1. Criteria for evaluation of representatives of state-owned enterprises under management of the Ministry of National Defense
This is a remarkable content of Circular No.105/2018/TT-BQP which amends Circular No.147/2016/TT-BQP on management of persons holding job titles or job positions in state-owned enterprises under management of the Ministry of National Defense.
According to the Circular, it is considered that a representative fails to complete his/her duty if less than 80% of the given task is accomplished. To be specific:
- 5 consolidated target of the enterprise including revenue, pre-tax profit, payment to state budget, average revenue and/or labor productivity and dividend yield reach less than 80% of those stated in the production and business plan;
- The results of yearly financial supervision, efficiency evaluation and enterprise classification according to Circular No.48/2017/TT-BQP dated March 05, 2017 show that the enterprise is ranked C and vulnerable to financial insecurity;
However, the representative who has enough grounds for proving that he/she is not the person to be blamed for, such person may recommend the competent authority to take it into account when carrying out the evaluation.
Circular No.105/2018/TT-BQP comes into force from September 08, 2018.
2. Foreign language proficiency standards applied to Principals
This is one of the standards specified in Circular No.14/2018/TT-BGDDT on standards applied to general education schools principals which comes into force from September 04, 2018.
According to the Circular, a Principal must have a good command of foreign language at the following levels:
- Satisfactory level: capable of communicating in English in daily context (preferably English);
- Good level: capable of directing the formulation and supervising the implementation of plans for development of foreign language proficiency (preferably English) for his/her school’s teachers, staff members and students;
- Very Good level: masters a foreign language (preferably English); creates a favorable environment to develop foreign language proficiency (English is preferred) for his/her school’s teachers, staff members and students.
Circular No.14/2018/TT-BGDDT will replace Circular No.14/2011/TT-BGDDT and Circular No.29/2009/TT-BGDDT dated October 22, 2009.
3. Regimes intended for people with meritorious services to the revolution who are overseas residents
This is a content of Decree No.102/2018/ND-CP on a regime intended for Vietnamese people with meritorious services to the revolution, revolutionists and persons doing international duties who are overseas residents.
According to the Decree, persons who participated in the Resistance War against either French or America are now overseas residents as prescribed in Clause 2, 3 and 4 Article 2 of this Decree maybe subject to the following regimes:
- They may receive an allowance amount of VND 4,000,000 if having served for 2 years or less than 2 years;
- If having served for more than 2 years, they may receive an additional amount of VND 1,500,000 each year from the third year onwards.
- If they pass away before September 05, 2018, their family may receive a one-time allowance amount of VND 6,000,000.
In addition, the aforesaid persons may be subject to the following policies, starting from the month in which they return to Vietnam for permanent residence:
- They are entitled to health insurance policy intended for people with meritorious services to the revolution or veterans;
- In case they pass away, their family may receive an allowance for burial as per provisions of the Social Insurance Law in force.
Decree No.102/2018/ND-CP comes into force from September 05, 2018.
4. Administrative procedure control for preparation of documents of the Ministry of Industry and Trade
Circular No.18/2018/TT-BCT on control of administrative procedures under management of the Ministry of Industry and Trade comes into force from September 03, 2018. Accordingly:
- Ministerial-affiliated entities shall take responsibility to assess impacts of administrative procedures in accordance with provisions of the Law on Promulgation of legislative document and Decree No.34/2016/ND-CP dated May 14, 2016 during the processing of proposing production of legislative documents.
- The application for legislative document preparation of ministerial-affiliated entities must be sent to the Ministry's Office for opinion receiving before submitted to the Department of Legal Affairs for appraisal purpose.
- The Ministry’s Office shall response in writing and clearly state its viewpoint on contents related to administrative procedures in the legislative document which is proposed to be produced (if any) within 3 working days from the day on which the satisfactory application for appraisal is received.
- Based upon opinions of the Ministry's Office, the aforesaid entities shall complete the application for legislative document preparation and sent it to the Department of Legal Affairs for appraisal purpose.
