Heavy fines for age discrimination occurring in labor administration activities will be imposed

On March 1, 2020, the Government has promulgated the Decree No. 28/2020/ND-CP regulating fines for administrative violations related to labor, social insurance or sending of Vietnamese workers abroad.

According to this Decree, fines of 5 – 10 million dong will be imposed on employers performing acts of age discrimination during their labor administration activities.

Pursuant to regulations laid down in clause 4 of Article 23 in the Law on Handling of Administrative Violations and the aforesaid regulation, if a violation is committed,

- The violating employer will be subject to a fine of 7.5 million dong in the absence of either aggravating or mitigating circumstances.

- In the presence of an aggravating circumstance, the fine will be 7.5 million dong higher than the existing one, but not exceeding 10 million dong as the maximum limit. On contrary, in the presence of a mitigating circumstance, the fine will be 7.5 million dong lower than, but not less than 5 million dong as the minimum limit.
