Cục Giám sát quản lý nhận được công văn số 64/CV-XNK ngày 13/6/2016 của Công ty Cổ phần Tập đoàn Lộc Trời phản ánh vướng mắc về việc sử dụng giấy giới thiệu và giấy ủy quyền khi làm thủ tục hải quan đối với hàng hóa xuất nhập khẩu. Qua nghiên cứu nội dung vướng mắc của Công ty và nội dung hướng dẫn của Cục Hải quan tỉnh An Giang tại công văn số 857/HQAG-NV ngày 25/5/2016 về việc trả lời vướng mắc về giấy ủy quyền, giấy giới thiệu, Cục Giám sát quản lý về Hải quan có ý kiến như sau:

Luật Hải quan năm 2014 và Thông tư số 38/2015/TT-BTC của Bộ Tài chính không quy định cụ thể loại văn bản thể hiện việc “cử người đại diện khi làm thủ tục hải quan và các thủ tục hành chính khác với cơ quan hải quan”; Tuy nhiên, nội dung này được xây dựng để đáp ứng yêu cầu thực tế tại các Chi cục Hải quan địa phương. Theo đó, khi làm thủ tục hải quan, người đại diện doanh nghiệp cần xuất trình văn bản chứng minh được doanh nghiệp cử đến để làm thủ tục hải quan đối với hàng hóa xuất nhập khẩu. Quy định tại Điểm d Khoản 1 Điều 2 Thông tư số 38/2015/TT-BTC cũng là cơ sở pháp lý để xác định sự phù hợp của giấy giới thiệu hoặc các chứng từ tương tự giấy giới thiệu trong bộ hồ sơ hải quan.

Nội dung, tinh thần quy định nêu trên đã được Tổng cục Hải quan giới thiệu cụ thể tại các buổi tập huấn, hướng dẫn thực hiện Thông tư số 38/2015/TT-BTC trong thời gian vừa qua.

Bên cạnh đó, ngày 15/10/2015, Tổng cục Hải quan đã có công văn số 9610/TCHQ-GSQL yêu cầu Cục Hải quan các tỉnh, thành phố khi có văn bản hướng dẫn nghiệp vụ cho các Chi cục hoặc trả lời vướng mắc cho doanh nghiệp thì đồng thời gửi 01 bản về Tổng cục Hải quan (qua Cục GSQL) để báo cáo, theo dõi; Tuy nhiên, Cục Hải quan tỉnh An Giang chưa thực hiện việc gửi công văn số 857/HQAG-NV như yêu cầu.

Do vậy, đề nghị Cục Hải quan tỉnh An Giang có văn bản chấn chỉnh, hướng dẫn các đơn vị thuộc và trực thuộc thực hiện theo đúng tinh thần nội dung quy định tại Điểm d Khoản 1 Điều 2 Thông tư số 38/2015/TT-BTC nêu trên và chấn chỉnh việc thực hiện công văn số 9610/TCHQ-GSQL dẫn trên; báo cáo kết quả về Cục Giám sát quản lý về Hải quan trước ngày 30/6/2016.

Cục Giám sát quản lý về Hải quan có ý kiến để Cục Hải quan tỉnh An Giang biết, thực hiện./,

The Customs Management & Supervision Department has received the Official Dispatch No. 64/CV-XNK dated June 13, 2016 from Loc Troi Group Joint Stock Company on queries concerning the validity of letters of introduction and powers of attorney submitted when following customs procedures for imported goods. In consideration of queries specified in the said document and guidelines on letters of introduction and powers of attorney provided by An Giang Customs Department at the Official Dispatch No. 857/HQAG-NV dated May 25, 2016, the Customs Management & Supervision Department gives guidance as follows:

Neither the Law on customs in 2014 nor the Circular No. 38/2015/TT-BTC of the Ministry of Finance prescribes the types of documents submitted to indicate the fact “Appointment of representatives to follow customs procedures and other administrative procedures at the customs authority”. However, this provision is formulated to meet actual demands at local customs offices. When following customs procedures for imported goods at the customs authority, the enterprise’s representative is required to submit documents proving his/her capacity as a representative. The regulation in Point d Clause 1 Article 2 of the Circular No. 38/2015/TT-BTC is also the legal ground for determining the conformity of a letter of introduction or other documents of equivalent validity included in a customs dossier.

The General Department of Customs has introduced and elaborated these contents at training programs for implementation of the Circular No. 38/2015/TT-BTC.

Moreover the General Department of Customs has sent the Official Dispatch No. 9610/TCHQ-GSQL dated October 15, 2015 requesting Customs Departments of provinces and cities to submit the copies of their official dispatches providing guidelines on customs operations for local customs offices or response to enterprises’ queries to the General Department of Customs (via the Customs Management & Supervision Department) but An Giang Customs Department does still not yet send the copy of the Official Dispatch No. 857/HQAG-NV to the General Department of Customs as requested.

Thus, An Giang Customs Department is requested to provide written instructions for its departments and affiliates to comply with the regulation in Point d Clause 1 Article 2 of the Circular No. 38/2015/TT-BTC and guidelines in the Official Dispatch No. 9610/TCHQ-GSQL, and submit reports on implementation results to the Customs Management & Supervision Department by June 30, 2016.
