10 notable policies which will come into force from mid-June of 2018

Following the article “Trade and investment policies which take effect from mid-June of 2018”, THƯ VIỆN PHÁP LUẬT introduces some more notable policies which will come into force from June 11 to 20, 2018.

5. Regulations on the duration of suspension of construction permits

Circular No.03/2018/TT-BXD guides Decree No.139/2017/ND-CP issued by the Ministry of Construction on April 24, 2018.

According to the Circular, the following violations shall lead to, in addition to fines, suspension of construction permits within the following time limits:

- 03 to 06 months regarding detached houses built in wildlife sanctuaries or historic sites or other constructions not specified in Point b, Point c Clause 09 Article 15 of Decree No.139.

- 06 to 09 months regarding detached houses built in urban areas not specified in Clause 7 Article 15 of Decree No.139.

- 09 to 12 months regarding constructions requiring the formulation of economic – technical report or construction projects or constructions specified in Clause 7 Article 15 of Decree No.139.

The violating entity is not allowed to execute construction works while its construction permit is suspended.  

Decree No.03/2018/TT-BXD comes into force from June 12, 2018.

6. Estimation of expenditure on provision of training for officials

From June 15, 2018, Circular No.36/2018/TT-BTC guiding estimation, management, usage and settlement of expenditure on provision of training for officials and public employees (hereinafter referred to as officials) will officially come into force.

According to the Circular, officials who are students of domestic training courses will receive the following allowances:

- Rewards not exceeding VND 200,000 per person for outstanding trainees;

- Other allowances:

+ Partial meal allowance for student during school attendance;

+ Allowance for commutes from the workplace to the training institution. (For separate commutes; during public holidays);

+ Rent for accommodation during the course (in case the training institution and organizer fail to provide accommodation)

7. Requirements for recalled drugs to be rectified or re-exported

Circular No.11/2018/TT-BYT providing for quality of drugs and drug materials comes into force from June 20, 2018.

According to the Circular, recalled drugs may be rectified or re-exported when satisfying the following requirements:

- Drugs are recalled due to a third-degree violation (Details in the Appendix II enclosed with this Decree);

- It is not any of the cases mentioned in Point b Clause 2 Article 15 of the Circular. To be specific:

+ Drugs are recalled due to a first-degree violation or a second-degree violation;

+ Drugs are recalled due to a third-degree violation but considered ineligible to be rectified or re-exported by the Ministry of Health as per Clause 3, Clause 4 Article 15 of the Circular;

+ Drugs are recalled due to a third-degree violation and considered eligible to be rectified or re-exported by the Ministry of Health but the manufacturer fails to rectify or export them.

8. Criteria applied to members of Advisory Council for issuance of the pharmaceutical business certificate

Circular No.10/2018/TT-BYT providing for criteria applied to members of Advisory Council for issuance of the pharmaceutical business certificate to producers, importers, exporters, preservation services, wholesalers and retailers of radioactive drugs.

Comments from the Council are the basis for the Ministry of Health or the Department of Health to carry out site inspection and to grant the certificate of pharmaceutical business.

Circular No.10/2018/TT-BYT comes into force from June 18, 2018.

9. Circular No.09/2018/TT-NHNN providing for scope of operation of credit institutions being cooperatives comes into force from June 15, 2018.

10. Decree No.60/2018/NĐ-CP on contents of statistical reports comes into force from June 15, 2018.
