NGHỊ ĐỊNH

QUY ĐỊNH CHỨC NĂNG, NHIỆM VỤ, QUYỀN HẠN VÀ CƠ CẤU TỔ CHỨC CỦA BỘ KHOA HỌC VÀ CÔNG NGHỆ

Căn cứ Luật Tổ chức Chính phủ số 63/2025/QH15;

Theo đề nghị của Bộ trưởng Bộ Khoa học và Công nghệ;

Chính phủ ban hành Nghị định quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Khoa học và Công nghệ.

Điều 1. Vị trí và chức năng

Bộ Khoa học và Công nghệ là cơ quan của Chính phủ, thực hiện chức năng quản lý nhà nước về hoạt động nghiên cứu khoa học, phát triển công nghệ, đổi mới sáng tạo, phát triển công nghệ cao, công nghệ chiến lược, phát triển tiềm lực khoa học và công nghệ; sở hữu trí tuệ; tiêu chuẩn, quy chuẩn kỹ thuật, đo lường, chất lượng sản phẩm, hàng hóa; năng lượng nguyên tử, an toàn bức xạ và hạt nhân; bưu chính; viễn thông; tần số vô tuyến điện; công nghiệp công nghệ số; ứng dụng công nghệ thông tin; trí tuệ nhân tạo; giao dịch điện tử; chuyển đổi số quốc gia; quản lý nhà nước đối với các dịch vụ công thuộc ngành, lĩnh vực quản lý của bộ theo quy định của pháp luật.

Điều 2. Nhiệm vụ và quyền hạn

Bộ Khoa học và Công nghệ thực hiện các nhiệm vụ, quyền hạn theo quy định của Luật Tổ chức Chính phủ, quy định của Chính phủ về chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của bộ, cơ quan ngang bộ và các nhiệm vụ, quyền hạn cụ thể sau đây:

1. Trình Chính phủ dự án, dự thảo: luật, nghị quyết của Quốc hội, pháp lệnh, nghị quyết của Ủy ban Thường vụ Quốc hội, nghị định của Chính phủ theo chương trình, kế hoạch xây dựng pháp luật hàng năm của Chính phủ và các nghị quyết, dự án, đề án theo phân công của Chính phủ, Thủ tướng Chính phủ.

2. Trình Chính phủ, Thủ tướng Chính phủ chiến lược, quy hoạch, kế hoạch phát triển dài hạn, trung hạn; công trình, chương trình, dự án, đề án quan trọng quốc gia thuộc ngành, lĩnh vực được giao quản lý; các quyết định, chỉ thị và các văn bản khác thuộc thẩm quyền của Thủ tướng Chính phủ.

3. Ban hành thông tư, quyết định, chỉ thị và các văn bản khác về ngành, lĩnh vực thuộc phạm vi quản lý nhà nước của bộ.

4. Xây dựng, ban hành kế hoạch tổng thể về khoa học, công nghệ và đổi mới sáng tạo 05 năm; kế hoạch về khoa học, công nghệ và đổi mới sáng tạo 05 năm của Bộ Khoa học và Công nghệ; hướng dẫn xây dựng, tổng hợp, kiểm tra kế hoạch về khoa học, công nghệ và đổi mới sáng tạo hàng năm của bộ, ngành, địa phương; phê duyệt các chương trình, nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo thuộc phạm vi quản lý nhà nước của bộ và theo phân cấp, ủy quyền của Chính phủ, Thủ tướng Chính phủ.

5. Chỉ đạo, hướng dẫn, kiểm tra và chịu trách nhiệm tổ chức thực hiện các văn bản quy phạm pháp luật, chiến lược, quy hoạch, kế hoạch, chương trình, đề án đã được phê duyệt.

6. Cấp, cấp lại, công nhận, sửa đổi, bổ sung, gia hạn, tạm đình chỉ, đình chỉ, thu hồi, chấm dứt, hủy bỏ hiệu lực các loại giấy phép, giấy chứng nhận, giấy xác nhận, giấy công nhận, giấy đăng ký trong phạm vi quản lý nhà nước về các ngành, lĩnh vực của bộ theo quy định của pháp luật.

7. Về hoạt động khoa học, công nghệ và đổi mới sáng tạo

a) Thực hiện quản lý nhà nước về khoa học, công nghệ và đổi mới sáng tạo trên phạm vi cả nước bao gồm: nghiên cứu cơ bản; nghiên cứu ứng dụng; phát triển công nghệ; phát triển giải pháp xã hội; sản xuất thử nghiệm; ứng dụng, chuyển giao công nghệ; đổi mới sáng tạo dựa trên đổi mới công nghệ, sáng tạo công nghệ, nâng cao hiệu suất công nghệ; khởi nghiệp sáng tạo; cung cấp dịch vụ khoa học, công nghệ và đổi mới sáng tạo; hoạt động sáng kiến, cải tiến kỹ thuật, sáng tạo tri thức và hoạt động liên quan khác;

b) Hướng dẫn các bộ, ngành, địa phương về chuyên môn, nghiệp vụ quản lý hoạt động khoa học, công nghệ và đổi mới sáng tạo;

c) Quản lý các nhiệm vụ, chương trình khoa học, công nghệ và đổi mới sáng tạo thuộc phạm vi quản lý của bộ; hướng dẫn, xây dựng, thẩm định và quản lý các nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo đặc biệt, chương trình khoa học, công nghệ và đổi mới sáng tạo quốc gia đặc biệt, chương trình khoa học, công nghệ và đổi mới sáng tạo quốc gia;

d) Rà soát, đánh giá định kỳ và trình Chính phủ, Thủ tướng Chính phủ ban hành danh mục công nghệ cao được ưu tiên đầu tư phát triển và danh mục sản phẩm công nghệ cao được khuyến khích phát triển, danh mục công nghệ chiến lược và sản phẩm công nghệ chiến lược, danh mục công nghệ khuyến khích chuyển giao, danh mục công nghệ hạn chế chuyển giao, danh mục công nghệ cấm chuyển giao;

đ) Thực hiện quản lý nhà nước và tổ chức đánh giá hoạt động khoa học, công nghệ và đổi mới sáng tạo theo quy định;

e) Thực hiện quản lý nhà nước về hoạt động công nghệ cao, công nghệ chiến lược; xây dựng, hướng dẫn và tổ chức thực hiện cơ chế, chính sách phát triển công nghệ, công nghệ cao, công nghệ chiến lược, công nghệ lõi; thúc đẩy ứng dụng, chuyển giao công nghệ, đổi mới công nghệ; phát triển thị trường khoa học và công nghệ tại Việt Nam; phát triển hệ thống đổi mới sáng tạo; khuyến khích sáng kiến, cải tiến kỹ thuật, hợp lý hóa sản xuất;

g) Xây dựng, hướng dẫn và tổ chức thực hiện cơ chế, chính sách ưu đãi, hỗ trợ, tài trợ, đặt hàng khuyến khích, thúc đẩy đổi mới sáng tạo và huy động nguồn lực đầu tư cho đổi mới sáng tạo;

h) Xây dựng, trình Chính phủ quy định cụ thể thẩm quyền, trình tự, thủ tục, điều kiện cấp Giấy chứng nhận đủ điều kiện hoạt động dịch vụ đánh giá, giám định công nghệ, điều kiện đặc thù về nhân lực, cơ sở vật chất - kỹ thuật đối với tổ chức thực hiện hoạt động thẩm định giá công nghệ và tổ chức thực hiện sau khi được ban hành;

i) Xây dựng, hướng dẫn và tổ chức thực hiện cơ chế, chính sách về hoạt động đánh giá, thẩm định, giám định công nghệ, chuyển giao công nghệ theo quy định của pháp luật; quản lý hoạt động nhập khẩu máy móc, thiết bị, dây chuyền công nghệ đã qua sử dụng; quản lý việc xác định dự án đầu tư sử dụng công nghệ lạc hậu, tiềm ẩn nguy cơ gây ô nhiễm môi trường, thâm dụng tài nguyên; giám định chất lượng và giá trị máy móc, thiết bị, dây chuyền công nghệ của dự án đầu tư; thẩm định, có ý kiến về công nghệ theo quy định của pháp luật;

k) Hướng dẫn quy trình xác định và chấp nhận rủi ro trong hoạt động khoa học, phát triển công nghệ và đổi mới sáng tạo sử dụng ngân sách nhà nước;

l) Hướng dẫn việc thành lập, quản lý, phát triển các mạng lưới đổi mới sáng tạo, các tổ chức, trung tâm đổi mới sáng tạo, hỗ trợ đổi mới sáng tạo; xây dựng, hướng dẫn, tổ chức thực hiện tiêu chí xác định trung tâm đổi mới sáng tạo theo quy định của pháp luật;

m) Hỗ trợ, khuyến khích tổ chức, cá nhân ứng dụng, chuyển giao, đổi mới công nghệ; mua bản quyền công nghệ, mua bí quyết công nghệ;

n) Tổ chức đánh giá, lựa chọn, công bố công nghệ tạo ra từ kết quả nghiên cứu khoa học, phát triển công nghệ và đổi mới sáng tạo;

o) Xây dựng, hướng dẫn và tổ chức thực hiện cơ chế thử nghiệm có kiểm soát (Sandbox) đối với các sản phẩm, dịch vụ và mô hình kinh doanh mới dựa trên công nghệ thuộc phạm vi quản lý của bộ;

p) Xây dựng, hướng dẫn và tổ chức thực hiện cơ chế, chính sách về xác định, công nhận, ưu đãi, hỗ trợ phát triển; quản lý, hướng dẫn việc thành lập; xây dựng, vận hành và phát triển các chủ thể, thiết chế hỗ trợ khởi nghiệp sáng tạo, bao gồm: tổ chức hỗ trợ khởi nghiệp sáng tạo, trung tâm hỗ trợ khởi nghiệp sáng tạo, cơ sở ươm tạo công nghệ, ươm tạo doanh nghiệp khoa học và công nghệ, cơ sở kỹ thuật, khu làm việc chung hỗ trợ khởi nghiệp sáng tạo, cá nhân, nhóm cá nhân, doanh nghiệp khởi nghiệp sáng tạo, doanh nghiệp khoa học công nghệ, chuyên gia hỗ trợ khởi nghiệp sáng tạo, nhà đầu tư khởi nghiệp sáng tạo, quỹ đầu tư mạo hiểm, hạ tầng, mạng lưới, hệ sinh thái khởi nghiệp sáng tạo theo quy định của pháp luật;

q) Xây dựng và triển khai các chương trình, đề án, dự án hỗ trợ khởi nghiệp sáng tạo, phát triển doanh nghiệp khoa học và công nghệ, cơ sở ươm tạo công nghệ, ươm tạo doanh nghiệp khoa học và công nghệ; hướng dẫn hỗ trợ, quản lý việc thành lập hoặc tham gia thành lập doanh nghiệp, tham gia góp vốn vào doanh nghiệp để thương mại hóa kết quả nghiên cứu khoa học, phát triển công nghệ theo quy định của pháp luật.

8. Về phát triển tiềm lực khoa học, công nghệ, đổi mới sáng tạo và chuyển đổi số

a) Hướng dẫn thực hiện cơ chế tự chủ, tự chịu trách nhiệm của các tổ chức khoa học và công nghệ công lập; trình Thủ tướng Chính phủ ban hành danh mục dịch vụ sự nghiệp công cơ bản, thiết yếu thuộc lĩnh vực khoa học và công nghệ; chủ trì, phối hợp với Bộ Tài chính và các bộ, cơ quan liên quan trình cấp có thẩm quyền ban hành và tổ chức thực hiện các cơ chế, chính sách nâng cao năng lực tự chủ của tổ chức khoa học và công nghệ công lập;

b) Thành lập, thẩm định việc thành lập, tổ chức lại, giải thể tổ chức khoa học và công nghệ công lập theo quy định của pháp luật;

c) Tổ chức thực hiện các cơ chế, chính sách về đào tạo, bồi dưỡng, quản lý, sử dụng, trọng dụng nhân lực, nhân tài trong lĩnh vực khoa học, công nghệ, đổi mới sáng tạo và chuyển đổi số; xây dựng và tổ chức thực hiện kế hoạch đào tạo, bồi dưỡng, nâng cao trình độ chuyên môn, nghiệp vụ về khoa học, công nghệ, đổi mới sáng tạo và chuyển đổi số;

d) Quản lý, hướng dẫn và tổ chức thực hiện hoạt động thông tin, thư viện, thống kê khoa học, công nghệ và đổi mới sáng tạo; đánh giá, xếp loại tạp chí khoa học; bổ sung tập trung nguồn tin khoa học và công nghệ quốc tế; đầu tư phát triển Hệ thống thông tin quốc gia về khoa học, công nghệ và đổi mới sáng tạo.

9. Về sở hữu trí tuệ

a) Xây dựng, hướng dẫn, tổ chức thực hiện quy trình, thủ tục xác lập và chuyển nhượng quyền sở hữu công nghiệp của tổ chức, cá nhân; quản lý hoạt động đại diện sử dụng đối tượng sở hữu công nghiệp, đại diện sở hữu công nghiệp, giám định sở hữu công nghiệp và các dịch vụ về sở hữu trí tuệ;

b) Thực hiện quản lý nhà nước về hoạt động sáng kiến;

c) Quản lý việc sử dụng dấu hiệu chỉ địa danh quốc gia trong đăng ký nhãn hiệu chứng nhận, nhãn hiệu tập thể cho sản phẩm, dịch vụ quốc gia của Việt Nam; xây dựng và tổ chức quản lý việc sử dụng biểu trưng, chỉ dẫn địa lý quốc gia Việt Nam; thực hiện các biện pháp bảo vệ quyền và lợi ích hợp pháp của Nhà nước, tổ chức, cá nhân trong lĩnh vực sở hữu công nghiệp;

d) Hướng dẫn về nghiệp vụ sở hữu công nghiệp cho các cơ quan quản lý, tổ chức, cá nhân; hỗ trợ tổ chức, cá nhân quản lý, khai thác, phát triển tài sản trí tuệ, xác định giá trị quyền sở hữu trí tuệ; thúc đẩy thương mại hóa, chuyển giao và phát triển tài sản trí tuệ theo quy định của pháp luật;

đ) Chủ trì tổ chức giải quyết tranh chấp về sở hữu công nghiệp và tranh chấp thương mại liên quan theo quy định của pháp luật.

10. Về tiêu chuẩn, quy chuẩn kỹ thuật, đo lường, chất lượng sản phẩm, hàng hóa

a) Thực hiện quản lý nhà nước về tiêu chuẩn, quy chuẩn kỹ thuật; chủ trì, phối hợp với các bộ, ngành, địa phương tổ chức xây dựng, thẩm định, công bố tiêu chuẩn quốc gia; là đầu mối quốc gia triển khai các cam kết về hàng rào kỹ thuật trong thương mại (TBT), bao gồm hoạt động thông báo, hỏi đáp, xử lý quan ngại thương mại, tham gia đàm phán và điều phối mạng lưới TBT theo quy định của pháp luật;

b) Thực hiện quản lý nhà nước về hoạt động đo lường đối với chuẩn đo lường, phương tiện đo, phép đo, lượng của hàng đóng gói sẵn, hoạt động kiểm định, hiệu chuẩn, thử nghiệm phương tiện đo; quản lý hệ thống chuẩn đo lường; phê duyệt chuẩn đo lường quốc gia; chỉ định tổ chức giữ chuẩn đo lường quốc gia; hỗ trợ đổi mới, phát triển hoạt động đo lường trong doanh nghiệp; thực hiện kiểm tra nhà nước về đo lường theo quy định của pháp luật;

c) Là cơ quan đầu mối chịu trách nhiệm trước Chính phủ trong việc thực hiện thống nhất quản lý nhà nước về chất lượng sản phẩm, hàng hóa; chủ trì, phối hợp với các bộ quản lý ngành, lĩnh vực, ủy ban nhân dân cấp tỉnh xây dựng, hướng dẫn, tổ chức thực hiện cơ chế, chính sách, kế hoạch về chất lượng sản phẩm, hàng hóa, truy xuất nguồn gốc sản phẩm, hàng hóa; thực hiện quản lý nhà nước về chất lượng sản phẩm, hàng hóa trong sản xuất và hàng hóa xuất khẩu, nhập khẩu, lưu thông trên thị trường, trên môi trường số, nền tảng số, thương mại điện tử; tổ chức kiểm tra, giám sát chất lượng theo quy định của pháp luật;

d) Quản lý nhà nước, hướng dẫn, triển khai và kiểm tra hoạt động đánh giá sự phù hợp; tổ chức công nhận năng lực các tổ chức đánh giá sự phù hợp; chỉ định các tổ chức đánh giá sự phù hợp theo quy định của pháp luật; tổ chức thực hiện các điều ước quốc tế, thỏa thuận quốc tế và thừa nhận lẫn nhau về kết quả đánh giá sự phù hợp;

đ) Tổ chức triển khai các hoạt động nâng cao năng suất, chất lượng sản phẩm, hàng hóa và hỗ trợ đổi mới sáng tạo trong doanh nghiệp; quản lý và tổ chức thực hiện Giải thưởng Chất lượng Quốc gia; quản lý việc xét tặng giải thưởng chất lượng hàng hóa của tổ chức, cá nhân; tổ chức triển khai áp dụng hệ thống quản lý chất lượng tiên tiến trong cơ quan, tổ chức, doanh nghiệp;

e) Thực hiện quản lý nhà nước về mã số, mã vạch, nhãn hàng hóa, nhãn điện tử, hộ chiếu số và truy xuất nguồn gốc của sản phẩm, hàng hóa; xây dựng, quản lý, vận hành, duy trì và khai thác hệ thống giám sát chất lượng sản phẩm, hàng hóa quốc gia;

g) Thực hiện quản lý nhà nước về hạ tầng chất lượng quốc gia (NQI).

11. Về năng lượng nguyên tử, an toàn bức xạ và hạt nhân

a) Thực hiện quản lý nhà nước về năng lượng nguyên tử trong các ngành kinh tế - kỹ thuật; thực hiện các dự án, chương trình, đề án, nhiệm vụ ưu tiên cấp quốc gia trong lĩnh vực năng lượng nguyên tử; theo dõi đôn đốc tình hình thực hiện các dự án, chương trình, đề án, nhiệm vụ ưu tiên của các bộ, ngành, địa phương trong lĩnh vực năng lượng nguyên tử;

b) Thực hiện quản lý nhà nước về bảo đảm an toàn bức xạ và hạt nhân, an ninh và thanh sát hạt nhân, ứng phó sự cố bức xạ và hạt nhân;

c) Thanh tra, kiểm tra và xử lý vi phạm về bảo đảm an toàn bức xạ và an toàn hạt nhân đối với các hoạt động trong lĩnh vực năng lượng nguyên tử; giám sát an toàn bức xạ, an toàn hạt nhân và an ninh hạt nhân;

d) Tổ chức quản lý mạng lưới quan trắc và cảnh báo phóng xạ môi trường quốc gia và hệ thống chuẩn đo lường bức xạ và hạt nhân;

đ) Thực hiện quản lý nhà nước về an toàn, an ninh nhiên liệu hạt nhân, nhiên liệu đã qua sử dụng, vật liệu hạt nhân, vật liệu hạt nhân nguồn, chất thải phóng xạ và hoạt động dịch vụ hỗ trợ ứng dụng năng lượng nguyên tử; quản lý xuất nhập khẩu công nghệ thiết bị bức xạ, nhiên liệu hạt nhân, nhiên liệu hạt nhân đã qua sử dụng, vật liệu hạt nhân và nguồn phóng xạ trong phạm vi cả nước;

e) Quy định việc kiểm soát và xử lý sự cố bức xạ, sự cố hạt nhân; tham gia ứng phó sự cố bức xạ, sự cố hạt nhân theo thẩm quyền; quy định về kiểm soát chiếu xạ nghề nghiệp, chiếu xạ y tế và an toàn bức xạ đối với dân chúng;

g) Tổ chức việc thông báo, khai báo chất phóng xạ, thiết bị bức xạ, vật liệu hạt nhân, thiết bị hạt nhân và cấp giấy phép tiến hành công việc bức xạ theo thẩm quyền, cấp giấy đăng ký hoạt động dịch vụ hỗ trợ ứng dụng năng lượng nguyên tử.

12. Về bưu chính

a) Tổ chức kiểm tra danh mục, cơ chế hỗ trợ và hoạt động cung ứng dịch vụ bưu chính công ích theo quy định của pháp luật;

b) Quy định, quản lý giá và chất lượng dịch vụ bưu chính công ích, dịch vụ bưu chính dành riêng, dịch vụ bưu chính phục vụ cơ quan Đảng, Nhà nước và các dịch vụ bưu chính khác theo quy định của pháp luật;

c) Quản lý tem bưu chính, an toàn trong hoạt động bưu chính theo thẩm quyền;

d) Quản lý bộ mã bưu chính quốc gia, bộ mã số tem bưu chính Việt Nam;

đ) Quy định theo thẩm quyền và hướng dẫn hoạt động của mạng bưu chính công cộng và mạng bưu chính phục vụ cơ quan Đảng, Nhà nước.

13. Về viễn thông

a) Ban hành, quy định giá dịch vụ viễn thông công ích và cơ chế thực hiện hoạt động viễn thông công ích; tổ chức thực hiện chương trình cung cấp dịch vụ viễn thông công ích;

b) Chủ trì xây dựng và tổ chức thực hiện các quy định về quản lý thị trường, cạnh tranh trong lĩnh vực viễn thông, Internet; quản lý hoạt động cung cấp dịch vụ đăng ký, duy trì tên miền; bảo vệ quyền lợi người sử dụng dịch vụ viễn thông, Internet theo quy định của pháp luật;

c) Ban hành và tổ chức thực hiện quy hoạch và các quy định về quản lý và sử dụng kho số viễn thông và tài nguyên Internet; phân bổ, cấp, thu hồi kho số viễn thông và tài nguyên Internet; tổ chức thực hiện việc đấu giá, chuyển nhượng quyền sử dụng các mã, số viễn thông, tên miền quốc gia Việt Nam “.vn”;

d) Ban hành cơ chế, chính sách, quy định và tổ chức thực hiện quản lý giá trong lĩnh vực viễn thông, Internet theo quy định của pháp luật; kiểm soát, đình chỉ áp dụng giá dịch vụ viễn thông khi doanh nghiệp viễn thông áp đặt, phá giá dịch vụ viễn thông gây mất ổn định thị trường viễn thông, làm thiệt hại đến quyền, lợi ích hợp pháp của người sử dụng dịch vụ viễn thông, doanh nghiệp viễn thông khác và Nhà nước; chỉ đạo và hướng dẫn thực hiện chế độ báo cáo, kế toán, kiểm toán phục vụ hoạt động quản lý giá dịch vụ viễn thông, Internet;

đ) Ban hành và tổ chức thực hiện các quy định về quản lý kết nối các mạng viễn thông;

e) Quy định theo thẩm quyền và hướng dẫn hoạt động của mạng viễn thông dùng riêng phục vụ các cơ quan Đảng, Nhà nước;

g) Hướng dẫn việc xây dựng, triển khai kế hoạch, phương án phát triển mạng lưới viễn thông; chỉ đạo, hướng dẫn, kiểm tra việc chia sẻ và sử dụng chung cơ sở hạ tầng viễn thông;

h) Chủ trì trong đảm bảo an toàn cơ sở hạ tầng viễn thông, Internet;

i) Quản lý chất lượng viễn thông, Internet; xây dựng, quản lý, vận hành phòng thử nghiệm, hiệu chuẩn chuyên ngành viễn thông và Internet theo quy định của pháp luật;

k) Thiết lập, quản lý, vận hành, khai thác hệ thống thu thập và quản lý số liệu viễn thông và hệ thống chuyển mạng viễn thông di động mặt đất giữ nguyên số thuê bao viễn thông (trung tâm chuyển mạng);

l) Thiết lập, quản lý, vận hành, khai thác đảm bảo an toàn hệ thống máy chủ tên miền quốc gia, trạm trung chuyển Internet quốc gia VNIX, hệ thống quản lý tài nguyên Internet quốc gia, kết nối với các hệ thống khu vực, quốc tế;

m) Thiết lập hệ thống, nền tảng đo tốc độ truy cập, sử dụng tài nguyên Internet, IPv6; thu thập, thống kê, công bố số liệu về Internet, tài nguyên Internet;

n) Xây dựng chương trình, tổ chức thực hiện thúc đẩy ứng dụng, chuyển đổi Internet sang thế hệ mới IPv6, phát triển Internet công nghiệp, Internet vạn vật (IoT); thúc đẩy phát triển an toàn, bền vững tài nguyên Internet, phổ cập tên miền quốc gia Việt Nam “.vn”;

o) Đăng ký, tiếp nhận chuyển giao, duy trì tài nguyên Internet Việt Nam với các tổ chức khu vực, quốc tế.

14. Về tần số vô tuyến điện

a) Hướng dẫn, tổ chức thực hiện quy hoạch phổ tần số vô tuyến điện quốc gia; hoạt động truyền dẫn, phát sóng theo quy hoạch hạ tầng thông tin và truyền thông được Thủ tướng Chính phủ phê duyệt; xây dựng và thực hiện các giải pháp, chính sách thúc đẩy ứng dụng vô tuyến điện trong các lĩnh vực kinh tế xã hội;

b) Chủ trì, phối hợp với Bộ Quốc phòng, Bộ Công an xây dựng, trình Thủ tướng Chính phủ phê duyệt và hướng dẫn triển khai thực hiện: quyết định phân bổ băng tần phục vụ mục đích quốc phòng, an ninh; cơ chế phối hợp xử lý nhiễu có hại giữa đài vô tuyến điện phục vụ kinh tế - xã hội với đài vô tuyến điện phục vụ mục đích quốc phòng, an ninh;

c) Ban hành và tổ chức thực hiện quy hoạch băng tần, quy hoạch phân kênh tần số, quy hoạch sử dụng kênh tần số; quy định về điều kiện phân bổ, ổn định và sử dụng tần số vô tuyến điện;

d) Quản lý chất lượng phát xạ vô tuyến điện, tương thích điện từ và an toàn bức xạ vô tuyến điện theo quy định của pháp luật; tổ chức thực hiện các biện pháp để ngăn ngừa, phát hiện, chống lại hoặc giảm thiểu tác hại của bức xạ vô tuyến điện đối với con người, môi trường;

đ) Quy định danh mục và điều kiện kỹ thuật, điều kiện khai thác các loại thiết bị vô tuyến điện được miễn giấy phép sử dụng tần số vô tuyến điện;

e) Bồi dưỡng, hướng dẫn nghiệp vụ vô tuyến điện; quản lý việc đào tạo và việc cấp chứng chỉ vô tuyến điện viên theo quy định của pháp luật;

g) Quản lý lệ phí cấp giấy phép sử dụng tần số vô tuyến điện, phí sử dụng tần số vô tuyến điện, tiền cấp quyền sử dụng tần số vô tuyến điện theo quy định của pháp luật;

h) Kiểm tra, kiểm soát tần số và thiết bị vô tuyến điện, xử lý nhiễu có hại; xây dựng, duy trì và vận hành hệ thống giám sát, kiểm soát tần số vô tuyến điện quốc gia;

i) Đăng ký, phối hợp quốc tế về tần số vô tuyến điện và quỹ đạo vệ tinh;

k) Trình cấp có thẩm quyền ban hành và tổ chức thực hiện quy định về đấu giá, thi tuyển và chuyển nhượng quyền sử dụng tần số vô tuyến điện.

15. Về công nghệ số và trí tuệ nhân tạo

a) Trình cấp có thẩm quyền ban hành hoặc ban hành theo thẩm quyền chính sách, ưu đãi, ưu tiên đầu tư phát triển sản phẩm, dịch vụ công nghệ số, bán dẫn, trí tuệ nhân tạo, công nghiệp công nghệ số, công nghiệp bán dẫn; tiêu chí đánh giá, chứng nhận về chức năng, tính năng kỹ thuật của sản phẩm, dịch vụ công nghệ số, bán dẫn, trí tuệ nhân tạo; cơ chế chính sách quản lý và phát triển khu công nghệ số tập trung; công bố danh mục sản phẩm, dịch vụ công nghệ số trọng điểm;

b) Thẩm định các chương trình, kế hoạch, dự án phát triển sản phẩm, dịch vụ công nghệ số, bán dẫn, trí tuệ nhân tạo, công nghiệp công nghệ số, công nghiệp bán dẫn;

c) Quản lý, điều phối, phát triển hạ tầng trí tuệ nhân tạo quốc gia và các hạ tầng khác phục vụ phát triển sản phẩm, dịch vụ công nghệ số, bán dẫn, trí tuệ nhân tạo; quản lý, giám sát hoạt động trí tuệ nhân tạo;

d) Tổ chức các hoạt động hỗ trợ xúc tiến đầu tư, xúc tiến thương mại về sản phẩm, dịch vụ công nghệ số, bán dẫn, trí tuệ nhân tạo, công nghiệp công nghệ số, công nghiệp bán dẫn;

đ) Thực hiện quản lý chất lượng, quản lý hoạt động đánh giá sự phù hợp đối với sản phẩm, dịch vụ công nghệ số, bán dẫn, trí tuệ nhân tạo theo quy định của pháp luật.

16. Về chuyển đổi số quốc gia

a) Tổ chức triển khai, quản lý, hướng dẫn, kiểm tra, đôn đốc thực hiện các nhiệm vụ về chuyển đổi số quốc gia, Chính phủ số, kinh tế số và xã hội số được cấp có thẩm quyền phê duyệt hoặc giao;

b) Xây dựng, duy trì, cập nhật và hướng dẫn triển khai Khung kiến trúc tổng thể quốc gia số; lập kế hoạch và ban hành hệ thống tiêu chuẩn, quy chuẩn kỹ thuật quốc gia;

c) Chủ trì quản lý nhà nước về chuyển đổi số; thực hiện vai trò điều phối quốc gia, phối hợp, đôn đốc việc triển khai các nhiệm vụ chuyển đổi số quốc gia, liên ngành, liên vùng; quản lý, hướng dẫn, kiểm tra, đôn đốc việc thực hiện các nhiệm vụ, dự án đầu tư, mua sắm, thuê dịch vụ chuyển đổi số theo quy định;

d) Chủ trì quản lý nhà nước về hệ thống số, quản lý việc tuân thủ các nguyên tắc kiến trúc và thiết kế, các yêu cầu tối thiểu đối với hệ thống số; tham mưu ban hành tiêu chí, yêu cầu kỹ thuật tối thiểu và danh mục các nền tảng số dùng chung quốc gia; quản lý, giám sát hoạt động xây dựng, vận hành, khai thác nền tảng số dùng chung quốc gia;

đ) Xây dựng, ban hành, cập nhật bộ chỉ số thống nhất phục vụ đánh giá mức độ chuyển đổi số; xây dựng, quản lý, vận hành Nền tảng thống kê, đo lường, giám sát, đánh giá mức độ triển khai chuyển đổi số và công bố mức độ chuyển đổi số cấp quốc gia, cấp bộ, ngành, địa phương;

e) Xây dựng, ban hành, cập nhật Khung năng lực số; hướng dẫn, tổ chức các hoạt động đào tạo, bồi dưỡng, tập huấn, đánh giá, phân tích, tổng hợp thông tin, truyền thông nhằm nâng cao nhận thức, phổ cập năng lực số; thu hút đa dạng các nguồn lực tham gia vào quá trình chuyển đổi số;

g) Xây dựng, hướng dẫn và tổ chức thực hiện Khung kiến trúc Chính phủ số, Khung kiến trúc công nghệ thông tin và truyền thông (ICT) phát triển đô thị thông minh quốc gia, mô hình Trung tâm giám sát, điều hành thông minh cấp tỉnh và hướng dẫn kỹ thuật về xây dựng và ứng dụng bản sao số đô thị;

h) Hướng dẫn, đo lường, thống kê, đánh giá chất lượng việc cung cấp dịch vụ số, dịch vụ công trực tuyến và hệ thống thông tin giải quyết thủ tục hành chính của các cơ quan nhà nước;

i) Xây dựng, quản lý, vận hành phòng thử nghiệm hệ thống thông tin; duy trì, vận hành, phát triển nền tảng tích hợp, chia sẻ dữ liệu quốc gia (NDXP); xây dựng, phát triển nền tảng thống kê, đo lường, giám sát, đánh giá triển khai chuyển đổi số và các nền tảng số phục vụ Chính phủ theo thẩm quyền;

k) Tổ chức đánh giá, kiểm định chất lượng các hệ thống số, hệ thống thông tin, nền tảng số, cơ sở dữ liệu và dịch vụ số phục vụ phát triển Chính phủ số;

l) Chủ trì, điều phối, theo dõi, đánh giá việc triển khai nhiệm vụ phát triển kinh tế số trong các ngành, lĩnh vực, địa phương;

m) Chủ trì, điều phối tổ chức các chương trình, hoạt động hỗ trợ, thúc đẩy chuyển đổi số cho các doanh nghiệp, hợp tác xã, hộ kinh doanh; tổ chức công bố, cập nhật công cụ đánh giá, tài liệu hướng dẫn và danh mục nền tảng số phục vụ chuyển đổi số doanh nghiệp;

n) Hướng dẫn, thúc đẩy hình thành và phát triển các mô hình kinh doanh mới dựa trên công nghệ số, dữ liệu số và đổi mới sáng tạo theo quy định của pháp luật;

o) Chủ trì, điều phối, theo dõi, đánh giá việc triển khai các chương trình, đề án, nhiệm vụ phát triển xã hội số; xây dựng tiêu chí đo lường về xã hội số và định kỳ hằng năm thực hiện điều tra, thu thập, công bố kết quả đo lường về xã hội số ở cấp độ quốc gia và cấp độ địa phương;

p) Hướng dẫn, hỗ trợ, thúc đẩy người dân tham gia xã hội số; phối hợp thu hẹp khoảng cách số.

17. Về giao dịch điện tử

a) Xây dựng và triển khai yêu cầu kỹ thuật, kiểm toán kỹ thuật, chất lượng sản phẩm, dịch vụ trong giao dịch điện tử;

b) Quản lý công tác báo cáo, đo lường, thống kê hoạt động giao dịch điện tử; quản lý việc giám sát an toàn hệ thống thông tin phục vụ giao dịch điện tử của chủ quản hệ thống thông tin; xây dựng, quản lý, vận hành hệ thống tiếp nhận, tổng hợp dữ liệu phục vụ quản lý nhà nước về giao dịch điện tử của cơ quan nhà nước;

c) Quản lý chữ ký điện tử, dịch vụ tin cậy, tổ chức cung cấp dịch vụ tin cậy; công nhận chữ ký điện tử nước ngoài, chứng thư chữ ký điện tử nước ngoài, tổ chức cung cấp dịch vụ chứng thực điện tử nước ngoài tại Việt Nam theo quy định của pháp luật;

d) Quản lý, tổ chức việc xây dựng, khai thác và phát triển hạ tầng chứng thực điện tử quốc gia, hệ thống kiểm tra trạng thái chứng thư chữ ký số; việc phát hành, thu hồi chứng thư chữ ký số;

đ) Quy định việc liên thông giữa các hệ thống cung cấp dịch vụ chữ ký số công cộng và chữ ký số chuyên dùng công vụ.

18. Xây dựng, quản lý, vận hành, khai thác mạng bưu chính, viễn thông dùng riêng, mạng truyền số liệu chuyên dùng phục vụ sự chỉ đạo, điều hành của các cơ quan Đảng, Nhà nước.

19. Quyết định các biện pháp huy động các mạng và dịch vụ, các phương tiện, thiết bị truyền dẫn thông tin phục vụ các trường hợp khẩn cấp về an ninh quốc gia, thiên tai, địch họa theo phân công của Chính phủ, Thủ tướng Chính phủ.

20. Quản lý, hướng dẫn và tổ chức thực hiện việc xét tặng Giải thưởng Hồ Chí Minh, giải thưởng Nhà nước về khoa học, công nghệ và đổi mới sáng tạo, các giải thưởng khác trong các ngành, lĩnh vực thuộc phạm vi quản lý của bộ theo quy định của pháp luật; tổ chức các giải thưởng và thực hiện công tác thi đua, khen thưởng theo quy định của pháp luật.

21. Quyết định và tổ chức thực hiện các biện pháp phòng ngừa, ngăn chặn các hoạt động thông tin vi phạm trong phạm vi chức năng, nhiệm vụ được giao theo quy định của pháp luật.

22. Thực hiện công tác kiểm tra, giám sát, giải quyết khiếu nại, tố cáo; tổ chức tiếp công dân, thực hiện phòng, chống tham nhũng, tiêu cực, lãng phí và xử lý các hành vi vi phạm pháp luật trong các lĩnh vực thuộc phạm vi quản lý của bộ theo quy định của pháp luật.

23. Đào tạo, bồi dưỡng, tập huấn phát triển nguồn nhân lực thuộc phạm vi quản lý của bộ; thực hiện dự báo nhu cầu và định hướng phát triển nhân lực thuộc phạm vi quản lý của bộ.

24. Xây dựng, hướng dẫn và tổ chức thực hiện các hoạt động truyền thông về cơ chế, chính sách, chương trình, đề án, kế hoạch và các hoạt động về khoa học, công nghệ, đổi mới sáng tạo và chuyển đổi số thuộc phạm vi quản lý của bộ; triển khai các nhiệm vụ nhằm phổ biến tri thức khoa học, công nghệ, đổi mới sáng tạo và chuyển đổi số trong phạm vi cả nước.

25. Về hợp tác và hội nhập quốc tế

a) Hướng dẫn và tổ chức thực hiện các hoạt động hội nhập quốc tế trong ngành, lĩnh vực thuộc phạm vi quản lý của bộ theo quy định;

b) Đề xuất ký kết và tổ chức thực hiện điều ước quốc tế, thỏa thuận quốc tế nhân danh Nhà nước và Chính phủ trong các ngành, lĩnh vực thuộc phạm vi quản lý của bộ theo quy định của pháp luật;

c) Quyết định việc ký kết và tổ chức thực hiện thỏa thuận quốc tế nhân danh bộ, các đề án hội nhập quốc tế và khu vực; quản lý, hướng dẫn, kiểm tra việc ký kết và thực hiện thỏa thuận quốc tế nhân danh đơn vị trực thuộc bộ trong các ngành, lĩnh vực thuộc phạm vi quản lý của bộ theo quy định của pháp luật;

d) Chủ trì đàm phán, xem xét tài trợ cho các chương trình, dự án chung với các đối tác quốc tế trong khuôn khổ các điều ước quốc tế, thỏa thuận quốc tế song phương, đa phương, khu vực và liên khu vực; tham gia các tổ chức quốc tế theo phân công của cơ quan có thẩm quyền; triển khai mạng lưới đại diện khoa học và công nghệ ở nước ngoài theo chỉ đạo của Chính phủ, Thủ tướng Chính phủ.

26. Quản lý nhà nước các dịch vụ sự nghiệp công trong các lĩnh vực thuộc phạm vi quản lý của bộ; giám sát, đánh giá, kiểm định chất lượng dịch vụ sự nghiệp công, hiệu quả hoạt động của đơn vị sự nghiệp công lập thuộc lĩnh vực quản lý; thực hiện nhiệm vụ quản lý nhà nước về giá dịch vụ sự nghiệp công theo quy định của pháp luật.

27. Quyết định hoặc trình cấp có thẩm quyền ban hành chế độ, tiêu chuẩn, định mức chi ngân sách đối với lĩnh vực khoa học, công nghệ, đổi mới sáng tạo và chuyển đổi số; hướng dẫn, tổng hợp và đề xuất dự toán chi ngân sách nhà nước cho lĩnh vực khoa học, công nghệ, đổi mới sáng tạo và chuyển đổi số (bao gồm chi đầu tư phát triển và chi thường xuyên) của các bộ, cơ quan ngang bộ, cơ quan khác ở trung ương và các địa phương theo quy định.

28. Xây dựng, quản lý, vận hành các nền tảng số quốc gia, nền tảng số dùng chung, hệ thống kiểm tra, giám sát, hệ thống thông tin, cơ sở dữ liệu quốc gia, cơ sở dữ liệu chuyên ngành về các lĩnh vực thuộc phạm vi quản lý của bộ theo quy định của pháp luật.

29. Quản lý tài chính, tài sản và tổ chức thực hiện ngân sách được giao theo quy định của pháp luật.

30. Quản lý quỹ tài chính nhà nước ngoài ngân sách thuộc bộ quản lý theo quy định của pháp luật; quản lý và tổ chức việc thực hiện các dự án đầu tư thuộc thẩm quyền của bộ theo quy định của pháp luật.

31. Thực hiện quyền, trách nhiệm, nghĩa vụ của đại diện chủ sở hữu nhà nước đối với doanh nghiệp nhà nước và phần vốn nhà nước đầu tư vào doanh nghiệp khác theo quy định của pháp luật.

32. Quản lý tổ chức bộ máy, vị trí việc làm, biên chế công chức, số lượng người làm việc trong đơn vị sự nghiệp công lập và số lượng người lao động theo chế độ hợp đồng lao động của bộ; thực hiện tuyển dụng, sử dụng và quản lý cán bộ, công chức, viên chức, người lao động theo quy định và phân cấp của cơ quan có thẩm quyền.

33. Tổ chức thực hiện công tác quản lý về hội, quỹ, tổ chức phi Chính phủ hoạt động trong ngành, lĩnh vực thuộc phạm vi quản lý nhà nước của bộ theo quy định của pháp luật.

34. Tổ chức thực hiện kế hoạch cải cách hành chính của bộ theo chương trình cải cách hành chính nhà nước đã được Chính phủ, Thủ tướng Chính phủ phê duyệt.

35. Thực hiện các nhiệm vụ, quyền hạn khác do Chính phủ, Thủ tướng Chính phủ giao và theo quy định của pháp luật.

20. Cục Thông tin, Thống kê và Đánh giá khoa học.

22. Học viện Chiến lược Khoa học và Công nghệ.

24. Tạp chí Khoa học và Công nghệ Việt Nam.

25. Trung tâm Chuyển đổi số.

Các đơn vị quy định từ khoản 1 đến khoản 21 Điều này là các tổ chức hành chính giúp Bộ trưởng thực hiện chức năng quản lý nhà nước; các đơn vị quy định từ khoản 22 đến khoản 25 Điều này là các đơn vị sự nghiệp công lập phục vụ chức năng quản lý nhà nước của bộ.

Cục An toàn bức xạ và hạt nhân là Cục loại 1. Cục An toàn bức xạ và hạt nhân và Ủy ban Tiêu chuẩn Đo lường Chất lượng Quốc gia được sử dụng con dấu hình Quốc huy.

Bộ trưởng Bộ Khoa học và Công nghệ trình Thủ tướng Chính phủ ban hành danh sách các đơn vị sự nghiệp công lập khác trực thuộc bộ.

Bộ trưởng Bộ Khoa học và Công nghệ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của các đơn vị trực thuộc bộ theo thẩm quyền.

Điều 4. Điều khoản chuyển tiếp

Học viện Chiến lược Khoa học và Công nghệ, Tạp chí Khoa học và Công nghệ Việt Nam (quy định tại Quyết định số 17/2025/QĐ-TTg ngày 16 tháng 6 năm 2025 của Thủ tướng Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Học viện Chiến lược Khoa học và Công nghệ trực thuộc Bộ Khoa học và Công nghệ); Vụ Khoa học Xã hội, Nhân văn và Tự nhiên, Vụ Kinh tế và Xã hội số, Cục Thông tin, Thống kê, Cục Công nghiệp Công nghệ thông tin, Cục An toàn bức xạ và hạt nhân, Trung tâm Công nghệ thông tin (quy định tại Nghị định số 55/2025/NĐ-CP ngày 02 tháng 3 năm 2025 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Khoa học và Công nghệ) tiếp tục thực hiện nhiệm vụ, quyền hạn theo quy định của pháp luật cho đến khi Bộ trưởng Bộ Khoa học và Công nghệ ban hành Quyết định quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Học viện Chiến lược Khoa học và Công nghệ, Tạp chí Khoa học và Công nghệ Việt Nam, Vụ Khoa học Xã hội và Tự nhiên, Vụ Kinh tế số và Xã hội số, Cục Thông tin, Thống kê và Đánh giá khoa học, Cục Công nghệ số và Trí tuệ nhân tạo, Cục An toàn bức xạ và hạt nhân, Trung tâm Chuyển đổi số.

Điều 5. Hiệu lực thi hành

Nghị định này có hiệu lực thi hành từ ngày 01 tháng 7 năm 2026 và thay thế Nghị định số 55/2025/NĐ-CP ngày 02 tháng 3 năm 2025 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Khoa học và Công nghệ.

Điều 6. Trách nhiệm thi hành

Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương chịu trách nhiệm thi hành Nghị định này.

DECREE

DEFINING FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF SCIENCE AND TECHNOLOGY

Pursuant to the Law on Government Organization No. 63/2025/QH15;

At the request of the Minister of Science and Technology;

The Government hereby promulgates a Decree defining functions, tasks, powers and organizational structures of the Ministry of Science and Technology.

Article 1. Position and functions

The Ministry of Science and Technology is a governmental agency which exercises the function of state management of scientific research, technology development and innovation, high technology and strategic technology development, scientific and technological potential development activities; intellectual property; standards, technical regulations, metrology and quality of products and goods; atomic energy, radiation and nuclear safety; postal services; telecommunications; radio frequencies; digital technology industry; application of information technology; electronic transactions; national digital transformation; state management of public services in the sectors and fields under its management as prescribed by law.

Article 2. Tasks and powers

1. Submit to the Government bills and draft resolutions of the National Assembly, ordinance projects and draft resolutions of the Standing Committee of the National Assembly, draft decrees of the Government formulated under the Ministry's approved annual law-making programs and plans, and other resolutions, projects and schemes as assigned by the Government or the Prime Minister.

2. Submit to the Government and the Prime Minister mid-term and long-term development strategies, planning schemes and plans; works, programs, projects and schemes of national significance in the sectors and fields which it is assigned to manage; decisions, directives and other documents within the competence of the Prime Minister.

3. Promulgate circulars, decisions, directives and other documents on the sectors and fields under its state management.

4. Formulate and promulgate 05-year master plan for science, technology and innovation; 05-year plan for science, technology and innovation of the Ministry of Science and Technology; provide guidance on formulation, consolidation and inspection of annual plans for science, technology and innovation of Ministries, ministries, central and local authorities; approve science, technology and innovation programs and tasks under its state management as decentralized or authorized by the Government or Prime Minister.

5. Direct, provide guidelines on, inspect and take responsibility for organization of implementation of approved legislative documents, strategies, planning schemes, programs and schemes.

6. Issue, re-issue, recognize, amend, supplement, extend, temporarily suspend, suspend, revoke, terminate and invalidate licenses, certificates, recognition and registration certificates within the ambit of its state management of sectors and fields as prescribed by law.

7. Regarding science, technology and innovation activities

a) Perform state management of science, technology, and innovation nationwide, including basic research; applied research; technology development; development of social solutions; pilot production; technology application and transfer; innovation based on technological innovation, technological creativity, enhancement of technological performance; startup and innovation; provision of science, technology, and innovation services; activities related to technical initiatives and improvements, knowledge creation, and other related activities;

b) Provide ministries, central and local authorities with professional guidelines in management of science, technology and innovation activities;

d) Periodically review and assess, and submit to the Government and the Prime Minister for promulgation, the list of high technologies prioritized for investment and development and the list of high-tech products encouraged for development, the list of strategic technologies and strategic technology products, the list of technologies encouraged for transfer, the list of technologies restricted from transfer, and the list of technologies prohibited from transfer;

dd) Perform state management of and organize the assessment of science, technology and innovation activities in accordance with regulations;

e) Perform state management of high technology and strategic technology activities; formulate, provide guidance on, and organize the implementation of mechanisms and policies for the development of technology, high technology, strategic technology, and core technology; promote technology application and transfer and technology innovation; develop the science and technology market in Vietnam; develop the innovation system; encourage technical initiatives and improvements, and production rationalization;

g) Formulate, provide guidance on, and organize the implementation of mechanisms and policies for provision of incentives, support, financing and order placement to encourage and promote innovation and mobilize investment resources for innovation;

h) Formulate and submit to the Government specific regulations on authority, sequence, procedures and conditions for issuance of certificates of eligibility for provision of technology examination and assessment services; special conditions for human resources, physical and technical facilities to be satisfied by technology valuation service providers, and organize the implementation thereof after their promulgation;

i) Formulate, provide guidance on and organize the implementation of mechanisms and policies for technology assessment, examination, appraisal and transfer; manage the import of used machinery, equipment and technology lines; manage the determination of investment projects using outdated technologies, potentially causing environmental pollution and resource intensification; inspect quality and value machinery, equipment and technology lines of investment projects as prescribed by law; examine or give opinions on technology as prescribed by law;

k) Provide guidance on procedures for identifying and accepting risks in science, technology development and innovation activities funded by the state budget;

l) Provide guidance on the establishment, management, and development of innovation networks, innovation and innovation support organizations and centers; formulate, provide guidance on, and organize the implementation of criteria for identifying innovation centers in accordance with law;

m) Support and encourage organizations and individuals to apply, transfer, and innovate technologies; purchase technology copyrights and know-how;

o) Formulate, provide guidance on, and organize the implementation of sandboxes for new technology-based products, services, and business models under its management;

p) Formulate, provide guidance on and organize the implementation of mechanisms and policies for determining, recognizing, incentivizing and encouraging the development; manage and provide guidance on the establishment; develop, operate, and develop entities and institutions supporting startup and innovation, including startup and innovation support organizations, startup and innovation support centers, technology incubators, science and technology business incubators, technical facilities, co-working spaces, individuals, groups of individuals, startups, science and technology enterprises, experts supporting startup and innovation, startup and innovation investors, venture capital funds, infrastructure, innovative start-up networks and ecosystems as prescribed by law;

q) Formulate and implement programs, schemes and projects supporting startup and innovation and develop science and technology enterprises, technology incubators, science and technology enterprise incubators; provide guidance on supporting and managing the establishment of or participation in the establishment of enterprises and contribution of capital to enterprises for the commercialization of results of scientific research and technology development in accordance with law.

8. Regarding development of scientific and technological potential, innovation and digital transformation

a) Provide guidance on the exercise of autonomy and self-responsibility by public scientific and technological institutions; submit to the Prime Minister for promulgation the list of basic and essential public science and technology services; preside over and cooperate with the Ministry of Finance, ministries and agencies concerned in submitting to a competent authority for promulgation and organize the implementation of mechanisms and policies to improve public scientific and technological institutions’ autonomy capacity;

b) Establish and appraise the establishment, re-organization or dissolution of public scientific and technological institutions in accordance with law;

c) Organize the implementation of mechanisms and polices for training, refresher training, management, employment, and preferential treatment of talents in the fields of science, technology, innovation and digital transformation; formulate and organize the implementation of plans to provide training and refresher training and develop expertise in science, technology, innovation and digital transformation;

d) Manage, provide guidance on and organize communication, library and statistical activities in relation to science, technology and innovation; assess and classify scientific journals; supplement concentrated international science and technology information sources; invest in the development of the national science, technology and innovation information system.

9. Regarding intellectual property

b) Perform the state management of innovative activities;

c) Manage the use of variations of geographical indications to register certification trademarks and collective trademarks for national products and services of Viet Nam; formulate and organize the management of the use of the national emblem and geographical indications of Viet Nam; implement measures to protect the legitimate rights of the State, organizations and individuals in the field of industrial property;

d) Provide professional guidance on industrial property to regulatory bodies, organizations and individuals; assist organizations and individuals in managing, exploiting and developing intellectual property and determining the value of intellectual property rights; promote the commercialization, transfer and development of intellectual property in accordance with law;

dd) Preside over organizing the resolution of industrial property disputes and related commercial disputes in accordance with law.

10. Regarding standards, technical regulations, metrology and quality of products and goods

a) Perform state management of standards and technical regulations; preside over and cooperate with ministries, central and local authorities in organizing the formulation, appraisal, and announcement of national standards; act as the national conduit to implement commitments on technical barriers to trade (TBT), including notifications, inquiries, handling of trade concerns, participation in negotiations, and coordination of the TBT network in accordance with law;

b) Perform state management of metrology activities involving measurement standards, measuring instruments, measurements, quantities of prepackaged goods, inspection, calibration, and testing of measuring instruments; manage the system of measurement standards; approve national measurement standards; designate organizations to maintain national measurement standards; support innovation and development of measurement activities in enterprises; carry out state inspections of measurement in accordance with law;

c) Act as a conduit responsible to the Government for the uniform state management of product and goods quality; preside over and cooperate with ministries managing sectors and fields and provincial People’s Committees in formulating, providing guidance on, and organizing the implementation of mechanisms, policies, and plans for product and goods quality and tracing; perform state management of quality of products and goods in production and of exports, imports and goods circulated on the market, in digital environment, on digital platforms, and in e-commerce; organize quality inspection and monitoring in accordance with law;

d) Perform state management, provide guidance on, implement, and inspect conformity assessment activities; organize the accreditation of the competence of conformity assessment bodies; designate conformity assessment bodies in accordance with law; organize the implementation of treaties, international agreements and agreements on mutual recognition of conformity assessments;

e) Perform state management of codes, barcodes, goods labels, electronic labels, digital passports, and tracing of products and goods; build, manage, operate, maintain, and exploit the national product and goods quality monitoring system;

g) Perform state management of the national quality infrastructure (NQI).

11. Regarding atomic energy and radiation and nuclear safety

a) Perform state management of atomic energy in techno-economic sectors; implement national priority projects, programs, schemes and tasks in the field of nuclear energy; monitor and expedite the implementation of priority projects, programs, schemes and tasks of ministries, central and local authorities in the field of nuclear energy;

b) Perform state management of assurance about radiation and nuclear safety, nuclear security and nuclear inspection, and response to radiation and nuclear incidents;

c) Inspect, examine, and handle violations concerning radiation and nuclear safety assurance with respect to activities in the field of nuclear energy; supervise radiation safety, nuclear safety, and nuclear security;

d) Organize the management of the national environmental radioactivity observation and warning network and the system of standardized national laboratories in the field of radiation and nuclear measurement;

dd) Perform state management of safety and security of nuclear fuels, spent fuels, nuclear materials, source nuclear materials, radioactive waste and support services for atomic energy application; manage the import and export of radiation technologies and equipment, nuclear fuels, spent nuclear fuels, nuclear materials and radioactive sources nationwide;

e) Prescribe the control and handling of radiation and nuclear accidents; participate in response to radiation and nuclear accidents under its authority; prescribe the control of occupational exposure, medical exposure and radiation safety for the public;

12. Regarding postal services

a) Organize the inspection of list of public postal services, support mechanisms and provision of such services as prescribed by law;

b) Regulate, manage prices and quality of public postal services, private postal services, postal services serving agencies of the Communist Party and the State, and other postal services as per the law;

c) Manage postage stamps and safety of postal operations under its authority;

d) Manage national postal codes and codes of Vietnamese postage stamps;

dd) Under its authority, regulate and provide guidelines for operation of public postal networks and postal networks serving agencies of the Communist Party and the State.

13. Regarding telecommunications

a) Promulgate and stipulate prices of public telecommunications services, and mechanisms for carrying out public telecommunications activities; organize the execution of programs for provision of public telecommunications services;

b) Preside over formulating and organizing the implementation of regulations on market surveillance and competition in the fields of telecommunications and Internet; manage the provision of domain name registration and maintenance services; safeguard interests of telecommunications and Internet service users in accordance with law;

d) Promulgate mechanisms, policies, regulations concerning and organize the management of prices in the fields of telecommunications and the Internet according to regulations of laws; control and suspend the application of prices of telecommunications services in case a telecommunications enterprise imposes or devalues prices of telecommunications services, which destabilizes the telecommunications market and causes damage to rights and legitimate interests of telecommunications service users, other telecommunications enterprises and the State; direct and provide guidance on reporting, accounting and audit regimes for the purpose of management of prices of telecommunications and Internet services;

dd) Promulgate and organize the implementation of regulations on management of connection between telecommunications networks;

e) Regulate and provide guidelines for operations of private telecommunications networks serving agencies of the Communist Party and the State;

g) Provide guidance on formulation and implementation of telecommunications network development plans and schemes; direct, provide guidance on and inspect the sharing and use of shared telecommunications infrastructure;

h) Preside over the assurance of telecommunications and Internet infrastructure safety;

i) Manage telecommunications and Internet quality; develop, manage and operate calibration and testing laboratories for telecommunications and the Internet as prescribed by law;

k) Establish, manage, operate and use systems for collection and management of telecommunications figures and deploy terrestrial mobile number portability (portability center);

l) Establish, manage, operate and use the national domain name server system, Vietnam National Internet Exchange VNIX and national internet resources management system, and connect them with regional and international systems;

m) Establish a system and platform to measure the speed of Internet resources and Ipv6; collect, produce statistics on and publish data on the Internet and Internet resources;

o) Register, receive and maintain Vietnam's Internet resources with regional and international organizations.

14. Regarding radio frequencies

a) Provide guidelines for and organize implementation of the planning scheme for allocation of national radio frequencies; transmission and broadcasting according to the information and communication infrastructure planning scheme approved by the Prime Minister; formulate and implement solutions and policies to promote the application of radio frequencies in socio-economic sectors;

b) Preside over and cooperate with the Ministry of National Defense and Ministry of Public Security in formulating and submitting to the Prime Minister for approval and provision of guidelines for implementation of: decisions on allocation of frequency bands for national defense and security purposes and propose; mechanisms for coordinating the handling of harmful interference between radio stations serving socio-economic purposes and radio stations serving national defense and security purposes;

c) Promulgate and organize the implementation of the frequency band planning scheme, planning scheme for division of frequency channels, planning scheme for use of frequency channels; stipulate conditions for allocation, stabilization and use of radio frequencies;

d) Manage quality of radio emission, electromagnetic compatibility and radio radiation safety as per the law; organize the implementation of measures to prevent, detect, combat, or minimize the harmful effects of radio radiation on humans and the environment;

dd) Regulate the list of and technical conditions and conditions for operation of radio equipment exempt from licenses for use of radio frequencies;

e) Provide refresher training in and professional guidelines on radio frequencies; manage the training in radio frequencies and issuance of radio operator certificates as prescribed by law;

g) Manage fees for issuance of licenses to use radio frequencies, fees for use of radio frequencies, fees for granting the rights to use radio frequencies as prescribed by law;

i) Register international frequencies and advance international cooperation in radio frequencies and satellite orbits;

k) Propose regulations on auction, examination and transfer of rights to use radio frequencies to competent authorities for promulgation and organize implementation thereof.

15. Regarding digital technology and artificial intelligence

a) Propose to competent authorities for promulgation, or promulgate under its authority, policies, incentives and priorities for investment in development of digital technology, semiconductor, artificial intelligence, digital technology industry and semiconductor industry products and services; criteria for assessment and certification of technical features and functions of digital technology, semiconductor and artificial intelligence products and services; mechanisms and policies for management and development of concentrated information technology and digital technology zones; announce the list of key digital technology products and services;

b) Appraise programs, plans and projects pertaining to development of digital technology, semiconductor, artificial intelligence, digital technology industry and semiconductor industry products and services;

c) Manage, coordinate, and develop national artificial intelligence infrastructure and other infrastructure serving the development of digital technology, semiconductor and artificial intelligence products and services; manage and supervise artificial intelligence activities;

d) Organize investment and trade promotion activities in respect of digital technology, semiconductor, artificial intelligence, digital technology industry and semiconductor industry products and services;

dd) Manage quality, manage assessment of conformity of digital technology, semiconductor and artificial intelligence products and services as prescribed by law.

16. Regarding national digital transformation

b) Formulate, maintain, update, and provide guidance on the implementation of the National Digital Enterprise Architecture Framework; formulate plans and promulgate the system of national standards and technical regulations;

c) Preside over state management of digital transformation; perform the role of a national coordinator for, cooperate and expedite the implementation of national, cross-sectoral, and inter-regional digital transformation tasks; manage, provide guidance on, inspect, and expedite the implementation of tasks and projects pertaining to investment in, procurement and hiring of digital transformation services in accordance with regulations;

d) Preside over state management of digital systems and manage compliance with architectural and design principles and minimum requirements applicable to digital systems; advise on the promulgation of criteria and minimum technical requirements and the list of national shared digital platforms; manage and supervise the development, operation, and exploitation of national shared digital platforms;

dd) Formulate, promulgate, and update a uniform set of indicators for assessing the level of digital transformation; build, manage, and operate a Platform for statistics, measurement, monitoring, and assessment of the implementation of digital transformation, and publish the level of digital transformation at the national, ministerial, central and local levels;

e) Build, promulgate, and update the Digital Competence Framework; provide guidance on and organize training, refresher training, assessment, analysis, information consolidation and communication activities to raise awareness of and universalize digital skills; attract diverse resources to the digital transformation process;

g) Establish, maintain, update and adopt the Vietnam E-Government Architecture Framework, National Information and Communications Technology (ICT) Architecture Framework for Smart City Development, Intelligent Operations Center model of provinces, and provide technical guidance on development and application of urban digital twins;

h) Provide guidance on, measure, produce statistics on, and assess the quality of digital services, online public services, and information systems for handling of administrative procedures of state agencies;

i) Build, manage and operate information system testing laboratories; maintain, operate and develop the National Data Exchange Platform (NDXP); build and develop platforms for production of statistics, measurement, monitoring, and assessment of digital transformation implementation and digital platforms serving the Government under its authority;

k) Organize the assessment and inspection of quality of digital systems, information systems, digital platforms, databases, and services serving the development of digital Government;

m) Preside over and coordinate the organization of programs and activities supporting and promoting digital transformation for enterprises, cooperatives, and household businesses; organize the publication and updating of assessment tools, instruction manuals and lists of digital platforms serving enterprise digital transformation;

n) Provide guidance on and promote the formation and development of new business models based on digital technology, digital data and innovation in accordance with law;

o) Preside over, coordinate, monitor and assess the implementation of digital society development programs, schemes and tasks; establish criteria for measuring the digital society and annually conduct surveys, collect and disclose digital society measurement results at the national and local levels;

p) Instruct, assist and encourage the people to participate in the digital society; cooperate in narrowing the digital divide.

17. Regarding e-transactions

a) Formulate and implement technical requirements, technical audits, and audits of quality of products and services in e-transactions;

b) Manage the reporting, measurement, and production of statistics on e-transaction activities; manage the monitoring of security of information systems serving e-transactions by information system owners; build, manage and operate systems for receiving and aggregating data serving the state management of e-transactions by state agencies;

c) Manage e-signatures, trust services, trust service providers; recognize foreign e-signatures, foreign e-signature certificates, foreign electronic authentication service providers in Viet Nam according to regulations of law;

d) Manage and organize the construction, exploitation and development of national electronic certification infrastructure, the system for maintaining and checking the status of digital signature certificates; the issuance and revocation of digital signature certificates;

18. Establish, manage, operate and use private postal networks and telecommunications networks, and specialized data transmission networks serving the direction and administration by agencies of the Communist Party and the State.

19. Decide measures for mobilization of information and communication network, services and equipment in case of emergency pertaining to national security, natural disasters and enemy-inflicted destruction as assigned by the Government and Prime Minister.

20. Manage, provide guidance on and organize the awarding of the Ho Chi Minh Prize, State Prize for science, technology and innovation, other prizes on the sectors and fields under its management as prescribed by law; organize grant of awards and emulation and reward activities as per law.

21. Decide and organize application of measures to prevent illegal information and communication activities within the ambit of its assigned functions and tasks as per law.

22. Conduct inspections and examinations, handle complaints and denunciations; organize receipt of citizens, prevent and combat corruption, misconduct and wastefulness, and handle violations of laws in the fields under its state management as prescribed by law.

23. Provide training and refresher training for development of human resources in the sectors and fields under its management; predict demands and provide directions for development of human resources in the sectors and fields under its management.

24. Formulate, provide guidance on, and organize the implementation of communication activities concerning mechanisms, policies, programs, schemes, plans and activities pertaining to science, technology, innovation, and digital transformation under its management; implement tasks to disseminate knowledge of science, technology, innovation, and digital transformation nationwide.

25. Regarding international cooperation and integration

a) Provide guidelines for and organize the conduct of activities aimed at international integration in the sectors and fields under its management as prescribed;

c) Decide the conclusion of and organize the implementation of international agreements on behalf of the Ministry and international and regional integration schemes; manage, provide guidance on, and inspect the conclusion and implementation of international agreements on behalf of units under the Ministry in sectors and fields under its management in accordance with law;

d) Preside over negotiating and consider financing joint programs and projects with international partners within the framework of bilateral, multilateral, regional and inter-regional agreements; join international organizations as assigned by competent authorities; deploy a network of overseas science and technology representatives under the direction of the Government and the Prime Minister.

26. Perform state management of public services in the fields under its state management; monitor, evaluate, and inspect the quality of public services and the operational efficiency of public service providers in the fields under its management; undertake the task of state management of prices of public services as per law.

27. Decide or submit to competent authorities for promulgation, budget spending regimes, standards and norms applicable to the fields of science, technology, innovation, and digital transformation; provide guidance on, consolidate, and propose state budget expenditure estimates in the fields of science, technology, innovation, and digital transformation (including development investment expenditures and recurrent expenditures) of ministries, ministerial-level agencies, other central-level agencies and localities in accordance with regulations.

28. Develop, manage and operate national digital platforms, shared digital platforms, inspection and monitoring systems, information systems, national databases and specialized databases in fields under its management in accordance with law.

29. Manage allocated finances and assets, and organize implementation of assigned estimates according to regulations of law.

30. Manage off-budget state financial funds under its management in accordance with law; manage and organize the execution of investment projects under its authority as prescribed by law.

31. Exercise rights and fulfill responsibilities and obligations of the State owner’s representative in respect of state-owned enterprises and state capital invested in other enterprises as prescribed by law.

32. Manage its organizational apparatus, job positions, payroll, number of persons working for public service units and number of employees working under employment contracts of the ministry; recruit, employ and manage cadres, civil servants, public employees, and employees in accordance with regulations and under the authority decentralized by competent authorities.

The Minister of Science and Technology shall submit to the Prime Minister for promulgation a list of other public service units affiliated to the Ministry.

The Minister of Science and Technology shall define functions, tasks, powers and organizational structures of units affiliated to the Ministry under his/her authority.

Article 4. Transitional clauses

The National Academy of Advanced Technology and Innovation, Viet Nam Social Sciences Review (specified in the Government’s Decree No. 17/2025/QD-TTg dated June 16, 2025 defining functions, tasks, powers and organizational structure of the National Academy of Advanced Technology and Innovation affiliated to the Ministry of Science and Technology); Department of Social Sciences, Humanities and Natural Sciences, Department of Digital Economy and Digital Society, National Agency for Information and Statistics, Authority of Information Technology Industry, Viet Nam Agency for Radiation and Nuclear Safety, Information Technology Center (specified in the Government’s Decree No. 55/2025/ND-CP dated March 02, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Science and Technology) shall continue to perform their tasks and exercise their powers as prescribed by law until the Minister of Science and Technology promulgates a Decision defining functions, tasks, powers and organizational structures of the National Academy of Advanced Technology and Innovation, Viet Nam Social Sciences Review, Department of Social and Natural Sciences, Department of Digital Economy and Digital Society, National Agency for Scientific Information, Statistics and Evaluation, Digital Technology and Artificial Intelligence Authority, Viet Nam Agency for Radiation and Nuclear Safety and Digital Transformation Center.

Article 5. Effect

This Decree comes into force from July 01, 2026 and supersedes the Government’s Decree No. 55/2025/ND-CP dated March 02, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Science and Technology.

Article 6. Responsibility for implementation

Ministers, heads of ministerial-level agencies, heads of Governmental agencies and Chairpersons of People’s Committees of provinces and central-affiliated cities are responsible for the implementation of this Decree.
