1. New guidelines for salaries of officials and public employees from July 01, 2018
The Ministry of Home Affairs promulgates Circular No.06/2018/TT-BNV providing guidelines for statutory pay rates applied to agencies, organizations, public service providers of the Vietnam Communist Party, the State, political-social organizations and associations.
According to the Circular, the salaries and allowances for public officials and public employees from July 01, 2018 shall be calculated under the following formula:
- Monthly salary = VND 1,390,000 per month x current pay coefficient
- Allowance:
+ Allowance calculated according to statutory pay rate = VND 1,390,000 per month x current allowance coefficient
+ Allowance calculated according to current pay plus leadership allowance and extra seniority allowance (if any) = [salary + leadership allowance (if any) + extra seniority allowance (if any) x rate of current allowance
+ Fixed allowances will remain unchanged in accordance with the law in force.
- Amount of compensating wage differential (if any) = VND 1,390,000 per month x current coefficient of compensating wage differential.
2. Reducing prices for medical examination service covered by health insurance
This is a remarkable regulation in Circular No.15/2018/TT-BYT which unifies prices for medical examination and treatment services covered by health insurance among hospitals of the same class across the country and provides guidelines for application of price and payment for medical services covered by health insurance in certain cases.
According to the Circular, the price for medical examination service covered by health insurance in medical facilities which includes direct expenses and salaries is adjusted as follows:
- For specially-classed hospitals and grade I hospitals, reduce from VND 39,000 to 33,100 per examination
- For and class II hospitals, reduce from VND 35,000 to 29,600 per examination
- For and class III hospitals, reduce from VND 31,000 to 26,200 per examination
- For and class IV hospitals, reduce from VND 29,000 to 23,300 per examination
- For medical aid stations in communes, the price for medical examination is VND 23,300 per examination.
Circular No.15/2018/TT-BYT replaces Joint Circular No.37/2015/TTLT-BYT-BTC dated October 29, 2015.
3. Procedure for holding examination on the law concerning multi-level marketing activities
This is a remarkable content of Circular No.10/2018/TT-BCT which provides guidelines for Decree No.40/2018/ND-CP on management of multi-level marketing activities.
The Competition and Consumer Protection Authority shall set an examination or authorize (in writing) the training facility in the law on multi-level marketing activities to set an examination on the law on multi-level marketing activities under the following procedure:
- Verify whether the application for examination is satisfactory and verify the understanding of the law on multi-level marketing activities according to Decision stated in clause 1 in Article 39 of Decree No.40 on management of multi-level marketing activities.
- Prepare a plan for time, place and method for examination
- Announce the examination plan
- Hold the examination
- Assess the examination results
- Announce the examination results
4. Sales promotion up to 100% permitted on Lunar New Year
This is a remarkable content of Decree No.81/2018/ND-CP which provides guidelines for the Commercial Law on trade promotion.
According to the Decree, if the concentrated sales promotion program is conducted 30 days ahead of the first day of lunar year, 100% discount on promoted products may be applied.
The maximum value of goods and services used for 100% sales promotion is also applied to sales promotion programs included in programs and activities for trade promotion decided by the Government.
Concentrated sales promotion programs include:
- Programs conducted by regulatory agencies of central and provincial level effective within certain frame of hours, days, weeks, months or seasons;
- Programs on Lunar New Year conducted 30 days before the first day of the lunar year;
- Programs conducted on other holidays.
The duration of sales promotion programs on Tet holiday and other holidays shall not excess the duration of such holidays in accordance with the Labor Law.
