Notable policies coming into force from the middle of January, 2020

There are many policies coming into force from January 11 – 20, 2020. The following are the most notable ones:

1. Issued level-A, B, C foreign language certificates being still valid

The Circular No. 20/2019/TT-BGDĐT on annulment of regulations on examination and issuance of foreign language certificates under the continuing education programs prescribed in the Decision No. 30/2008/QĐ-BGDĐT is officially coming into force from January 15, 2020.

According to this Circular, from January 15, 2020, regulations on examination and issuance of foreign language certificates under the continuing education programs prescribed in the Decision No. 30 shall be abrogated.

However, the level-A, B, C foreign language certificates issued according to the Decision No. 30/2008/QĐ-BGDĐT still remain valid.

Additionally, training courses in foreign languages that have been provided before January 15, 2020 under the continuing education programs shall continue to be provided until the end of such courses.

2. Modified list of fees and charges within the jurisdiction of provincial-level People’s Councils

This content is introduced in the Circular No. 85/2019/TT-BTC on fees and charges within the jurisdiction of the People’s Councils of provinces and central-affiliated cities (provincial-level People’s Councils).

According to this Circular, the toll road fee (applicable to roads under the scope of the provincial-level authority) shall be removed from the list of fees and charges within the jurisdiction of the provincial-level People’s Councils.

Other fees and charges on the list are kept unchanged.

The Circular No. 85/2019/TT-BTC is coming into force from January 13, 2020 and supersedes the Circular No. 250/2016/TT-BTC dated November 11, 2016.

3. Notable regulations on requests for exclusion from trade remedies

The Circular No. 37/2019/TT-BCT providing guidance on trade remedies is coming into force from January 15, 2020.

According to this Circular, there are 02 types of documents required when submitting a request for exclusion from trade remedies, including:

- The document stating information about the production line and output of the good for which the exclusion request is submitted in the past 03 years and those in the current year;

- Documents proving the demand for use of the quantity of good for which the exclusion request is submitted, including contracts signed with customers, written approvals for in-progress projects or other relevant documents.

Additionally, the description of the imported good for which the exclusion request is submitted no longer includes information on the import duty applied according to the import and export tariff schedules in each period.

Other required documents of a request for exclusion from trade remedies shall continue to follow Article 12 of the Circular No. 06/2018/TT-BCT dated April 20, 2018.

4. Regulations on exchange of genetic resources of precious and rare livestock breed

The Circular No. 22/2019/TT-BNNPTNT introduces regulations on exchange of genetic resources of precious and rare livestock breed for the purposes of research, selection and production of new livestock breed and lines, and for business purposes. To be specific:

- Organizations and individuals are allowed to exchange genetic resources of precious and rare livestock breed, including: breed animals, breed eggs, sperm and embryos;

- Organizations and individuals involving the exchange of genetic resources of precious and rare livestock breed are required to use the genetic resources for the purposes registered with the Minister of Agriculture and Rural Development;

- In December every year or upon request of a competent authority, organizations and individuals involving the exchange of genetic resources of precious and rare livestock breed shall submit physical and electronic reports on the exchange and use of genetic resources to the Ministry of Agriculture and Rural Development.

The Circular No. 22/2019/TT-BNNPTNT is coming into force from January 15, 2020.
