Notable policies coming into force from the beginning of November, 2018

Following the notices of Regulations on “Finance – Bank” and “Labour – Employment”, THƯ VIỆN PHÁP LUẬT would like to introduce 04 notable regulations as follows:

1. Regulations on awarding of “Gia đình văn hóa” title

On September 17, 2018, the Government promulgated the Decree No. 122/2018/ND-CP providing guidelines for consideration and awarding of "Gia Đình Văn Hóa”, “Thôn Văn Hóa”, “Làng Văn Hóa”, “Ấp Văn Hóa”, “Bản Văn Hóa” and “Tổ Dân Phố Văn Hóa” (“Cultured Family, Hamlet, Village or Residential Group") titles.

The most notable regulation is that a family shall be not eligible for the “Gia Đình Văn Hóa” title if there is any family member joining the group of people which is gathered to disrupt social security or order.

Applications for “Gia đình văn hóa” or “Khu dân cư văn hóa” title must be submitted by January 30 every year and consideration and voting for these titles must be completed by December 20 of the same year.

The Decree No. 122/2018/ND-CP is coming into force from November 05, 2018.

2. Establishment of foreign cultural institutions in Vietnam
  
As from November 05, 2018, the establishment of foreign cultural institutions in Vietnam shall be governed by regulations introduced in the Government’s Decree No. 126/2018/ND-CP.

According to this Decree, a foreign cultural institution in Vietnam is construed as follows:

- It is the general name of non-profit organizations that pursue cultural goals and other related goals.

- It is established by or with the participation of foreign organizations or individuals and operates in the territory of Vietnam.

The Decree No. 126/2018/ND-CP supersedes the Decree No. 18/2001/ND-CP on establishment and operation of foreign cultural and educational institutions in Vietnam.

3. Increase in purchase prices of wind power

On September 10, 2018, the Prime Minister promulgated the Decision No. 39/2018/QD-TTg amending several articles of the Decision No. 37/2011/QD-TTg on provision of assistance in development of wind power projects in Vietnam.

Definitions of “onshore wind power project” and "offshore wind power project” are additionally provided for in order to use as the basis for setting power purchase prices corresponding to these projects.

The electricity buyer shall purchase the electricity output generated by onshore wind power projects and offshore wind power projects at the price of VND 2,223 per kWh and of VND 1,928 per kWh respectively.

(The current purchase price is VND 1,614 per kWh).

The Decision No. 39/2018/QD-TTg is coming into force from November 01, 2018.

4. Recall and disposal of disqualified foods

On September 14, 2018, the Ministry of Health promulgated the Circular No. 23/2018/TT-BYT on recall and disposal of disqualified foods under management of the Ministry of Health.

According to this Circular, recalled food products shall be still disposed of by adopting one of 04 measures as follows:  Correction of label error, repurposing, re-exporting and destruction.

However, if a voluntary recall is conducted by the product owner, this product owner shall have the right to select one of the abovementioned measures for disposing of recalled products.

The Circular No.23/2018/TT-BYT is coming into force from November 01, 2018.
