Department (NAFIQPM), the Ministry of Agriculture and Rural Development of
Vietnam would like to deliver the message below:
Pursuant to Regulations
of European Commission (EC) No. 178/2002, 852/2004, 853/2004, 2017/625,
2020/2235, 2022/2292 on assurance of food safety and hygiene throughout the
chain of production, preparation, processing and preservation of fishery
products being exported into European Union (EU), NAFIQPM would like to notify
the mandatory contents of certification for shipments of fishery products
exported from your countries into Vietnam for processing and export into EU:
1. General
requirements for export shipments to Vietnam for processing and export into EU:
- The fishery product
shipment is from one of the countries/regions, facilities (factory ships,
reefer ships, fish factories, cold storages) on the EU-approved lists.
- The shipment is
manufactured, prepared, processed, preserved in accordance with EC Regulations
on food safety and hygiene (EC 178/2002, 852/2004, 853/2004).
- The products satisfy
EU's requirements regarding microorganisms, pollutants and labeling, and are
supervised or controlled by competent authorities throughout their production
process.
2. The certification contents in Health/Veterinary
Certificates issued by exported food safety authorities of exporting countries
to shipments of fishery products; bivalve molluscs exported into Vietnam can be
found in the Appendix hereof.

In order for us to
supervise and obtain adequate information about certification of shipments of
fishery products processed in Vietnam from raw materials imported from EU countries
for export into EU countries, NAFIQPM would like you to include the
aforementioned certification contents in the Health/Veterinary Certificates
applied for by your exporters/manufacturers before the shipments are exported
into Vietnam.

of export shipments to Vietnam for processing and export into EU

Fish, crustaceans and products from those animals
intended for human consumption
“-have been obtained
in the region(s) or country(ies) .......which, at the date of issue of this
certificate is/are authorised for entry into the Union of fishery products
and in Annex IX to Commission Implementing Regulation (EU) 2021/405;
-come from (an)
establishment(s) applying general hygiene requirements and implementing a
programme based on the hazard analysis and critical control points (HACCP)
principles in accordance with Article 5 of Regulation (EC) No 852/2004,
regularly audited by the competent authorities, and being listed as an EU
approved establishment;
-have been caught
and handled on board vessels, landed, handled and where appropriate prepared,
processed, frozen and thawed hygienically in compliance with the requirements
laid down in Section VIII, Chapters I to IV of Annex III to Regulation (EC)
No 853/2004;
- have not been
stored in holds, tanks or containers used for other purposes than the
production and/or storage of fishery products;
- satisfy the health
standards laid down in Section VIII, Chapter V of Annex III to Regulation
(EC) No 853/2004 and the criteria laid down in Commission Regulation (EC) No
2073/2005;

- have been marked
in accordance with Section I of Annex II to Regulation (EC) No 853/2004;
-fulfil the
guarantees covering live animals and products thereof, if of aquaculture
origin, provided by the residue plans submitted in accordance with Article 29
of Council Directive 96/23/EC, and the concerned animals and products are
listed in Commission Decision 2011/163/EU for the concerned country of
origin;
-have been produced
under conditions guaranteeing compliance with the maximum levels for
contaminants laid down in Commission Regulation (EC) No 1881/2006;
-have satisfactorily
undergone the official controls laid down in Articles 67 to 71 of Commission
Implementing Regulation (EU) 2019/627.”

harvested outside classified production areas, these comply with the specific
requirements laid down in Section VII, Chapter IX, of Annex III to Regulation
(EC) No 853/2004;
- come from a
production area classified according to Article 52 of Commission Implementing
Regulation (EU) 2019/627 as [A] [B] or [C] at the moment of their harvesting
(please indicate the classification of the production area at the moment of
harvesting) (except for Pectinidae, marine gastropods and Holothuroidea that
are not filter feeders, which are harvested outside classified production
areas);
- have satisfactorily
undergone the official controls laid down in (4)[Articles 51 to 66 of
Implementing Regulation (EU) 2019/627 or in Article 11 of Commission
Delegated Regulation (EU) 2019/624] (4)[Articles 69 to 71 of Implementing
