issued in the form of electronic data, signed with a digital signature in accordance with the law on electronic transactions and meeting the technical requirements prescribed in clause 3 of Article 20 of this Decree.

6. "Information system for the issuance and management of Apostilles" means a professional information system developed, managed and operated by the Ministry of Foreign Affairs to serve the receipt, processing, issuance, storage, lookup and verification of Apostilles (hereinafter referred to as the Apostille Information System).

8. "Electronic register (e-Register)" means the public online lookup interface of the Data Repository, which allows verification of the authenticity of Apostilles in accordance with the provisions of the Convention.

Article 4. Matters certified by an Apostille

1. An Apostille certifies the origin of the public document, including the authenticity of the signature, the capacity of the person signing and the seal or stamp affixed to the public document (if any).

2. An Apostille does not certify the content or form of the public document.

Article 5. Requirements for issuance of Apostilles and order of priority of application

1. Public documents of Vietnam shall bear an Apostille at the request of agencies, organizations or individuals for use in a Contracting State in respect of which the Convention is in force for Vietnam. The issuance of an Apostille is not mandatory where the public document is exempt from or does not require certification or authentication under an international treaty to which the Socialist Republic of Vietnam is a party, or under the law or practice applied in the country where the document is to be used. The issuance of an Apostille does not replace notarization or certification as prescribed by law where the public document is to be used in Vietnam.

2. To be used in Vietnam, public documents of a Contracting State in respect of which the Convention is in force for Vietnam must bear an Apostille, except for documents refused under Article 26 of this Decree, or where an international treaty to which the Socialist Republic of Vietnam is a party, or Vietnamese law and practice, provides for exemption from or does not require consular legalization or other certification procedures for such documents.

3. Public documents of Vietnam for use abroad and public documents of foreign countries for use in Vietnam shall be certified in the following forms:

a) By Apostille as prescribed in this Decree, applicable to public documents circulating between Vietnam and a Contracting State in respect of which the Convention is in force for Vietnam;

c) Where an international treaty to which the Socialist Republic of Vietnam is a party provides for simpler requirements or exempts the requirement for certification or authentication of public documents compared to the forms prescribed in points a or b of this clause, the provisions of that international treaty shall take precedence.

Public documents that have been consularly authenticated or consularly legalized may still bear an Apostille for use in a Contracting State in respect of which the Convention is in force for Vietnam, and vice versa.

4. Where a Contracting State has objected to Vietnam's accession, or vice versa, in accordance with Article 12 of the Convention, the Apostille Convention shall not be in force between the two countries; public documents circulating between the two countries shall be governed by the provisions of point b of clause 3 of this Article.

Chapter II

ISSUANCE OF APOSTILLES IN RESPECT OF PUBLIC DOCUMENTS OF VIETNAM

Article 6. Competent authorities for issuing Apostilles of Vietnam

1. The Ministry of Foreign Affairs is the competent authority for issuing Apostilles of Vietnam. The Minister of Foreign Affairs shall specify the authority carrying out the issuance of Apostilles (hereinafter collectively referred to as the Apostille-issuing authority).

2. The Ministry of Foreign Affairs shall notify the depositary of the Convention of the Apostille-issuing authority and any related changes through diplomatic channels.

3. The Minister of Foreign Affairs shall prescribe the criteria, conditions and implementation roadmap for the delegation of authority to issue Apostilles to People's Committees of provinces and centrally-affiliated cities, and the responsibilities of People's Committees of provinces and centrally-affiliated cities to which authority is delegated, in accordance with the law on organization of the Government and the law on organization of local governments.

1. Agencies, organizations and individuals may apply for an Apostille in respect of their own documents or those of another person without a power of attorney.

2. A person applying for an Apostille in respect of another person's documents shall be legally responsible for the legality of the submission and use of such documents and shall comply with the law on personal data protection and relevant legal provisions.

Article 8. Language used and places of issuance of Apostilles

1. The languages used for issuance of Apostilles are Vietnamese and English; the heading "Apostille (Convention de La Haye du 5 octobre 1961)" shall be expressed in French in accordance with Article 4 of the Apostille Convention.

2. The issuance of Apostilles shall be carried out at the office of the Apostille-issuing authority.

Article 9. Fees for the issuance of Apostilles

1. Applicants for Apostilles must pay the fees prescribed for consular authentication and consular legalization at the time of submitting the application in accordance with the law on fees and charges.

2. Where the application is submitted and the result is received by postal service, the applicant must pay postal fees.

3. Where the application is submitted online, payment of fees shall be governed by the law on carrying out administrative procedures in an electronic environment.

Article 10. Public documents of Vietnam eligible for the issuance of an Apostille

Public documents of Vietnam eligible for the issuance of an Apostille include:

1. Documents prepared, issued or certified by competent agencies or persons in judicial and enforcement proceedings in accordance with the law through the years, including: judgments, decisions and procedural documents of People's Courts, People's Procuracies and investigative authorities; decisions, records and documents of civil judgment enforcement management authorities, civil judgment enforcement authorities and criminal judgment enforcement authorities; and bailiffs' records and other documents prepared by bailiffs and enforcement officers in the exercise of their duties.

2. Administrative documents prepared, issued or certified by competent agencies, organizations or persons in accordance with the law, including: civil status, nationality and adoption documents; criminal record certificates; degrees, diplomas, certificates and academic records; medical examination certificates, health certificates, medical assessment reports and other medical documents; and other administrative documents issued or certified by state authorities or organizations authorized or delegated by the State to provide public services in accordance with the law.

3. Notarial acts in accordance with the law on notarization through the years, including notarized contracts, transactions, translations and copies.

4. Certified documents prepared by competent agencies, organizations or persons in accordance with the law on certification, including: certification of copies from originals; certification of signatures and certification of translators' signatures; and certification of contracts and transactions.

5. Other public documents prepared, issued or certified by competent agencies, organizations or persons of Vietnam in the exercise of their functions and duties as prescribed by law that are also eligible for the issuance of an Apostille, except in the cases prescribed in clause 1 of Article 11 of this Decree.

Article 11. Documents outside the scope of or not eligible for Apostille issuance

b) Administrative documents directly relating to commercial or customs operations, except for documents that, prior to the date the Apostille Convention enters into force for the Socialist Republic of Vietnam, were subject to consular authentication in accordance with the law on consular authentication and consular legalization. The Ministry of Foreign Affairs shall specify the documents referred to in this point in the list prescribed in clause 7 of Article 30 of this Decree;

c) Documents not prepared, issued or certified by a competent agency, organization or person in the exercise of their functions, duties and powers as prescribed by law and not yet notarized or certified;

d) Public documents prepared, issued or certified by a competent agency, organization or person of a foreign country.

2. The following documents are not eligible for Apostille issuance:

a) Documents that have been unlawfully altered, modified or falsified in content;

b) Documents for which there are grounds to determine that they are forged;

c) Documents for which the verification result under Article 15 of this Decree determines that the document was not issued by the competent authority, or that the seal, signature, title or authority on the document is not authentic, exceeds the authority, is not an original seal, is not an original signature or does not conform to the registered specimen;

d) Public documents that have been declared invalid, revoked, annulled or determined to have been issued in violation of the law by a decision, judgment or legally effective document of a competent state authority;

dd) Public documents subject to restriction from being taken abroad under Vietnamese law;

Article 12. Application documents and methods of submission of applications for Apostilles

An application for an Apostille shall be prepared in one set. The components of the application by method of submission are as follows:

1. Direct submission at the single-window division or by postal service:

a) An application form for an Apostille in the template issued by the Minister of Foreign Affairs;

b) The original public document for which an Apostille is requested; where the public document is a certified copy or a certified translation in accordance with the law on notarization and certification, such certified copy or certified translation shall be submitted. The public document must be kept intact and must not be disassembled, altered or have its content changed.

2. Fully online submission through the National Public Service Portal or the national identity application:

a) An application form using the interactive electronic form;

b) The electronic public document bearing a valid digital signature of the competent agency, organization or person in accordance with the law on electronic transactions.

Article 13. Receipt of applications for Apostilles

1. The receiving authority shall verify the identity of the applicant through their electronic identity account. Where the application is submitted in person or by postal services and identity information cannot be retrieved, or where the information retrieved is incomplete, verification and cross-checking shall be carried out on the basis of identity documents or documents proving the legal personality of an organization presented or additionally submitted by the applicant.

2. The receiving authority shall check the completeness and validity of the application and cross-check the information on the public document against the information in the application form for an Apostille.

3. Where the public document is found to show signs of forgery, unauthorized alteration or modification, the receiving authority shall record such information in the document for handling in accordance with Articles 14 and 15 of this Decree.

4. Where the application is incomplete or non-conforming, the receiving authority shall guide the applicant to supplement and complete the application once. Within 7 working days from the date of receipt of the guidance, the applicant shall be responsible for supplementing and completing the application; this period shall not be counted towards the processing deadline.

Article 14. Processing of applications for Apostilles

1. The Apostille-issuing authority shall cross-check the signatures, seals, titles and authority on the public document against the data on seals, signatures, titles and authority prescribed in Article 23 of this Decree.

2. The processing of the cross-checking result shall be carried out as follows:

a) Where the cross-checking result is matching, the Apostille-issuing authority shall issue an Apostille as prescribed in Article 16 of this Decree;

b) Where the application falls within one of the cases requiring verification prescribed in clause 1 of Article 15 of this Decree, the Apostille-issuing authority shall carry out verification as prescribed in Article 15 of this Decree;

d) Where the public document is a certified copy or a certified translation bearing a certified signature of the translator, and there are reasonable grounds to doubt the authenticity of the certified copy or certified translation, the Apostille-issuing authority shall prioritize accessing and cross-checking electronic notarization and certification data in accordance with the law on notarization and certification; where such data cannot be accessed, the applicant shall be required to present the original for inspection and cross-checking.

3. The receipt, processing and delivery of results shall be updated on the administrative procedure processing information system and synchronized with the National Public Service Portal in accordance with the law on carrying out administrative procedures under the one-stop-shop and linked one-stop-shop mechanism.

Article 15. Verification of the authenticity of public documents

1. The Apostille-issuing authority shall carry out verification of the authenticity of the public document in one of the following cases:

a) The signature, seal, title and authority on the public document are not yet in the data on seals, signatures, titles and authority prescribed in Article 23 of this Decree, or have not yet been formally notified to the Ministry of Foreign Affairs;

b) There are reasonable grounds to doubt the authenticity of the document, including cases where the document shows signs of forgery, unauthorized alteration or modification;

c) There is information, signs or reports that the public document is subject to restriction from being taken abroad or restricted from use abroad under specialized law.

2. Where the application falls within a case prescribed in clause 1 of this Article, the Apostille-issuing authority shall suspend the processing of the document in question, notify the applicant of the verification, clearly stating the reasons and expected verification period, and send a written request for verification as follows:

a) For cases prescribed in points a and b of clause 1 of this Article: send to the authority or organization that issued the document, or the superior state management authority thereof, for confirmation of the authenticity of the document, seal, signature, title and authority; the applicant shall not be required to submit additional documents;

3. The authority requested to carry out verification shall be responsible for responding in writing within 5 working days from the date of receipt of the request; in complex cases, the deadline shall not exceed 10 working days and the reasons must be notified to the authority that sent the request.

4. Immediately upon receipt of the written verification result, the Apostille-issuing authority shall proceed as follows:

a) Where the result confirms the authenticity and the document is eligible for circulation, the Apostille-issuing authority shall issue an Apostille as prescribed in Article 16 of this Decree;

b) Where the result confirms that the document is not authentic, the Apostille-issuing authority shall refuse to issue an Apostille and return the document to the applicant, with notification as prescribed in Article 18 of this Decree; where the document contains elements of forgery or was issued by an authority or organization without competence, the Apostille-issuing authority shall refuse to issue and carry out the retention and transfer of the document as prescribed in clause 4 of Article 18 of this Decree;

c) Where the document is authentic but is subject to restriction from being taken abroad or restricted from use abroad under specialized law, the Apostille-issuing authority shall refuse to issue an Apostille, with notification as prescribed in Article 18 of this Decree, and transfer the document to the competent state authority managing the relevant field for handling in accordance with specialized law.

5. Where the verification period has expired without receipt of a response, the following procedures shall apply:

a) After 15 days from the date of sending the written request for verification without receipt of a response, the Apostille-issuing authority shall be responsible for following up with the authority requested to carry out verification;

b) After 30 days from the date of sending the written request for verification without receipt of a response, the Apostille-issuing authority shall notify the applicant in writing of the verification process and return the document together with the public document;

c) Where the verification result is received after the deadline prescribed in point b of this clause and the document has been returned, the Apostille-issuing authority shall notify the applicant to resubmit the application as prescribed in Article 12 of this Decree.

1. A paper Apostille shall contain all the particulars prescribed in Article 20 of this Decree in a format prescribed by the Minister of Foreign Affairs, and shall be stamped or affixed directly onto the public document or expressed on a separate sheet firmly attached to the public document.

2. An electronic Apostille shall be integrated with or inseparably linked to the electronic public document, ensuring the integrity in accordance with the technical requirements prescribed in clause 3 of Article 20 of this Decree.

3. The delivery of results to the applicant shall be carried out by the method registered upon submission of the application: in person at the single-window division; by postal service; or as an electronic document sent to the personal data repository of the applicant on the administrative procedure processing information system of the Ministry of Foreign Affairs and the National Public Service Portal as prescribed by law, or to the applicant's email address. The issuance and management of result codes and the storage of electronic results shall be carried out in accordance with the law on carrying out administrative procedures under the one-stop-shop and linked one-stop-shop mechanism.

4. Immediately upon issuance of an Apostille, the Apostille-issuing authority shall update the information in the Data Repository as prescribed in Article 21 of this Decree.

Article 17. Processing deadlines

1. The deadline for issuing an Apostille shall be calculated from the date of receipt of the complete and conforming application and shall be determined according to the number of public documents for which an Apostille is requested in one application set and the method of submission. For applications for paper Apostilles submitted as prescribed in clause 1 of Article 12 of this Decree, the processing deadlines shall be as follows:

a) 1 working day for applications containing one to four public documents;

b) 2 working days for applications containing five to nine public documents;

c) 4 working days for applications containing ten or more public documents.

a) Within the same working day for applications containing one to four public documents received before the cut-off time as prescribed by the law on carrying out administrative procedures in an electronic environment; applications received after the cut-off time shall be counted from the next working day;

b) 1 working day for applications containing five to nine public documents;

c) 3 working days for applications containing ten or more public documents.

The commencement of the processing deadline prescribed in this clause shall be determined in accordance with the law on carrying out administrative procedures in an electronic environment.

3. The deadlines prescribed in clauses 1 and 2 of this Article shall not include the verification period as prescribed in Article 15 of this Decree.

4. Where an application cannot be processed within the deadline prescribed in clauses 1 and 2 of this Article due to objective reasons, technical system failures or force majeure events as prescribed by law, and such cases do not fall within the verification cases prescribed in Article 15 of this Decree, the Apostille-issuing authority must notify the applicant in writing before the expiry of the deadline, clearly stating the reasons and the new processing deadline in accordance with the law on carrying out administrative procedures under the one-stop-shop and linked one-stop-shop mechanism. The extension of the processing deadline may be made only once.

Article 18. Handling of refusals and retention of documents

1. The Apostille-issuing authority shall refuse to issue an Apostille in the following cases:

a) The document is outside the scope of Apostille issuance as prescribed in clause 1 of Article 11 of this Decree;

c) The deadline prescribed in clause 4 of Article 13 of this Decree has expired but the application still does not satisfy the requirements prescribed in Article 12 of this Decree;

d) The cross-checking result under clause 1 of Article 14 of this Decree confirms that the signature, seal, title or authority on the public document does not match the data on seals, signatures, titles and authority prescribed in Article 23 of this Decree.

2. When refusing to issue an Apostille, the Apostille-issuing authority must notify the applicant in accordance with the law on carrying out administrative procedures under the one-stop-shop and linked one-stop-shop mechanism within the deadlines prescribed in clauses 1 and 2 of Article 17 of this Decree; for refusals prescribed in point c of clause 1 of this Article, the notification deadline is 1 working day from the date of expiry of the deadline prescribed in clause 4 of Article 13 of this Decree. The notification must clearly state the reasons and legal basis. The original public documents received shall be returned to the applicant together with the refusal notification, except in the cases prescribed in clause 4 of this Article.

3. The Apostille-issuing authority shall guide the applicant to carry out the appropriate procedure as prescribed by law, such as consular authentication or consular legalization procedures in accordance with the law on consular authentication and consular legalization, for cases where the document is to be used in a country that is not a Contracting State.

4. Where the written verification result confirms that the document contains elements of forgery or was issued by an authority or organization without competence, the Apostille-issuing authority shall:

a) Retain all public documents and related materials in the application; prepare a record of retention bearing the signature of the applicant, or clearly state the reasons for the applicant's refusal to sign;

b) Notify the applicant in writing of the retention of the documents and the transfer of the documents to the competent authority for handling, clearly stating the reasons;

c) Within 5 working days from the date of preparation of the record of retention, notify in writing the competent authority as prescribed by law at the location where the Apostille-issuing authority has its office to come and receive all retained documents and the record of retention for consideration and handling in accordance with the law.

Article 19. Annulment, revocation and replacement of issued Apostilles

a) The application for an Apostille is determined to contain elements of forgery on the basis of a verification result under Article 15 of this Decree or a conclusion of the competent authority;

b) The public document bearing an Apostille is determined by the competent authority to have been issued in violation of the law or to have had no legal effect at the time the Apostille was issued.

An annulled Apostille shall have no legal effect from the time of its issuance.

2. Except in the cases prescribed in clause 1 of this Article, where there are errors in the issuance of the Apostille not attributable to the fault of the applicant that render the document unusable abroad, the authority that issued the Apostille shall revoke and replace it at the request of the applicant.

A revoked Apostille shall cease to have legal effect from the time information on the revocation is made publicly available on Vietnam's electronic register.

The replacement Apostille shall have a new serial number and tracking number as prescribed in points h and l of clause 1 of Article 20 of this Decree. The replacement shall be carried out on the basis of the previously submitted application and fees. Where the attached public document cannot be reused for replacement, the Apostille-issuing authority shall guide the applicant to provide another original or a certified copy or certified translation of the same public document and shall not require resubmission of the application. The request for replacement shall be made in person at the single-window division, by postal services or online; the revocation and replacement shall be carried out immediately upon receipt of the request.

3. The Apostille-issuing authority shall carry out the annulment or revocation and replacement of the Apostille as prescribed in clause 1 or clause 2 of this Article. At the latest by the next working day from the date of the annulment or revocation and replacement decision, the Apostille-issuing authority shall update the validity status of the Apostille in the Data Repository as prescribed in Article 21 of this Decree, make publicly available on Vietnam's electronic register, and notify the person issued with the Apostille of the annulment or revocation and replacement by an appropriate method. For electronic Apostilles, the invalidation of the electronic administrative procedure result shall be carried out in accordance with the law on carrying out administrative procedures in an electronic environment. Where there are grounds to determine that the Apostille has been used or is in the process of being verified in a Contracting State, the Ministry of Foreign Affairs shall notify the competent authority of that Contracting State of the annulment or revocation and replacement in writing or by electronic means; where necessary, the notification shall be made through diplomatic channels.

On the basis of inspection activities or state management of Apostilles, where the Apostille-issuing authority has not carried out the annulment or revocation and replacement as prescribed in clause 1 or clause 2 of this Article, the Minister of Foreign Affairs shall issue a written request to the Apostille-issuing authority to carry out such action within 5 working days from the date of receipt of the request. Where the Apostille-issuing authority fails to do so within the above deadline, the Minister of Foreign Affairs shall directly decide on the annulment or revocation and replacement and shall be responsible for such decision.

4. The annulment or revocation and replacement of an Apostille shall not affect the handling of the consequences of transactions established in the country receiving the document under the law of that country. In Vietnam, the legitimate rights and interests of bona fide third parties shall be protected in accordance with civil law.

1. An Apostille shall have the heading and language as prescribed in clause 1 of Article 8 of this Decree and shall contain the following particulars:

a) The name of the country where the Apostille is issued;

b) The full name of the person signing the public document;

c) The title of the person signing the public document;

d) The name of the authority whose seal or stamp is on the public document, in cases where the public document does not bear a signature;

dd) The place of issuance of the Apostille;

e) The date of issuance of the Apostille;

g) The name of the Apostille-issuing authority;

h) The serial number of the Apostille;

k) The signature of the authorized person of the Apostille-issuing authority;

l) The tracking number.

2. The Apostille shall be integrated with a QR code linked to the Data Repository prescribed in Article 21 of this Decree, enabling online lookup and verification of information on the issued Apostille through the electronic register.

3. In addition to the requirements prescribed in clauses 1 and 2 of this Article, an electronic Apostille must meet the following technical requirements:

a) It must be signed with the official-use digital signature of the Apostille-issuing authority in accordance with the law on electronic transactions and the law on cipher;

b) It must bear a timestamp specifying the time of issuance of the Apostille;

c) It must be inseparably linked to the electronic public document; ensuring the integrity so that its content cannot be altered after issuance.

4. The model Apostille of Vietnam must contain all the particulars prescribed in clauses 1 and 2 of this Article; for electronic Apostilles, it must additionally meet the technical requirements prescribed in clause 3 of this Article; and it must ensure conformity with the Model Certificate annexed to the Convention. The Minister of Foreign Affairs shall prescribe in detail the presentation format of the model Apostille.

Article 21. Electronic Apostille Data Repository and electronic register

2. Upon issuance of an Apostille, the Apostille-issuing authority shall update the following information in the Data Repository:

a) The serial number and date of issuance of the Apostille;

b) The full name and title of the person signing the public document, or the name of the authority whose seal is on the public document;

c) Whether the Apostille is issued in paper or electronic form;

d) The validity status of the Apostille;

dd) The electronic Apostille as issued;

e) The tracking number of the Apostille.

3. The electronic register shall ensure continuous public online access 24 hours a day, 7 days a week by the serial number of the Apostille or by scanning the QR code on the Apostille; no account registration shall be required; all information prescribed in clause 2 of this Article shall be displayed in full. The lookup interface shall be provided in at least Vietnamese and English.

4. Information in the Data Repository shall be stored in accordance with the law on archiving, ensuring that it meets the requirements for online lookup and verification of Apostilles in accordance with the Apostille Convention; the confidentiality, backup, access, sharing and information security shall be governed by the law on data, cybersecurity and personal data protection.

1. The components of paper documents arising in the course of issuing Apostilles shall be governed by the law on consular authentication and consular legalization; the preservation regime and archiving period shall be governed by the law on archiving.

2. The storage and preservation of information on electronic Apostilles shall be governed by the provisions of Article 21 of this Decree.

Article 23. Data on seals, signatures, titles and authority of persons authorized to sign public documents of Vietnam

1. Data on seals, signatures, titles and authority of persons authorized to sign public documents of Vietnam in the consular authentication and consular legalization information system shall be carried forward and updated into the Apostille Information System to serve cross-checking and verification in the issuance of Apostilles.

2. The Apostille-issuing authority shall access and use the specimen seal, signature, title and authority data of persons authorized to sign documents in accordance with the law on consular authentication and consular legalization to cross-check and verify the origin of public documents prior to issuing Apostilles.

3. The formal notification, updating and management of specimen seals, signatures, titles and authority of persons authorized to sign public documents shall be governed by the law on consular authentication and consular legalization.

Article 24. Verification of Apostilles issued by Vietnam at the request of foreign authorities

1. Where the competent authority of a Contracting State in respect of which the Convention is in force for Vietnam sends a request for verification of an Apostille issued by Vietnam, the Apostille-issuing authority that issued the Apostille shall be responsible for verifying and responding regarding the authenticity of the Apostille on the basis of information stored in the electronic register or the records on documentation.

2. Verification under this Article is for the purpose of confirming the authenticity of the Apostille and information on its issuance, and does not include certifying the content of the public document bearing the Apostille.

4. The deadline for responding to a verification request is 5 working days from the date of receipt of the verification request; in cases requiring additional verification or involving complex factors, the deadline shall not exceed 10 working days.

5. The Apostille-issuing authority shall notify the Ministry of Foreign Affairs of the verification results for monitoring and compilation in service of state management of the implementation of the Apostille Convention.

Chapter III

EXEMPTION FROM CONSULAR LEGALIZATION AND USE IN VIETNAM OF PUBLIC DOCUMENTS OF CONTRACTING STATES

Article 25. Principles for exemption from consular legalization and use of public documents bearing Apostilles

1. In this Chapter, "Contracting State" means a Contracting State in respect of which the Convention is in force for Vietnam, unless otherwise provided.

2. Public documents of a Contracting State in respect of which the Convention is in force for Vietnam that have been bearing an Apostille by the competent authority of that Contracting State, and that do not fall within the cases prescribed in Article 26 of this Decree, shall be exempt from consular legalization and may be used in Vietnam without any additional certification procedures being required under relevant law.

3. Agencies and organizations in Vietnam shall not require additional consular authentication or consular legalization procedures in respect of public documents that have been validly bearing an Apostille.

4. An electronic Apostille issued by the competent authority of a Contracting State shall have the same legal effect as a paper Apostille and shall not be denied legal effect solely because it is expressed in the form of electronic data. The authenticity of an electronic Apostille shall be verified through the electronic register of the Contracting State that issued it as prescribed in Article 27 of this Decree, or in accordance with the mechanism provided for by the Apostille Convention.

Documents of a Contracting State in respect of which the Convention is in force for Vietnam that have been bearing an Apostille shall be refused receipt in Vietnam in the following cases:

1. The document bearing the Apostille is not a public document under the law of the country where it was prepared, or is a document prepared by diplomatic or consular officials, or is an administrative document directly relating to commercial or customs operations.

2. The Apostille was not issued by the competent authority of the Contracting State where the public document was prepared, or the Apostille does not bear the French-language heading "Apostille (Convention de La Haye du 5 octobre 1961)" and does not contain all the particulars required by the Model Certificate annexed to the Apostille Convention.

3. The public document and the Apostille show signs of forgery, unauthorized alteration or modification.

4. The content of the public document violates Vietnamese law, infringes upon the interests of the Vietnamese State, or is contrary to the fundamental principles of Vietnamese law on public order and social morality.

5. The Apostille has been annulled or revoked by the competent authority of the Contracting State.

Article 27. Use of public documents of Contracting States in Vietnam

1. Public documents bearing an Apostille that are not in Vietnamese must be translated into Vietnamese; the translation must be notarized or certified in accordance with Vietnamese law, unless otherwise provided by specialized law.

2. A valid Apostille shall be received and used in Vietnam without any additional consular legalization procedures being required. Where necessary, the receiving agency or organization may verify the Apostille through the electronic register of the Contracting State that issued it by online lookup or by scanning the QR code on the Apostille.

Article 28. Assistance with verification of Apostilles issued by competent authorities of Contracting States at the request of domestic agencies and organizations

1. Domestic agencies and organizations falling within the cases prescribed in clause 3 of Article 27 of this Decree may request the Ministry of Foreign Affairs to assist with verification of an Apostille in writing, accompanied by information on the Apostille to be verified.

2. Immediately upon receipt of the request, the Ministry of Foreign Affairs shall send a verification request to the competent authority for issuing Apostilles of the Contracting State in writing or by electronic means; upon receipt of a response, the Ministry of Foreign Affairs shall immediately notify the requesting agency or organization of the result.

3. Where the verification result shows that the Apostille is invalid or shows signs of forgery, the Ministry of Foreign Affairs shall coordinate with the Ministry of Public Security and relevant authorities to consider and handle the matter in accordance with the law; and, where necessary, notify the Contracting State that issued the Apostille.

Chapter IV

STATE MANAGEMENT AND RESPONSIBILITIES OF AGENCIES, ORGANIZATIONS AND INDIVIDUALS IN THE IMPLEMENTATION OF THE APOSTILLE CONVENTION

Article 29. Scope of state management

The scope of state management of the implementation of the Apostille Convention includes:

1. Formulation, promulgation and organization of implementation of legal normative documents on the implementation of the Apostille Convention.

3. Development, management and operation of the Apostille Information System and the electronic register.

4. Inspection, supervision and handling of violations of the law in the field of implementation of the Apostille Convention.

5. Training and professional development of officials and civil servants carrying out the issuance of Apostilles.

6. Dissemination and communication of the law on the Apostille Convention.

7. International cooperation in the field of implementation of the Apostille Convention.

8. Statistical reporting on the implementation of the Apostille Convention.

Article 30. Responsibilities of the Ministry of Foreign Affairs

The Ministry of Foreign Affairs shall assist the Government in unified state management of the implementation of the Apostille Convention and shall have the following tasks and powers:

1. Serve as the national focal point for the implementation of the Apostille Convention; take charge of the organization and implementation of this Decree.

3. Develop, manage and operate the Apostille Information System, the electronic register and the technical infrastructure for the issuance of Apostilles; ensuring connectivity and interoperability with the National Public Service Portal.

4. Prescribe the presentation format of the model Apostille; issue application forms, interactive electronic forms and professional forms; organize the printing and issuance of the model Apostille; notify the model Apostille of Vietnam to the depositary of the Convention and Contracting States through diplomatic channels.

5. Update and publish the list of Contracting States in respect of which the Convention is in force for Vietnam and information on whether these Contracting States continue to recognize or do not recognize the results of consular authentications issued prior to the date the Convention enters into force for the Socialist Republic of Vietnam; make publicly available on the Ministry of Foreign Affairs' electronic information portal and the National Public Service Portal.

6. Serve as the national focal point for verification of Apostilles under the Apostille Convention; monitor and compile verification of Apostilles issued by Vietnam at the request of foreign authorities; assist domestic agencies and organizations in verifying Apostilles issued by Contracting States and follow up with the competent authority of the Contracting State in cases of delayed response to verification requests.

7. Guide and inspect the implementation of this Decree; take charge and coordinate with relevant ministries and ministerial-level agencies to review and issue lists and professional guidance documents on categories of public documents within and outside the scope of Apostille issuance in accordance with specialized law. The lists and professional guidance documents shall be made publicly available on the Ministry of Foreign Affairs' electronic information portal for uniform reference and application by agencies, organizations and individuals.

8. Compile and report to the Government on the implementation of the Apostille Convention on an annual basis or as required.

Article 31. Responsibilities of ministries, ministerial-level agencies and People's Committees of provinces and centrally-affiliated cities

Ministries, ministerial-level agencies and People's Committees of provinces and centrally-affiliated cities, within the scope of their tasks and powers, shall:

Article 32. Responsibilities of agencies and organizations that prepare and issue public documents of Vietnam

1. Be legally responsible for the authenticity, content and form of documents they prepare and issue.

2. Promptly notify the Ministry of Foreign Affairs of specimen seals, signatures, titles, authority and authorization periods of agencies, organizations and persons authorized to sign and issue public documents in accordance with the law on consular authentication and consular legalization.

3. Agencies and organizations that prepare and issue public documents, upon receipt of a verification request as prescribed in clause 2 of Article 15 of this Decree, shall be responsible for responding in writing within the deadline prescribed in clause 3 of Article 15 of this Decree.

Article 33. Responsibilities of relevant agencies, organizations and individuals

1. Agencies, organizations and individuals applying for Apostilles shall:

a) Be legally responsible for the intended use, content, authenticity and legality of the documents;

b) Provide relevant information to the Apostille-issuing authority.

2. Vietnamese agencies and organizations receiving and using documents bearing an Apostille by a Contracting State shall:

b) Proactively coordinate with the competent authority to verify the authenticity of foreign documents when necessary.

Chapter V

ENFORCEMENT PROVISIONS

Article 34. Entry into force

This Decree comes into force as of September 11, 2026.

Article 35. Application of law on Apostilles and consular authentication and consular legalization

1. From the date this Decree comes into force, the certification of public documents for use in a Contracting State in respect of which the Convention is in force for Vietnam shall be governed by the provisions of this Decree.

2. Consular authentication and consular legalization shall continue to be carried out in accordance with the law on consular authentication and consular legalization in the following cases:

a) Public documents of Vietnam for use in a country that is not a Contracting State;

c) Other cases outside the scope of this Decree.

Article 36. Transitional provisions

1. Applications for consular authentication in respect of public documents of Vietnam that were validly received prior to the date this Decree comes into force but have not yet been resolved by that date, including cases where the application is in the process of additional verification, shall continue to be processed and results delivered in accordance with the law on consular authentication and consular legalization. The use of such consular authentication results in a Contracting State shall be governed by international treaties to which the Socialist Republic of Vietnam is a party or the principle of reciprocity. The person issued with the consular authentication shall have the right to apply for an Apostille in respect of that public document as prescribed in this Decree.

2. The transitional mechanism for documents already certified or authenticated prior to the date this Decree comes into force shall be as follows:

a) Public documents of Contracting States that have been consularly legalized by the competent authority of Vietnam prior to the date this Decree comes into force shall continue to be valid for use in Vietnam; receiving agencies and organizations shall not require the user to carry out Apostille procedures in respect of such public documents;

b) Public documents of Vietnam that have been consularly authenticated prior to the date this Decree comes into force and that need to be used in a Contracting State in respect of which the Convention is in force for Vietnam, the person issued with the consular authentication shall have the right to apply to the Apostille-issuing authority for an Apostille in respect of that public document as prescribed in this Decree, without being required to apply for re-issuance of the original public document. Fees shall be charged in accordance with Article 9 of this Decree.

3. From the date the Convention enters into force in relation to Vietnam, Apostilles issued by competent authorities of Contracting States in respect of which the Convention is in force for Vietnam prior to that date shall be received and used in Vietnam where they do not fall within the cases of refusal prescribed in Article 26 of this Decree.

4. The deployment of electronic components in the issuance and management of Apostilles shall be carried out in accordance with the implementation roadmap for the Apostille Information System as follows:

a) During the period before the Apostille Information System is put into operation, the Apostille-issuing authority shall issue paper Apostilles as prescribed in this Decree; the receipt and processing of applications by online submission shall be carried out on the administrative procedure processing information system of the Ministry of Foreign Affairs connected to the National Public Service Portal; aspects of the procedure that are eligible to be carried out in an electronic environment shall be deployed on these systems immediately; the recording, storage, online lookup and verification of issued Apostilles shall be carried out on the basis of the retained records, ensuring that the requirements of the Apostille Convention are met;

c) The Minister of Foreign Affairs shall announce the time when the Apostille Information System is put into operation and shall direct the transition of the method of issuing Apostilles, ensuring uninterrupted issuance of Apostilles.

Article 37. Implementation

1. From the date the Apostille Convention enters into force for the Socialist Republic of Vietnam, diplomatic missions and consular posts of Vietnam abroad shall not carry out consular legalization in respect of public documents of Contracting States in respect of which the Convention is in force for Vietnam that are exempt from consular legalization under the provisions of the Apostille Convention.

2. The Ministry of Foreign Affairs shall guide and inspect the implementation of clause 1 of this Article; direct diplomatic missions and consular posts of Vietnam abroad to notify the competent authorities of the host country, the Vietnamese community and relevant organizations and individuals of the application of the Apostille mechanism in place of consular legalization in respect of public documents of Contracting States in respect of which the Convention is in force for Vietnam, and guide the carrying out of Apostille issuance procedures. Notifications shall be made in a timely manner, ensuring uninterrupted authentication of public documents.

3. Ministers, Heads of ministerial-level agencies and Chairpersons of People's Committees of provinces and centrally-affiliated cities shall implement this Decree.
