forms

For the purposes of management and use of C/O
forms, including EUR.1 form in EU-Vietnam Free
Trade Agreement (EVFTA), EUR.1 UK form in Vietnam - UK Free
Trade Agreement (UKVFTA), EAV form in Vietnam-Eurasian Economic Union
Free Trade Agreement (VN-EAEU FTA), X form in Agreement promoting
bilateral trade between the Ministry of Industry and Trade of Vietnam of the
Socialist Republic of Vietnam and the Ministry of Commerce of the Kingdom of
Cambodia, the Agency of Foreign Trade hereby requests the Agency’s affiliated
units, Regional Departments of Foreign Trade, and Hai Phong Department of
Industry and Trade (hereinafter referred to as “C/O issuing authorities” to
perform the following tasks:
1. Regarding printing of C/O
Based on demands for C/O forms, quantity of the
issued C/O sorted by types, quantity of unused C/O forms, and the growth of
export to the abovementioned countries, the Office of the Agency of Foreign
Trade shall annually develop a plan for printing of each C/O form, and submit
it to a competent authority for approval. C/O forms to be printed must meet the
criteria set out in EVFTA Agreement, UKVFTA Agreement, VN-EAEU FTA Agreement,
and the Agreement promoting bilateral trade between the Ministry of Industry
and Trade of Vietnam of the Socialist Republic of Vietnam and the Ministry of
Commerce of the Kingdom of Cambodia.
The Origin of Goods Department shall notify
relevant organizations of countries of import of any changes in C/O forms and
selected printing houses as prescribed.
2. Management and use of C/O
2.1. The Agency’s Office shall distribute C/O forms
to C/O issuing authorities at the request of relevant units; prepare and submit
periodical consolidated report on distribution of C/O forms to the Agency’s
leadership.

Based on the average number of C/O forms used by a
trader within the latest 3 months, each C/O issuing authority shall decide the
number of C/O forms distributed to that trader, and monitor and inspect that
trader’s use of such distributed C/O forms.
If a trader uses a considerably increased number of
C/O forms, the trader will provide written explanation thereof at the request
of the C/O issuing authority. Where necessary, the C/O issuing authority may
conduct an inspection of the trader’s use of C/O forms, and request the trader
in writing to use C/O forms in an effective manner in case of high ratio of C/O
forms which are invalid due to printing errors (>10% of total number of C/O
forms distributed to the trader).
Each C/O issuing authority shall quarterly compare
the number of C/O forms of each type received with that distributed to traders,
and make and submit a consolidated report on receipt and distribution of C/O
forms (using the form in Appendix II hereof) to the Agency’s Office.
Each C/O issuing authority shall prepare an annual
report on its receipt and distribution of C/O forms in the year and estimation
of the number of C/O forms to be used in the following year, and send it to the
Agency’s Office by December 15 every year.
2.3. C/O issuing authorities shall request traders
that wish to use C/O forms to fulfill the following obligations:
Based on their actual status, each trader shall
prepare a report on its receipt and use of C/O forms and estimated number of
C/O forms to be used in the next period which is made using the form in
Appendix III hereof, and send it to the C/O issuing authority.
Each trader shall use C/O forms in a proper and
efficient manner to minimize the number of damaged or invalid C/O forms.
The Agency of Foreign Trade hereby requests the
Agency’s affiliated units, and C/O issuing authorities to strictly comply with
the guidelines herein, and report any difficulties that arise during the
implementation of this document to the Agency of Foreign Trade (via the
Agency’s Office) for consideration./.
