The Decision makes four more precedents available for use during trials as of April 15, 2020, including:
- Precedent No. 40/2021/AL regarding recognition of de facto conversion of rights to use land;
- Precedent No. 41/2021/AL regarding de facto termination of marital relationships;
- Precedent No. 42/2021/AL regarding the choice of court for resolution of consumer disputes in case of entering into contracts containing arbitration clause;
- Precedent No. 43/2021/AL regarding effect of mortgages under which the mortgaged property is the real estate that the mortgagor receives as transferred property without paying the seller in full yet.
The aforesaid precedents must be applied according to the instructions given in Article 8 of Resolution No. 04/2019/NQ-HDTP dated June 18, 2019 regarding procedures for selection, announcement and application of precedents.
Decision No. 42/QD-CA is taking effect as of the signature date.
