Kính gửi: Cục Hải quan tỉnh Bình Dương.

Trả lời công văn số 1954/HQBD-GSQL ngày 5/9/2022 của Cục Hải quan tỉnh Bình Dương phản ánh vướng mắc liên quan đến hoạt động xuất nhập khẩu tại chỗ của thương nhân nước ngoài không có hiện diện tại Việt Nam, Tổng cục Hải quan có ý kiến như sau:

1. Về thương nhân nước ngoài không có hiện diện tại Việt Nam:

- Thương nhân nước ngoài không có hiện diện tại Việt Nam được quy định tại khoản 5 Điều 3 Luật Quản lý ngoại thương số 05/2017/QH14 ngày 12/6/2017. Thủ tục hải quan đối với hàng hóa xuất khẩu, nhập khẩu tại chỗ của thương nhân nước ngoài không có hiện diện tại Việt Nam thực hiện theo quy định tại Điều 35 Nghị định số 08/2015/NĐ-CP ngày 21/01/2015 của Chính phủ.

- Căn cứ quy định tại điểm c khoản 2 Điều 18 Luật Hải quan thì người khai hải quan chịu trách nhiệm trước pháp luật về sự xác thực của nội dung đã khai và các chứng từ đã nộp, xuất trình. Do vậy, doanh nghiệp xuất nhập khẩu tại chỗ (người khai hải quan) phải chịu trách nhiệm trước pháp luật về việc xác định thương nhân nước ngoài không có hiện diện tại Việt Nam.

2. Về thực hiện quyền xuất khẩu, nhập khẩu của tổ chức, cá nhân không có hiện diện tại Việt Nam:

Đề nghị Cục Hải quan tỉnh Bình Dương căn cứ quy định tại Nghị định số 90/2007/NĐ-CP ngày 31/5/2007 của Chính phủ để thực hiện.

3. Một số nội dung khác đề cập tại công văn số 1954/HQBD-GSQL ngày 5/9/2022 của Cục Hải quan tỉnh Bình Dương có liên quan đến chức năng, nhiệm vụ của Bộ Công Thương, vì vậy, đề nghị Cục Hải quan tỉnh Bình Dương trao đổi với các đơn vị liên quan liên hệ với Bộ Công Thương để được hướng dẫn cụ thể.

Tổng cục Hải quan trả lời để Cục Hải quan tỉnh Bình Dương biết./.

1. Regarding foreign traders without commercial presence in Vietnam:

- Foreign traders without commercial presence in Vietnam are defined in Clause 5 Article 3 of the Law on Foreign Trade Management No. 05/2017/QH14 dated 12/6/2017. Customs procedures applied to in-country exports and imports of foreign traders without commercial presence in Vietnam are prescribed in Article 35 of the Government’s Decree No. 08/2015/ND-CP dated 21/01/2015.

2. Regarding the right to export and import of organizations and individuals without commercial presence in Vietnam:

Customs Department of Binh Duong Province shall implement regulations of the Government’s Decree No. 90/2007/ND-CP dated 31/5/2007.
