Organic produce requires quality inspections in the following 2 cases

This is the highlight of the Circular No. 16/2019/TT-BNNPTNT elaborating on the Decree No. 109/2018/ND-CP on organic agriculture.

Pursuant to the Circular, the specialized management General Departments or Authority affiliated to the Ministry of Agriculture and Rural Development must, within scope of their duties and remit, conduct inspection of quality of organic produce under their jurisdiction in the following cases:

- Inspections are conducted according to approved plans;

- Inspections are carried out in case of suspicious acts.

Inspection of quality of organic produce will be subject to the Law on Quality of Commodities, the Law on Food Safety and other relevant regulations in force.

If organic produce fails to meet quality standards, the following actions will be taken:

- Recalled organic produce will be disposed of under Clause 4 of Article 13 in the Decree No. 109/2018/ND-CP dated August 29, 2018;

- Any practices leading to failure to guarantee the quality of organic produce will be subject to penalties under the regulations on administrative penalties and other documents related to the quality of commodities, products and food safety.

Circular No. 16/2019/TT-BNNPTNT is entering into force on December 18, 2019.
