CIRCULAR
PRESCRIBING
TITLES, CODES OF LEVELS AND PROFESSIONAL STANDARDS FOR LEVELS OF CIVIL SERVANTS
SPECIALIZED IN ADMINISTRATIVE MANAGEMENT
Pursuant to the
Law on Cadres and Public Officials dated November 13, 2008;
Pursuant to the Government’s Decree No.
24/2010/ND-CP dated March 15, 2010 on recruitment, placement and management of
civil servants;
Pursuant to the Government's Decree No.
58/2014/ND-CP dated June 16, 2014, defining the functions, tasks, powers and
organizational structure of the Ministry of Home Affairs;
Upon the request of the Director of the
Department of Civil Servant – Public Employee Management;
The Minister of Home Affairs promulgates the
Circular prescribing titles, codes of levels, authority, responsibilities and
professional standards for levels of civil servants specialized in
administrative management as stated hereunder.

Article 1. Scope
This Circular prescribes titles, codes of levels,
authority, responsibilities and professional standards for levels of civil
servants specialized in administrative management.
Article 2. Subjects of
application
This Circular applies to officials and civil
servants specialized in administrative management that work within agencies and
organizations of the Communist Party of Vietnam and the State and
socio-political organizations at the central, provincial and district level,
and public service delivery units (hereinafter referred to as administrative
agencies and entities).

Article 4. General standards of
professional conduct
a) Show great political courage and determination
towards Marxism-Leninism, Ho Chi Minh's ideology, firmly grasp the guidelines
and policies of the Communist Party; prove loyalty to the Fatherland and the
Constitution of the Socialist Republic of Vietnam; protect the interests of the
Fatherland and the people;
b) Fully perform the obligations of civil servants
in accordance with law; duly perform duties assigned by seniors; obey law, maintain
administrative rules, discipline and order; set good examples of compliance
with workplace conduct rules and regulations;
c) Demonstrate dedication, high sense of
responsibility, integrity, honesty, objectivity, impartiality and exemplary
character while on duty; show politeness, good manners, respect and obey
professional etiquette while communicating and dealing with the public;
d) Lead a healthy,
modest and social life; hold ethical values such as diligence, thrift,
integrity, righteousness and impartiality; avoid abusing official position to
seek personal interests; prevent bureaucracy, corruption, extravagance and
misconduct;
dd) Have awareness of continuous learning and
training to improve professional conduct, qualification and competency.

Persons reaching the level of senior specialist are
administrative civil servants subject to ultimate professional qualification
and competency requirements concerning one or several areas of activity in
administrative agencies and entities at the provincial or higher level; are
responsible for advising on, constructing or planning macro policies and
strategies applicable to the relevant sectors, industries or localities; direct
and take charge of implementing regulations and policies.
2. Duties
a) Lead activities of formulating and perfecting
regulatory systems or legal normative documents, socio-economic guidelines and
policies, projects, programs and projects of strategic political, economic,
security, defense, cultural and society significance of Ministries and central
authorities on a nationwide scale, or general socio-economic proposals, programs
and projects of provinces and centrally-affiliated cities;
b) Direct and conduct activities of providing
instructions about and examining the implementation of professional management
regulatory systems and proposing measures and solutions for effective
implementation. In special cases, directly perform official and other duties
assigned by seniors;
c) Take charge of reviewing, evaluating and
proposing plans to amend, supplement and enhance the effectiveness and
efficiency of management activities;
d) Lead activities of conducting study on
scientific research proposals and projects at the ministerial and provincial
level in order to renew and perfect management mechanisms, improve the
effectiveness and efficiency of the operation of agencies and organizations,
and support the implementation of the Communist Party's guidelines and policies
and the State's laws;
dd) Lead activities of compiling and constructing
professional guidance documents of sectors and industries; organize specialized
training, mentoring and coaching courses or courses on dissemination of
knowledge and experience regarding sectors and industries.
3. Professional competence and qualification
standards
a) Fully grasp and understand guidelines and
policies of the Communist Party and laws of the State; development
orientations, strategies and policies of sectors and industries falling within
their remit;

c) Grasp the development status and trends of
domestic and worldwide industries or sectors falling within their remit;
conduct researches aimed at supporting information management and handling
activities;
d) Have the ability to propose and advise on
planning policies, preside over the formulation of bills, draft ordinances,
schemes and programs associated with the professional expertise in sectors and
industries falling within their remit to submit them to competent authorities
to seek their approval decisions;
dd) Master and have a good command of skills in
drafting, presenting, defending and directing the formulation and
implementation of projects, proposals and programs related to state management
activities;
e) Have the ability to analyze, synthesize,
systematize and propose methods of improving or solving practical problems and
challenges within their remit in relevant industries, sectors or localities;
g) Have the ability to organize and direct the application
of scientific and technical advances to improve and enhance the quality and
efficiency of their jobs in relevant industries, sectors or localities;
h) In order to be eligible for the test for
promotion to the level of senior specialist, civil servants must be the persons
who have led activities of formulating and soliciting competent authorities to
adopt at least 02 (two) legal normative documents, or have led activities of
studying and devising at least 02 (two) scientific research projects, proposals
or programs at the ministerial or central level which are successfully tested,
or have led activities of formulating at least 02 (two) specialized or general
economic, cultural or social proposals, projects and programs at the provincial
level which are successfully tested by competent authorities;
i) Gain professional experience in the field of
administration, public affairs or in leadership and management activities. In
order to be accepted as candidates for the test for promotion to the level of
senior specialist, civil servants must have at least 5 years' (60 months’)
experience in holding the principal specialist or equivalent position,
including at least 2 years’ (24 months’) experience in holding the principal
specialist position.
4. Training and mentoring qualification
standards
a) Obtain undergraduate or higher degrees in majors
relevant to their areas of activity;

c) Receive certificates of completion of state
management mentoring or coaching session intended for those holding the
position of senior specialist;
c) Complete certificates of foreign language
proficiency equivalent to level 4 according to the Framework of Reference
for Foreign Language Competency prescribed in the Circular No. 01/2014/TT-BGDDT
dated January 24, 2014 of the Ministry of Education and Training, promulgating
the 6-level Framework of Reference for foreign language proficiency in Vietnam;
dd) Possess graduate certificates in computer
science at the level corresponding to the basic standards for information
technology literacy skills as prescribed in the Circular No. 03/2014/TT-BTTTT
dated March 11, 2014 of the Ministry of Information and Communications,
regulating standards for information technology literacy skills.
Article 6. Level of specialist
1. Responsibilities
Persons reaching the level of principal specialist
are administrative civil servants subject to high professional qualification
and competency requirements concerning one or several areas of activity in
administrative agencies and entities at the district or higher level; are
responsible for performing one or several complicated in-house tasks; advising
on, constructing or taking charge of the implementation of policies and
regulations applicable to the relevant sectors, industries or localities.
2. Duties
a) Head or participate in activities of studying,
formulating and implementing strategies, policies and regulations; building and
perfecting regulatory systems and mechanisms that fall within his/her range of
professional competency and proficiency on a nationwide, provincial and
district scale;
b) Lead activities of studying and formulating
professional management regulations and regulations applicable to sectors,
industries or localities;

d) Take charge of or engage in carrying out
professional activities; compiling reports, keeping statistics on, custody of,
retaining and managing depository documents and records, implementing
professional processes and procedures; constructing, reviewing and perfecting
regulatory mechanisms and policies;
dd) Conduct and lead studies into projects and
proposals on professional management, reform of management tasks, requirements
and improvement of effectiveness of management approaches;
e) Directly perform official and other duties
assigned by seniors
3. Professional competence and qualification
standards
a) Fully grasp the guidelines and policies of the
Party and the laws of the State; political systems and organizational
structures of state agencies, rules and regulations on official duties, civil
servants, and professional knowledge and skills falling within their remit;
b) Take charge of formulating and perfecting
regulatory systems; constructing legal normative documents providing
implemental instructions; drawing up projects, proposals, plans and programs of
action; making assessment of economic and social impacts on policies to be
introduced;
c) Demonstrate proficiency in drafting
administrative documents according to the correct forms, processes, procedures
and authority; successfully present and defend ideas and recommendations;
fulfill assigned managerial and supervisory tasks;
d) Take charge of providing instructions on
implementation and implementing policies and regulations on state management
within their remits or localities where they are working; implement and propose
inspection and assessment measures;
dd) Take charge of cooperating in and directing the
inspection and review of implementation of policies applicable to relevant
sectors, industries or localities;

g) In order to be eligible for the test for
promotion to the level of principal specialist, civil servants must be the
persons who have led activities of formulating, or studying and devising at
least 01 (one) legal normative document, or at least 01 (one) scientific
research project, proposal or program at the ministerial, central, provincial
or district level, which is introduced, brought into effect, or successfully
tested and accredited before being put to use, by competent authorities;
h) Gain professional experience in the field of
administration, public service or in leadership and management activities. In
order to be accepted as candidates for the test for promotion to the level of
principal specialist, civil servants must have at least 5 years' (60 months’)
experience in holding the specialist or equivalent position, including at least
3 years’ (36 months’) experience in holding the specialist position.
4. Training and mentoring qualification
standards
a) Obtain undergraduate or higher degrees in majors
relevant to their areas of activity;
b) Receive graduate certificates of state
management mentoring or coaching session intended for those holding the
position of principal specialist;
c) Complete certificates of foreign language
proficiency equivalent to level 3 according to the Framework of Reference for
Foreign Language Competency prescribed in the Circular No. 01/2014/TT-BGDDT
dated January 24, 2014 of the Ministry of Education and Training, promulgating
the 6-level Framework of Reference for foreign language proficiency in Vietnam,
or certificates of ethnic language proficiency for job positions requiring the
good command of ethnic language;
d) Possess graduate certificates in computer
science at the level corresponding to the basic standards for information
technology literacy skills as prescribed in the Circular No. 03/2014/TT-BTTTT
dated March 11, 2014 of the Ministry of Information and Communications,
regulating standards for information technology literacy skills.

2. Duties
a) Formulate specific plans, planning schemes and
regulations to perform state management tasks falling within their remit;
engage in the development of mechanisms and decisions specific to areas of
management according to legislative regulations and actual situations;
b) Consider handling specific issues under their
delegated authority or provide counsels to solicit competent authorities to do
so; cooperate with their colleagues to carry out related jobs;
c) Direct, expedite, supervise and propose measures
for implementation of regulatory regulations or decisions to ensure
effectiveness;
d) Engage in inspecting, collecting information,
keeping statistics, custody of, retaining or managing documents, records and
data to ensure coherent, accurate and legitimate state management;
dd) Actively cooperate with relevant units and
other civil servants in performing assigned tasks, implementing their assigned
authority and responsibilities;
e) Sum up situations, conduct the analysis and
assessment of work performance and send reports to seniors;
g) Consolidate public opinions and submissions
regarding issues falling within their remit to take them into consideration
before making their recommendations to seniors. Directly perform official and
other duties assigned by seniors.

b) Show the thorough understanding of objectives
and objects of management, regulatory principles and mechanisms within their
remit; understand the basics of psychological science, management science;
scientific management;
c) Clearly understand the process of drawing up
specific plans and decisions and have a good command of their assigned areas of
activities; possess skills in drafting documents and making presentations on
their assigned researches and counsels;
d) Use methods of studying, reviewing, proposing
and improving management activities; have the ability to work independently or
in a team; have the ability to finish work on time and according to quality and
efficiency requirements;
dd) Have a good command of the practical situation
and socio-economic context of management tasks under their delegated authority;
grasp the development trend of domestic industries and sectors;
e) In order to be eligible for the test for
promotion to the level of specialist, civil servants must have at least 3
years’ (36 months’) experience in holding the technical expert or equivalent
position. In case of holding the position of staff member at the time of
application for admission to the test, civil servants must have at least 5
years’ (60 months’) experience in holding this position.
4. Training and mentoring qualification
standards
a) Obtain undergraduate or higher degrees in majors
relevant to their areas of activity;
b) Receive graduate certificates of state
management mentoring or coaching session intended for those holding the
position of specialist;
c) Complete certificates of foreign language
proficiency equivalent to level 2 according to the Framework of Reference for
Foreign Language Competency prescribed in the Circular No. 01/2014/TT-BGDDT
dated January 24, 2014 of the Ministry of Education and Training, promulgating
the 6-level Framework of Reference for foreign language proficiency in Vietnam,

Article 8. Level of technical
expert
1. Responsibilities
Persons reaching the level of technical expert are
administrative civil servants performing tasks subject to technical
specialization requirements in administrative agencies and entities; are
responsible for assisting in leadership, management or supporting senior civil
servants and performing statistics, consolidation and reporting tasks assigned
by seniors.
2. Duties
a) Participate in, support and help the implementation
of official duties and tasks, including specific tasks such as developing and
implementing professional plans and proposals on the basis of sectoral or local
management regulations and regulatory systems;
b) Perform assigned tasks; analyze and evaluate the
effectiveness and submit timely reports according to management requirements
and objectives;
c) Detect and propose solutions to promptly
correcting shortcomings arising in the process of performing official duties by
officeholders in order to ensure serious, coherent and efficacious
implementation of regulatory systems, policies and decisions;
d) Participate in the formulation and
implementation of regulations on management of documents, records, statistics
and archival of documents and data in a complete and accurate manner according
to task requirements.

a) Hold at least secondary school diplomas or
associate degrees in the majors relevant to their work positions;
b) Receive graduate certificates of state
management mentoring or coaching session intended for those holding the
technical expert position;
c) Complete certificates of foreign language
proficiency equivalent to level 1 according to the Framework of Reference
for Foreign Language Competency prescribed in the Circular No. 01/2014/TT-BGDDT
dated January 24, 2014 of the Ministry of Education and Training, promulgating
the 6-level Framework of Reference for foreign language proficiency in Vietnam;

Article 9. Staff member level
1. Responsibilities
Persons reaching the level of staff member are
administrative civil servants executing their assigned tasks within
administrative agencies and entities; are responsible for assisting in
operations of administrative agencies and entities at the district or higher
level.
2. Duties
a) Take on specific assignments such as
photocopying and duplicating documents; receive, register and transfer incoming
and outgoing documents in accordance with regulations of administrative
agencies and entities;
b) Check the document format and report any
incorrect one to direct managers;
c) Strictly comply with confidentiality regulations
for in-house document-related clerical work.
d) Perform other assistant tasks such as security
guards, drivers, attendants, receptionists, technicians and other tasks
assigned by superiors.

b) Understand simple clerical work and other tasks
and duties as required by their job position; strictly comply with regulations
on receipt and transfer when receiving and transferring documents and
materials;
c) Fully grasp internal confidentiality regulations
related to clerical work;
d) Manipulate printing and photocopying tools and
techniques and office equipment.
4. Training and mentoring qualification
standards
a) Graduate at least vocational secondary school
diplomas in the majors relevant to their work position. Except drivers who need
to obtain driving licenses issued by competent authorities;
b) Complete certificates of professional training
session related to assigned work to meet requirements of work duties or
positions.

Article 11. Entry into force
1. This Circular shall enter into force as of December
1, 2014.
2. Annul the Decision No. 414/TCCP-VC dated May 29,
1993 of the Government’s Commission for Organization and Personnel (now the
Ministry of Home Affairs) on the promulgation of professional standards for
administrative ranks of civil servants.
3. Abolish the ranks and codes of the ranks in the
Decision No. 78/2004/QD-BNV dated November 3, 2004 of the Ministry of Home
Affairs on the promulgation of the list of civil servant ranks and the ranks of
public employees, specifically as follows:
a) Typist technician (rank code 01.005);
b) Typing staff member (rank code 01.006);
c) Technical staff member (rank code 01.007);
d) Clerical staff member (rank code 01.008);
dd) Assisting staff member (rank code 01.009);

g) Security staff member (rank code 01.011)/
Civil servants currently holding the positions
mentioned in clause 3 of this Article are changed to the position of staff
member (rank code 01.005) prescribed in Article 9 herein.
Article 12. Implementation responsibilities
1. Ministers, Heads of Ministry-level agencies,
Heads of Governmental bodies, Presidents of People’s Committees of
centrally-affiliated cities and provinces, and other organizations and
individuals involved, shall be responsible for enforcing this Circular.
2. In the course of implementation hereof, if there
is any difficulty that arises, it should be notified to the Ministry of Home
Affairs to seek its instructions or further action./.
