Kính gửi: Cơ quan quản lý an toàn thực phẩm xuất khẩu các nước.

Thay mặt Cục Chất lượng, Chế biến và Phát triển thị trường (NAFIQPM), Bộ Nông nghiệp và Phát triển nông thôn Việt Nam xin gửi tới Cơ quan thẩm quyền quản lý an toàn thực phẩm xuất khẩu các nước lời chào trân trọng.

Thực hiện các quy định của Ủy ban Châu Âu (EC) số 178/2002, 852/2004, 853/2004, 2017/625, 2020/2235, 2022/2292 về đảm bảo vệ sinh, an toàn thực phẩm trong toàn bộ chuỗi sản xuất, sơ chế, chế biến, bảo quản thủy sản xuất khẩu vào EU, NAFIQPM trân trọng thông báo yêu cầu nội dung chứng nhận cho các lô hàng thủy sản và sản phẩm thủy sản xuất khẩu từ Quý quốc vào Việt Nam để chế biến xuất khẩu vào EU như sau:

1. Yêu cầu chung đối với lô hàng xuất khẩu vào Việt Nam để chế biến xuất khẩu vào EU:

- Lô hàng thủy sản từ quốc gia/vùng lãnh thổ, từ cơ sở (tàu chế biến, tàu đông lạnh, tàu cấp đông, cơ sở chế biến, kho lạnh) trong danh sách được Liên minh Châu Âu công nhận.

- Lô hàng được sản xuất, sơ chế, chế biến, bảo quản đáp ứng các yêu cầu về vệ sinh, toàn thực phẩm của Liên minh Châu Âu (Quy định EC số 178/2002, 852/2004, 853/2004).

- Sản phẩm đáp ứng yêu cầu chỉ tiêu vi sinh vật, chất ô nhiễm, ghi nhãn đáp ứng quy định có liên quan của Liên minh Châu Âu và được giám sát, kiểm soát bởi Cơ quan thẩm quyền trong toàn bộ quá trình sản xuất.

2. Nội dung chứng nhận trong Giấy chứng thư (Health/Veterinary Certificate) do Cơ quan quản lý an toàn thực phẩm xuất khẩu các nước cấp kèm theo với lô hàng thủy sản và sản phẩm thủy sản; nhuyễn thể 2 mảnh vỏ xuất khẩu vào Việt Nam (xin xem tại Phụ lục kèm theo).

3. Riêng đối với các lô hàng cá ngừ đông lạnh, ngoài việc đáp ứng yêu cầu nêu tại Mục 1, 2 nêu trên, đề nghị cung cấp thông tin chứng nhận trong Chứng thư về phương pháp cấp đông (Frozen in Brine/Blast/Contact…) và nhiệt độ cấp đông cá sau khi khai thác trên tàu, và thực hiện chứng nhận cho lô hàng dùng làm: sản xuất đồ hộp (Canning Industry)/sản phẩm dùng làm thực phẩm cho người (products for human consumption).

Nhằm tạo điều kiện thuận lợi cho chúng tôi trong việc thực hiện kiểm soát và có đủ thông tin thực hiện chứng nhận cho các lô hàng thủy sản được chế biến tại Việt Nam từ nguyên liệu nhập khẩu từ Quý quốc và xuất khẩu vào EU, NAFIQPM trân trọng đề nghị Quý Cơ quan cấp Chứng thư với các nội dung chứng nhận theo đề nghị nêu trên khi nhà xuất khẩu/cơ sở sản xuất của Quý quốc đề nghị nội dung chứng nhận trước khi lô hàng xuất khẩu vào Việt Nam.

“-have been obtained in the region(s) or country(ies) .......which, at the date of issue of this certificate is/are authorised for entry into the Union of fishery products and in Annex IX to Commission Implementing Regulation (EU) 2021/405;

-come from (an) establishment(s) applying general hygiene requirements and implementing a programme based on the hazard analysis and critical control points (HACCP) principles in accordance with Article 5 of Regulation (EC) No 852/2004, regularly audited by the competent authorities, and being listed as an EU approved establishment;

-have been caught and handled on board vessels, landed, handled and where appropriate prepared, processed, frozen and thawed hygienically in compliance with the requirements laid down in Section VIII, Chapters I to IV of Annex III to Regulation (EC) No 853/2004;

- have not been stored in holds, tanks or containers used for other purposes than the production and/or storage of fishery products;

- satisfy the health standards laid down in Section VIII, Chapter V of Annex III to Regulation (EC) No 853/2004 and the criteria laid down in Commission Regulation (EC) No 2073/2005;

- have been packaged, stored and transported in compliance with Section VIII, Chapters VI to VIII of Annex III to Regulation (EC) No 853/2004;

- have been marked in accordance with Section I of Annex II to Regulation (EC) No 853/2004;

-fulfil the guarantees covering live animals and products thereof, if of aquaculture origin, provided by the residue plans submitted in accordance with Article 29 of Council Directive 96/23/EC, and the concerned animals and products are listed in Commission Decision 2011/163/EU for the concerned country of origin;

-have been produced under conditions guaranteeing compliance with the maximum levels for contaminants laid down in Commission Regulation (EC) No 1881/2006;

-have satisfactorily undergone the official controls laid down in Articles 67 to 71 of Commission Implementing Regulation (EU) 2019/627.”

- come from (an) establishment(s) applying general hygiene requirements and implementing a programme based on the hazard analysis and critical control points (HACCP) principles in accordance with Article 5 of Regulation (EC) No 852/2004, regularly audited by the competent authorities, and being listed as an EU approved establishment;

- satisfy the health standards laid down in Section VII, Chapter V, of Annex III to Regulation (EC) No 853/2004, (4)[Section VIII, Chapter V, of Annex III to Regulation (EC) No 853/2004] and the criteria laid down in Commission Regulation (EC) No 2073/2005;

- have been packaged, stored and transported in compliance with (4)[Section VII, Chapters VI and VIII, of Annex III to Regulation (EC) No 853/2004] (4)[Section VIII, Chapters VI to VIII, of Annex III to Regulation (EC) No 853/2004;

- have been marked and labelled in accordance with (4)[Section I of Annex II and Section VII, Chapter VII, of Annex III to Regulation (EC) No 853/2004] (4)[Section I of Annex II to Regulation (EC) No 853/2004];

- in the case of Pectinidae, marine gastropods and Holothuroidea that are not filter feeders harvested outside classified production areas, these comply with the specific requirements laid down in Section VII, Chapter IX, of Annex III to Regulation (EC) No 853/2004;

- come from a production area classified according to Article 52 of Commission Implementing Regulation (EU) 2019/627 as [A] [B] or [C] at the moment of their harvesting (please indicate the classification of the production area at the moment of harvesting) (except for Pectinidae, marine gastropods and Holothuroidea that are not filter feeders, which are harvested outside classified production areas);

- have satisfactorily undergone the official controls laid down in (4)[Articles 51 to 66 of Implementing Regulation (EU) 2019/627 or in Article 11 of Commission Delegated Regulation (EU) 2019/624] (4)[Articles 69 to 71 of Implementing Regulation (EU) 2019/627];

- fulfil the guarantees covering live animals and products thereof, if of aquaculture origin, provided by the residue plans submitted in accordance with Article 29 of Council Directive 96/23/EC, and the concerned animals and products are listed in Commission Decision 2011/163/EU for the concerned country of origin;

- have been produced under conditions guaranteeing compliance with the maximum residue levels for pesticides laid down in Regulation (EC) No 396/2005 of the European Parliament and of the Council, and the maximum levels for contaminants laid down in Commission Regulation (EC) No 1881/2006.”

To: Exported food quality authorities of countries

On behalf of National Agro-Forestry-Fisheries Quality Assurance, Processing And Market Development Department (NAFIQPM), the Ministry of Agriculture and Rural Development of Vietnam would like to deliver the message below:

Pursuant to Regulations of European Commission (EC) No. 178/2002, 852/2004, 853/2004, 2017/625, 2020/2235, 2022/2292 on assurance of food safety and hygiene throughout the chain of production, preparation, processing and preservation of fishery products being exported into European Union (EU), NAFIQPM would like to notify the mandatory contents of certification for shipments of fishery products exported from your countries into Vietnam for processing and export into EU:

1. General requirements for export shipments to Vietnam for processing and export into EU:

- The fishery product shipment is from one of the countries/regions, facilities (factory ships, reefer ships, fish factories, cold storages) on the EU-approved lists.

- The shipment is manufactured, prepared, processed, preserved in accordance with EC Regulations on food safety and hygiene (EC 178/2002, 852/2004, 853/2004).

- The products satisfy EU's requirements regarding microorganisms, pollutants and labeling, and are supervised or controlled by competent authorities throughout their production process.

2. The certification contents in Health/Veterinary Certificates issued by exported food safety authorities of exporting countries to shipments of fishery products; bivalve molluscs exported into Vietnam can be found in the Appendix hereof.

In order for us to supervise and obtain adequate information about certification of shipments of fishery products processed in Vietnam from raw materials imported from EU countries for export into EU countries, NAFIQPM would like you to include the aforementioned certification contents in the Health/Veterinary Certificates applied for by your exporters/manufacturers before the shipments are exported into Vietnam.
