Application procedures for foreign male employee’s entitlement to paternity insurance benefits are in effect

This is the highlight of the Decision No. 1904/QD-LDTBXH regarding introduction of new administrative procedures, amendments and supplements in the social insurance sector under its state management.

The Decision prescribes application procedures for entitlement to paternity insurance benefits for foreign male employees who are paying compulsory SI contributions during their spouses' childbirth will be comprised of the followings:

Step 1: Submit application for paternity insurance benefits to their employers within the maximum duration of 45 working days from the date on which they get back to work.

Step 2: Within duration of 10 days after receipt of all required documents from insured employees, employers will be responsible for preparing paternity insurance benefit documentation for submission to social insurance agencies.

Step 3: Within duration of 10 working days from the date of receipt of all documents required by employers, social insurance agencies will be responsible for processing employees’ applications and paying SI benefits to them. In case of refusal, the written responses clearly stating reasons for such refusal must be sent to applicants.

Documentation requirements for entitlement to SI benefits:

- Duplicate copy of the notice of birth or the birth certificate of the child. 

- Confirmation of the surgical birth or the baby under 32 weeks of age, issued by a healthcare institution.

- List of employees on leave that are entitled to paternity insurance benefits, compiled by the employer.

- If papers held by employees who are foreign citizens working in Vietnam are issued by foreign entities, they must be translated into Vietnam and legally certified as true in accordance with Vietnamese laws.

The Decision No. 1904/QD-LDTBXH entered into force from December 28, 2018.
