Foreign employees satisfying 04 requirements stated below must pay compulsory SI contributions

Recently, the Ministry of Labor, War Invalids and Social Affairs has issued the Official Dispatch No. 1064/LDTBXH-BHXH on responses to difficulties in implementing the Decree No. 143/2018/ND-CP providing instructions on the compulsory SI for foreign employees. The Official Dispatch includes the followings:

In comparison to provisions laid down in clause 1 and clause 2 of Article 2 in the Decree No. 143 and clause 1 of Article 3 in the Decree No. 11/2016/ND-CP foreign employees will be eligible for paying compulsory SI contributions if 04 following requirements are met:

- They must hold work permits or practice certificates or practice licenses, issued by Vietnamese competent authorities;

- They must hold indefinite-term employment contracts or those having the minimum term of 1 year with employers in Vietnam; 

- They have not already reached 60 years of age for male and 55 years of age for female.

- They are not intracompany transferees, including:

Managers, managing directors, experts and technical staff members working at foreign enterprises; those who have been recruited by foreign enterprises for at least 12 months prior to participation in the compulsory SI and have worked for the commercial presences of such foreign enterprises within the territory of Vietnam.

The Official Dispatch No. 1064/LDTBXH-BHXH was promulgated on March 18, 2019.
