Căn cứ khoản 3 Điều 112 Bộ luật Lao động năm 2019, trong đó giao Thủ tướng Chính phủ căn cứ vào điều kiện thực tế quyết định cụ thể ngày nghỉ tết Âm lịch và nghỉ lễ Quốc khánh. Để có cơ sở đề xuất với Thủ tướng Chính phủ quyết định ngày nghỉ tết Âm lịch và nghỉ lễ Quốc khánh năm 2024, Bộ Lao động - Thương binh và Xã hội đã xây dựng dự thảo phương án đề xuất nghỉ tết Âm lịch và nghỉ lễ Quốc khánh năm 2024 đối với cán bộ, công chức, viên chức và người lao động của các cơ quan hành chính, sự nghiệp, tổ chức chính trị, tổ chức chính trị - xã hội, doanh nghiệp; đồng thời, gửi lấy ý kiến 16 bộ, cơ quan liên quan (trong đó, 13 bộ, cơ quan có ý kiến tham gia, cụ thể: Về phương án nghỉ lễ Quốc khánh, có 13/13 ý kiến thống nhất với phương án nghỉ ngày 02 và 03/9/2024; về phương án nghỉ tết Âm lịch, có 13/13 ý kiến chọn phương án nghỉ 02 ngày trước Tết và 03 ngày sau Tết. Trên cơ sở tổng hợp ý kiến của các bộ, cơ quan liên quan (Bảng tổng hợp ý kiến kèm theo), Bộ Lao động - Thương binh và Xã hội báo cáo với Thủ tướng Chính phủ phương án nghỉ tết Âm lịch và nghỉ lễ Quốc khánh năm 2024 đối với cán bộ, công chức, viên chức và người lao động của các cơ quan hành chính, sự nghiệp, tổ chức chính trị, tổ chức chính trị - xã hội (sau đây gọi tắt là công chức, viên chức) và người lao động thuộc khối doanh nghiệp không phải là công chức, viên chức (sau đây gọi tắt là người lao động) như sau:

1. Đối với công chức, viên chức

1.1. Dịp nghỉ tết Âm lịch năm 2024

a) Phương án 1: nghỉ 05 ngày theo quy định, trong đó, nghỉ 02 ngày trước Tết và 03 ngày sau Tết

Công chức, viên chức nghỉ tết Âm lịch năm 2024 từ thứ Năm ngày 08/02/2024 Dương lịch đến hết thứ Tư ngày 14/02/2024 Dương lịch (tức ngày 29 tháng Chạp năm Quý Mão đến hết ngày mùng 5 tháng Giêng năm Giáp Thìn). Như vậy với phương án này, dịp nghỉ tết Âm lịch công chức, viên chức sẽ được nghỉ 07 ngày (bao gồm 05 ngày nghỉ tết Âm lịch và 02 ngày nghỉ bù ngày nghỉ hằng tuần theo quy định tại khoản 3 Điều 111 Bộ luật Lao động).

b) Phương án 2: nghỉ 05 ngày theo quy định, trong đó nghỉ 01 ngày trước Tết và 04 ngày sau Tết.

Công chức, viên chức nghỉ tết Âm lịch năm 2024 từ thứ Sáu ngày 09/02/2024 Dương lịch đến hết thứ Năm ngày 15/02/2024 Dương lịch (tức ngày 30 tháng Chạp năm Quý Mão đến hết ngày mùng 6 tháng Giêng năm Giáp Thìn). Như vậy với phương án này, dịp nghỉ tết Âm lịch công chức, viên chức sẽ được nghỉ 07 ngày (bao gồm 05 ngày nghỉ tết Âm lịch và 02 ngày nghỉ bù ngày nghỉ hằng tuần theo quy định tại khoản 3 Điều 111 Bộ luật Lao động và 02 ngày nghỉ hằng tuần).

c) Đề xuất phương án: Bộ Lao động - Thương binh và Xã hội đề xuất dịp nghỉ tết Âm lịch theo phương án 1. Lý do: cả 02 phương án đều có số ngày nghỉ bằng nhau nhưng phương án 1 đảm bảo hài hòa thời gian nghỉ trước và sau Tết (phương án này được tất cả các Bộ, cơ quan liên quan có ý kiến thống nhất).

1.2. Dịp nghỉ lễ Quốc khánh năm 2024

a) Phương án 1: nghỉ 02 ngày theo quy định, trong đó, nghỉ ngày 02 tháng 9 Dương lịch và 01 ngày liền kề sau ngày 02 tháng 9.

Công chức, viên chức được nghỉ thứ Bảy ngày 31/8/2024 đến hết thứ Ba ngày 03/9/2024 Dương lịch. Như vậy, với phương án này dịp nghỉ lễ Quốc khánh năm 2024 công chức, viên chức sẽ được nghỉ 04 ngày (bao gồm 02 ngày nghỉ lễ Quốc khánh, 02 ngày nghỉ hằng tuần).

b) Phương án 2: nghỉ 02 ngày theo quy định, trong đó, nghỉ ngày 02 tháng 9 Dương lịch và 01 ngày liền kề trước ngày 02 tháng 9.

Công chức, viên chức được nghỉ 04 ngày liên tục từ thứ Bảy ngày 31/8/2024 đến hết thứ Ba ngày 03/9/2024 Dương lịch. Như vậy, với phương án này dịp nghỉ lễ Quốc khánh năm 2024 công chức, viên chức sẽ được nghỉ 04 ngày (bao gồm 02 ngày nghỉ lễ Quốc khánh, 01 ngày nghỉ hằng tuần và 01 ngày nghỉ bù ngày nghỉ hằng tuần theo quy định tại khoản 3 Điều 111 Bộ luật Lao động).

c) Đề xuất phương án: Bộ Lao động - Thương binh và Xã hội đề xuất dịp nghỉ lễ Quốc khánh năm 2024 theo phương án 1. Lý do: cả 02 phương án đều nghỉ 04 ngày liên tục từ thứ Bảy ngày 31/8/2024 đến hết thứ Ba ngày 03/9/2024 nhưng phương án 1 có ưu điểm là giảm tục hành chính và không phải thực hiện việc bố trí nghỉ bù ngày nghỉ hằng tuần theo quy định tại khoản 3 Điều 111 Bộ luật Lao động (phương án này được tất cả các Bộ, cơ quan liên quan có ý kiến thống nhất).

2. Đối với người lao động

Căn cứ vào điều kiện thực tế và lịch nghỉ đối với công chức, viên chức, người sử dụng lao động bố trí lịch nghỉ tết Âm lịch và nghỉ lễ Quốc khánh cho người lao động như sau (khuyến khích người sử dụng lao động áp dụng thời gian nghỉ tết Âm lịch cho người lao động như quy định đối với công chức, viên chức):

- Dịp nghỉ tết Âm lịch năm 2024:

+ Lựa chọn 01 ngày trước Tết và 04 ngày đầu sau Tết hoặc 02 ngày trước Tết và 03 ngày đầu sau Tết hoặc 03 ngày trước Tết và 02 ngày sau Tết.

+ Thông báo phương án nghỉ tết Âm lịch cho người lao động trước khi thực hiện ít nhất 30 ngày.

- Dịp nghỉ lễ Quốc khánh năm 2024:

Người sử dụng lao động quyết định cho người lao động nghỉ 02 ngày (ngày 02 tháng 9 Dương lịch và 01 ngày liền trước hoặc sau).

- Nếu ngày nghỉ hằng tuần trùng với ngày nghỉ tết Âm lịch hoặc nghỉ lễ Quốc khánh thì người sử dụng lao động bố trí nghỉ bù ngày nghỉ hằng tuần cho người lao động vào ngày làm việc kế tiếp theo quy định tại khoản 3 Điều 111 Bộ luật Lao động.

Bộ Lao động - Thương binh và Xã hội kính đề nghị Thủ tướng Chính phủ xem xét, quyết định việc nghỉ tết Âm lịch và nghỉ lễ Quốc khánh năm 2024 và giao Bộ trưởng Bộ Lao động - Thương binh và Xã hội thông báo cho các cơ quan hành chính, sự nghiệp, tổ chức chính trị, tổ chức chính trị - xã hội và doanh nghiệp, người lao động biết và thực hiện (dự thảo thông báo kèm theo)./.

To: Prime Minister of Vietnam

Pursuant to Clause 3 Article 112 of the Labor Code 2019, which assigns the Prime Minister of Vietnam to consider actual conditions for deciding the specific days off for the Lunar New Year Holiday and the National Day Holiday. To have grounds to appeal to the Prime Minister of Vietnam for decisions on days off for the Lunar New Year Holiday and the National Day Holiday 2024, the Ministry of Labor – War Invalids and Social Affairs of Vietnam has developed draft schemes to propose the days off for the Lunar New Year Holiday and the National Day Holiday 2024 for officials, public employees, and employees of administrative agencies, public service providers, political organizations, socio-political organizations, and enterprises while collecting opinions from 16 concerned Ministries and central authorities with 13 among them agree with the scheme to have days off on September 2 and September 3, 2024 for the National Day Holiday and the scheme to have 2 days off before Tet and 3 days off after Tet for the Lunar New Year Holiday. The Ministry of Labor - War Invalids and Social Affairs of Vietnam shall, based on the summary of opinions from concerned Ministries and central authorities (enclosed tables of summary of opinions), submit a report to the Prime Minister of Vietnam on the schemes for days off for the Lunar New Year Holiday and the National Day Holiday 2024 for officials, public employees, and employees of administrative agencies, public service providers, political organizations, socio-political organizations (hereinafter referred to as “officials and public employees”) and employees of enterprise clusters who are not officials and public employees (hereinafter referred to as “employees”) with the following contents:

1. For officials and public employees:

1.1. Lunar New Year Holiday 2024

a) Scheme 1: 5 days off according to regulations with 2 days off before Tet and 3 days off after Tet.

Officials and public employees shall enjoy the Lunar New Year Holiday 2024 from Thursday, February 8, 2024 of the Gregorian Calendar to the end of Wednesday, February 14, 2024 of the Gregorian Calendar (which is December 29 of the Moon Calendar of the Year of the Cat to the end of January 5 of the Moon Calendar of the Year of the Dragon). Therefore, with this scheme, officials and public employees will have 7 days off for the Lunar New Year Holiday (including 5 days off for the Lunar New Year Holiday and 2 compensatory days off for the weekly days off according to Clause 3 Article 111 of the Labor Code).

b) Scheme 2: 5 days off according to regulations with 1 day off before Tet and 4 days off after Tet.

Officials and public employees shall enjoy the Lunar New Year Holiday 2024 from Friday, February 9, 2024 of the Gregorian Calendar to the end of Thursday, February 15, 2024 of the Gregorian Calendar (which is December 30 of the Moon Calendar of the Year of the Cat to the end of January 6 of the Moon Calendar of the Year of the Dragon). Therefore, with this scheme, officials and public employees will have 7 days off for the Lunar New Year Holiday (including 5 days off for the Lunar New Year Holiday and 2 compensatory days off for the weekly days off according to Clause 3 Article 111 of the Labor Code, and 2 weekly days off).

1.1. National Day Holiday 2024

a) Scheme 1: 2 days off according to regulations, specifically September 2 of the Gregorian calendar and an adjacent day after September 2.

Officials and public employees enjoy days off from Saturday, August 31, 2024 to the end of Tuesday, September 3, 2024 of the Gregorian calendar. Therefore, with this scheme, officials and public employees will have 4 days off for the National Day Holiday (including 2 days off for the National Day Holiday and 2 weekly days off).

b) Scheme 2: 2 days off according to regulations, specifically September 2 of the Gregorian calendar and a day preceding September 2.

Officials and public employees enjoy 4 consecutive days off from Saturday, August 31, 2024 to the end of Tuesday, September 3, 2024 of the Gregorian calendar. Therefore, with this scheme, officials and public employees will have 4 days off for the National Day Holiday (including 2 days off for the National Day Holiday, 1 weekly day off, and 2 compensatory days off for the weekly days off according to Clause 3 Article 111 of the Labor Code).

c) The Ministry of Labor - War Invalids and Social Affairs of Vietnam suggests the selection of scheme 1 out of the 2 because they both have the same number of days off, which is 4 consecutive days off from Saturday, August 31, 2024 to the end of Tuesday, September 3, 2024, but scheme 1 does not require any administrative procedure and arrangement of compensatory days off for the weekly days off according to Clause 3 Article 111 of the Labor Code (scheme 1 is consensually agreed on by every concerned Ministry and central authority).

2. For employees

Employers shall, based on the actual condition and the holiday schedules for officials and public employees, arrange the schedules for the Lunar New Year Holiday and National Day Holiday for employees (it is encouraged for employers to apply the schedule for the Lunar New Year Holiday for officials and public employees) as follows:

- Lunar New Year Holiday 2024:

+ Notify employees of the scheme for the Lunar New Year Holiday schedule before implementation at least 30 days in advance. 

- National Day Holiday 2024:

Employers shall decide to let employers have 2 days off (September 2 of the Gregorian calendar and an adjacent day before or after September 2).

- If the weekly days off coincide with the days off for the Lunar New Year Holiday or National Day Holiday, employers shall arrange compensatory days off for employees on the next working days according to Clause 3 Article 111 of the Labor Code.

The Ministry of Labor – War Invalids and Social Affairs of Vietnam sincerely requests the Prime Minister of Vietnam to consider deciding on the days off for the Lunar New Year Holiday and National Day Holiday 2024 and assigns the Minister of Labor – War Invalids and Social Affairs of Vietnam to inform administrative agencies, public service providers, political organizations, socio-political organizations, enterprises, and employees for awareness and implementation (enclosed with draft notification)./.
