Tổng cục Hải quan nhận được công văn số 534/XNK-TMQT ngày 13/6/2019 của Cục Xuất nhập khẩu - Bộ Công thương về việc nhập khẩu thuốc lá bán hàng miễn thuế, cụ thể như sau:

Hiện nay, mặt hàng thuốc lá điện tử, thuốc lá điếu loại không cháy, sử dụng cho tẩu IQOS và tương tự... chưa được phân loại hàng hóa, chưa có tiêu chuẩn kỹ thuật và quy chuẩn kỹ thuật để nhập khẩu vào Việt Nam. Bộ Công thương đang nghiên cứu để báo cáo Thủ tướng Chính phủ quy định quản lý các mặt hàng nêu trên. Do đó, mặt hàng thuốc lá điện tử, thuốc lá điếu loại không cháy, sử dụng cho tẩu IQOS và tương tự chưa được nhập khẩu vào Việt Nam.

Do vậy, đề nghị Cục Hải quan các tỉnh, thành phố có quản lý hoạt động kinh doanh hàng miễn thuế không cho phép đưa mặt hàng thuốc lá điện tử, thuốc lá điếu loại không cháy, sử dụng cho tẩu IQOS và tương tự để bán hàng miễn thuế.

Trường hợp doanh nghiệp kinh doanh hàng miễn thuế đã thực hiện tạm nhập mặt hàng thuốc lá điện tử và các loại tương tự mà không được Bộ Công thương cấp phép thì yêu cầu doanh nghiệp thực hiện thủ tục tái xuất theo quy định và xử phạt vi phạm (nếu có).

Tổng cục Hải quan thông báo để Cục Hải quan các tỉnh, thành phố biết và thực hiện./.

To: Provincial Customs Departments

In response to Official Dispatch No. 534/XNK-TMQT dated 13/6/2019 of Export and Import Administration – the Ministry of Industry and Trade on import of tobacco products for sale as duty-free goods, below are opinions of General Department of Customs:

Electronic cigarettes and flameless cigarettes used for IQOS kits and the likes, etc. are yet to be classified and not regulated by any technical standards or regulations before import into Vietnam. The Ministry of Industry and Trade is studying this issue to propose management of these products to the Prime Minister. Therefore, no permission has been granted to the import of electronic cigarettes and flameless cigarettes used for IQOS kits and the likes into Vietnam.

Customs Departments of provinces where sale of duty-free goods is available must not permit sale of electronic cigarettes and flameless cigarettes used for IQOS kits and the likes as duty-free goods.

Sellers of duty-free goods that have temporarily imported these products without a license of the Ministry of Industry and Trade shall be requested to re-export them and face penalties (if violations are found).
