According to the Decree:
- Investors in PPP projects and projects using land shall be selected by open international bidding, except for the following cases:
+ Open domestic bidding
+ Appointment of investors according to Clause 4 Article 22 of the Law on Investment 2013.
- Cases of open domestic bidding:
+ The fields in which foreign investment is restricted by Vietnam Law or international agreements to which Vietnam is a signatory.
+ Foreign investors do not participate in the pre-qualification or fail the pre-qualification.
+ PPP projects of Group C according to regulations of law on public investment.
+ Projects using land in which the preliminary total investment is below VND 120 billion.
This Decree comes into force on May 05, 2015.
