Ngày 09 tháng 3 năm 2023, Bảo hiểm xã hội (BHXH) Việt Nam có Công văn số 615/BHXH-VP về việc rà soát, đánh giá hiệu quả việc cử cán bộ làm việc tại Trung tâm phục vụ hành chính công cấp tỉnh, Bộ phận tiếp nhận và trả kết quả thủ tục hành chính (TTHC) cấp huyện (gọi chung là Trung tâm PVHCC) và việc cử cán bộ làm việc vào sáng thứ Bảy để tiếp nhận hồ sơ TTHC đối với BHXH các tỉnh. Trên cơ sở báo cáo kết quả rà soát và đề xuất của BHXH tỉnh, BHXH Việt Nam có ý kiến như sau:

1. Đối với việc tổ chức làm việc sáng thứ Bảy hằng tuần

Việc tổ chức thực hiện tiếp nhận hồ sơ giải quyết TTHC vào sáng thứ Bảy hàng tuần1 được BHXH các tỉnh triển khai thực hiện cơ bản nghiêm túc, đúng quy định. Quá trình thực hiện phát sinh một số tồn tại, vướng mắc, chủ yếu từ tính hiệu quả của việc bố trí nhân lực làm việc sáng thứ Bảy hàng tuần so với tỷ lệ, số hồ sơ tiếp nhận giải quyết các ngày làm việc trong tuần cho thấy nhu cầu thực tiễn người dân đến trụ sở cơ quan BHXH nộp hồ sơ trực tiếp vào sáng thứ Bảy không cao, nhiều nơi không phát sinh hồ sơ.

Căn cứ kết quả rà soát, đánh giá và đề xuất, kiến nghị của BHXH tỉnh, đồng thời để phát huy tính hiệu quả trong việc bố trí nhân lực làm việc sáng thứ Bảy hàng tuần, phù hợp với thực tiễn từng địa phương, đáp ứng yêu cầu cải cách hành chính nhà nước và xây dựng, phát triển Chính phủ điện tử, Chính phủ số, BHXH Việt Nam thống nhất phương án thực hiện đối với BHXH tỉnh như sau:

a) Đối với BHXH tỉnh đề xuất tiếp tục thực hiện bố trí tiếp nhận hồ sơ TTHC vào sáng thứ Bảy do có phát huy hiệu quả nhất định, đồng thời để đáp ứng nhu cầu một bộ phận người dân trên địa bàn đã quen đến trụ sở BHXH vào sáng thứ Bảy nộp hồ sơ: BHXH tỉnh tiếp tục thực hiện bố trí cán bộ làm việc vào sáng thứ Bảy hằng tuần, bảo đảm hiệu quả, tiết kiệm.

b) Đối với BHXH tỉnh đề xuất dừng thực hiện bố trí tiếp nhận hồ sơ TTHC vào sáng thứ Bảy do hồ sơ phát sinh quá ít hoặc không phát sinh hồ sơ, đánh giá tính hiệu quả thấp; hoặc BHXH tỉnh/huyện thực hiện tiếp nhận hồ sơ tại Trung tâm PVHCC, làm việc theo lịch làm việc của Trung tâm PVHCC từ thứ 2 đến thứ 6 hàng tuần, không làm việc ngày thứ Bảy: Giao Giám đốc BHXH tỉnh quyết định lựa chọn phương án tạm dừng thực hiện việc bố trí cán bộ làm việc vào sáng thứ Bảy tại bộ phận một cửa cơ quan BHXH và chịu trách nhiệm trong công tác tiếp nhận hồ sơ giải quyết TTHC tại địa bàn quản lý, đáp ứng yêu cầu phục vụ người dân, doanh nghiệp theo quy định hiện hành.

2. Đối với việc cử cán bộ làm việc tại Trung tâm PVHCC

Quá trình triển khai cử cán bộ làm việc tại Trung tâm PVHCC các cấp2, đa số BHXH các tỉnh đã thực hiện bố trí cán bộ làm việc tại Trung tâm PVHCC, một số BHXH tỉnh, thành phố chưa thực hiện do tại địa phương chưa triển khai Trung tâm PVHCC, hoặc chưa triển khai đối với cơ quan ngành dọc đóng tại địa phương, hoặc chưa bố trí được cơ sở vật chất, bàn làm việc cho cơ quan BHXH.

Tiếp theo các văn bản đã hướng dẫn3 tổ chức triển khai thực hiện Quyết định số 1291/QĐ-TTg, BHXH Việt Nam thống nhất phương án tiếp nhận hồ sơ tại Trung tâm PVHCC như sau:

a) Đối với BHXH tỉnh đề xuất tiếp tục thực hiện tiếp nhận hồ sơ tại Trung tâm PVHCC do việc triển khai thực hiện có hiệu quả, ổn định, tỷ lệ tiếp nhận hồ sơ tại Trung tâm PVHCC tương đối cao, đồng thời để thống nhất với khối Trung tâm PVHCC tại địa phương: BHXH tỉnh tiếp tục duy trì bố trí cán bộ làm việc tại Trung tâm PVHCC, thường xuyên phối hợp với Trung tâm PVHCC rà soát, thống nhất danh mục TTHC tiếp nhận và trả kết quả tại Trung tâm.

b) Đối với BHXH các tỉnh khác: Giám đốc BHXH tỉnh quyết định thực hiện tiếp nhận tại trụ sở BHXH sau khi có ý kiến đồng ý của UBND cùng cấp.

3. Tổ chức thực hiện

a) Trên cơ sở chỉ đạo của BHXH Việt Nam, Giám đốc BHXH tỉnh quyết định và chịu trách nhiệm thực hiện theo phương án phù hợp đặc điểm tình hình địa phương; Báo cáo kết quả thực hiện về BHXH Việt Nam trước 19/3/2024 (tích hợp nội dung vào Báo cáo Kiểm soát TTHC quý I/2024 của BHXH tỉnh;báo cáo đầy đủ số liệu, tỷ lệ hồ sơ tiếp nhận để phục vụ công tác quản lý, cung cấp thông tin, chỉ đạo điều hành). Từ quý II/2024, báo cáo những nội dung phát sinh mới (nếu có).

b) Giám đốc BHXH tỉnh có trách nhiệm thực hiện công tác truyền thông, hướng dẫn để việc chuyển đổi phương thức tiếp nhận và trả kết quả TTHC (nếu có) không làm gián đoạn, ảnh hưởng đến quyền lợi của người dân, doanh nghiệp.

c) Văn phòng BHXH Việt Nam tổng hợp, theo dõi tình hình thực hiện tại BHXH các tỉnh, thành phố.

Quá trình thực hiện, báo cáo các khó khăn vướng mắc phát sinh gửi về BHXH Việt Nam (qua Văn phòng) để chỉ đạo, hướng dẫn kịp thời./.

(Hereinafter referred to as “provincial social insurance”)

On March 9, 2023, Vietnam Social Security promulgated Official Dispatch No. 615/BHXH-VP on review and evaluation of effectiveness of assigning officials to work at provincial centers for public administrative procedures, district departments for reception and return of administrative procedure results (hereinafter referred to as “centers for administrative procedures”) and assigning officials to work on Saturday mornings to receive administrative procedure documents regard provincial social insurance. On the basis of reports and propositions of provincial social insurance, Vietnam Social Security remarks:

1. Regarding working on Saturday morning on a weekly basis

Provincial social insurance organized reception and processing of administrative procedure documents on Saturday mornings1 on a stringent and law-compliant manner. Implementation process is plagued with difficulties and issues primarily regarding effectiveness of personnel working on Saturday mornings relative to the amount of documents received and processed in a week which indicate that the number of people arrive at headquarters of social insurance authority to file on Saturday morning is low and, in some locales, none at all.

Depending on review results, evaluation, proposition, and recommendations of provincial social insurance, in order to improve effectiveness of personnel working on Saturday mornings, adhere to practical conditions of each locale, satisfy administrative reform requirements, develop electronic Government and digital Government, Vietnam Social Security hereby unifies the solution as described below:

a) In respect of provincial social insurance that proposes a continuation of reception of administrative procedure documents on Saturday mornings as substantial effectiveness has been achieved and as local population is used to arriving at headquarters of social insurance on Saturday mornings to file documents: respective provincial social insurance shall assign officials to work on Saturday mornings on a weekly basis while maintaining efficiency and effectiveness.

b) In respect of provincial social insurance that proposes suspension of reception of administrative procedure documents on Saturday mornings as the number of documents received are too low or none at all and/or as effectiveness is deemed inadequate or provincial/district social insurance that opts to receive documents at centers for administrative procedures at the same working hours as the centers for administrative procedures from Monday to Friday and not Saturday: Directors of provincial social insurance shall decide to temporarily suspend assigning personnel to work on Saturday mornings at single-window departments of social insurance authority and be responsible for receiving administrative procedure documents in their provinces and cities, satisfy demands of the general public and enterprises as per the law.

2. Regarding assigning officials to work at centers for administrative procedures

As follow-up to documents guiding3 implementation of Decision No. 1291/QD-TTg, Vietnam Social Security hereby unifies document reception at centers for administrative procedures:

a) Regarding provincial social insurance proposing continuation of document reception at centers for administrative procedures as a result of effective, stable implementation and relatively high rate of documents received at centers for administrative procedures, for the purpose of cooperating with local centers for administrative procedures: provincial social insurance shall continue to assign officials to work at centers for administrative procedures, regularly cooperate with the centers in reviewing and producing lists of administrative procedures request received and administrative procedure results returned at corresponding centers.

b) Regarding other provincial social insurance: directors of provincial social insurance shall decide on reception at headquarters of respective social insurance after obtaining consensus of the same People’s Committees.

3. Organizing implementation

a) On the basis of direction of Vietnam Social Security, directors of provincial social insurance shall decide and be responsible for implementation respective to their provinces and cities; submit reports on implementation results to Vietnam Social Security before March 19, 2024 (integrate with Report on administrative procedure statistics of the first Quarter of 2024 of provincial social insurance; report all data and document reception rate for the purpose of management, information, and coordination). Starting from the second Quarter of 2024, reports shall include new details (if any).

b) Directors of provincial social insurance shall be responsible for communicating and guiding the transition of means to file administrative procedure request and receive administrative procedure results (if any) so as to prevent interruption and impact on benefits of the general public and enterprises.

c) Office of Vietnam Social Security shall consolidate and monitor implementation at provincial social insurance.

Difficulties that arise during implementation shall be reported to Vietnam Social Security (via the Office of Vietnam Social Security)./.
