Thời gian qua, do ảnh hưởng của cuộc xung đột quân sự giữa Nga và Ucraina, nhiều lô hàng xuất khẩu của Việt Nam không thể đưa vào Nga, Ucraina và một số quốc gia Đông Âu; Để kịp thời hỗ trợ cho các doanh nghiệp Việt Nam đã làm thủ tục xuất khẩu nhưng phải đưa hàng hóa trở lại Việt Nam hoặc thay đổi đối tác nhập khẩu, Tổng cục Hải quan yêu cầu Cục Hải quan các tỉnh, thành phố chỉ đạo các Chi cục Hải quan trực thuộc:

1. Trường hợp hàng hóa đã đăng ký tờ khai hải quan nhưng không thể thực hiện tiếp thủ tục xuất khẩu:

Nếu doanh nghiệp đề nghị hủy tờ khai hải quan xuất khẩu để đưa hàng hóa trở lại nội địa, Chi cục Hải quan hướng dẫn doanh nghiệp và thực hiện hủy tờ khai hải quan theo quy định tại Điều 22 Thông tư số 38/2015/TT-BTC, được sửa đổi, bổ sung tại Thông tư số 39/2018/TT-BTC.

2. Trường hợp hàng hóa đã hoàn thành thủ tục xuất khẩu nhưng phải tái nhập trở lại Việt Nam:

Chi cục Hải quan hướng dẫn doanh nghiệp thực hiện thủ tục hải quan tái nhập theo quy định tại Điều 47 Nghị định số 08/2015/NĐ-CP; không yêu cầu người khai hải quan phải nộp giấy phép hoặc văn bản thông báo kết quả kiểm tra chuyên ngành; giải quyết thủ tục không thu thuế nếu tại thời điểm làm thủ tục tái nhập người khai hải quan nộp đủ bộ hồ sơ không thu thuế theo quy định.

3. Trường hợp hàng hóa đã được đăng ký tờ khai hải quan nhưng thay đổi đối tác nhập khẩu (kể cả trường hợp đã hoàn thành thủ tục xuất khẩu, hàng hóa đã vận chuyển đến nước nhập khẩu):

Nếu đối tác nước ngoài từ chối nhận hàng và doanh nghiệp Việt Nam đề nghị được thay đổi đối tác nhập khẩu, Chi cục Hải quan hướng dẫn doanh nghiệp thực hiện thủ tục khai sửa đổi, bổ sung thông tin tờ khai hải quan và nộp, xuất trình các chứng từ chứng minh việc sửa đổi, bổ sung theo quy định tại Điều 20 Thông tư số 38/2015/TT-BTC, được sửa đổi, bổ sung tại Thông tư số 39/2018/TT-BTC.

Tổng cục Hải quan thông báo và yêu cầu Cục Hải quan các tỉnh, thành phố chỉ đạo các Chi cục Hải quan trực thuộc tạo thuận lợi tối đa cho doanh nghiệp được đưa hàng hóa trở lại Việt Nam hoặc thay đổi thông tin đối tác nhận hàng tại nước ngoài, thông quan nhanh chóng, giảm bớt chi phí phát sinh. Trong quá trình thực hiện, nếu có khó khăn, vướng mắc thì khẩn trương báo cáo Tổng cục Hải quan (qua Cục Giám sát quản lý về Hải quan) để được hỗ trợ giải quyết.

1. If goods have had their customs declarations completed but cannot be exported:

If enterprises request cancellation of the export declaration in order to re-import the shipments, Customs Sub-departments shall guide the enterprises and cancel the declarations in accordance with Article 22 of Circular No. 38/2015/TT-BTC amended by Circular No. 39/2018/TT-BTC.

The Customs Sub-departments shall guide enterprises to adopt re-importation procedures in accordance with Article 47 of Decree No. 08/2015/ND-CP without requesting declarants to submit permit or notice on specialized inspection results and process procedures without collecting taxes if the declarants submit adequate documents on tax exemption when adopting procedures for re-importation.

3. If goods have had their customs declarations completed but their importers changed (including the case where export procedures are completed and the goods have been transported to importing countries):

General Department of Vietnam Customs hereby notifies and requests Customs Departments of provinces and cities to direct affiliated Customs Sub-departments to help enterprises allowed to re-import goods into Vietnam or change importers, grand customs clearance swiftly, and reduce costs. Difficulties that arise during the implementation of should be reported to the General Department of Vietnam Customs (via Control and Supervision Department).
