Terrorism and terrorism financing crimes are now elaborated in a Resolution

On October 25, 2019, the Judicial Panel of the People’s Supreme Court has issued the Resolution No. 07/2019/NQ-HDTP providing instructions about several regulations laid down in Article 299 on terrorism crimes and Article 300 on terrorism financing crimes in the Criminal Code.

This Resolution defines several terms specified in Article 299 and Article 300 in the Criminal Code, specifically including:

- “A state of terror in the general public” means a psychological condition of anxiety, intimidation and bewilderment of the public about safety for their life, health, property and other legitimate rights and interests.

Example: An act of setting off an explosion at a bus terminal can cause the public worry about safety for their life, health and property during their road use.

- “Destruction of property of an entity or person” means an act of causing loss of value of such property and totaling it.

- “Providing finance or other property in any form to a terrorist organization or an individual terrorist” means an act of providing, giving or leasing out finance or lending property or other financial support to a terrorist organization or individual terrorist.
 

“In the presence of the Resolution No. 07, there are sound and sufficient legal grounds for imposing strict penalties to eradicate terrorism crimes; thanks to this, national security will be maintained, contributing to the general global stability” - Lawyer Nguyen Thuy Han in charge of LawSoft’s Law Forum – concluded.

In addition, the Resolution also explains circumstances indexing penalties listed in the bracket, such as illegally expropriating and damaging property of entities or persons; attacking and harming computer networks, telecommunications networks and electronic equipment, etc.

The Resolution No. 07/2019/NQ-HDTP is entering into force on December 1, 2019.
