Forces for handling airspace-violating aircraft forced to land in Vietnam

On October 24, 2024, the Government of Vietnam promulgated Decree No. 139/2024/ND-CP on intercepting, accompanying, and forcing aircraft that violate Vietnam’s airspace to land at airports and aerodromes.

According to the Decree, the forces for handling airspace-violating aircraft forced to land include:

- Forces of the Ministry of National Defense of Vietnam.

- Cooperative forces of the Ministry of Transport of Vietnam, Ministry of Public Security of Vietnam, and relevant ministries and central authorities.

- Forces of the Steering Committees for Anti-Terrorism of provinces and centrally affiliated cities.

Procedures for handling aircraft violating Vietnam’s airspace

Airspace management and flight administration authorities of the Air Defense - Air Force, when detecting or receiving information on aircraft violating Vietnam’s airspace, shall:

- Promptly submit reports to the commanders of the same level or superior headquarters and provide notices for civil flight management units and relevant agencies and units;

- Comply with orders of the Minister of National Defense of Vietnam for air forces to intercept, accompany, or force aircraft violating Vietnam’s airspace to land at airports or aerodromes according to Article 6 and Article 7 of Decree 139/2024;

- In cases of receipt of information on aircraft violating Vietnam’s airspace from the Naval Service, military zones and civil flight management facilities shall verify the information before implementing Points a and b Clause 1 Article 12 of Decree 139/2024;

Civil flight management facilities at airports or aerodromes for violating aircraft to land

In cases of intercepting, accompanying, or forcing aircraft violating Vietnam’s airspace to land at the designated aerodrome, the civil flight management facility shall:

- Cooperative with relevant military units in intercepting, accompanying, and forcing violating aircraft to land at the airport or aerodrome;

- Establish communication with the commanding unit for intercepting, accompanying, and forcing the violating aircraft; continue to maintain two-way communication with the aircraft intercepting, accompanying, and forcing the violating aircraft and provide it with information relevant to the violating aircraft;

- Provide notice to the adjacent flight management facility if the violating aircraft enters the area under the management of such facility;

- After the violating aircraft safety lands at the designated airport or aerodrome, provide guidelines on the parking location for the violating aircraft.
