Ngày 19 tháng 10 năm 2023, Bộ Y tế đã có Quyết định số 3896/QĐ-BYT về việc điều chỉnh bệnh viêm đường hô hấp cấp do chủng mới của vi rút Corona gây ra (COVID-19) từ bệnh truyền nhiễm nhóm A sang bệnh truyền nhiễm nhóm B của Luật Phòng, chống bệnh truyền nhiễm. Quyết định nêu rõ, từ 20 tháng 10 năm 2023 bệnh COVID-19 không còn là bệnh truyền nhiễm nhóm A mà chuyển sang nhóm B của Luật Phòng, chống bệnh truyền nhiễm. Theo đó, các hoạt động phòng, chống dịch COVID-19 được thực hiện theo quy định của Luật Phòng, chống bệnh truyền nhiễm nhóm B.

Để đảm bảo sự đồng bộ trong việc thực hiện các chính sách, biện pháp phòng, chống dịch khi chuyển từ nhóm A sang nhóm B, Bộ Y tế đề nghị Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương, Y tế các Bộ, ngành, cơ sở y tế thực hiện một số nội dung sau:

1. Việc thanh toán chi phí khám bệnh, chữa bệnh và tiền ăn, sinh hoạt phí đối với người bệnh COVID-19 kể từ ngày 20/10/2023:

a. Đối với người có thẻ bảo hiểm y tế thanh toán theo quy định của pháp luật về bảo hiểm y tế; người không có thẻ bảo hiểm y tế tự thanh toán chi phí khám bệnh, chữa bệnh theo quy định;

b. Đối với chi phí tiền ăn, sinh hoạt phí thực hiện theo quy định của Luật Phòng, chống bệnh truyền nhiễm nhóm B.

2. Đối với người bệnh vào viện trước ngày 20/10/2023 và ra viện sau ngày 20/10/2023:

a. Chi phí khám bệnh, chữa bệnh đối với người bệnh COVID-19:

- Trước ngày 20/10/2023 thực hiện theo quy định tại Điều 7 Nghị định số 29/2022/NĐ-CP ngày 29/4/2022 của Chính phủ quy định chi tiết và biện pháp thi hành Nghị quyết số 12/2021/UBTVQH15 ngày 30/12/2021 của Ủy ban Thường vụ Quốc hội về việc cho phép thực hiện một số cơ chế, chính sách trong lĩnh vực y tế để phục vụ công tác phòng, chống dịch COVID-19.

- Kể từ ngày 20/10/2023 thực hiện theo hướng dẫn tại điểm a mục 1 nêu trên.

b. Chi phí tiền ăn, sinh hoạt phí đối với người bệnh COVID-19:

- Trước ngày 20/10/2023 thực hiện theo hướng dẫn của Luật phòng, chống bệnh truyền nhiễm nhóm A (thực hiện theo quy định tại Nghị quyết số 16/NQ-CP ngày 08/02/2021 của Chính phủ về chi phí cách ly y tế, khám chữa bệnh và một số chế độ đặc thù trong phòng, chống dịch COVID-19).

- Kể từ ngày 20/10/2023 thực hiện theo hướng dẫn tại điểm b mục 1 nêu trên.

3. Các chế độ chính sách cho người tham gia phòng, chống dịch COVID- 19 thuộc nhóm B được thực hiện theo Quyết định 73/2011/QĐ-TTg ngày 28/12/2011 về việc quy định một số chế độ phụ cấp đặc thù đối với công chức, viên chức, người lao động trong các cơ sở y tế công lập và chế độ phụ cấp chống dịch kể từ ngày 20/10/2023.

4. Đề nghị các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ, Ủy ban Nhân dân các tỉnh, thành phố trực thuộc trung ương chỉ đạo các đơn vị liên quan chủ động phối hợp rà soát các nguồn lực đã được mua sắm, đầu tư và căn cứ vào hướng dẫn chuyên môn y tế để xây dựng nhu cầu và bảo đảm kinh phí khám bệnh, chữa bệnh và giám sát dịch bệnh khi dịch COVID-19 chuyển từ bệnh truyền nhiễm nhóm A sang nhóm B.

Bộ Y tế hướng dẫn để các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ, Ủy ban Nhân dân các tỉnh, thành phố trực thuộc trung ương để chỉ đạo thực hiện theo quy định./.

On October 19, 2023, the Ministry of Health issued Decision No. 3896/QD-BYT on downgrading classification of coronavirus disease 2019 (COVID-19) from class A to class B under the 2007's Law on Prevention and Control of Infectious Diseases. In this Decision, from October 20, 2023, COVID-19 is no longer a class-A infectious disease and it is classified as a class-B infectious disease according to the Law on Prevention and Control of Infectious Diseases. Accordingly, COVID-19 prevention and control activities shall be carried out in accordance with regulations on prevention and control of Class-B infectious diseases of the Law on Prevention and Control of Infectious Diseases.

To synchronously implement policies on and measures for COVID-19 prevention and control,  when classifying COVID-19 from class A to class B, the Ministry of Health requests People's Committees of provinces and central-affiliated cities, Ministries, central government authorities and health establishments to carry out the following contents:

1. Payment of treatment costs, meal expenses and subsistence allowances (with regard to COVID-19 patients from October 20, 2023):

a. Regarding patients with health insurance cards: the payment shall comply with regulations of the law on health insurance; regarding patients without health insurance cards, they shall make self-payment according to law regulations;

b. The payment of meal expenses and subsistence allowances shall comply with regulations on prevention and control of Class-B infectious diseases of the Law on Prevention and Control of Infectious Diseases.

2. With regard to COVID-19 patients who are hospitalized by October 20, 2023 and de-hospitalized after October 20, 2023:

- By October 20, 2023, the payment shall comply with Article 7 of Government's Decree No. 29/2022/ND-CP dated April 29, 2022 on elaboration of and provision of measures for implementation of the Resolution No. 12/2021/UBTVQH15 dated December 30, 2021 of the National Assembly’s Standing Committee on permission to enforce a number of health benefits and policies on COVID-19 prevention and control.

- From October 20, 2023, the payment shall follow guidelines specified in Point a, Section 1.

b. Meal expenses and subsistence allowances:

- By October 20, 2023, the payment shall follow guidelines under regulations on prevention and control of Class-A infectious diseases of the Law on Prevention and Control of Infectious Diseases; and comply with Government's Resolution No. 16/NQ-CP dated February 08, 2021 on quarantine and healthcare expenses and particular regimes in COVID-19 prevention and control.

- From October 20, 2023, the payment shall follow guidelines specified in Point b, Section 1.

3. The implementation of policies applicable to participants in prevention and control of COVID- 19 classified as a Class-B infectious disease shall comply with Decision No. 73/2011/QD-TTg dated December 28, 2011 from October 20, 2023.

4. Ministers, ministerial agencies, governmental agencies, People's Committees of provinces and central-affiliated cities are required to direct relevant units to proactively make connection to review purchased and invested resources and, according to medical guidelines, issue demands and ensure funding for medical examination and treatment, and monitor COVID-19 during classification of coronavirus disease 2019 (COVID-19) from class A to class B.

The Ministry of Health provides guidelines for Ministers, ministerial authorities and Governmental authorities, and People's Committees of provinces and central-affiliated cities to direct the implementation according to regulations./.
