The Decision prescribes that, when giving birth, foreign female workers eligible to be entitled to pregnancy and maternity insurance benefits must implement the following application procedures:
- Step 1: They must submit application for pregnancy and maternity insurance benefits to employers within duration of 45 working days from the date on which they get back to work.
In case they resign from work before the childbirth date, they must directly submit application to social insurance agencies and must present their social insurance booklets.
- Step 2: Within duration of 10 days after receipt of all required documents from insured workers, employers will be responsible for preparing pregnancy and maternity insurance benefit documentation for submission to social insurance agencies.
- Step 3:
+ Within duration of 10 days after receipt of all required documents from employers, social insurance agencies must process submitted documents and must consider making decisions on paying benefits to insured workers;
+ Within duration of 05 days after receipt of all required documents from insured workers resigning from work before childbirth, social insurance agencies must process submitted documents and must consider making decisions on paying benefits to insured workers;
+ In case social insurance agencies refuse to do so, they must send written responses clearly stating reasons for such refusal.
