According to this document, the scope of lawyer’s legitimate rights and interests that are protected during their law practicing activities covers the followings:
- Protection for a lawyer’s rights and interests stipulated by laws which serve as a basis for implementation of their social functions and professional responsibilities.
- Protection against administrative decisions or acts violating laws that cause adverse impacts on legitimate rights and interests that lawyers and legal professional organizations have during their law practicing activities.
- Protection against administrative decisions or acts violating laws that cause adverse impacts on the operational organization of Bar Associations and members of the Vietnam Bar Federation.
- Protection against acts of infringement upon legitimate rights and interests of lawyers during their professional activities, directly threatening the life, health, reputation and dignity of lawyers.
As for apprentice lawyers, under certain circumstances, the Committee for Protection of Lawyer’s Rights may consider a proper intervention action.
“Decision No. 139/QD-BTV paves the way for lawyers or legal professional organizations to request protection from the Bar Federation and Bar Associations, etc. in case of any infringement upon their legitimate rights and interests.
