NGHỊ QUYẾT

VỀ VIỆC KÉO DÀI NHIỆM KỲ HOẠT ĐỘNG 2004 – 2009 CỦA HỘI ĐỒNG NHÂN DÂN VÀ ỦY BAN NHÂN DÂN CÁC CẤP

Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung một số điều theo Nghị quyết số 51/2001/QH10;
Sau khi xem xét Tờ trình số 173/TTr-CP ngày 03 tháng 11 năm 2008 của Chính phủ về việc điều chỉnh nhiệm kỳ hoạt động 2004 – 2009 của Hội đồng nhân dân và Ủy ban nhân dân các cấp; Báo cáo thẩm tra số 563/BC-UBPL12 ngày 12 tháng 11 năm 2008 của Ủy ban pháp luật và ý kiến của các vị Đại biểu Quốc hội,

QUYẾT NGHỊ:

Điều 1.

Kéo dài nhiệm kỳ hoạt động 2004 – 2009 của Hội đồng nhân dân và Ủy ban nhân dân các cấp cho đến kỳ họp thứ nhất của Hội đồng nhân dân các cấp khóa sau vào năm 2011.

Ngày bầu cử đại biểu Hội đồng nhân dân các cấp khóa sau do Ủy ban thường vụ Quốc hội ấn định và công bố.

Điều 2.

Ủy ban thường vụ Quốc hội, Chính phủ, Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam trong phạm vi nhiệm vụ, quyền hạn của mình tổ chức thực hiện Nghị quyết này.

Điều 3.

Ủy ban thường vụ Quốc hội, Hội đồng dân tộc, các Ủy ban của Quốc hội, Đoàn đại biểu Quốc hội, các đại biểu Quốc hội trong phạm vi nhiệm vụ, quyền hạn của mình giám sát việc thực hiện Nghị quyết này.

Điều 4.

Nghị quyết này có hiệu lực thi hành từ ngày 01 tháng 4 năm 2009.

Nghị quyết này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XII, kỳ họp thứ 4 thông qua ngày 14 tháng 11 năm 2008.

RESOLUTION

ON PROLONGATION OF THE 2004-2009 TERM OF OFFICE OF PEOPLES COUNCILS AND PEOPLES COMMITTEES AT ALL LEVELS

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10;
After considering the Governments Report No. 173/TTr-CP of November 3, 2008, on adjustment of the 2004-2009 term of office of Peoples Councils and Peoples Committees at all levels; and the National Assembly Law Committees Examination Report No. 563/BC-UBPL12 of November 12, 2008, and opinions of National Assembly deputies;

RESOLVES:

Article 1. To prolong the 2004-2009 term of office of Peoples Councils and Peoples Committees at all levels to the first meeting of Peoples Councils of the next tenure at all levels in 2011.

The date of election of deputies to Peoples Councils of the next tenure at all levels shall be fixed and announced by the National Assembly Standing Committee.

Article 2. The National Assembly Standing Committee, the Government, the Supreme Peoples Court, the Supreme Peoples Procuracy and the Central Committee of the Vietnam Fatherland Front shall, within the ambit of their respective tasks and powers, organize the implementation of this Resolution.

Article 4. This Resolution takes effect on April 1, 2009.

Resolution was adopted on November 14, 2008, by the XII^th National Assembly of the Socialist Republic of Vietnam at its 4^th session.
