According to the Circular, the maximum commissions under guest worker broker agreement shall be agreed upon by the service provider and intermediary organization and/or individual without exceeding 0.5 times the salaries under the contract of the worker for every 12 months of work.
If the working period under an employment contract lasts for at least 36 months, the maximum commissions under broker agreement must not exceed 1.5 times the salaries under employment contract of the worker.
The maximum commissions under broker agreement for specific professions, sectors, and jobs are specified under Appendix X of Circular No. 21/2021/TT-BLDTBXH such as:
- All professions and jobs in Japan: VND 0;
- Crew members of off-shore fishing boats or cargo ships in Taiwan (China) and Korea: VND 0;
- Domestic worker in Malaysia and Brunei: VND 0; etc.
Circular No. 21/2021/TT-BLDTBXH comes into force from February 1, 2022 and replaces Circular No. 21/2013/TT-BLDTBXH dated October 10, 2013.
