Tổng cục Hải quan nhận được công văn số 744/HQTH-NV ngày 18/4/2023 của Cục Hải quan tỉnh Thanh Hóa, số 560/HQKG-NV ngày 08/4/2023 của Cục Hải quan tỉnh Kiên Giang, số 2131/HQLA-NV ngày 09/11/2022 của Cục Hải quan tỉnh Long An báo cáo vướng mắc đối với hàng hóa nhập khẩu để SXXK nhưng được thương nhân nước ngoài gửi kho ngoại quan sau đó nhập khẩu vào nội địa từ kho ngoại quan để sản xuất hàng hóa xuất khẩu. Về vấn đề này, Tổng cục Hải quan có ý kiến như sau:

1. Về kiến nghị của Cục Hải quan tỉnh Thanh Hóa, Cục Hải quan tỉnh Kiên Giang, Cục Hải quan tỉnh Long An đề nghị hướng dẫn thủ tục hải quan và chính sách thuế đối với hàng hóa nhập khẩu để SXXK từ kho ngoại quan vào thị trường nội địa (trước đó hàng có nguồn gốc là hàng nhập khẩu để gia công, sản xuất xuất khẩu của doanh nghiệp nội địa)

Tổng cục Hải quan đã có công văn số 4826/TCHQ-GSQL ngày 14/11/2022 hướng dẫn thủ tục hải quan và chính sách thuế đối với hàng hóa xuất khẩu gửi kho ngoại quan sau đó nhập khẩu trở lại vào thị trường nội địa từ kho ngoại quan (trước đó hàng xuất khẩu có nguồn gốc là hàng nhập khẩu để gia công, sản xuất xuất khẩu của doanh nghiệp nội địa). Các Cục Hải quan căn cứ công văn hướng dẫn nêu trên để thực hiện.

2. Về kiến nghị của Cục Hải quan tỉnh Thanh Hóa đề nghị Tổng cục xem xét kiến nghị sửa đổi điểm h khoản 2 Điều 12 Nghị định số 134/2016/NĐ-CP được sửa đổi, bổ sung tại khoản 6 Điều 1 Nghị định số 18/2021/NĐ-CP và các quy định có liên quan theo hướng miễn thuế đối với nguyên liệu, sản phẩm tại chỗ gửi kho ngoại quan nhập khẩu trở lại nội địa để sản xuất hàng hóa sau đó xuất khẩu

Tổng cục Hải quan ghi nhận kiến nghị nêu trên và sẽ nghiên cứu để báo cáo các cấp có thẩm quyền khi xây dựng, sửa đổi, bổ sung các văn bản quy phạm pháp luật.

Trước mắt, Tổng cục Hải quan gửi kèm công văn số 1320/TCHQ-TXNK ngày 15/4/2022 về việc hàng hóa nhập khẩu tại chỗ để sản xuất xuất khẩu để Cục Hải quan tỉnh Thanh Hóa nghiên cứu và thực hiện theo quy định hiện hành.

Tổng cục Hải quan thông báo để Cục Hải quan tỉnh Thanh Hóa, Cục Hải quan tỉnh Kiên Giang, Cục Hải quan tỉnh Long An biết, thực hiện./.

Below is the response of General Department of Customs to Official Dispatch No. 744/HQTH-NV dated 18/4/2023 of Customs Department of Thanh Hoa province, Official Dispatch No. 560/HQKG-NV dated 08/4/2023 of Customs Department of Kien Giang province, Official Dispatch No. 2131/HQLA-NV dated 09/11/2022 of Customs Department of Long An province enquiring about goods that are imported for manufacture of exports, but are sent by foreign traders to bonded warehouses, then imported into the domestic market from bonded warehouses for manufacture of exports:

1. Regarding the request of Customs Departments of Thanh Hoa, Kien Giang and Long An provinces for guidance on customs procedures and tax policies on goods imported into the domestic market from bonded warehouses for manufacture of exports (initially imported by domestic enterprises for processing, manufacturing of exports):

The General Department of Customs already issued Official Dispatch No. 4826/TCHQ-GSQL dated 14/11/2022 providing guidance on customs procedures and tax policies on exports that are sent to bonded warehouses and then re-imported into the domestic market (initially imported by domestic enterprises for processing, manufacturing of exports). The Customs Departments shall follow the instructions in this Official Dispatch.

2. Regarding the request of Customs Department of Thanh Hoa province that General Department of Customs consider proposing amendments to Point h Clause 2 Article 12 of Decree No. 134/2016/ND-CP, which is amended by Clause 6 Article 1 of Decree No. 18/2021/ND-CP and relevant regulations towards exemption of duties on raw materials and in-country products that are sent to bonded warehouses and re-imported into the domestic market for production of exports.

General Department of Customs has acknowledged these opinions and will submit reports to competent authorities during the process of formulation and amendment of legislative documents.

First of all, Customs Department of Thanh Hoa province should study the Official Dispatch No. 1320/TCHQ-TXNK dated 15/4/2022 on in-country import of goods for manufacture of exports (enclosed herewith) in order to comply with applicable regulations.
