Medical Services Administration answers queries regarding licensing requirements for massage business

On May 30, 2019, Medical Services Administration issued the Official Dispatch No. 579/KCB-PHCN&GD on management of massage services.

By this document, Medical Services Administration gives the following opinions:

The Decree No. 155/2018/ND-CP has left out Article 38 in the Decree No. 109/2016/ND-CP on licensing requirements of massage establishments and prescribes that massage establishments must send the written notification of conformance to message regulations to the Departments of Health.

Previously, the Circular No. 41/2017/TT-BYT also removed a part of regulation on licensing requirements for massage service prescribed in the Circular No. 11/2001/TT-BYT dated June 6, 2001.

Hence, massage service has no longer been regulated as a conditional business type and procedures for announcement of massage establishments have no longer been put under the state management of the Ministry of Health.

This means that the Departments of Health is not going to receive and deal with procedures for announcement of conformance to massage regulations for massage establishments in the future.

The rest of regulations in the Circular No. 11/2001/TT-BYT that have not yet been repealed will be expected to enter into the draft Circular stating repeal thereof in 2019.
