Tổng cục Hải quan nhận được phản ánh của Công ty TNHH IRISO Việt Nam và Công ty TNHH Panasonic System về việc hướng dẫn không thống nhất trình tự thực hiện thủ tục hải quan điện tử của doanh nghiệp chế xuất (DNCX) mua hàng của doanh nghiệp nội địa, mua bán với doanh nghiệp chế xuất khác. Cụ thể: một số Chi cục Hải quan yêu cầu doanh nghiệp nhập khẩu làm thủ tục hải quan trước, doanh nghiệp xuất khẩu làm thủ tục hải quan sau; một số đơn vị lại hướng dẫn ngược lại. Về vấn đề này, Tổng cục Hải quan hướng dẫn như sau:

1. Doanh nghiệp chế xuất thực hiện thủ tục hải quan điện tử thì thực hiện theo quy định tại Chương VI, Thông tư số 196/2012/TT-BTC ngày 15/11/2012 của Bộ Tài chính quy định về thủ tục hải quan điện tử đối với hàng hóa xuất khẩu, nhập khẩu thương mại.

2. Đối với hàng hóa của DNCX nhập khẩu từ nội địa theo hình thức mua bán: Thực hiện theo quy định tại Khoản 2, Điều 42, Thông tư số 196/2012/TT-BTC. Theo đó DNCX nhập khẩu hàng hóa từ nội địa làm thủ tục hải quan trước, doanh nghiệp nội địa làm thủ tục hải quan sau.

3. Đối với hàng hóa mua bán giữa các DNCX với nhau quản lý theo mục đích sử dụng là sản xuất, đầu tư, tiêu dùng thì thực hiện theo quy định tại Khoản 3, Điều 42, Thông tư số 196/2012/TT-BTC. Theo đó thì DNCX mua làm thủ tục hải quan trước, DNCX bán làm thủ tục hải quan sau.

Tổng cục Hải quan đề nghị Cục Hải quan các tỉnh, thành phố nghiên cứu, thực hiện./.

1. The exporting and processing enterprises implementing electronic customs procedures shall comply with the Chapter VI of Circular No. 196/2012/TT-BTC, of November 15, 2012 of the Ministry of Finance, regulating the electronic customs procedures for the commercial imports, exports.

2. For goods imported from inland by the exporting and processing enterprises under the trading form shall comply with clause 2, Article 42 of the Circular No. 196/2012/TT-BTC. Accordingly, the exporting and processing enterprises that import goods from inland shall do customs procedures before domestic enterprises do procedures.
