Recently, Ministry of Industry and Trade has received propositions of several enterprises^[1] manufacturing powder-based food (instant noodles, rice noodles, vermicelli, etc.) regarding compliance with regulation No. (EU)2021/2246 on amendment to regulation No. (EU)2019/1793 of the European Union on provisional application of official and emergency control measures on the aforementioned food when import into the EU. As per EU guidelines, prior to exporting the aforementioned commodities, competent authorities shall inspect manufacturing process, collect sample to test residual Ethylene oxide, and issue certificate using form under (EU)2019/1793.

In order to obtain the basis for considering and issuing certificate to serve export of the aforementioned commodities to the EU, Ministry of Industry and Trade thereby request Departments of Industry and Trade/Food Safety Management Boards of provinces and central-affiliated cities to guide enterprises submit application for certification (if necessary) together with proof of shipment under Appendix 1 to the Ministry of Industry and Trade (via Science and Technology Department^[2]) before adopting export procedures.

Within 5 working days from the date on which the application is received, Ministry of Industry and Trade shall request applicants to cooperate with food testing facilities serving state management (Appendix 2) to collect sample and test for residue of Ethylene oxide. On the basis of test results and report (Appendix 1) of the food testing facilities, Ministry of Industry and Trade shall issue certificate as per the law. If necessary, Ministry of Industry and Trade shall organize inspectorates to inspect food safety assurance in manufacturing of export food.
