1. Guidance on calculation of allowances for teachers of students with disabilities
On August 10, 2017, Ministry of Labour, War Invalids and Social Affairs promulgates the Circular No. 22/2017/TT-BLDTBXH guiding the implementation of the Decree No. 113/2015/ND-CP on special, incentive, responsibility allowance, physical hardship, hazard and danger allowance paid to teachers working in public educational establishments.
According to this Circular, a teacher of students with disabilities may not receive responsibility allowance and incentive allowance when:
- he/she goes on a mission trip, works or studies abroad; in this case, he/ she shall receive 40% of salary in accordance with regulation in Clause 4 Article 8 of Decree No. 204/2004/ND-CP ;
- he/she goes on a mission trip or attends a training course abroad resulting in he/ she may not teacher students with disabilities for 03 consecutive months or longer;
- he/she takes personal leave without pay for a month or longer;
- he/she takes sick leave or maternity leave longer than the permissible period of time laid down in the Law of social insurance;
- he/she is suspended from school.
The Circular No. 22/2017/TT-BLDTBXH comes into force as of September 25, 2017.
2. Regulations on cost of health examination for enrolment in military institutions
This is the most noticeable regulation in the Circular No. 187/2017/TT-BQP which comes into force as from September 25, 2017.
According to this Circular, the cost of health examination for new students of military schools or academies shall include:
- Physical and clinical examinations at specialties in accordance with regulations in the Joint Circular No.16/2016/TTLT-BYT-BQP;
- Subclinical examination (including tests for blood type, hematologic indices, serum biochemistry, urine test, general ultrasound, ECG, and chest X-ray).
3. Guidance on provision of cellular information services
The Circular No. 08/2017/TT-BTTTT on amendments to the Circular No. 17/2016/TT-BTTTT on procedures for registration of provision of information services via cellular networks. To be specific:
- Each cellular service provider shall only provide periodic services (by day, week, month, quarter, and year) after obtaining the user’s consent via SMS, and must confirm by sending a message according to the following structure to the user: “Successful registration of “name of registered service” service, provision code, billing cycle, service charge, service cancellation and user service number.”
Additionally, the following information must be known to users as the cellular information services are launched: Name and code of service, provision code, method of registration, billing cycle, service charge, service rejection and user service number. The Circular No. 08/2017/TT-BTTTT comes into force as of September 21, 2017.
4. Dossiers for registration for participation in the Social Assistance System Strengthening Project for Vietnam
This regulation is introduced in the Circular No. 21/2017/TT-BLDTBXH on amendments to the Joint Circular No. 26/2014/TTLT-BLDTBXH-BTC-BGDDT guiding the financial management and implementation of the World Bank-funded Social Assistance System Strengthening Project for Vietnam.
According to this Circular, dossiers for registration for participation in the Project applicable to beneficiaries entitled to the consolidated social assistance package are amended as follows:
- A participation registration dossier for a pregnant woman includes: A written registration for participation in the Project and an antenatal or ultrasound fetal examination slip (clearly stating the mother’s full name, year of birth and address, gestational age, estimated date of delivery) bearing the health facility’s certification;
- A participation registration dossier for a child who is between 0 and 3 years old: A written registration for participation in the Project and a copy of the child’s birth certificate or certificate of live birth, or a written registration for participation in the Project bearing the Commune-level People's Committee’s certification of the child’s date of birth (if the child was born at a disadvantaged commune);
- A participation registration dossier for a child who is between 03 and 15 years old: A written registration for participation in the Project bearing the Commune-level People's Committee’s certification of the child's non-enrolment in school and a copy of the child’s birth certificate, or a written registration for participation in the Project bearing the Commune-level People's Committee’s certification of the child’s date of birth (if the child was born at a disadvantaged commune) and certification of the child's non-enrolment in school.
These are substitutes for birth certificates required in the participation registration dossiers of eligible beneficiaries being children.
The Circular No. 21/2017/TT-BLDTBXH comes into force as of September 22, 2017.
